39 Power to ask for examination by health practitioner
(1) When deciding an application for financial assistance, the
commissioner may ask the applicant to—
(a) submit to an examination by a health practitioner; and
(b) arrange for a report of the examination to be given to the
commissioner.
(2) Despite any law or duty requiring a health practitioner to maintain the
confidentiality of health examinations, a health practitioner may give
the commissioner—
(a) a report about an examination conducted under this section; and
(b) any other information the health practitioner considers is
relevant to the report about the examination.
Note It is an offence for an official to divulge protected information
(see s 89 (1)).
(3) If the commissioner asks for an examination under this section the
commissioner must pay for the examination.
