21 Appointment of Deputy Commissioners (1) The Governor in Council, on the recommendation of the Minister, may appoint as many Deputy Commissioners as the Governor in Council considers necessary. S. 21(1A) inserted by No. 20/2025 s. 19C. (1A) A Deputy Commissioner must be— (c) a person who has a permanent visa or is entitled to be granted a permanent visa under the Migration Act 1958 of the Commonwealth; or (d) a New Zealand citizen who has a special category visa or is entitled to be granted a special category visa under the Migration Act 1958 of the Commonwealth. (2) The Minister must consult the Chief Commissioner before making a recommendation to the Governor in Council for the appointment of a Deputy Commissioner. (3) A Deputy Commissioner holds office in accordance with Part 2 of Schedule 1.
