Victoria State Emergency Service Regulations 2017

The Regulations deploy a set of defined concepts that determine who can act, what conduct is regulated, which procedures apply and how outcomes take effect. The definitions in regulation 5 are central; a number are operationalised throughout the instrument.

• Misconduct. Regulation 5 provides a broad, enumerated definition of misconduct for registered and probationary members. Misconduct covers contraventions of the Act or these Regulations (a), unlawful acts while on or off duty where such acts are likely to harm Service operations or reputation (b, c), negligence in carrying out duties (d), disruptive or incompetent behaviour on duty likely to harm operation or reputation (e), harassment or bullying (f, g), failure to comply with lawful instructions or standing orders (h), giving false or misleading information (i), failure to disclose material changes in circumstances (j), failures to take reasonable care for personal or others’ health and safety while on duty (k, l), failure to cooperate in OHS compliance action (m), obstructing grievance resolution processes (n) and any other acts intended to harm Service operations or reputation (o). The definition expressly treats “health” to include psychological health (regulation 5).
• Complaint. The Regulations use the term complaint to mean a written complaint to the Chief Officer, Operations under regulations 8, 9 or 10 (regulation 5). Which types of misconduct can be the subject of a complaint depends on which regulation the complainant invokes: regulation 8 limits certain misconduct categories, regulation 9 provides a specific route for unlawful acts, and regulation 10 is the general public complaint route.
• Roles and decisionmakers. The instrument distinguishes between the Chief Officer, Operations and the Authority. The Chief Officer, Operations has primary responsibility for receiving, deciding whether to investigate, conducting investigations (or appointing external investigators), and taking certain administrative actions including cancelling membership for training non‑attendance (regulations 13-17, 14(2), 35). The Authority conducts hearings and may impose further action following a hearing (regulations 18-21). Both the Chief Officer, Operations and the Authority may suspend membership without a hearing in defined circumstances (regulations 22-24).
• Controllers and registered units. A controller leads a registered unit and is responsible for preparing an approved plan or syllabus for exercises and training (regulations 29-31). Controllers must audit attendance and report non‑compliance to the Chief Officer, Operations (regulation 33).
• Training and attendance. The Chief Officer, Operations must produce, each year by 30 April, training and exercises for the following financial year (regulation 28). The Chief Officer must inform controllers by 31 May of the range of exercises to be provided by their units (regulation 29). Controllers prepare and forward plans by 30 June for approval (regulation 30). Registered members must attend at least 60% of applicable exercises each calendar year and must not be absent from applicable exercises for more than three months in any 12‑month period (regulation 32).
• Insignia and property. Regulation 6 controls use of the Service insignia (Schedule 1). Property owned or issued by the Authority and under a registered unit’s control may be redeployed elsewhere by the Authority (regulation 40(1)). Identity cards must be signed and carried while on duty (regulation 38). On cessation of membership, identity cards and issued equipment must be surrendered within 7 days (regulation 39).

Mechanically these concepts determine procedure: who may complain and how; what constitutes misconduct in different complaint routes; who decides to investigate and on what timeline; what disciplinary options the Authority may impose and when those options take effect; and how training planning, delivery and compliance are governed.

The Regulations set out duties and powers that affect the following people and entities:

• Registered members and probationary members. These are the primary subjects. The Regulations define misconduct applicable to them (regulation 5) and place duties on them to cooperate in grievance resolution (regulation 7(3)), to attend training (regulation 32), to carry identity cards on duty (regulation 38), and to surrender equipment on cessation (regulation 39). They are exposed to disciplinary processes (Parts 2 and 3) and can be suspended or have membership cancelled (regulations 21, 22, 23, 24, 35).
• Service members. The term is used in Parts 2 and is the class of people who must attempt informal resolution of suspected misconduct before lodging a written complaint (regulation 7). Service members also have a separate complaint route for unlawful conduct (regulation 9).
• Controllers of registered units. Controllers are responsible for preparing training plans/syllabuses and delivering the approved exercises and training (regulations 29-31). They must audit attendance and report non‑compliance by 31 December each year (regulation 33). Controllers may recommend cancellation of membership after unsatisfactory completion of training (regulation 34) and must not conduct courses endorsing the Service without prior approval (regulation 36).
• Chief Officer, Operations. The Chief Officer is the operational official with responsibilities to receive complaints, decide within statutory timeframes whether to investigate, appoint investigators, develop and disseminate training (regulations 11, 13-17, 28-31, 35), and may suspend a member without a hearing in specified circumstances (regulation 22). The Chief Officer also handles criminal record checks for registration applicants (regulation 37).
• The Authority. The Authority conducts hearings for matters referred by the Chief Officer (regulation 18), may determine outcomes and take further action including suspension, transfer, reduction in rank or cancellation (regulations 20-21), may suspend membership without a hearing where an indictable offence is charged that, if proven, would harm Service operations or reputation (regulation 23), and may act following conviction without conducting a hearing (regulation 24).
• Members of the public and complainants. Regulation 10 provides a route for members of the public (persons other than Service members) to make written complaints about misconduct.
• External investigators and legal representatives. The Chief Officer may appoint external investigators (regulation 14(2)). Registered or probationary members may be represented by an Australian legal practitioner or any other person at hearings and may call and cross‑examine witnesses (regulation 18(3)).

Administrative consequences extend beyond individuals. Registered units are the locus for issuance and control of property; the Authority may withdraw property from a unit and redeploy it to perform Authority functions (regulation 40(1)). Entities that purport to run courses “endorsed by the Service” will be impacted by the prohibition in regulation 36. Applicants for registration are required to consent to criminal record checks and other enquiries relevant to suitability (regulation 37).

Who decides: the Chief Officer, Operations makes threshold and many operational decisions (investigate or dismiss, training development and approval, cancellation for training non‑attendance), the Authority conducts hearings and imposes formal sanctions, and VCAT is the external review forum for particular Authority decisions (regulation 25). Who pays: the Regulations do not create new fees or fines but create administrative burdens on controllers and members (attendance recording, plan preparation, responses to notices), and on the Chief Officer and Authority for investigative and hearing workloads.

The Regulations allocate a set of duties to members, controllers and the Chief Officer, and preserve procedural rights through hearing rules and review rights. Key duties and rights are set out below with the controlling provisions cited.

Duties on Service members and complainants

• Informal resolution, then grievance policy: A Service member who reasonably believes another registered or probationary member has engaged in misconduct must attempt informal resolution promptly (regulation 7(1)). If informal resolution fails, the complainant must pursue the Authority’s grievance policy (regulation 7(2)). A Service member must cooperate with attempts to resolve matters (regulation 7(3)). Note that regulation 7 excludes certain misconduct categories (paragraphs (b) and (c) of the definition in regulation 5) from the informal‑resolution obligation.
• Written complaints: A complaint under regulations 8, 9 or 10 must be in writing and specify the facts or matters the complainant knows and the reasonable belief formed (regulations 8(2), 9(2), 10(2)). Regulation 9 is the express route for Service members alleging commission of an unlawful act (regulation 9(1)-(2)).
• Withdrawal: A complainant may withdraw a complaint in writing before the matter is referred to the Authority for a hearing or before the Authority conducts a hearing; the Chief Officer or Authority must notify the subject within 14 days (regulation 12).

Duties and powers of the Chief Officer, Operations

• Notification and timeframes: The Chief Officer must notify a member subject to a complaint in writing within 14 days after the complaint is made (regulation 11(1)‑(2)). The Chief Officer must decide whether to investigate within 14 days (regulation 13(1)), and if deciding to investigate must provide notice (regulation 13(3)). Investigations are to be completed within 28 days from commencement (regulation 16(1)) subject to a single extension of up to 28 days for difficulty obtaining evidence or emergencies (regulation 16(2)‑(3)), with notice of extension to the subject (regulation 16(4)). The Chief Officer must decide the outcome of an investigation within 14 days of completing it and notify the member within 7 days of that decision (regulation 17(1), (4)). If matter is referred to a hearing, the notice to the member must give time, date and place of the hearing at least 14 days before the hearing (regulation 17(5)).
• Investigatory procedure and external investigators: The Chief Officer must not commence the investigation without giving the written notice required by regulation 13(3) (regulation 14(1)) and may appoint an external investigator (regulation 14(2)).
• Administrative suspension: The Chief Officer may suspend a member without a hearing where continued membership would likely harm Service operation or reputation if the misconduct were substantiated, or where the member is likely to re‑offend (regulation 22(1)). A suspension cannot be imposed under that provision if the matter has been referred to the Authority for a hearing that has commenced (regulation 22(2)). Notice of suspension and reasons must be given within 14 days (regulation 22(4)). A suspended member must comply with property and cessation obligations as if membership were cancelled (regulation 22(5)).
• Training and cancellations: The Chief Officer must develop exercises and training by 30 April each year (regulation 28(1)) and must approve or refuse controllers’ plans within 31 days of submission (regulation 30(2)). The Chief Officer may cancel membership for non‑attendance or unsatisfactory completion of exercises following prescribed procedures, including consulting with the controller, giving a 7‑day notice and offering further exercises where appropriate (regulation 35(1)‑(6)).

Authority powers and member rights at hearing

• Hearing conduct: The Authority conducts hearings of matters referred by the Chief Officer (regulation 18(1)) and is empowered to regulate its own procedure, act expeditiously with little formality and technicality, is not bound by the rules of evidence, and may inform itself on any matter it sees fit, but is bound by the rules of natural justice (regulation 18(2)(a)‑(e)).
• Representation and evidentiary rights: The subject of a hearing may be represented by an Australian legal practitioner or any other person, may call and examine witnesses, cross‑examine adverse witnesses, and make submissions (regulation 18(3)(a)‑(d)).
• Post‑hearing sanctions: After a hearing the Authority may determine that misconduct is not substantiated or is substantiated and either insufficiently serious or meriting further action (regulation 20). The Authority’s list of further actions includes formal warning, counselling, reprimand, transfer to another unit, reduction in rank or classification, suspension for up to 5 years, or cancellation of membership (regulation 21(2)(a)‑(g)). The Authority must give notice of any further action and reasons within 21 days (regulation 21(3)). If suspension is imposed the suspended member must comply with cancellation surrender obligations (regulation 21(4)).
• Suspension or action without hearing on criminal charges or convictions: The Authority may suspend membership without a hearing if the member is charged with an offence punishable by imprisonment and, if found guilty, would likely harm Service operations or reputation (regulation 23). If a member is found guilty of such an offence and a certified court record is received, the Authority may take action without a hearing (regulation 24(1)‑(3)). Notice of such action must be given within 14 days (regulation 24(2)).
• Review rights: A registered or probationary member may apply to VCAT to review Authority decisions under regulation 21(2), 23(1) or 24(1), and such applications must be lodged within 30 days after receipt of written notice (regulation 25(1)‑(2)). The Authority may stay the effect of suspension or cancellation until an application for review is dismissed or withdrawn (regulation 27).

Other duties

• Controllers: prepare plans, deliver approved training, keep attendance records and report non‑compliance by 31 December each year (regulations 30-33).
• Identity cards: must be signed and carried while on duty (regulation 38).
• Criminal record checks: applicants for registration must provide any necessary authority to permit the Chief Officer to conduct criminal record checks and other consented enquiries relevant to suitability (regulation 37).
• Property use and surrender: property under registered unit control may be withdrawn and redeployed by the Authority (regulation 40(1)); members must not use Authority property for non‑Authority purposes without prior Chief Officer approval (regulation 40(2)); and members must surrender identity cards and issued equipment within 7 days of cessation of membership (regulation 39).

These duties and rights are procedural and administrative in nature; the Regulations set explicit notice, timing and content requirements for decisions, investigations, suspensions and appeals.

The Regulations do not create new criminal offences with specified monetary fines in the text provided, but they set out a comprehensive internal enforcement and sanctioning structure within the Service and specify administrative remedies and processes for members.

Disciplinary sanctions and internal enforcement

• Menu of sanctions. The Authority may impose a range of disciplinary measures following a hearing: formal warning, formal counselling, reprimand, transfer to another registered unit, reduction in rank or classification, suspension of membership for up to five years, or cancellation of membership (regulation 21(2)(a)‑(g)). The Authority must provide written notice of the action and reasons within 21 days (regulation 21(3)).
• Immediate effect and stays. Except where stayed by the Authority, suspensions and cancellations generally take effect immediately upon the subject receiving written notice (regulation 26(3)‑(4)); transfers and reductions in rank take effect 30 days after notice unless the member applies to VCAT for review, in which case they take effect immediately upon the dismissal or withdrawal of the review application (regulation 26(1)‑(2)). The Authority has express power to stay the effect of suspension or cancellation until a VCAT review is dismissed or withdrawn (regulation 27).
• Suspension without hearing. The Chief Officer, Operations may suspend a member without a hearing where continued membership would likely harm the Service’s operation or reputation if misconduct were substantiated, or where the member is likely to commit further misconduct (regulation 22(1)). The Authority may suspend membership without a hearing when a member is charged with an imprisonable offence which, if proven, would likely harm the Service (regulation 23(1)). Both Chief Officer and Authority must give written notice of suspension and reasons within 14 days (regulations 22(4), 23(4)). Suspensions under these provisions may be for a specified period and suspension may have immediate operational consequences (regulations 22(3), 23(2), 22(5), 23(5)).
• Action without hearing after conviction. If a member is found guilty of an offence punishable by imprisonment and the conviction is likely to harm the Service, the Authority may take disciplinary action without conducting a hearing once a certified court record is received and the Authority believes action is in the Service’s best interests (regulation 24(1)). Notice of action and reasons must be provided within 14 days (regulation 24(2)).

Procedural enforcement mechanisms

• Time limits and notice obligations. The Regulations prescribe strict timeframes for key steps, decision to investigate within 14 days (regulation 13(1)); investigation completion within 28 days with possible single extension of 28 days and requirement to notify the subject of the extension (regulation 16); decision on outcome within 14 days of investigation completion and notice within 7 days of the decision (regulation 17).
• Hearing procedure. The Authority may tailor procedure (regulation 18(2)(a)) and is not bound by rules of evidence (regulation 18(2)(c)), but is bound by natural justice (regulation 18(2)(e)). Subjects have rights to representation and to call and cross‑examine witnesses (regulation 18(3)).
• External investigators. The Chief Officer may appoint external investigators to conduct investigations (regulation 14(2)). This expands investigatory capacity beyond internal staff.
• Reporting and audit obligations. Controllers must audit and report non‑attendance to the Chief Officer by 31 December each year (regulation 33). Failure to comply with training attendance obligations may trigger cancellation procedures (regulation 35).
• Property control and return obligations. Members must surrender identity cards and issued property within 7 days of cessation (regulation 39). Use of Authority property for non‑Authority purposes is prohibited without prior Chief Officer approval (regulation 40(2)). The Authority may redeploy property as it sees fit (regulation 40(1)).

External review

• VCAT review. Registered or probationary members may apply to the Victorian Civil and Administrative Tribunal to review Authority decisions under regulation 21(2), 23(1) or 24(1). An application must be lodged within 30 days of receiving notice of the Authority’s decision (regulation 25(1)‑(2)). The Authority may stay the effect of a suspension or cancellation while a VCAT review is pending (regulation 27).

Penalties by statute or criminal enforcement

• The Regulations themselves do not set out monetary fines or criminal penalties for most contraventions, instead relying on internal disciplinary measures. However, the definition of misconduct includes commission of unlawful acts (regulation 5(b)‑(c)), and regulation 37 requires applicants to authorise criminal record checks. Any criminal liability would arise under separate laws rather than these Regulations.

Enforcement focus and limits

• Enforcement under the Regulations is chiefly administrative and procedural, executed by the Chief Officer and the Authority, with judicial review through VCAT for certain decisions. The instrument emphasises process (timeframes, notices, hearings and review) and internal sanctions rather than external statutory penalties.

The Regulations are subordinate legislation made under the Victoria State Emergency Service Act 2005 (regulation 2). Several provisions explicitly reference other statutory regimes or institutions, which generates specific interactions and compliance intersections.

Authorising and interpretative context

• Enabling Act. The Regulations are made under section 55 of the Victoria State Emergency Service Act 2005 (regulation 2). Where the Regulations prescribe disciplinary processes, training requirements or membership effects, those operational mechanisms are a statutory elaboration of powers conferred by the Act.
• Subordinate Legislation Act 1994. The Endnotes record the making date and note that the Regulations will sunset under the Subordinate Legislation Act 1994 after ten years (Endnotes, item 1). That creates an external expiry mechanism requiring legislative attention before 26 September 2027.

Interactions with administrative review and tribunal law

• VCAT. The Regulations provide for review of certain Authority decisions by the Victorian Civil and Administrative Tribunal (regulation 25). This creates a judicialised review path consistent with administrative review practices in Victorian public law and exposes Authority decisions to VCAT’s procedures, remedies and potential orders.

Occupational health and safety law

• OHS obligations. Regulation 5 includes as misconduct a failure to cooperate with Authority action to comply with a requirement under the Occupational Health and Safety Act 2004 or its regulations (regulation 5(m)). This cross‑reference integrates the Service’s internal disciplinary regime with compliance obligations under the OHS framework and permits disciplinary responses where members obstruct the Authority’s statutory OHS compliance actions.

Criminal law and record checks

• Criminal record checks. Regulation 37 requires applicants seeking registration to provide authority for the Chief Officer, Operations to conduct criminal record checks and, with the applicant’s consent, other enquires relevant to suitability (regulation 37). The mechanics of criminal record disclosures and use of such information will intersect with privacy law and criminal records disclosure regimes, though the Regulations themselves do not elaborate data handling or disclosure limits. Where a member is charged or convicted of an imprisonable offence, the Authority has express suspension and post‑conviction action powers (regulations 23 and 24), which interact procedurally with the criminal justice process (for example, suspensions may cease if charges are withdrawn or the member is acquitted: regulation 23(3)).

Statutory instrument interpretation

• Interpretation of Legislation Act 1984. The Endnotes discuss style changes and interpretative effects arising from the Interpretation of Legislation Act 1984 (ILA) and related sections (Endnotes, section 1). Those notes are not substantive changes to the disciplinary scheme but affect how headings, examples, punctuation and provision numbering are treated when construing the statutory instrument.

Contractual, employment and industrial law

• The Regulations set internal disciplinary and training rules for volunteers or members. They do not create an employment contract or set wages. Where members are paid employees or have separate industrial instruments, the Regulations will interact with those contracts or instruments only to the extent the authorising Act and service arrangements allow. The text does not amend industrial rights or award obligations; any such interaction would depend on separate instruments or agreements.

Administrative law norms

• Natural justice. The Authority is bound by rules of natural justice in hearings (regulation 18(2)(e)). That binds Authority procedures to administrative law principles and provides a basis for procedural review in adversarial or contentious cases where the member claims denial of natural justice.

Limitations and boundaries

• The Regulations do not themselves create criminal sanctions for most non‑compliance, instead providing an internal disciplinary framework. Where criminal law is implicated, separate statutes supply offences and penal consequences. The Regulations prescribe disciplinary consequences (suspension, cancellation, reduction, transfer) and administrative processes rather than direct statutory fines or imprisonment.

In short, the Regulations operate within and alongside the VSESA 2005, intersect with the Occupational Health and Safety Act 2004 for OHS‑related misconduct, use VCAT as the external review body, and rely on criminal justice processes when members are charged or convicted. They also exist within the interpretative architecture supplied by the Interpretation of Legislation Act 1984 and the Subordinate Legislation Act 1994.

The instrument records a concise amendment history and the revocation of the prior regulatory instruments. The relevant factual points from the text and Endnotes are:

• Revocations. Regulation 4 expressly revokes the Victoria State Emergency Service Regulations 2006 and the Victoria State Emergency Service Amendment Regulations 2012.
• Making and commencement dates. The Regulations were made on 26 September 2017 by the Governor in Council under section 55 of the Victoria State Emergency Service Act 2005 and came into operation on 1 October 2017 (Endnotes, item 1; regulation 3).
• Amendments since making. The Endnotes (Table of Amendments, item 2) state that there are no amendments to the Victoria State Emergency Service Regulations 2017 by statutory rules, subordinate instruments or Acts at the date of this version (Version No. 001, version as at 1 October 2017). The published Table of Amendments (Endnotes, section 2) records “There are no amendments made to the Victoria State Emergency Service Regulations 2017”.
• Amendments not in operation. The Endnotes (section 3) record that there are no amendments not in operation at the date of this publication.
• Sunset provision. The Endnotes note that the statutory rule will sunset 10 years after the day of making under section 5 of the Subordinate Legislation Act 1994, pointing to automatic expiry on 26 September 2027 unless legislative action is taken before that date to extend or replace the instrument (Endnotes, item 1).
• Style and interpretative notes. The Endnotes include interpretative and style notes arising under the Interpretation of Legislation Act 1984 (ILA), indicating the application of ILA provisions to headings, examples, punctuation and provision numbers as part of statutory construction (Endnotes, section 1). Those notes are not textual amendments but affect how the Regulations are read and cited.

There is no recorded sequence of amending statutory rules or Acts altering the substance of the Regulations in the published Version No. 001. The instrument replaces the earlier regulatory framework (the 2006 Regulations and the 2012 amendment) and establishes the current regulatory baseline until amended or sunsetted.

The Regulations themselves do not include any case law or litigation references. The instrument provides an internal administrative review path and an external review route as follows:

• VCAT review. Registered members and probationary members may apply to the Victorian Civil and Administrative Tribunal for review of particular Authority decisions under regulation 21(2), 23(1) or 24(1) (regulation 25). The application must be lodged within 30 days after receipt of the Authority’s written notice of the decision. The Authority may stay the effect of suspension or cancellation until a VCAT review is dismissed or withdrawn (regulation 27). These provisions create a clear statutory channel for tribunal review of disciplinary outcomes.
• No reported litigation cited. The Statutory Rule text and Endnotes do not record any reported litigation or judicial interpretation of the 2017 Regulations. The Endnotes’ Table of Amendments identifies no subsequent amending instruments that might have been prompted by litigation (Endnotes, section 2).
• Procedural safeguards relevant to judicial review. The Authority is required to follow natural justice in hearings (regulation 18(2)(e)). That requirement provides a basis for judicial or administrative review where a member alleges denial of natural justice, procedural unfairness, or jurisdictional error. The Regulations also set fixed timeframes and notice requirements which, if unmet, could give rise to procedural complaints or grounds for review.
• Criminal process interaction. Where membership is suspended or disciplinary action is taken following criminal charges or convictions (regulations 23-24), any litigation or court processes relating to the charge or conviction will interact with the internal disciplinary response but the Regulations do not themselves create criminal offences or specify court‑based remedies.

In short, the Regulations create an administrative enforcement and review system that anticipates external tribunal review at VCAT. The published instrument contains no internal record of litigation, reported cases or precedent interpreting these particular Regulations.

Several features of the Regulations create compliance traps, timing mismatches and procedural subtleties that practitioners, controllers and members should note. These are concrete operational items drawn from the text; they identify points where small mistakes can have material consequences.

Complaint‑type exclusions and parallel complaint routes

• Different complaint routes cover different types of misconduct. Regulation 8 provides a route for Service members who have tried but cannot informally resolve misconduct but explicitly excludes misconduct paragraphs (b) and (c) from the definition for that regulation , those paragraphs relate to commission of unlawful acts (regulation 5(b)‑(c)). Regulation 9 provides a separate route for Service members to complain about unlawful acts (regulation 9(1)‑(3)). Regulation 10 is the general public (non‑Service member) complaint route. Practitioners should note which subset of the definition of misconduct applies to each regulation to avoid filing under the wrong provision and thereby triggering a procedural misstep.
• Service members must attempt informal resolution under regulation 7 before making a regulation 8 complaint, but regulation 7 also excludes paragraphs (b) and (c) (unlawful acts) from the informal resolution obligation (regulation 7(4)). That creates an explicit carve‑out requiring different handling for alleged unlawful conduct (use regulation 9).

Timing and notice precision

• Tight statutory timeframes. The Chief Officer must decide whether to investigate within 14 days of receiving a complaint (regulation 13(1)); investigations must be completed within 28 days with only one possible extension of up to 28 days (regulation 16); and the Chief Officer must decide the outcome within 14 days after completion and notify the member within 7 days (regulation 17). Failure to comply with these timelines could produce procedural unfairness or provide grounds for administrative review.
• Hearing notice requirement. Where the Chief Officer refers a matter to the Authority for a hearing, notice of time, date and place must be provided at least 14 days before the hearing (regulation 17(5)). Practitioners should ensure compliance with that minimum when preparing for hearings.

Timing misalignment between training planning (financial year) and attendance obligations (calendar year)

• The Chief Officer develops training and exercises for the following financial year by 30 April and informs controllers by 31 May (regulations 28-29). Controllers prepare and submit plans by 30 June for approval (regulation 30). However, minimum attendance obligations for registered members are expressed on a calendar year basis (regulation 32(1)). That creates a potential mismatch between planning and attendance measurement that controllers and members should clarify operationally: training is mandated by financial year planning but compliance is measured on a calendar year basis.

Automatic operational consequences on suspension and cancellation

• Surrender and de‑escalation obligations take effect immediately. If suspended under certain provisions, the member must comply with regulation 39 as if membership were cancelled (regulations 22(5), 23(5), 21(4), 24(3)). Regulation 39 requires surrender within 7 days of identity cards and all issued clothing, publications and equipment. Subjects may therefore lose operational capacity and must return issued property even if suspension is later reversed or stayed.
• Effects of VCAT applications on timing. Some sanctions take effect 30 days after notice (transfers and reductions in rank) unless a VCAT review is commenced, in which case the sanction takes effect immediately on dismissal or withdrawal of the review (regulation 26). Practitioners must track time limits for lodging VCAT applications (30 days under regulation 25) to preserve relief options.

Scope of Authority’s procedural flexibility

• Authority not bound by rules of evidence but must observe natural justice (regulation 18(2)(c) and (e)). This combination gives the Authority considerable procedural latitude while preserving basic fairness. Litigants should recognise that admissibility standards will differ from courts, and that fair hearing principles remain enforceable.

Training cancellation process offers procedural remedies to members

• Before cancellation for non‑attendance, the Chief Officer must give written notice of proposed cancellation with reasons and a 7‑day opportunity for the member to request continued registration and provide reasons (regulation 35(3)). The Chief Officer must also arrange further exercises and training where the member wishes to continue (regulation 35(5)). Controllers and members should carefully follow the 7‑day window to avoid losing registration without avail.

Use and redeployment of property

• The Authority may withdraw property from a registered unit and deploy it elsewhere (regulation 40(1)). Members do not have an absolute right to retained use of Authority property; prior approval is required to use property for non‑Authority purposes (regulation 40(2)). Items issued must be returned on cessation (regulation 39). Any failure to surrender required property within 7 days could lead to administrative complications; the Regulations contain no monetary penalties in text but administrative consequences are explicit.

Criminal record checks and consent

• Applicants must provide authority for criminal record checks and, with consent, other enquiries relevant to suitability (regulation 37). Practitioners should ensure consent processes are documented and that applicants are properly informed about the nature of checks to be undertaken.

Course endorsement prohibition

• Controllers or members must not conduct or assist in courses claiming Service endorsement without prior Chief Officer approval (regulation 36). Entities or individuals who purport to run “Service‑endorsed” courses without approval risk administrative sanctions, and controllers should ensure clear branding and approval processes.

Reporting obligations for controllers

• Controllers must forward names of non‑complying registered members to the Chief Officer on or before 31 December each year (regulation 33). Missing that deadline risks delayed enforcement action and may complicate later cancellation steps under regulation 35.

These operational “gotchas” are procedural and timing risks embedded in the Regulations. Clean administrative practice, calendar tracking, careful filing under the correct complaint route, timely notices, and clear records of consent for criminal checks, reduces exposure to adverse disciplinary consequences.

This section provides a practical compliance checklist and procedural roadmap for the principal actors identified in the Regulations. The checklist is aligned to the specific regulatory requirements and their timelines.

For controllers of registered units

• Training planning and approval timeline:
  • By 30 June each year prepare and forward to the Chief Officer, Operations a plan or syllabus of exercises and training for the following financial year (regulation 30(1)).
  • Ensure the plan aligns with the range of exercises notified by the Chief Officer by 31 May and reflects the emergency activities of unit members and the unit as a whole (regulations 29(1)-(2), 30(3)(a)).
  • Expect the Chief Officer to approve or refuse within 31 days (regulation 30(2)). If refused, seek clarification promptly and resubmit.
• Delivery and attendance records:
  • Provide to all registered members the approved range of exercises and training (regulation 31(1)-(2)).
  • Maintain attendance records continuously and calculate each member’s attendance against the minimum 60% threshold for applicable exercises each calendar year and the three‑month absence limit (regulation 32(1)‑(2)). Keep contemporaneous supporting documentation for absences (medical certificates, approved leave).
  • On or before 31 December, forward to the Chief Officer the names of all registered members who have not complied with regulation 32(1) or (2) (regulation 33).
• Unsatisfactory completion or non‑attendance:
  • If recommending cancellation under regulation 34, document performance failings and the training attempted. Provide a formal recommendation to the Chief Officer with supporting evidence.
  • Avoid conducting any external course that purports to be endorsed by the Service without prior written approval from the Chief Officer (regulation 36).

For the Chief Officer, Operations (operational responsibilities)

• Training design and notification:
  • By 30 April each year develop exercises and training for the following financial year that do not exceed genuine occupational requirements and give priority to expected Service and community needs (regulation 28(1)‑(4)). Document the needs assessment used to set priorities.
  • By 31 May notify controllers of the range of exercises and training to be provided (regulation 29(1)) and by 30 June approve or refuse controllers’ plans within 31 days (regulation 30(2)).
• Complaint intake and investigations:
  • On receipt of a written complaint, provide written notice to the subject within 14 days (regulation 11(1)‑(2)).
  • Decide within 14 days whether to investigate; if deciding to investigate give written notice and commence investigation (regulation 13(1)‑(3)).
  • Complete investigations within 28 days; if an extension is necessary for difficulty obtaining evidence or emergency reasons, extend for no more than a further 28 days and notify the subject of the extension (regulation 16).
  • Decide the outcome within 14 days of completing the investigation and notify the subject within 7 days; if referring to a hearing, ensure notice of time, date and place is given at least 14 days before the hearing (regulation 17(1)‑(5)).
  • Consider appointing external investigators where internal capacity or independence concerns require it (regulation 14(2)).
• Non‑attendance and cancellation:
  • If receiving controllers’ reports by 31 December or recommendations under regulation 34, consult with the controller and the member to determine reasons for non‑compliance before proposing cancellation (regulation 35(2)).
  • When proposing cancellation for non‑attendance or unsatisfactory completion, provide written notice of the proposal and give the member 7 days to request continued registration and give reasons (regulation 35(3)). Arrange appropriate exercises and testing where the member requests to continue (regulation 35(5)).
• Suspension powers:
  • Use the suspension power under regulation 22 only where the test in regulation 22(1)(a) or (b) is met and not where the matter has been referred to the Authority and a hearing commenced (regulation 22(2)). Provide written notice and reasons within 14 days (regulation 22(4)).

For registered members and probationary members

• Informal resolution and grievance policy:
  • If you have reasonable grounds that another member has engaged in misconduct, attempt to resolve the matter informally as soon as reasonably practicable (regulation 7(1)). If unsuccessful, pursue the Authority’s grievance policy (regulation 7(2)). Cooperate in attempts to resolve the matter (regulation 7(3)).
  • For alleged unlawful conduct, use the specific complaint route under regulation 9.
• Complaint preparation:
  • When making a complaint under regulations 8-10 ensure it is in writing and sets out the facts you know and the reasonable belief formed (regulations 8(2), 9(2), 10(2)).
• Training attendance:
  • Attend at least 60% of applicable exercises each calendar year and avoid absence exceeding 3 months in any 12‑month period for applicable exercises (regulation 32). Keep records of medical leave or other authorised absences to present to the controller and Chief Officer if called to explain non‑attendance.
• Identity card and equipment:
  • Sign your identity card and carry it while on duty (regulation 38). On cessation of membership, surrender identity card and all issued clothing, publications and equipment to the controller or Chief Officer within 7 days (regulation 39).
• Legal representation and hearings:
  • If summoned to a hearing, you may be represented by an Australian legal practitioner or any other person, call and examine witnesses, cross‑examine other witnesses and make submissions (regulation 18(3)). Prepare witness lists and documentary evidence early and seek legal advice about VCAT review rights where relevant.

For applicants seeking registration

• Criminal record checks:
  • Provide any necessary authority to the Chief Officer for criminal record checks and, with consent, other enquiries relevant to suitability (regulation 37). Keep a record of consents provided and any disclosures made.

For the Authority

• Hearing conduct:
  • Conduct hearings expeditiously and with as little formality and technicality as reasonably possible, ensure natural justice is observed and give written reasons and notices as required (regulation 18(2)(b) and (e); regulation 21(3); regulation 20(3)).
  • Make decisions about further action consistent with the sanction list in regulation 21 and ensure that prescribed notice periods and effect dates under regulation 26 are observed.
• Suspension and convict‑based action:
  • If exercising suspension under regulation 23 or action without hearing under regulation 24, ensure certified court records are obtained where required and provide written notice with reasons within 14 days (regulations 23(4), 24(2)). Ensure that suspensions within regulation 23(1) cease when charges are withdrawn or dismissed or upon acquittal (regulation 23(3)).

Record keeping and governance

• Maintain contemporaneous records of:
  • Receipt of complaints and the notices provided to members (regulations 11, 13, 17).
  • Investigation steps, evidence gathered, and extensions granted with reasons (regulation 16).
  • Training plans, approvals, and attendance registers; controllers’ annual non‑compliance reports forwarded to the Chief Officer by 31 December (regulation 33).
  • Notices of suspension, cancellation proposals, and any VCAT applications or stays (regulations 22-27).
• Ensure an auditable trail for decisions and communications in case of VCAT review or administrative scrutiny.

Practical risk‑management steps

• Establish standardised templates for written complaints, notices of investigation, notices of proposed cancellation, suspension notices and hearing notices that comply with the content and timing obligations set out in the Regulations.
• Align calendar and financial year reporting: because training is planned on a financial year clock while attendance obligations are measured by calendar year, controllers should map training delivery across both cycles and advise members clearly about which exercises count for particular calendar years.
• For any decision that may adversely affect a member (suspension, cancellation, demotion, transfer), document the factual basis and the legal test applied, and give precise written reasons within the timeframes mandated by the Regulations.

Following these procedures and documenting each step reduces procedural risk, preserves natural justice, and positions decisions to withstand VCAT review if one is commenced.
