Victims of Crime Assistance Rules 2020

The instrument revolves around a small set of procedural concepts that convert statutory entitlement into administrative process. These are: prescribed forms; venue and lodgement rules; delegated decision‑making and review; time limits and extension powers; evidentiary requirements; and recordation.

Prescribed form and content. The Rules make Form 1 the prescribed application for assistance under s 26 of the Act (Rule 6). Form 1 is detailed. It requires applicant identity and demographic data (including Aboriginal and Torres Strait Islander origin), the category of applicant (primary, secondary, related victim or funeral expenses), particulars of the act of violence (location, date, identity and relationship to alleged offender), police reporting details and whether criminal proceedings have commenced. The form asks for the effects of the act (physical, psychological, grief) and the types of assistance sought (special financial assistance, counselling, medical expenses, safety costs, loss of earnings, funeral expenses and others). It also draws applicants’ attention to section 67 of the Act , the offence for knowingly giving false or misleading information (Form 1).

Venue and lodgement rules. Rule 7 prescribes where an application must be lodged: with or posted to a registrar at the venue nominated by the Chief Magistrate, or, failing nomination, the venue closest to the applicant’s residence or where the act occurred (subject to family relationship rules). There are exceptions: applications made by applicants residing outside the State, related victims, or primary/secondary victims aware of the existence of a related victim must be lodged at Melbourne (Rule 7(3)). Registrars may accept applications lodged at other venues at their discretion (Rule 7(4)). Electronic lodgement is expressly permitted (Rule 10). Rule 11 determines that an application is made when it is received by the registrar in accordance with the lodgement rules; the registrar must note the receipt date (Rule 11).

Delegated decision‑makers and scope. The Rules recognise the delegation architecture in the Act by authorising judicial registrars and Tribunal officers to exercise delegated powers and to have "all the powers of the Tribunal necessary to exercise those delegated powers" (Rules 12(a)(b) and 14A(a)(b)). The Rules therefore make clear that delegates exercise the Tribunal's functional powers insofar as delegation instruments are in force under s 24 of the Act.

Review and treatment of delegate decisions. The Rules set out a structured review pathway for final decisions of judicial registrars and Tribunal officers under s 59A of the Act. Rule 8 (and Rule 8A for Tribunal officers) prescribes Form 2 and Form 3, requires an affidavit setting out reasons, imposes a 14‑day lodging period (with Tribunal power to extend) and requires lodgement at the venue where the decision was made (Rules 9 and 9A). Rules 13 and 14B describe the Tribunal’s choice to determine the review on the papers or to list a hearing, and provide that the Tribunal may affirm or set aside and substitute a new final decision. Rules 14 and 14C clarify that lodging a review application does not operate automatically as a stay.

Evidentiary and administrative adjuncts. The forms and rules require additional procedural elements: where an incident was not reported to police the applicant must provide a statutory declaration setting out the circumstances (Form 1); an applicant must file with a review application an affidavit stating reasons (Rules 8(2), 8A(2)); if additional material is to be filed in support of a review it must be filed within 28 days of the review application (Form 2 and Form 3). The application form includes an authorisation clause allowing the Tribunal to obtain additional evidence or documentation it considers necessary (Form 1).

Sunset and interpretation frameworks. The Endnotes record that the Rules will sunset 10 years after making (25 August 2030) under the Subordinate Legislation Act 1994, and they record the application of the Interpretation of Legislation Act 1984 (Endnotes, paras 1 and 3). The Rules also expressly record their enabling provision, section 57 of the Act (Rule 2).

Collectively these concepts allocate the burden of producing documentary material and timely lodging to applicants, allocate recordkeeping and venue discretion to registrars and the Chief Magistrate, and convert delegated decision‑making into a reviewable but not automatically stayed administrative process. The Rules also create compliance tasks: sworn affidavits for reviews, statutory declarations where incidents were not reported, and timely electronic or physical lodgement.

The Rules create procedural obligations and powers that affect several discrete actors. The main categories, with the concrete effects drawn from the Rules, are:

• Applicants and potential applicants. Those seeking assistance under the Act are directly affected by the rules prescribing Form 1 as the mandatory application (Rule 6). The form requires applicants to choose a single category (primary, secondary, related victim or funeral expenses) and supply personal details, incident particulars, evidence about reporting to police and details of other claims or entitlements (Form 1). Applicants who reside outside the State, related victims, and primary or secondary victims aware of the existence of a related victim are required to lodge at the Melbourne registrar (Rule 7(3)). Applicants who did not report to police must supply a statutory declaration explaining that failure (Form 1). Review applicants must file a contemporaneous affidavit explaining reasons for review (Rules 8(2), 8A(2)), lodge within 14 days (subject to extension), and supply additional materials within 28 days if they wish (Form 2, Form 3).

• Related victims, primary and secondary victims. The Rules treat these categories specifically. Form 1 requires applicants who are related victims to list other persons who may also be related victims and those who may incur funeral expenses (Form 1). The choice of lodging venue may differ depending on relationship and whether applicants are co‑claimants (Rule 7(1)(b)(ii), Rule 7(3)).

• Representatives of children and persons under disability. The form provides for an agent or representative to complete the application on behalf of a child or person under disability and requires the representative’s details and relationship to the applicant (Form 1).

• Tribunal delegates: judicial registrars and Tribunal officers. The Rules allocate delegated powers and specify the scope of those powers. Judicial registrars are authorised to exercise powers delegated under section 24(3) of the Act and "have all the powers of the Tribunal necessary to exercise those delegated powers" (Rule 12). Similarly, Tribunal officers may exercise delegated powers under section 24(4) and have all necessary powers (Rule 14A). These provisions affect the operational role of registrars and tribunal officers and the expectations on their decisions being capable of review.

• Registrars and the Chief Magistrate. The Chief Magistrate has nomination power for venues at which applications must be lodged; nominations are to be published in the Government Gazette (Rule 7(2)). Registrars are responsible for receiving applications, noting dates of receipt (Rule 11(2)), and have discretion to accept applications lodged at venues other than those prescribed (Rules 7(4), 9(2), 9A(2)). Registrars therefore exercise administrative discretion with practical consequences for applicants’ choice of venue.

• Tribunal (sitting members). The Tribunal is the ultimate decisionmaker on review applications. The Rules require the Tribunal, when determining a review, to consider the application and accompanying affidavit and to either determine on the papers or direct a hearing (Rules 13(1)-(2), 14B(1)-(2)). The Tribunal also decides whether to grant stays (Rules 14 and 14C).

• Persons providing evidence or other agencies. Form 1 contains an authorisation by the applicant allowing the Tribunal to obtain any additional evidence or documentation the Tribunal considers necessary (Form 1, Authorisation of Applicant). This gives the Tribunal latitude to seek material from third parties, including police or health services, subject to normal legal limits under privacy and evidence law, though the Rules do not themselves set privacy safeguards.

• The public/legal profession. Lawyers, advocates and support organisations acting for victims must follow prescribed forms, lodging rules and time limits, and must prepare the affidavits and supporting material required for reviews. The Rules therefore impose a documentary and evidentiary workflow on practitioners.

The allocation of responsibilities indicates who bears cost and effort: applicants (and their representatives) must assemble documentary materials, sworn evidence and ensure timely lodgement; registrars and the Chief Magistrate manage venue nominations and receipt records; delegated decision‑makers (judicial registrars and Tribunal officers) exercise the Tribunal’s delegated powers, subject to potential review by the Tribunal; the Tribunal decides whether to hear reviews orally or on the papers and whether to order a stay.

The Rules create explicit duties for applicants and registrars and set rights and decision points for reviewers and delegates. Drawn directly from the text, the principal duties and rights are:

Duties on applicants

• Use the prescribed form. An application for assistance under s 26 of the Act must be in Form 1 (Rule 6). This imposes a duty on applicants to supply the categories of information and declarations the form requires.

• Single category per application. The form warns applicants that they may apply in only one category (Form 1). This is a duty to select the correct category and may constrain multi‑claim strategies.

• Police reporting/statutory declaration. If the act of violence was not reported to police the form requires the applicant to provide a statutory declaration setting out the circumstances and reason for not reporting (Form 1). This creates a documentary duty before the Tribunal accepts a non‑reported claim for assessment.

• Honour authorisation and oath declarations. Form 1 contains an authorisation permitting the Tribunal to obtain additional evidence and an acknowledgment that giving false or misleading information is an offence under section 67 of the Act (Form 1). The Rule thus places a duty to be truthful and to accept the Tribunal’s exercise of evidence‑gathering powers.

• Timeliness for review applications. An applicant seeking review of a judicial registrar or Tribunal officer final decision must file an application in Form 2 or Form 3 and accompany it with an affidavit setting out reasons, lodged within 14 days of the decision (Rules 8(2), 8(3); 8A(2), 8A(3)). That 14‑day window is a strict time non‑compliance risk; however, the Tribunal has power to extend time under Rules 8(4) and 8A(4).

Duties on registrars

• Receipt and record date. A registrar must note the date of receipt when an application is received in accordance with the lodgement rules (Rule 11(2)). This creates an administrative record duty likely relevant to limitation and timeliness disputes.

• Venue acceptance discretion. Registrars may accept applications lodged at venues other than that required by the rules (Rule 7(4), Rule 9(2), Rule 9A(2)). That discretion is a duty to exercise administrative judgment in handling convenience and access.

Rights and powers of delegates and the Tribunal

• Delegated powers. Judicial registrars and Tribunal officers may exercise powers delegated to them under section 24 of the Act and have all the powers of the Tribunal necessary to exercise those delegated powers (Rules 12 and 14A). That confers on them functional authority to make final decisions within delegation instruments.

• Review procedure. Applicants have a statutory right to seek review of final decisions of judicial registrars and Tribunal officers under section 59A; the Rules set the procedural rights for such reviews , specified form, affidavit and 14‑day filing period (Rules 8 and 8A). On review the Tribunal may determine on the papers or list a hearing (Rules 13(2), 14B(2)), and may affirm or set aside and substitute its own final decision (Rules 13(3), 14B(3)). The forms (Form 2 and Form 3) note that a review under s 59A is treated as a hearing de novo of the original application for assistance.

• Stay discretion. The lodging of a review application does not suspend the operative effect of the decision being reviewed unless the Tribunal orders a stay (Rules 14 and 14C). The Rules thus remove an automatic stay right and place the burden on the review applicant to seek a stay where necessary.

Other rights and administrative choices

• Mode of determination. Applicants may request that proceedings be conducted in a closed Court or that publication of their application be restricted; they may indicate preference to attend a hearing or have the application determined in their absence; and they may request an interpreter (Form 1, Form 2, Form 3). The Tribunal retains the right to accept or refuse these procedural requests in the exercise of its case management and privacy powers.

• Electronic lodging. Applicants have the right to lodge by fax, email or other electronic communication (Rule 10), subject to the clerk’s acceptance and Rule 11’s receipt rule.

• Chief Magistrate’s venue nominations. The Chief Magistrate may, by Gazette notice, nominate a venue for lodgement of applications generally or by class (Rule 7(2)). This is an administrative power affecting applicants’ procedural rights to choose a local venue.

Taken together, the Rules impose documentary, timing and procedural duties on applicants and registrars while conferring on delegates and the Tribunal powers to make and review final decisions, to determine matters on the papers, and to control stays. The statutory reference points are section 26 (application), section 24 (delegation), section 59A (review), section 57 (rules power) and section 67 (offence for false or misleading information).

The Rules themselves do not prescribe monetary penalties or sanctions. They do, however, engage enforcement mechanisms and criminal sanction provisions present in the Act and create administrative enforcement pathways. The Rules reference and activate enforcement by:

• Criminal offence under the Act. Form 1 contains an explicit acknowledgement that it is an offence under section 67 of the Victims of Crime Assistance Act 1996 to knowingly give false or misleading information in, or in relation to, an application for assistance (Form 1, Acknowledgement). The Rules therefore incorporate the Act’s criminal offence as a deterrent and enforcement tool. The Rules do not set out the penalty particulars; they merely record the statutory offence and the applicant’s acknowledgement.

• Administrative enforcement through decision‑making and review. The Tribunal and its delegates (judicial registrars and Tribunal officers) exercise final decision‑making authority over applications for assistance. A final decision of a judicial registrar or Tribunal officer may be reviewed by the Tribunal under section 59A, as implemented by Rules 8, 8A, 13 and 14B. The Tribunal can affirm, set aside or substitute decisions; this operational mechanism enforces compliance with procedural and substantive requirements by permitting administrative correction.

• Refusal and handling of incomplete or noncompliant applications. The Rules require certain documentary elements (statutory declaration where police were not notified, affidavits accompanying review applications). While the Rules do not prescribe a specific mandatory refusal ground for missing items, acceptance is tied to the prescribed form and accompanying materials; registrars have discretion to accept applications lodged at other venues and presumably to manage defective applications. The Rules give registrars and the Tribunal procedural levers to reject or refuse on the papers where material is insufficient, though the Rules do not set out an exhaustive refusal regime.

• Recordkeeping and date stamping. Rule 11(2) requires registrars to note the date of receipt of an application, creating a recorded administrative timeline that enforces compliance with time limits and supports enforcement where applicants or the Tribunal dispute timeliness.

• Extension of time. The Tribunal may extend the 14‑day period for filing a review application (Rules 8(4) and 8A(4)). This is a remedial enforcement flexibility balancing strict time limits with equitable considerations. However, the Tribunal’s extension power is discretionary and procedural.

• No automatic stay. Rules 14 and 14C state that lodging of a review application does not operate as a stay of a final decision unless the Tribunal orders otherwise. This reduces the capacity of a review applicant to frustrate the operation of a decision merely by seeking review, and places the onus on the review applicant to obtain an order from the Tribunal.

• Authorisation to obtain evidence. Form 1 contains an authorisation permitting the Tribunal to obtain additional evidence or documentation necessary to decide the application. That authorisation facilitates enforcement through fact‑gathering, including from third parties. The Rules do not spell out the limits or processes for obtaining such material; they create an administrative pathway for evidence collection.

Operational enforcement of the Rules therefore occurs through a mixture of criminal deterrence (s 67), administrative correction (review, substitution of decisions), registrars’ receipt and acceptance processes, and the Tribunal’s discretionary powers to stay or extend time. The Rules do not themselves create novel penalties; they operationalise existing statutory sanctions and allocate recordkeeping and review functions to administrative officers, which has practical consequences for enforcement and compliance.

The Rules explicitly position themselves within the statutory and interpretative architecture set out by the Act and broader statute. The Rules’ interactions with other laws are set out within the text and the Endnotes. These interactions include:

Direct references to the Victims of Crime Assistance Act 1996. The Rules are made under section 57 of the Act (Rule 2) and operationalise a number of Act provisions. They prescribe the form for an application under section 26 (Rule 6) and provide the procedural mechanisms for review under section 59A (Rules 8, 8A, 13, 14B). They also reference the delegation powers provided by section 24 of the Act by authorising judicial registrars and Tribunal officers to exercise delegated powers and all necessary Tribunal powers (Rules 12 and 14A). The forms include an express reference to the offence provision in section 67 as a warning to applicants (Form 1). The Rules therefore function as subordinate procedural law under the enabling Act.

Subordinate Legislation Act 1994 (sunset). The Endnotes indicate the Rules will sunset 10 years after making under section 5 of the Subordinate Legislation Act 1994 (Endnotes, para 1). That interaction imposes a statutory expiry on these Rules requiring re‑making or replacement before 25 August 2030 if continued effect is intended.

Interpretation of Legislation Act 1984 and style. The Endnotes apply the Interpretation of Legislation Act 1984 (ILA) to the Rules and note that certain style and heading changes are authorised under ILA s 54A, and detail the operation of ILA provisions such as headings being part of the instrument, the treatment of examples, punctuation, provision numbers and location of legislative items (Endnotes, para 1 and para 3). This affects statutory interpretation, such that headings, examples, punctuation and notes within the Rules are officially part of the instrument for interpretation purposes.

Interaction with other compensation schemes. Form 1 asks applicants to list applications or claims under other schemes including WorkCover, Transport Accident Commission, insurance, civil proceedings or sentencing outcomes (Form 1). The Rules do not by themselves create or quantify offsets or indemnities, but the form’s factual collection indicates that the Tribunal will typically consider other entitlements when assessing an application. The Rules do not codify the nature of interaction or statutory priority between the Tribunal’s assistance scheme and other schemes; the Act contains the substantive law concerning offsets and prioritisation. The Rules only require disclosure.

Privacy and evidence laws (implicit interaction). Form 1 authorises the Tribunal to obtain additional evidence or documentation it considers necessary (Form 1). That administrative power intersects with privacy and evidence regimes (common law, statutory privacy obligations and evidentiary procedure in tribunals), though the Rules do not themselves set privacy safeguards or evidence admissibility standards. Practically, Tribunal evidence‑gathering will operate within the constraints of other laws and protocols.

Criminal law process. The Rules require disclosure of whether the offence was reported to police and whether criminal proceedings have commenced (Form 1). Where the incident has not been reported, the Rules require a statutory declaration explaining the failure to report. This places the Tribunal’s procedural path in close communication with criminal processes; however, the Rules do not control criminal prosecutions or the operation of criminal courts. The Rules' review provisions treat a section 59A review as a de novo hearing of the original application (Form 2, Form 3) and do not displace criminal law processes.

Tribunal governance. The Chief Magistrate’s power to nominate venues for lodgement by Gazette (Rule 7(2)) interacts with administrative law standards governing the exercise of delegations and executive powers, and with statutes regulating the Magistrates' Court venues. Rule 15 declares each Magistrates' Court venue a venue of the Tribunal, linking the Tribunal structure administratively to the Magistrates' Court network.

In sum, the Rules operate as procedural subordinate law under the Act, directly implementing sections 24, 26, 57, 59A and 67 of the Act and fitting within interpretative frameworks supplied by the Interpretation of Legislation Act 1984 and the Subordinate Legislation Act 1994. The Rules collect material relevant to other statutory schemes and criminal processes but do not themselves establish offsets, privacy rules, or criminal procedure changes; those interactions are left to primary legislation and other applicable law.

The instrument as published incorporates amendments and records the revocation of previous rules. The key amendment and instrument history, as drawn from the Rules and Endnotes, is:

• Making and commencement. The Victims of Crime Assistance Rules 2020 were made by the Chief Magistrate together with two Deputy Chief Magistrates under section 57 of the Victims of Crime Assistance Act 1996 on 25 August 2020 and came into operation on 28 August 2020 (Rule 3; Endnotes, para 1).

• Revocations. Rule 4 revokes the Victims of Crime Assistance Rules 2010 and subsequent amending rules listed at Rule 4(a)-(c). The Endnotes specify the instruments revoked: S.R. No. 84/2010, S.R. No. 13/2014, and S.R. No. 46/2016 (Endnotes, para 4).

• S.R. No. 9/2021 amendments. The publication incorporates amendments made by Victims of Crime Assistance Amendment Rules 2021, S.R. No. 9/2021, which were made on 17 February 2021 and commenced on 22 February 2021 (Endnotes, Table of Amendments). The 2021 amendments inserted Order 3A about Tribunal officers and rules 8A, 9A, 10 (heading and content amendments), 14A-14C, and Form 3. Specific insertions and amendments referenced in the main text include:

  • Rule 5: definition of "application for review of a decision of a Tribunal officer" added by S.R. No. 9/2021 rule 6.

  • Rule 8A: Application for review of a decision of a Tribunal officer , Form 3 inserted by S.R. No. 9/2021 rule 7, providing the 14‑day time limit and affidavit requirement for Tribunal officer reviews.

  • Rules 9A, 14A, 14B and 14C: inserted by S.R. No. 9/2021 rule 11, establishing lodgement, powers, review procedure and stay rules for Tribunal officers.

  • Rule 10: heading and content amended by S.R. No. 9/2021 rule 9(1) and rule 9(2), clarifying electronic lodgement.

  • Form 3: inserted by S.R. No. 9/2021 rule 12.

• Endnotes and interpretative provisions. The Endnotes set out interpretative directions under the Interpretation of Legislation Act 1984 and confirm the sunset on 25 August 2030 under the Subordinate Legislation Act 1994 (Endnotes, paras 1 and 3).

• Amendments not in operation. The published version states it contains amendments made as at 22 February 2021 and notes no amendments not in operation in this version (Endnotes, para 3).

The amendments in 2021 broadened the delegate review architecture by creating an express category of Tribunal officer and parallel procedures for review of their decisions, in addition to judicial registrars. They also clarified electronic filing mechanics. The Rules list the specific provisions that were inserted or amended; the Endnotes provide dates of making and commencement for S.R. No. 9/2021.

The Rules are subject to expiry and would require further legislative action or replacement before 25 August 2030. Practitioners should monitor any fresh statutory rules, instruments or replacement rules before that date to ensure continuity.

The Rules document contains no cases, reported litigation or judicial exposition of the Rules themselves. The text includes no references to judicial determinations, statutory interpretation disputes, or instances of the Tribunal’s or registrars’ decisions being judicially reviewed. The Endnotes and table of amendments do not include litigation materials. Accordingly, the only textual history recorded is administrative: the making dates, revocations of prior subordinate instruments and the S.R. No. 9/2021 amendments.

Practical implications of this absence of recorded litigation in the Rules publication are:

• No internal jurisprudence provided. The Rules do not record any judicial interpretations, and practitioners cannot rely on precedent from the Rules text for contested interpretative points. Interpretation thus requires recourse to the primary Act, administrative law principles, and any external case law not recorded in the instrument.

• Reliance on the Act for substantive rights. The Rules implement procedural detail; questions about substantive entitlement, offsets with other compensation schemes, definitions of primary, secondary and related victim status, or the scope of s 24 delegations must be found in the Act itself. Because the Rules do not provide adjudicative interpretations, litigants and advisers must consult decisions of the Tribunal or courts (external to this document) for authoritative law on contested points.

• Uncertainty on nuanced procedural questions. The Rules leave several operational matters to registrar or Tribunal discretion (for example, acceptance of an application at a non‑prescribed venue, ordering stays, conducting hearings closed to the public, or the exercise of extension powers). Without recorded litigation, there is no internal textual guide on the limits of that discretion. Administrative fairness and judicial review principles will therefore govern disputes.

• Need for monitoring Tribunal decisions. In the absence of litigation contained in the Rules, practitioners should monitor Tribunal determinations and any court judgments concerning the Act and its procedural rules to understand how ambiguities are resolved in practice. The Rules indicate the Tribunal’s procedural options but do not provide case law to shape expectations.

Because the Rules themselves contain no litigation history, any argument about the operation of these provisions in contentious circumstances must be founded on the plain text of the Rules and the Act, and on external case law or Tribunal determinations not reproduced in this instrument.

The Rules contain several points that routinely generate operational or strategic risks if overlooked. These are concrete procedural and evidentiary traps and points of administrative discretion that can affect outcomes.

14‑day review window and affidavit requirement. A review of a judicial registrar or Tribunal officer final decision requires a review application in Form 2 or Form 3 accompanied by an affidavit setting out reasons and lodged within 14 days of the decision (Rules 8(2)-(3), 8A(2)-(3)). Although the Tribunal can extend time (Rules 8(4) and 8A(4)), late filing without an early extension risks the Tribunal declining extension. Practitioners must prepare affidavit material promptly and be ready to seek extension where there is a risk of delay.

No automatic stay on lodgement. Lodging a review does not stay the operative effect of the impugned decision unless the Tribunal orders otherwise (Rules 14 and 14C). A review applicant seeking to prevent enforcement of a decision must make a separate application for a stay to the Tribunal and establish grounds for it. Expect procedural and substantive scrutiny, and craft stay applications addressing prejudice and balance of convenience.

Venue requirements and prescribed Melbourne lodgement. The Rules prescribe specific venue lodgement rules. In particular, applications made by applicants residing outside the State, related victims, or primary/secondary victims aware of a related victim must be lodged at the Melbourne registrar (Rule 7(3)). Incorrect venue selection can delay acceptance; registrars have discretion to accept at other venues (Rule 7(4)), but reliance on that discretion without confirmation is a risk.

Prescribed form and single category requirement. The Rules prescribe Form 1 for s 26 applications (Rule 6). Form 1 requires selecting one application category only. Filing in multiple categories on one form is explicitly disallowed, so counsel must choose the correct discrete application and, if multiple interests exist, assess whether separate applications are needed and how that affects timing and evidence.

Statutory declaration if not reported to police. If the act of violence was not reported the applicant must provide a statutory declaration setting out the circumstances and reason for the failure to report (Form 1). Failure to file such a declaration where reporting did not occur may render the application incomplete or provide the Tribunal a ground to reject or request further information.

Authorisation to obtain documents and privacy implications. Form 1 contains an authorisation permitting the Tribunal to obtain additional evidence and documentation the Tribunal considers necessary. This facilitates third‑party evidence collection but may create privacy or consent issues for applicants and third parties. Applicants should be advised of potential documentary inquiries and professionals should prepare clients for possible information release requests.

Requirement to list other claim schemes. Form 1 asks for details of claims under WorkCover, TAC, insurance, civil proceedings or sentencing, and any payments received (Form 1). While the Rules do not itself quantify offsets, disclosure is mandatory and failure to disclose could interact with section 67 (false information). Practitioners should collate documents and ensure accurate disclosure.

Receipt date is decisive. Rule 11(1) and (2) make an application the moment it is received by the registrar in accordance with lodging rules and require the registrar to note the date of receipt. Electronic transmission times, postal delays, or fax/ email bounce backs can therefore have material consequences for timeliness. Where the 14‑day review window applies, preserve proof of transmission and seek receipt confirmation.

Registrar discretion to accept at alternate venues. While the Rules prescribe lodgement venues, registrars may accept applications at other venues (Rules 7(4), 9(2), 9A(2)). That discretion can be helpful but is not guaranteed; practitioners should obtain written confirmation where possible to avoid disputes about proper lodgement.

De novo nature of reviews. Form 2 and Form 3 note that a review under section 59A is "treated as a hearing de novo of the original application for assistance" and that the Tribunal may refuse or substitute the original order. Practically, a review applicant should be prepared to re‑establish the facts and evidence and cannot assume that the prior delegate’s findings will bind the Tribunal.

Administrative timing for supporting materials on review. Form 2 and Form 3 allow applicants to file additional supporting material but require it to be filed within 28 days of the review application. Missing that window risks the Tribunal refusing to admit late material or deeming the review to proceed on existing materials.

No penalties or thresholds in the Rules. Several substantive consequences (for example, how other payments affect awards) are governed by the Act rather than the Rules. Practitioners should not assume offsets, caps or eligibility requirements are determined in the Rules and should consult the Act for substantive tests.

Sunset date. The Rules will sunset on 25 August 2030 (Endnotes). This imposes a calendar risk for long-term policy stability; depending on future legislative action the Rules may be remade, amended, or replaced.

Taken together, these "gotchas" emphasise the need to manage timeliness, venue selection, documentary proof, statutory declarations, and to obtain registrar confirmations and stay orders where necessary.

The Rules set out clear procedural steps and documents that applicants, representatives, and Tribunal staff must follow. The compliance checklist below is drawn directly from the Rules and forms and is designed for practitioners and administrators to operationalise compliance.

For applicants (first‑instance application under s 26)

1. Use Form 1. Complete the prescribed application (Form 1) in full. The Rules make Form 1 the mandatory form for an application for assistance (Rule 6). Ensure the form selects only one category (primary, secondary, related victim or funeral expenses) because the form expressly limits applications to a single category.

2. Provide required incident details. Complete the "Circumstances of the act of violence" section with location, date, time, identity and relationship to the alleged offender, and whether the alleged offender was a family member or domestic partner (Form 1).

3. Police reporting. State whether the act was reported to police. If not, prepare and attach a statutory declaration setting out the circumstances and reasons for not reporting, as required by Form 1. If reported, include police officer details and report date.

4. Effects and assistance. Identify the effects resulting from the act (physical, psychological, grief, trauma) and specify the types of assistance sought (financial, counselling, medical, safety costs, loss of earnings, funeral expenses). Attach medical, counselling or other supporting documentation where available.

5. Disclose other claims. List any claims under WorkCover, TAC, insurance, civil proceedings or other schemes, including amounts received or pending and reference numbers, as Form 1 requires.

6. Authorisation and acknowledgement. Sign the authorisation permitting the Tribunal to obtain additional evidence and the acknowledgement in relation to section 67 of the Act. The applicant’s signature is required unless lodged online.

7. Venue and lodgement. Determine the correct lodgement venue under Rule 7. If the Chief Magistrate has nominated a venue by Gazette, use that venue (Rule 7(2)). If no nomination, lodge at the venue closest to the applicant’s place of residence, or if multiple applicants not close family members, at the venue closest to where the act occurred (Rule 7(1)). If the applicant resides outside the State, is a related victim, or is a primary/secondary victim aware of a related victim, lodge in Melbourne (Rule 7(3)). Alternatively, confirm with the registrar whether they will accept lodgement at another venue (Rule 7(4)).

8. Lodgement method and proof. Lodge by post, in person or by fax, email or other electronic communication (Rule 10). Preserve proof of electronic transmission and seek acknowledgment of receipt. The application is made when received by the registrar in accordance with Rules 7, 9, 9A or 10 and the registrar will note the date of receipt (Rule 11).

For applicants seeking review of a delegate decision

1. Use the correct form. File Form 2 to seek review of a judicial registrar’s final decision, or Form 3 to review a Tribunal officer’s decision (Rules 8 and 8A).

2. Prepare an affidavit. The application must be accompanied by an affidavit setting out the reasons for the review (Rules 8(2) and 8A(2)). Draft the affidavit carefully, addressing the grounds for review, relevant facts, and any errors of law or fact warranting review.

3. Observe the 14‑day period. Lodge the review application and affidavit within 14 days after the date of the delegate’s final decision (Rules 8(3) and 8A(3)). If required, file a prompt application for extension of time explaining the reasons; the Tribunal may extend the time before or after it expires (Rules 8(4) and 8A(4)).

4. Lodge at the correct venue and file supporting material. Lodge the review application and affidavit with the registrar at the venue where the decision was made (Rules 9(1) and 9A(1)). If additional supporting material will be filed, do so within 28 days from the date of the review application, as prompted by Form 2 and Form 3.

5. Seek stays if necessary. Because lodging a review does not automatically stay the delegate’s decision, promptly apply to the Tribunal for a stay with supporting reasons if it is necessary to prevent operational or enforcement consequences (Rules 14 and 14C).

Administrative compliance for registrars, judicial registrars and Tribunal officers

1. Record receipt dates. When receiving any application under these Rules, note the date of receipt on the application (Rule 11(2)). This is critical for timeliness assessments and review time limits.

2. Exercise venue discretion consistently. If a registrar accepts an application at a venue other than that prescribed, provide written confirmation to the applicant. The Rules permit acceptance at an alternate venue but do not mandate it (Rules 7(4), 9(2), 9A(2)).

3. Verify prescribed forms and accompanying affidavits/declarations. Check that applications for assistance are on Form 1 and that reviews use the correct form and include required affidavits or statutory declarations (Rules 6, 8, 8A).

4. Manage electronic lodgements. Ensure systems are in place to receive and timestamp electronic applications, including mechanisms to acknowledge receipt and to keep secure records consistent with privacy obligations (Rule 10 and Rule 11).

5. Apply delegated powers consistently and document delegation instruments. Judicial registrars and Tribunal officers should ensure any delegated powers they exercise are authorised by an instrument under section 24 of the Act and that their exercise of "all the powers of the Tribunal necessary" is documented in decision records (Rules 12 and 14A).

6. Case management of reviews. When an application for review arrives, the Tribunal must determine the review after considering the application and affidavit and decide whether to determine the review on the papers or list it for hearing, and whether to affirm or set aside and substitute a decision (Rules 13(1)-(3), 14B(1)-(3)). Prepare a docketing and case management procedure to address these options.

Practical tips

• Keep documentary checklists for Form 1 that include police reports, statutory declarations, medical and counselling records, financial documents for loss of earnings claims, and proof of other claims.

• Where multiple related victims or potential claimants exist, use Form 1’s related victim section to list potential other claimants and manage joinder or notification needs.

• For electronic filings, obtain and keep registrar confirmation of receipt and ascribe the registrar’s recorded date where disputes on timeliness may arise.

• Promptly prepare affidavit material supporting review applications and, if necessary, a separate stay application, addressing the Tribunal’s likely criteria.

• Monitor Gazette notices from the Chief Magistrate for any venue nominations that affect lodgement obligations (Rule 7(2)).

Following these steps will align applicants and administrators with the Rules’ procedural expectations and reduce the risk of delay, rejection or timeliness disputes.
