Victims of Crime Assistance (Delegation) Regulations 2023

The instrument relies on , and is framed around , a small set of legal and administrative concepts contained in the text and its endnotes.

• Prescribed amount: The central substantive concept is the “prescribed amount” for the purposes of section 24(1A) of the Victims of Crime Assistance Act 1996. The Regulations make that amount $5,000 (regulation 5). The text does not define “interim award”, “assistance” or “delegate”; those terms are used only to locate the numerical cap within the Act (regulation 1 and reg 5 refer to “interim award of assistance” and “delegate”).

• Delegation: The instrument is a delegation regulation in form and is expressly made under section 72 of the Victims of Crime Assistance Act 1996 (regulation 2). It therefore functions as an exercise of delegated subordinate law-making power under that section. The regulation’s title and structure identify it as prescribing a delegation-related parameter, not as setting out delegation authorisations, criteria or instruments themselves.

• Revocation and replacement: Regulation 4 revokes the 2013 Delegation Regulations. That is a formal removal of the prior instrument and replacement with the 2023 instrument. The endnotes confirm the 2023 instrument was made by the Governor in Council and specify its commencement date (Endnote 1).

• Commencement and temporal effect: The Regulations take effect on 26 September 2023 (regulation 3). The endnotes record that the instrument will sunset 10 years after making under the Subordinate Legislation Act 1994 (Endnote 1). That places a statutory expiry on the instrument unless it is remade, specifying a maximum lifecycle to 26 September 2033.

• Interpretative context: The endnotes reproduce aspects of the Interpretation of Legislation Act 1984 (ILA) relevant to how the statutory rule is to be read: style changes authorised by s 54A of the ILA, and that headings, examples, notes and punctuation form part of statutory rules made after 1 January 2001, among other interpretative directions (Endnote 1). Those ILA provisions affect how courts or administrators would treat the drafting elements of the Regulation as part of the instrument.

Taken together, these concepts show that the Regulations are a narrow subordinate law that sets a monetary ceiling for one kind of administrative act under the Act, and which is framed to operate within established interpretative and lifecycle rules for subordinate instruments. The text does not create substantive program eligibility, nor does it allocate or direct funding, nor does it establish enforcement penalties in the instrument itself.

The Regulations operate by setting a monetary ceiling for a specific administrative power of delegates under the Victims of Crime Assistance Act 1996. The direct and immediate affected parties, as identifiable from the instrument, are:

• Delegates who may make interim awards of assistance under the Act. Regulation 5 prescribes that for the purposes of s 24(1A) of the Act the amount is $5,000. The instrument therefore constrains the maximum an authorised delegate may award as an interim payment. The Regulations rely on the Act to identify who is a “delegate”; the Regulations themselves do not define or appoint delegates.

• Applicants for victims-of-crime assistance seeking interim payments. Persons eligible under the Act who apply for interim assistance will be limited, for the interim tranche made by a delegate, to a maximum of $5,000 under these Regulations (regulation 5). The Regulations do not specify how many interim payments are permissible, how they interact with final awards, or what categories of assistance are covered; those matters fall back to the Act or administrative practice.

• Administrators and agencies responsible for operating the Victims of Crime Assistance scheme. They must adjust internal authorisations, payment systems and processes to ensure delegates do not exceed the prescribed $5,000 amount. The Regulations revoke the 2013 delegation regulations (regulation 4), so administrators who relied on that prior instrument must update policy, forms, internal delegation instruments and training to reflect the new ceiling and the revocation.

• Legal and compliance advisers who counsel delegates, agencies or applicants about the operation of interim awards. The Regulations create a single statutory parameter that these advisers must check when advising on interim payments under s 24(1A) of the Act.

• The greater public sector governance architecture is indirectly affected by the instrument’s lifecycle rules. The endnotes record that the Regulations were made by the Governor in Council and will sunset 10 years after the making date under s 5 of the Subordinate Legislation Act 1994 (Endnote 1). That raises administrative obligations for the relevant department to monitor expiry and seek remaking if the ceiling is to be retained beyond the sunset date.

What the instrument does not affect, as shown by the text, is the substance of eligibility, the criteria for making awards, the funding source, or enforcement provisions. Those matters are outside the Regulations and remain in the Act or other instruments. The Regulations are narrowly targeted; their effect is to bind delegates by a statutory cap in their capacity to make interim awards under s 24(1A).

The Regulations are brief and do not create an extensive set of duties or rights in their own text. Nevertheless, they generate a small number of concrete legal obligations and entitlements through their interaction with the Victims of Crime Assistance Act 1996 and the subordinate-legislation framework.

• Duty of monetary limitation on delegates: The primary duty established by the Regulations is that a delegate making an interim award of assistance under s 24(1A) of the Act may not exceed the amount prescribed by regulation 5, namely $5,000. While regulation 5 frames this as the “prescribed amount” for the purposes of s 24(1A), the effect is to limit the discretionary monetary exercise of the delegate to that ceiling. The text does not prescribe frequency, categories, or procedural conditions for interim awards; it prescribes only the quantitative cap.

• Revocation duty for administrators: By revoking the 2013 Delegation Regulations (reg 4), the instrument imposes an administrative duty on relevant departments and decision-makers to update the subordinate instruments, delegation schedules, forms and internal guidance that previously relied on or referenced the 2013 Regulations. The Regulations do not themselves set a transitional regime, so administrators must ensure that practice, records and delegation instruments reflect the new regulatory ceiling effective from the commencement date (regulation 3).

• Commencement-based timing duty: The Regulations commence on a defined date (regulation 3). Persons exercising or administering delegate powers must apply the new prescribed amount from that date onward. The instrument does not create retrospective authorisations; it only states its commencement.

• Rights of applicants: The Regulations establish a statutory ceiling for interim awards, which functions as a limit on the maximum interim assistance an applicant can receive from a delegate under s 24(1A). The Regulations do not create a freestanding right to receive interim assistance; the entitlement to any award remains governed by the Act. These Regulations determine only the maximum amount a delegate may award in interim assistance.

• No standalone procedural or enforcement duties: The Regulations do not create procedural steps, timeframes, record-keeping obligations, appeal rights, or penalty provisions. That absence means any such duties or rights must be located in the Act or other subordinate instruments; the Regulations’ role is confined to the monetary ceiling.

• Lifecycle obligation under Subordinate Legislation Act 1994: The endnotes record a statutory sunset in ten years (Endnote 1). While the Regulations do not themselves create duties regarding the sunset, the presence of that sunset implies an administrative obligation on the responsible agency to monitor and, if required, prepare replacement or remaking instruments before 26 September 2033.

In short, the Regulations impose a single operational duty on delegates and corresponding constraint on applicants, while leaving procedural, definitional and enforcement matters to the underlying Act and other instruments. Practically, the key immediate duty for administrators is to implement system changes so delegates do not make interim awards that exceed $5,000 from 26 September 2023.

The Regulations contain no penalty clauses, enforcement mechanisms, or compliance-sanctioning provisions within their text. They are an enabling subordinate instrument that prescribes a monetary figure; they do not set out offences, fines or enforcement processes.

Because the Regulations are made under section 72 of the Victims of Crime Assistance Act 1996 (regulation 2) and because regulation 5 operates “for the purposes of section 24(1A) of the Victims of Crime Assistance Act 1996”, any sanctions or enforcement consequences for exceeding the prescribed amount must be sought in the parent Act or in related administrative practice. The instrument itself is silent on remedies if a delegate were to exceed $5,000, whether by error or intentionally.

The endnotes detail interpretative provisions from the Interpretation of Legislation Act 1984 that form part of how the instrument is read (Endnote 1). Those ILA provisions affect statutory construction but do not create enforcement powers relevant to compliance with the monetary cap.

Given the Regulations’ narrow content, enforcement and remedies will be implemented by:

• administrative controls and internal governance within the agency responsible for the Victims of Crime Assistance scheme to prevent delegates paying in excess of the cap; and

• any statutory oversight, review or disciplinary mechanisms provided by the Act or by public sector governance frameworks, none of which are specified in the Regulations themselves.

Because the instrument revokes the 2013 Regulations (regulation 4) without stating transitional penalty arrangements, there is an implementation risk that systems or delegation instruments previously calibrated to the 2013 instrument could remain in place if not updated. That risk is administrative rather than statutory, but it has the potential to expose agencies or delegates to corrective action if payment practice runs contrary to the new prescribed amount and the parent Act supplies a sanctioning mechanism.

In short, the Regulations do not themselves enforce or penalise; they rely on the Act and agency compliance architecture to produce compliance outcomes. The text therefore places the onus of enforcement on the Act’s framework and on administrative controls, not on the subordinate instrument.

The Regulations are explicitly connected to a small set of other statutory instruments, as appears in their text and endnotes. The interrelationships are primarily hierarchical and interpretative rather than substantive.

• Victims of Crime Assistance Act 1996: The Regulations are made under section 72 of that Act (regulation 2) and operate for the purposes of section 24(1A) by prescribing the amount a delegate may award as interim assistance (regulation 5). The Regulations therefore function as subordinate law implementing a specific parameter in the Act. Definitions, the identity of delegates, eligibility criteria, substantive rights to assistance and procedural safeguards are matters for the Act itself. The parent Act is the logical source for the operational framework within which this monetary ceiling operates.

• Revocation of previous subordinate instrument: Regulation 4 expressly revokes the Victims of Crime Assistance (Delegation) Regulations 2013. That is a direct legal interaction that removes the earlier delegation regulation from the subordinate law corpus and replaces it with the 2023 instrument for the specific purpose of prescribing the interim-award amount. The text does not explicate transitional savings or differences between the instruments. Administrators will need to reconcile the revocation with any cross-references in policies or other instruments that previously referenced the 2013 Regulations.

• Subordinate Legislation Act 1994: The endnotes state the Regulations will sunset ten years after making on 26 September 2033, referencing section 5 of the Subordinate Legislation Act 1994 (Endnote 1). That places a legislative expiry mechanism on the instrument, requiring agencies to consider remaking or replacing the subordinate instrument if the ceiling is to remain beyond that date. The sunset is an automatic statutory interaction; the Regulations will cease operating unless remade or otherwise preserved according to the Subordinate Legislation Act.

• Interpretation of Legislation Act 1984 (ILA): The endnotes include a number of interpretative directions drawn from the ILA, including that style changes are authorised by s 54A, and that headings, examples, notes, punctuation and provision numbers form part of the statutory rule for instruments made after 1 January 2001 (Endnote 1). Those interact with the Regulations by governing how the text is to be interpreted and treated as part of the statutory rule. For example, headings in the Table of Provisions, explanatory notes and the endnotes themselves are to be treated as integral drafting components under the ILA provisions listed.

• Absence of cross-linked obligations in this instrument: The Regulations do not interact directly with criminal law, administrative penalties statutes, or budget/funding statutes in their text. No funding source is named; no payment mechanism is described; no offences or penalty provisions are introduced. Those matters will be addressed in the Act or other policy instruments.

In sum, the Regulations operate as a subordinate implementing instrument under the Victims of Crime Assistance Act 1996, replace an earlier regulation, are subject to the sunset rules of the Subordinate Legislation Act 1994 and are to be interpreted in light of the ILA provisions cited in the endnotes. The instrument’s interactions are formal and procedural rather than broad substantive cross‑statutory alterations.

The Regulations are new as of 26 September 2023 and, according to the document’s “Table of Amendments”, have no subsequent amendments. The endnotes provide the making and commencement detail: they were made on 26 September 2023 by the Governor in Council under s 72 of the Victims of Crime Assistance Act 1996 and came into operation on that same date (Endnote 1; regulations 2 and 3).

Key historical entries in the instrument are:

• Revocation of the 2013 instrument: Regulation 4 explicitly revokes the Victims of Crime Assistance (Delegation) Regulations 2013. While the 2013 regulations are revoked, the 2023 instrument does not include a schedule comparing the two instruments or stating transitional provisions; the only note is the bare revocation (regulation 4 and Explanatory details reference Reg. 4: S.R. No. 138/2013).

• No amendments recorded: The “Table of Amendments” section states there are no amendments made to these 2023 Regulations by statutory rules, subordinate instruments or Acts (Table of Amendments). That indicates the instrument has not been altered since making, at least up to the version date of 26 September 2023.

• Sunset: Under the Subordinate Legislation Act 1994 the Regulations will sunset ten years after the date of making, i.e., on 26 September 2033, unless remade or otherwise preserved (Endnote 1). That is an automatic temporal limit on the Regulations’ legal life and is part of the instrument’s amendment/expiry history even while the instrument itself is unamended.

• Interpretation and style formalities: The endnotes refer to the Interpretation of Legislation Act 1984 and its provisions about form and style (s 54A and various s 36 provisions). Those notes are drafting and interpretative history that affect how the instrument is read and will be relevant if amendments are made in future.

There is no record in this instrument of prior amounts, policy rationales beyond the stated objective, or amendment proposals. The practical effect of the revocation is that any statutory history embedded in the 2013 regulations is removed and the new single-figure ceiling is now the controlling subordinate rule for the relevant purpose.

The statutory instrument as provided contains no litigation history. There are no cases, judicial decisions or references to litigation recorded in the Regulations, the Table of Provisions, or the endnotes. The text does not cite any judicial interpretation of the prescribed amount, nor does it record any legal challenges to the instrument or to the 2013 instrument that it revokes.

Given the absence of litigation references in the document, there are no source-based precedents, judicial constructions, or appeals embedded in the instrument’s text for readers to consult. Any adjudicative questions about the meaning or application of the prescribed amount in practice would need to be resolved through the parent Act’s mechanisms, administrative review processes, or in future litigation, none of which are present in these Regulations.

The endnotes and explanatory details do not record any judicial engagement with the instrument or its provisions. Therefore, based solely on the provided source, there is no litigation history to summarise. Practitioners seeking case law concerning the operation of s 24(1A) of the Victims of Crime Assistance Act 1996 or disputes about interim awards will need to consult the court and tribunal databases and the parent Act rather than rely on this instrument for past judicial guidance.

The Regulations are short, but they contain several practical pitfalls and points that can cause operational or legal confusion if overlooked. These arise from what the instrument prescribes and, equally importantly, from what it does not specify.

• Narrow scope: The Regulations only prescribe the monetary ceiling for interim awards made by a delegate under s 24(1A) of the Act (regulation 5). They do not define or describe the process for making interim awards, the categories of assistance covered, the identity or appointment of delegates, whether multiple interim awards may be made, or how interim awards interact with final awards under the Act. Mistaking the Regulation’s ceiling for an all-purpose cap on final or other awards would be an error.

• Delegation definition not in this instrument: The Regulations rely on the concept of a “delegate” but do not define it. The identity and authority of delegates, any internal delegation instruments, and any constraints on who may exercise the delegated power are matters for the Act or for administrative policy. Agencies should not assume the Regulation supplies any of those definitions.

• Revocation without transitional details: Regulation 4 revokes the 2013 regulations but contains no transitional saving, grandfathering clause or express reconciliation language. If existing delegation instruments, templates, or automated payment systems still reflect the old instrument’s parameters, there is a risk of inconsistency or inadvertent non‑compliance from the commencement date (regulation 3). Administrators must proactively reconcile the revocation.

• No enforcement or penalty provisions: The Regulations do not specify remedies, penalties or sanctions for exceeding the prescribed amount. Practitioners should not assume that the Regulation itself creates a statutory offence or automatic clawback regime. Any enforcement consequences require reference to the parent Act or to departmental controls.

• Sunset date: The instrument will sunset ten years after making (Endnote 1, referencing Subordinate Legislation Act 1994 s 5). That creates a planning horizon and a potential cliff date of 26 September 2033. Failure to plan for redevelopment or remaking of the instrument could result in the loss of the statutory prescribed amount if the instrument lapses without replacement.

• Commencement and retrospective expectations: The Regulations commence on 26 September 2023 (regulation 3). Any actions taken before that date are not governed by the new prescribed amount; administrators and delegates must apply the new ceiling only from the commencement date. If files or matters span the transition, care is required to apply the correct legal parameter for each decision point.

• Interpretative features are part of the instrument: The endnotes point out that headings, examples, notes, punctuation and other drafting elements form part of the statutory rule under the ILA (Endnote 1). Practitioners should not treat the Table of Provisions, explanatory notes or endnotes as mere commentary for interpretative purposes; in many instances, those drafting elements are part of the legal instrument.

• Silence on funding and source: The Regulations do not identify a funding source, payment mechanism or budget authority. That silence may create operational friction between grant-making officers and finance sections if there is no clear internal guidance about how interim awards up to $5,000 will be financed.

• Overreliance on the instrument for policy: The instrument states its objective (regulation 1) but provides no rationale, prioritisation, or discretionary criteria. Using the Regulation as a substitute for policy development or case-by-case guidance would be inappropriate.

These “gotchas” are matters of omission as much as of commission: the Regulations are deliberately minimal, and the practical difficulties will arise where administrators, delegates or advisers expect the instrument to carry more operational detail than it does.

Compliance with the Regulations is operationally straightforward but requires coordination between legal advisers, delegations officers, payment administrators and caseworkers because the instrument prescribes a single monetary limit without procedural detail. The following steps, grounded in the instrument’s text, set out practical compliance tasks.

1. Read the instrument and its references. Confirm the prescribed amount is $5,000 for the purposes of s 24(1A) of the Victims of Crime Assistance Act 1996 (regulation 5). Note the commencement date, 26 September 2023 (regulation 3), and the revocation of the 2013 Regulations (regulation 4). A compliance checklist should record these fundamental facts.

2. Update delegation instruments and schedules. Because the instrument is a delegation regulation made under s 72 of the Act (regulation 2), internal delegation instruments should be reviewed and updated so that any internal authorisation or instrument used by the agency reflects that delegates may make interim awards up to $5,000. Remove or amend any references to the revoked 2013 Regulations (regulation 4) in delegation schedules, policy manuals and decision‑making matrices.

3. Configure payment systems and financial controls. Ensure financial systems will not permit payment disbursements by delegates in excess of $5,000 for interim awards governed by s 24(1A). Put automated caps, approval gates and exception reporting in place so that any attempted payment above the statutory ceiling triggers review by a nominated senior officer.

4. Train delegates and case officers. Provide concise written guidance to delegates on the new prescribed amount and explicitly state that the Regulations set a monetary ceiling for interim awards. Clarify that the Regulations do not establish eligibility criteria, frequency, or other procedural rules, those remain matters for the Act and agency policy.

5. Reconcile existing matters in progress. For applications or files that straddle the 26 September 2023 commencement date, document the legal basis for any interim awards made either before or after commencement. If prior interim awards exceed $5,000 and were made under pre-commencement authority, record the basis and whether those payments were lawful under the earlier instrument.

6. Document governance and review processes. Maintain an internal audit trail linking each interim award to the statutory authority (note regulation 5 and s 24(1A) of the Act). Establish periodic compliance checks to confirm delegates are adhering to the ceiling and that finance systems are correctly configured.

7. Plan for the sunset. Note the instrument’s expiry in ten years under the Subordinate Legislation Act 1994 (Endnote 1). Create a timeline for legislative review and, if appropriate, prepare a business case for remaking or replacing the subordinate rule in advance of 26 September 2033.

8. Liaise with legal counsel on interpretative questions. Because the Regulations do not define “delegate”, “interim award” or other operative terms, obtain legal advice where edge cases arise (for example, where multiple payments might cumulatively exceed $5,000, or where an interim award interacts with other kinds of assistance). Record legal advice on file.

9. Review public-facing materials. Update brochures, web pages and application forms to reflect the $5,000 ceiling where they discuss interim awards. Avoid presenting the figure as a guarantee of payment; instead, state that it is a statutory maximum for interim awards by delegates under the Act.

10. Monitor for amendments and related legislative changes. Although the Table of Amendments currently shows no changes, continue to monitor subordinate legislation updates. Ensure policy teams monitor the parent Act, since changes to s 24(1A) or s 72 of the Act could require further updates.

These steps implement the Regulations’ singular legal requirement, the $5,000 ceiling, while recognising the instrument’s deliberately limited scope. Compliance is primarily an administrative task of aligning delegation instruments, payment systems and training with the new statutory parameter and ensuring records demonstrate lawful exercise of delegated authority.
