8 Restriction on publicity of proceedings

(1)  [Section 8 Subsection (1) amended by No. 10 of 2001, Sched. 1, Applied:24 Oct 2001] Proceedings before the Commissioner under this Act shall be conducted in private.

(2)  [Section 8 Subsection (2) amended by No. 10 of 2001, Sched. 1, Applied:24 Oct 2001] *[Section 8 Subsection (2) amended by No. 43 of 1991, s. 5 and Sched. 1 ]*No person shall–

(a) in any newspaper or periodical, or in any book publicly exposed or offered for sale; or

(ab) [Section 8 Subsection (2) amended by No. 38 of 2015, s. 57, Applied:13 Oct 2015] in any electronic form; or

(b) in any television or radio broadcast–

publish or cause or allow to be published a report of any proceedings before the Commissioner on an application under this Act.

Penalty:  Fine not exceeding 5 penalty units.

(3)  Nothing in this section prohibits the publication of any matter by or under the authority of the Attorney-General, or by a person who, by virtue of his office, is authorised or required to make the publication.
