Victorian College of Agriculture and Horticulture Act 1982

College. The Victorian College of Agriculture and Horticulture is defined in s 2 as the institution established by s 3. It consists of a Council, the academic and general staff, and the students (s 3(2)). The College is a post-secondary education institution within the framework of the Post-Secondary Education Act 1978. The Act does not prescribe the College’s educational objectives, curriculum, powers to award qualifications, or any academic governance rules; those matters are left to the Order in Council and the Post-Secondary Education Act.

Council. The Council is the governing body of the College (s 4). It is a body corporate, meaning it can hold property, sue and be sued, enter contracts, and do all things that a natural person can do, subject to the Act and the Order in Council. It is not incorporated by the VCAH Act itself but by an Order in Council under s 23 of the Post-Secondary Education Act 1978, following an application by the Minister. Section 6(4) disapplies s 26(1) of that Act, which would otherwise have required the Order in Council to be tabled in Parliament and subject to disallowance. This shortcut means the Council could be created more quickly, without parliamentary scrutiny of the Order, which is a noteworthy delegation of legislative power to the executive.

The Agricultural Colleges. Section 2 defines this as the six named institutions: Dookie, Glenormiston, Longerenong, Burnley, McMillan Rural Studies Centre and Gilbert Chandler College of Dairy Technology. These had been operated as State Agricultural Colleges under the Agricultural Colleges Act 1958. The Act does not define “agricultural college” generally; it refers only to these specific colleges. The definition is used for the transfer provisions.

Appointed day. Under s 7(1), the transfer of control and the repeal occur on a day fixed by proclamation. That day must be after the day the Council is constituted as a body corporate (s 7(2)). The appointed day was 8 March 1983 (see Endnote 1). Until that day, the Agricultural Colleges Act 1958 remained in force and the Minister retained control.

Crown lands. Section 5 gives the Council a specific additional power to enter into arrangements for the use of Crown lands that were used for the agricultural colleges (other than the Longerenong and Dookie land parcels, which are dealt with separately under s 7(1)(b)). The land must have been temporarily or permanently reserved under the Crown Land (Reserves) Act 1978. The arrangement is with the body administering the land (Minister, committee of management or trustees). This power is in addition to any powers under the Post-Secondary Education Act 1978 or the Order in Council.

Transitional provisions. Part II is the core of the Act. It ensures continuity of legal relationships, property, records, scholarships, and references. The continuity clause (s 7(3)) is broad: all things and circumstances appointed or created under the repealed Agricultural Colleges Act 1958 continue with the same status, operation and effect as if that Act had not been repealed. This avoids gaps in authority, leases, employment, or other legal arrangements.

The Act directly affects the following entities and persons.

The Minister of Agriculture (as at 1982). The Minister was the controlling authority for the six agricultural colleges under the Agricultural Colleges Act 1958. The Act strips the Minister of control and vests it in the Council. The Minister also has a transitional role as the initial “governing body” of the College for the purpose of applying for incorporation of the Council under the Post-Secondary Education Act 1978 (s 6(1) and (3)). The Minister ceases to be governing body once the Order in Council is published. The Minister also loses personal property used for the colleges, which vests in the Council (s 7(1)(c)). The Minister may continue to be a body administering Crown lands for the purposes of s 5 arrangements if the Minister has control of the relevant reserves.

The Post-Secondary Education Commission. Under s 6, the Commission receives the application from the Minister for incorporation of the Council. The Commission can lawfully require things from the Minister in respect of that application. The Commission does not appear to have ongoing supervisory power over the College under this Act; that would be under the Post-Secondary Education Act.

The Council of the College. The Council acquires governing body status and all the property, documents, control and administration of the six colleges. It gains a new power under s 5 to negotiate arrangements for Crown lands. It must honour existing scholarships (s 7(1)(e)). It is bound by the continuity provisions and the Dookie Land Act preservation (s 7(4)). The Council is the primary ongoing duty-holder under the Act.

Students of the agricultural colleges. Students who held scholarships under s 7(2) of the repealed Act are entitled to continue receiving the benefit for the remainder of the term (s 7(1)(e)). All other students become students of the College, as the College consists of its students (s 3(2)). Their academic records are transferred (s 7(1)(d)).

Staff. The academic and general staff of the agricultural colleges become part of the College (s 3(2)). The Act does not specify employment continuity; that is covered by the general continuity clause (s 7(3)) ensuring that persons continue with the same status and operation as if the old Act had not been repealed.

Owners or holders of leases, grants, licences. Any person who had a lease, renewal, demise, purchase, condition, obligation, liability or right under the Agricultural Colleges Act 1958 continues unaffected under the new Act (s 7(3)). This includes leaseholders of college farmland, suppliers, and contractors.

Bodies administering Crown lands (e.g., committees of management, trustees). These bodies may be approached by the Council to enter into arrangements for use of Crown lands under s 5. They have discretion whether to agree, but the provision facilitates the College’s continued use of land that had been used for agricultural education.

The broader Victorian government. The Act repeals an older Act and removes responsibility for agricultural education from the Ministry of Agriculture, placing it within the post-secondary education system. This may affect budgeting, policy coordination and ministerial accountability.

Private sector parties dealing with the College. Any person who contracts with the College, sues or is sued by it, or relies on its corporate status is affected by the Council’s powers and the College’s legal continuity. The Act clarifies that the College is not a new entity; it succeeds to the old colleges’ rights and obligations.

Duty of the Minister to apply for incorporation. Section 6(1) deems the Minister to be the governing body of the College for the purpose of making an application under s 23(1) of the Post-Secondary Education Act 1978. Section 6(2) requires the Minister to do so “as soon as practicable” after commencement. This is a mandatory duty, though no penalty is prescribed for delay. The Minister also has the right to do all things lawfully required by the Commission in respect of the application (s 6(3)).

Right of the Minister to transfer control. While not expressed as a duty, the Minister’s loss of control on the appointed day is automatic (s 7(1)(a)). The Minister must give up possession of personal property and documents (s 7(1)(c) and (d)). The Minister continues to have a role in relation to Crown lands under s 5 if the Minister administers those lands.

Right of the Council to assume control and hold property. On the appointed day, control and administration of the agricultural colleges vests in the Council (s 7(1)(a)). Personal property vests in the Council (s 7(1)(c)). The Council takes possession of documents (s 7(1)(d)). These are rights that give the Council full legal and practical authority over the colleges.

Power of the Council to enter into Crown land arrangements. Section 5(1) grants the Council a power, in addition to other powers, to enter into arrangements for the College’s use of Crown lands used for the agricultural colleges (excluding the Dookie and Longerenong lands dealt with under s 7(1)(b)). The arrangement is with the body administering the Crown lands. The arrangement must fully describe the lands (s 5(3)). The Council has a right to propose such arrangements, but no duty to do so. The other party has discretion whether to consent.

Right of old scholarship holders. Any student who had been awarded a scholarship under s 7(2) of the Agricultural Colleges Act 1958 before the appointed day is entitled to the benefit for the remainder of the term (s 7(1)(e)). This is a preserved right that the College cannot unilaterally terminate.

Right of continuous legal effect. Section 7(3) says that all persons, things and circumstances appointed or created under the repealed Act continue under the VCAH Act with the same status, operation and effect. This preserves all existing rights, obligations, leases, regulations, orders, grants, etc. This is a right for any person who had a legal position under the old regime; that position is not extinguished by the repeal.

Duty not to disturb continuity of the Dookie Land Act. Section 7(4) provides that the Dookie Agricultural College Land Act 1972 continues unaffected. That Act deals with specific land at Dookie. The Council cannot assert that the VCAH Act overrides the Dookie Act.

Duty to refer to the College. Section 7(1)(i) deems references to the agricultural colleges, state agricultural colleges or Division of Agricultural Education in other Acts, instruments or documents to be references to the College, unless inconsistent. This is a rule of statutory interpretation binding on courts, administrators and private parties. It avoids the need to amend each old document.

The Act contains no penalty provisions. There is no criminal offence, civil penalty, or infringement notice for breach of its provisions. The Act is a structural and transitional enactment; its enforcement mechanism is not punitive but relies on the ordinary law (contract, property, tort, judicial review) if any duty is breached.

For example, if the Minister failed to apply for incorporation under s 6(2) “as soon as practicable,” the remedy would likely be an order for mandamus (now called a mandatory order) in the Supreme Court to compel performance of a public duty. No time limit is specified, so the duty is enforceable within the usual judicial review framework. If the Council failed to honour a scholarship under s 7(1)(e), the scholarship holder could sue for breach of a statutory duty or enforce the contract right. If the Council attempted to use Crown lands without an arrangement under s 5, the land-administering body could take action under the Crown Land (Reserves) Act 1978, such as revoking permission or seeking an injunction.

The repeal of the Agricultural Colleges Act 1958 (s 7(1)(f)) removes the old penalty provisions that may have existed in that Act. The VCAH Act does not re-enact them, so any former criminal offences under the old Act are not continued unless saved by the transitional provision s 7(3) which says things continue “as if that Act had not been repealed.” Section 7(3)(a) says “all persons things and circumstances” continue, which could include offences. However, it is ambiguous whether a criminal offence is a “thing” or “circumstance.” The typical rule is that repeal of a penal Act abates pending prosecutions unless there is a saving clause. Section 7(3)(b) lists examples that do not mention penalties, only “obligation liability or right.” This suggests offences are not saved. So enforcement of pre-appointed day breaches of the old Act would be difficult.

The Act does not confer any enforcement powers on any government agency. The Post-Secondary Education Commission may have had powers under the Post-Secondary Education Act 1978, but those are not replicated here. The VCAH Act is essentially a one-time transfer that requires no ongoing policing.

The main practical enforcement risk arises if the Council acts beyond its powers (ultra vires). The Council is a statutory body and its powers are limited by the Act and the Order in Council. If it enters an arrangement for Crown lands that does not fully describe the lands (s 5(3)), that arrangement may be void or unenforceable. If it uses land without an arrangement, it may be trespassing. Such issues would be resolved through private law remedies or administrative law.

In summary, the Act is not a regulatory regime; it is a corporate and property law instrument. Its “penalty” for non-compliance with its provisions is legal invalidity of acts done without authority, and the possibility of litigation by affected parties.

Post-Secondary Education Act 1978 (PSE Act). This is the parent statute for the College’s corporate existence. Section 6 of the VCAH Act relies on s 23 of the PSE Act for the incorporation of the Council by Order in Council. Section 6(4) disapplies s 26(1) of the PSE Act, which would have required the Order to be laid before Parliament and subject to disallowance by either House within 12 sitting days (or a specified period depending on the version). This exemption means the creation of the College’s governing body was not subject to parliamentary scrutiny. The VCAH Act does not replicate the PSE Act’s provisions on College governance, powers, or reporting; those apply through the Order in Council and the PSE Act itself. The VCAH Act only adds the specific Crown land power in s 5, which is “in addition to any powers conferred upon it by the Post-Secondary Education Act 1978 and by the Order in Council.”

Crown Land (Reserves) Act 1978. This Act governs the reservation and management of Crown lands. Section 7(1)(b) of the VCAH Act deems the Longerenong and Dookie college lands to be permanently reserved under the Crown Land (Reserves) Act 1978 for the purpose of agricultural colleges. That means those lands are no longer subject to the Agricultural Colleges Act 1958 (now repealed) and fall under the Crown land management regime. The Council controls the lands, but the reservation creates a purpose limitation. Section 5(1) refers to Crown lands (other than those two) that were already reserved under the Crown Land (Reserves) Act 1978 and used for the agricultural colleges, giving the Council power to enter into arrangements for their use. The body administering the land (e.g., a committee of management) must consent; the Council does not gain automatic control.

Agricultural Colleges Act 1958 (repealed). This is the Act that the VCAH Act repeals (s 7(1)(f)). The repeal is effective from the appointed day. The VCAH Act does, however, preserve continuity of everything done under that Act (s 7(3)). The scholarships, regulations, orders, grants, leases and other instruments continue. The Second Schedule to that Act, which described the Dookie and Longerenong lands, is referenced in s 7(1)(b) to identify those lands. The VCAH Act also revokes an earlier proclamation made under s 6 of the 1958 Act that had declared McMillan and Gilbert Chandler to be agricultural colleges (s 7(1)(h) and Schedule Two).

Dookie Agricultural College Land Act 1972. Section 7(4) expressly preserves this Act. It is a standalone Act dealing with land at Dookie. The VCAH Act does not affect it, so any special provisions in that Act (e.g., conditions on the land use) continue independently.

Land Act 1958. The preamble to the VCAH Act mentions that the Act amends the Land Act 1958, but no such amendment appears in the body of the VCAH Act as provided. The original Act may have included an amendment schedule that was subsequently repealed or consolidated. The current version does not contain any amendment to the Land Act 1958. The reference in the preamble is historic and likely spent.

Post-Secondary Education Remuneration Tribunal Act 1980. Similarly, the preamble says the VCAH Act amends this Act, but no amendment is visible in the current text. It may have been an amendment to bring the College within the Tribunal’s jurisdiction, later superseded.

Interpretation of Legislation Act 1984 (ILA). The Endnotes explain that the ILA governs style changes, headings, examples and other matters. The ILA is a general Act applicable to all Victorian legislation. Its s 39B allows the insertion of subsection numbers when amendments add subsections. These notes are interpretive, not substantive interaction.

State Superannuation Act 1988. The 1988 amendment to the VCAH Act (No. 50/1988) included changes via Schedule 2 Part 2 item 67. This likely updated references to the superannuation scheme applicable to College staff. However, that amendment is no longer in the body of the Act (s 8 was repealed by the 1998 Act). The remaining interaction is historical.

Public Sector Reform (Miscellaneous Amendments) Act 1998. This Act repealed s 8 of the VCAH Act and Schedule 1 (which had contained transitional provisions regarding the Victorian College of Agriculture and Horticulture Superannuation Scheme). The repeal took effect 1 July 1998. It removed spent provisions.

Statute Law Revision Act 2015. This Act repealed s 7(1)(g) and Schedule 1 of the VCAH Act. Section 7(1)(g) had dealt with the vesting of certain land or other property; Schedule 1 had contained additional transitional matters. Their removal cleans up the statute but does not affect current operations.

Crown land legislation generally. The VCAH Act does not create new Crown land; it merely transfers control and allows arrangements. It interacts with the Crown Land (Reserves) Act 1978 as described. The Council may also need to comply with the Land Act 1958 if it uses unallocated Crown land, but s 5 only permits arrangements for already-reserved lands.

Freedom of information, privacy, and other general laws. The College, as a public statutory body, would be subject to the Freedom of Information Act 1982, the Privacy and Data Protection Act 2014, the Public Administration Act 2004, and other general Victorian laws. The VCAH Act does not override those.

The VCAH Act has been amended three times since its enactment in 1982. The original Act received Royal Assent on 14 December 1982 and commenced on 22 December 1982. The appointed day for the transfer was fixed as 8 March 1983.

State Superannuation Act 1988 (No. 50/1988). This Act amended the VCAH Act by s 93(2) and Second Schedule Part 2 item 67. The amendment commenced on 1 July 1988. The precise change is not specified in the current text, but it likely updated references to the superannuation arrangements for College staff, possibly replacing the specific VCAH Superannuation Scheme with the State Superannuation Fund. The amendment was later rendered partly obsolete by subsequent repeals.

Public Sector Reform (Miscellaneous Amendments) Act 1998 (No. 46/1998). This Act repealed s 8 and Schedule 1 of the VCAH Act, effective 1 July 1998. Section 8 had contained a specific provision relating to the Victorian College of Agriculture and Horticulture Superannuation Scheme. Schedule 1 had set out transitional details of that scheme. The repeal removed those spent provisions, as the superannuation arrangements were by then fully covered by the State Superannuation Act. This is a typical clean-up of an Act where transitional provisions have become redundant.

Statute Law Revision Act 2015 (No. 21/2015). This Act repealed s 7(1)(g) and Schedule 1 of the VCAH Act (note that Schedule 1 had been previously repealed in 1998, so the 2015 repeal may have been a further clean-up or a correction; the 2015 Act s 3(Sch. 1 item 63) repealed both, but the current version shows Schedule 1 is repealed, and s 7(1)(g) is marked as repealed by No. 21/2015). The repeal took effect on 1 August 2015. Section 7(1)(g) had likely dealt with the vesting of some land or other property that was no longer relevant. The repeal removes these spent lines.

There are no amendments not in operation listed in the Endnotes. The Act is stable.

The repeal of s 7(1)(g) and Schedule 1 leaves the Act with only the core structural provisions: the establishment (s 3), the Council (s 4), the Crown land power (s 5), the incorporation process (s 6), the transfer and continuity (s 7), and the definition section (s 2). Sections 1, 1A? No, only s 1 is short title. Section 8 was gone. The schedules are reduced to Schedule Two (the revoked proclamation). The Endnotes contain general information and tables.

The Act’s amendment history shows no substantive policy changes; only administrative and statute law revision amendments have occurred. The College itself may have been renamed or amalgamated with other institutions since 1983 (e.g., into the University of Melbourne or a TAFE? Not in source, so cannot state). The Act remains on the books with its original short title, suggesting the corporate entity still exists in law, though possibly inactive or superseded.

The provided source contains no references to any litigation. There are no cases mentioned in the Act, schedules, endnotes, or explanatory details. The table of amendments and endnotes do not cite any judicial decisions. The Act is a transitional statute dealing with a specific institutional merger in 1982-83, and it is unlikely to have generated significant litigation. Disputes over property or employment may have been resolved without reported decisions, or outside the scope of the source.

It is possible that cases have interpreted s 5 (Crown land arrangements) or s 7(3) (continuity) but none are recorded in the source. The Act’s provisions are relatively clear and mechanical, reducing the likelihood of interpretive disputes. The disapplication of s 26(1) of the Post-Secondary Education Act in s 6(4) could have been challenged as a breach of parliamentary process, but no such challenge is indicated.

The repeal of the Agricultural Colleges Act 1958 could have led to proceedings about the validity of pre-transfer leases or contracts, but the continuity clause s 7(3) is designed to avoid that.

Given the absence of litigation history in the source, any comment would be speculative. The analyst must not invent cases. Therefore, the only safe statement is that the source does not refer to any litigation arising under this Act. A search of Victorian case databases (not in source) would be needed to confirm whether any unreported decisions exist.

In the context of a deep dive for a paying audience, this absence is itself informative: the Act was structured to minimise legal risk. The transitional provisions were drafted to preserve all existing rights and obligations, which reduces grounds for dispute. The Act’s brevity and clarity also limit ambiguity. If litigation had occurred, it might have involved the meaning of “lands used for or in connexion with the Agricultural Colleges” in s 5(1), or the scope of “all personal property” in s 7(1)(c), or the effect of the continuity clause on employee entitlements. None of these have been recorded in the source.

The Council is not created by this Act. A casual reader might assume s 4 creates the Council as a body corporate. It does not. It says the Council “shall be constituted as a body corporate by Order in Council made as provided for in section 6.” The actual incorporation occurs under the Post-Secondary Education Act 1978, not the VCAH Act. If the Order in Council never issued, the College would have a Council in name only. In practice, it did issue.

No parliamentary scrutiny of the Order in Council. Section 6(4) disapplies s 26(1) of the Post-Secondary Education Act 1978, which would have required the Order to be tabled and subject to disallowance. This means the executive (Governor in Council) could create the corporate governing body without Parliament having a chance to reject it. This reduces accountability.

The appointed day must be after the Council is incorporated. Section 7(2) requires this sequencing. If the appointed day had been proclaimed before the Council was incorporated, the transfer would be unlawful. The actual dates show it was done correctly: the Act commenced 22 December 1982, the Order presumably issued soon after, and the appointed day was 8 March 1983.

The definition of “the Agricultural Colleges” is closed. It lists six specific institutions. No future college can be added without amending the Act. If the government later wanted to add another agricultural college to the College’s control, a new Act would be needed. However, the College could potentially acquire other institutions under its general powers, but they would not be “the Agricultural Colleges” under the Act.

The Crown land power (s 5) only covers lands “used for or in connexion with the Agricultural Colleges.” It does not allow the Council to seek arrangements for any Crown land, only those already used for the agricultural colleges on the appointed day. Furthermore, it excludes the Longerenong and Dookie lands (which were dealt with separately under s 7(1)(b)). The Council cannot use s 5 to expand its land holdings; it can only regularise use of existing college-associated lands.

Section 5(3) requires the arrangement to “describe fully the lands to which it refers.” A vague description could render the arrangement invalid. This is a technical requirement that could catch out a Council that does not precisely identify the land (e.g., by lot, plan, or metes and bounds).

The continuity clause (s 7(3)) is broad but not absolute. It says things continue “as if that Act had not been repealed.” However, if a power under the old Act was only exercisable by the Minister, it may not automatically transfer to the Council unless the context implies it. For example, the power to award scholarships under s 7(2) of the old Act: does the Council now have that power? The old section is repealed, but the continuity clause preserves the status of scholarships awarded, not necessarily the power to award new ones. The Council would need to find authority elsewhere.

The Dookie Agricultural College Land Act 1972 is preserved (s 7(4)), even though Dookie land is now under Crown land reservation (s 7(1)(b)). There could be conflict between the two regimes. The VCAH Act does not resolve it; it just says the Dookie Act continues unaffected. If the Dookie Act says something different from the Crown Land (Reserves) Act, the Dookie Act prevails as a specific Act, but interpretation would require a court.

The repeal of the Agricultural Colleges Act 1958 is subject to s 7(3), but not all subordinate instruments may have been saved. Instruments under the old Act that were not “appointed or created by or under” that Act but merely referred to it might fall into a gap. Section 7(1)(i) deems references to the old colleges to be references to the College, but that only helps if the instrument is still in force.

No penalty for delay. The Minister must apply “as soon as practicable” (s 6(2)). There is no deadline. A dilatory Minister could delay the entire transfer without penalty. In practice, the Minister acted within a few months.

The Act does not specify the College’s educational powers. It simply calls it a “post-secondary education institution.” The VCAH Act does not confer degree-awarding powers, set its objects, or even mention what it teaches (though the name implies agriculture and horticulture). Those details are in the Order in Council and the PSE Act. Anyone relying on the VCAH Act alone to understand the College’s capacity may be misled.

The 2015 repeal of s 7(1)(g) removed a provision that had vested something. What was it? Not in the source. The repeal means that any uncompleted vesting under that paragraph could be affected. Since the repeal is retrospective? Probably not; it removes the provision from the current text, but the historical vesting would still have effect at the time. But if any act relied on that paragraph and it is now gone, future references could be problematic.

For a statute that is primarily transitional and now largely spent, compliance is mainly historical. However, several ongoing legal obligations and practical steps may still apply.

If you are the Council (or its modern successor). The Council must ensure it continues to hold and manage the assets and documents transferred under s 7. It must maintain the continuity of scholarships under s 7(1)(e) for any remaining beneficiaries (unlikely after four decades). If the Council wishes to use Crown lands that were used for the original agricultural colleges (other than Dookie and Longerenong), it must enter into an arrangement under s 5 with the body administering those lands. That arrangement must fully describe the lands (s 5(3)) and must be in writing. The Council should document the terms clearly, including the duration, any fees, and permitted uses. It should not assume it has automatic control over those lands; the arrangement is the only legal basis.

The Council should also review any pre-existing leases, grants, or licences that were in place under the Agricultural Colleges Act 1958 and ensure they are still honoured. The continuity clause (s 7(3)) preserves them, but the Council may need to step into the shoes of the Minister of Agriculture as the counterparty. If any lease contains a covenant that references the old Act or the Minister, s 7(1)(i) deems those references to the College, so amendment may be unnecessary, but practical notification is wise.

If you are a person dealing with the College (e.g., a supplier, contractor, lessee). You can verify the College’s corporate existence and the Council’s authority. The Council is a body corporate created by Order in Council under the PSE Act, with additional powers under the VCAH Act. You should request a copy of the Order in Council if needed. Section 5 arrangements for Crown lands may involve the College as a tenant or licensee; ensure the arrangement is in place and properly describes the land. If the College is acting outside its powers (e.g., purporting to grant a lease over Crown land without an arrangement under s 5), you should seek legal advice.

If you are a body administering Crown lands. If the Council approaches you to use land that was formerly used for an agricultural college, you are not obliged to agree. Section 5 gives the Council a power to seek an arrangement but does not compel you to grant one. If you do agree, you must ensure the arrangement complies with the Crown Land (Reserves) Act 1978 and other applicable laws. The arrangement must fully describe the lands (s 5(3)). You should also consider whether the land remains needed for its original reservation purpose.

If you are a student or scholarship holder. Your rights are preserved. If the College fails to honour a pre-1983 scholarship, you can rely on s 7(1)(e) and s 7(3). While unlikely now, the Act remains the legal basis.

If you are a researcher or journalist. To understand the current legal status of the College, you must go beyond the VCAH Act. Check whether the Order in Council has been amended or revoked, and whether the Post-Secondary Education Act 1978 has been replaced (it has been; the current framework is the Education and Training Reform Act 2006). The VCAH Act may be a dead letter if the College no longer exists as a distinct entity. However, its provisions on land and continuity could still affect title searches and document interpretation.

General compliance steps. There are no reporting requirements under this Act. No returns need to be lodged. No fees are payable. The Act creates no regulatory agency. Compliance is about ensuring that the legal effects of the 1982 transfer are still recognised and that any ongoing use of lands or reference to the College is consistent with the Act’s definitions and continuity rules. If the College has been renamed or merged, the Victorian government may need to amend or repeal this Act to avoid confusion. Until then, any reference to “Victorian College of Agriculture and Horticulture” in legislation or documents should be interpreted as the body established by this Act.
