> > (1) Without limiting clause 5(3), the Commissioner may consider a person to be a victim of an act of violence or act of modern slavery, or a family victim of a road crime, for the purposes of authorising payments for approved counselling services for that person in accordance with this Part.

> > (2) Subclause (1) is subject to any subsequent finding by the Commissioner that the person is not a victim of an act of violence or act of modern slavery, or a family victim of a road crime.
