40B Civil penalty requirements (1) The Table in Schedule 1 sets out civil penalty requirements for the purposes of the **Essential Services Commission Act 2001** and, for each civil penalty requirement— (a) the provision which is a civil penalty requirement; and (b) the regulated entity that is subject to the civil penalty requirement. (2) A provision specified in column 3 of the Table in Schedule 1 constitutes a civil penalty requirement for the purposes of the **Essential Services Commission Act 2001**. For matters relating to contraventions of provisions that are offences and civil penalty requirements, see Subdivision 4 of Division 1 of Part 7 of the **Essential Services Commission Act 2001**. (3) A person or entity specified in column 4 of the Table in Schedule 1 is a regulated entity for the purposes of Divisions 1 and 2 of Part 7 and 54ZN of the **Essential Services Commission Act 2001**. (4) An amount specified in column 5 of the Table in Schedule 1 is a civil penalty amount for the purposes of section 54E(f) of the **Essential Services Commission Act 2001**.
