14D Duty to disclose matters adverse to accreditation (1) An accredited person must not, without reasonable excuse, fail to disclose to the ESC any adverse matter within 14 days of becoming aware of the adverse matter. Penalty: 20 penalty units. (2) In this section, a matter is an ***adverse matter*** if it is likely that the ESC, having regard to the matter, would determine that the person is not— (a) a fit and proper person for the purposes of accreditation; or (b) a competent and capable person for the purposes of accreditation.
