(1) Despite section 109, the Council must bear the costs of the proceedings if the Council applies to VCAT for review under section 170(1) of the **Local** **Government Act 2020**.
(2) The Council is not required to bear the costs of the proceedings under subclause (1) if VCAT otherwise orders.
