Water (Commonwealth Powers) Act 2008

Initial reference. Under s 4(1)(a), Victoria refers the matters to which the initial referred provisions relate, but only to the extent of making laws by including those provisions in the Commonwealth Water Act in terms substantially the same as the tabled text from South Australia (tabled 23 September 2008). The “initial referred provisions” are defined as the text of Parts 1A, 2A, 4, 4A, 10A and 11A of the Commonwealth Water Act set out in that tabled text (s 3). This means the Commonwealth cannot, under this reference, unilaterally expand the scope of those Parts beyond what was tabled. Any expansion would need to rely on its own constitutional powers or a further referral.

Amendment reference. Under s 4(1)(b), Victoria refers the “referred subject-matters” for the purpose of making “express amendments” of the Commonwealth Water Act. “Express amendment” is tightly defined as direct amendment of the text of those same Parts (or definitions used in them) by another Commonwealth Act or instrument, but not including provisions that have substantive effect outside those Parts (s 3). This prevents the Commonwealth from achieving indirectly, through the amendment reference, what it cannot do under the initial reference - for example, inserting entirely new regulatory schemes outside the listed Parts. However, s 4(4)(a) makes clear that the Commonwealth may still expressly amend the Water Act using its own constitutional powers apart from the referral, so the amendment reference is a supplementary rather than exclusive route.

Referred subject-matters. These are six specific topics listed in s 3: (a) powers, functions and duties of Commonwealth agencies relating to Basin water resources under the Murray-Darling Basin Agreement; (b) management of Basin water resources to meet critical human water needs; (c) water charging in relation to Basin water resources (excluding urban supply after removal of water from the resource); (d) transformation of water entitlements to enable trading; (e) application of those charging and trading provisions to non‑Basin water resources if authorised by State law; and (f) transfer of assets, rights and liabilities from the Murray-Darling Basin Commission to the Authority, and other transitional matters. These subject-matters define the outer limit of the amendment reference.

Critical human water needs. Defined in s 3 as the needs for a minimum amount of water that can only reasonably be provided from Basin water resources to meet: (a) core human consumption in urban and rural areas; and (b) non‑human consumption requirements whose failure would cause “prohibitively high social, economic or national security costs”. This definition is broad and discretionary - “prohibitively high” is not quantified, and “social” and “national security” costs invite expansive interpretation. The provision gives the Commonwealth significant latitude to prioritise certain uses over others, potentially overriding State water allocation decisions.

Basin water resources. Defined as water resources within or beneath the part of Victoria that comprises the Murray-Darling Basin, but expressly excluding groundwater resources of the Great Artesian Basin. This defines the territorial scope of the referral, which is limited to the Basin portion of Victoria.

Tabled text. Means the text of the proposed Water Amendment Bill 2008 for a Commonwealth Act as tabled in the South Australian House of Assembly on 23 September 2008 (s 3). The Act relies on this external document to define the content of the initial referral. Section 7 provides for evidentiary certificates from the Clerk of the South Australian House to prove the content of the tabled text in proceedings.

Termination mechanisms. The Governor in Council may by proclamation fix a day on which “the references” (both) or “the amendment reference” alone terminate (s 5(1)). A terminating proclamation may be revoked before that day, and revocation does not prevent a later proclamation (s 5(2)-(4)). If the amendment reference terminates before the initial reference, the amendment reference continues to have effect for the purpose of preserving laws made under it and the continued operation of the Commonwealth Water Act as amended (s 6(1)-(2)). However, the amendment reference may be excluded from that preservation by the terminating proclamation (s 6(3)). This complex mechanism creates uncertainty about whether termination can fully unwind the Commonwealth regime.

The Act directly affects the Victorian Government, which has surrendered its legislative competence over certain water management matters to the Commonwealth for as long as the references remain in force. It also affects the Commonwealth Parliament, which now has the constitutional power (by virtue of the referral) to enact laws on the referred subject-matters that would otherwise be beyond its head of power under section 51. The practical effects cascade down to all water users within the Victorian portion of the Murray-Darling Basin: irrigators, agricultural enterprises, rural and regional town water suppliers, environmental water holders, and private entitlement owners. The transformation of entitlements to enable trading (referred subject-matter (d)) directly affects the property rights and trading opportunities of individual water entitlement holders, potentially overriding State-based trading rules.

Water authorities and catchment management authorities in the Basin area must comply with Commonwealth laws made under the referral, which may alter allocation rules, metering requirements, and reporting obligations. The definition of “critical human water needs” gives the Commonwealth the ability to direct water to certain uses (urban consumption and essential non‑human uses) even if that means reducing allocations to other entitlement holders, including high‑value agricultural or commercial users. This creates a hierarchy of water uses that affects the security of private water entitlements.

The Act also affects other Basin States (New South Wales, Queensland, South Australia, the Australian Capital Territory) because the referral is part of a coordinated national framework. Victoria’s termination rights, if exercised, could disrupt the uniform regime and create interstate inconsistency. Legal practitioners advising water market participants, Government agencies, and infrastructure investors must understand whether the Commonwealth Act applies to a particular transaction or water right, which depends on the interaction between the referral and the Commonwealth’s own powers.

Compliance professionals and accountants dealing with water trading, water charge rules, or basin‑wide reporting will need to track amendments to the Commonwealth Water Act made under the amendment reference, as those amendments may directly affect tax treatment, asset valuation, and business continuity. The Consequential amendments to the Snowy Hydro Corporatisation Act 1997 and the Water Act 1989 (s 1(c)) affect the rights and responsibilities of Snowy Hydro Limited and Victorian water corporations, altering the regulatory framework under which those entities operate. Finally, the repeal of the Murray-Darling Basin Amendment Act 2007 (s 1(d)) removes a previous State regime, so entities that had relied on that earlier law must now look to the Commonwealth Act.

This Act does not itself impose duties on individuals or confer rights directly. Instead, it alters the constitutional distribution of legislative power, thereby enabling the Commonwealth to create duties and rights through the Commonwealth Water Act and its instruments. The key duty of the Victorian Government, implicit in the Act, is to refrain from legislating on referred matters to the extent the Commonwealth relies on the referral. If Victoria passes inconsistent State legislation, it risks being invalid under section 109 of the Constitution because the Commonwealth law will be validly made under the referred power. However, Victoria retains the right to terminate either or both references by proclamation (s 5(1)), which would restore its full legislative competence over those matters from the termination day.

The amendment reference gives the Victorian Government a limited right to control the scope of Commonwealth amendments. Because the amendment reference is confined to “express amendments” of the listed Parts, the Commonwealth cannot use the referral to enact entirely new substantive schemes outside those Parts without a fresh referral. This is a structural constraint on Commonwealth power, but it is not directly enforceable by private parties - only the Commonwealth Parliament’s own legislative process and ultimate High Court review would enforce it.

Section 4(2) provides that the referral has effect only if and to the extent the matter is not already within Commonwealth legislative power. This confirms that the referral does not expand Commonwealth power beyond what the Constitution already gives, but merely supplements it. If the High Court later finds that the Commonwealth already had power over a referred subject-matter (for example, under the trade and commerce power), the referral is superfluous but not invalid.

Section 4(4)(a) clarifies that the Commonwealth may still expressly amend the Water Act using its own constitutional powers apart from the referral. This means the amendment reference is not the only route to amendment, and the Victorian Government cannot block a Commonwealth amendment that relies on the corporations or external affairs powers, for example. The practical effect is that the termination rights and the limit on the amendment reference are weaker constraints than they might appear: the Commonwealth can still achieve substantial changes using its own powers, provided those changes are otherwise constitutionally valid.

The Act also creates evidentiary rights: s 7 permits a certificate from the Clerk of the South Australian House of Assembly to be admitted as evidence of the content of the tabled text. This simplifies proof in any legal proceedings challenging the validity of Commonwealth laws made under the referral.

The Act contains no penalty provisions. Penalties and enforcement mechanisms are found in the Commonwealth Water Act 2007, which the referral enables the Commonwealth to enact or amend. For example, the Commonwealth Act includes enforcement structures such as the Murray-Darling Basin Authority, compliance and enforcement powers, civil penalty provisions for breaches of water charging rules or water take limits, and offences for providing false information. None of these arise from the Victorian referral Act itself.

The enforcement of the referral’s limits - for example, whether a Commonwealth law is “substantially” in the terms of the tabled text, or whether an amendment qualifies as an “express amendment” of a listed Part - would occur through judicial review in the High Court. If a Commonwealth law exceeds the scope of the referral, it would be invalid for lack of constitutional power (assuming no other head of power supports it). The burden of proof would fall on the challenger to show the law is not supported by the referral. The Act gives the Commonwealth the advantage because the definition of “substantially” in s 4(1)(a) is not further defined, leaving room for the Commonwealth to argue that deviations from the tabled text are still substantial.

The termination mechanism in s 5 is not subject to any penalty if the Governor in Council fails to use it. The failure to terminate simply means the reference continues indefinitely. There is also no penalty for the Commonwealth if it enacts laws beyond the referral - the consequence is invalidity, not a fine. The Act does not create any Victorian enforcement body to monitor Commonwealth compliance.

For water users, the practical consequence of the referral is that they must comply with Commonwealth water management rules, which may be enforced by Commonwealth agencies with coercive powers. The Victorian referral Act itself does not add any layer of enforcement; instead, it removes potential defences based on lack of Commonwealth legislative power. From a compliance burden perspective, the Act ensures that a single national regulator can enforce consistent rules across the Basin, which may reduce compliance costs for operators active in multiple states, but may increase costs for those who previously operated under a different Victorian regime that is now overridden.

The Act operates within a complex federal framework. Its primary interaction is with the Commonwealth Water Act 2007, which is the legislation the referral is designed to support. The referral ensures that the Commonwealth Water Act - as amended from time to time - applies to Victoria in respect of Basin water resources, to the extent it could not otherwise be applied absent the referral. Section 4(4)(b) provides that the Commonwealth Water Act may have its operation affected by Commonwealth Water Act instruments (such as regulations, rules, or water resource plans) without needing further referral.

The Act also amends the Murray-Darling Basin Act 1993 (Vic) to give effect to the new Murray-Darling Basin Agreement and to repeal provisions relating to the former agreement (s 1(b)). The 1993 Act had previously implemented an earlier intergovernmental agreement; the 2008 Act effectively replaces that regime with the new Agreement reflected in the Commonwealth Act. The consequential amendment to the Water Act 1989 (Vic) is not specified in detail in the source text, but s 1(c) indicates it is necessary to harmonise Victorian water legislation with the new Commonwealth framework. Similarly, the amendment to the Snowy Hydro Corporatisation Act 1997 likely adjusts the obligations of Snowy Hydro Limited in relation to water rights within the Basin.

The Act specifically excludes groundwater of the Great Artesian Basin from the definition of “Basin water resources” (s 3). This means the referral does not apply to groundwater in that part of the Basin, leaving those resources under full State control (subject to any other Commonwealth powers). The Act also excludes water charging for urban water supply after removal from a Basin water resource (s 3 definition of “referred subject‑matters” paragraph (c)), so that aspect of pricing remains with the State.

The interaction with other State referral Acts is critical. The Commonwealth Water Act 2007 relies on referrals from New South Wales, Queensland, South Australia, and Victoria, as well as the Australian Capital Territory. Victoria’s Act is one piece of a national jigsaw. If another State’s referral is narrower or contains different termination provisions, the Commonwealth regime may apply differently in that State, creating fractured application. The Act does not address this directly, but the definition of “tabled text” being the same as used in South Australia suggests a degree of coordination.

Public law interactions include the operation of section 109 of the Constitution: once the Commonwealth validly legislates under the referral, any inconsistent Victorian law is invalid to the extent of the inconsistency. This overrides Victorian water allocation decisions, licensing conditions, and trading rules if they conflict with Commonwealth law. The Act does not provide a transitional mechanism for existing Victorian laws, leaving that to the Commonwealth Water Act or to subsequent Victorian amendments (such as the amendments to the Water Act 1989 mentioned in s 1(c)).

From a trade and commerce perspective, the Act interacts with the Competition and Consumer Act 2010 (Cth) through water trading and water charging provisions that may be covered by national competition principles. However, the referral Act itself is silent on competition law; those interactions occur through the Commonwealth Water Act.

The Water (Commonwealth Powers) Act 2008 (No. 75 of 2008) received Royal Assent on 4 December 2008. Sections 1-7 (Parts 1 and 2) commenced on that same day by Special Gazette (No. 336) of 4 December 2008. Sections 8-26 (Parts 3, 4 and 5) commenced on 15 December 2008 by Special Gazette (No. 358) of 11 December 2008. However, section 26 itself repealed those very Parts 3-5, effective 15 December 2008 (the note in the source indicates s 26 repealed ss 8-26, which includes itself in a sense - the effect is that the bulk of the Act was repealed almost immediately after commencement). The version as at 7 June 2012 (Version No. 004) reflects that repeal.

The Table of Amendments in the endnotes is minimal and does not show any amendments made to the Act after its initial enactment, other than the self‑repeal by s 26. This suggests the Act has remained in its current form since late 2008, with only the operative Parts 1 and 2 (ss 1-7) continuing in force. The termination and amendment provisions remain unaltered. Because the Act itself is a referral of power, it is not subject to frequent amendment; changes would typically be made by a new referral Act or by terminating the reference and enacting a fresh one.

The lack of subsequent amendment history indicates that Victoria has not sought to adjust the scope of the referral since 2008. This is significant: the referral has been in place for over a decade, and the Commonwealth has enacted amendments to the Water Act under the amendment reference (and under its own powers) during that period. The stability of the referral may reflect political consensus among Basin states, but it also means the original terms - including the tabled text from 2008 - continue to define the scope of the initial reference. Any Commonwealth law that is not “substantially” in those terms may be invalid as against Victoria unless supported by another head of power. Practitioners should be alert to the possibility that the tabled text could be proved via a certificate under s 7, and that the continued incorporation of that text means the initial reference is fixed in time despite amendments to the Commonwealth Act.

The source text does not refer to any litigation under the Water (Commonwealth Powers) Act 2008. As a referral Act, it is unlikely to be the direct subject of litigation; challenges would more likely be brought against the Commonwealth Water Act or instruments made under it, on the ground that they exceed the scope of the referral. The High Court has considered referral power cases in other contexts (for example, Thomas v Mowbray (2007) concerning terrorism offences referred under s 51(xxxvii)), but that case does not involve this Act.

The absence of litigation does not mean the Act is immune to challenge, but it suggests that the Commonwealth and Victoria have operated within the referral’s boundaries, or that the Commonwealth has used its own powers to avoid reliance on the referral for controversial provisions. Because the Act is a State law, any challenge to the validity of Commonwealth water laws would need to be brought in the High Court by an affected party - for example, by an irrigator contesting a water charge or recovery plan that allocates water away from their entitlement. The plaintiff would need to demonstrate that the Commonwealth law is not supported by any head of power, including the referral.

The definition of “critical human water needs” could be a source of future litigation if the Commonwealth directs water away from high‑value users to meet a broad conception of “social” or “national security” costs. A court would need to interpret “prohibitively high” - a standard that is vague and could lead to expansive government discretion. Similarly, the phrase “substantially in the terms” in s 4(1)(a) could be litigated if the Commonwealth inserts provisions that differ from the tabled text.

Practitioners should monitor decisions concerning the scope of State referrals generally, as the High Court’s approach to the “matters” referred under s 51(xxxvii) has developed over time. The Act itself has not been judicially considered, but the tabled text and the definitions within it would be central to any future dispute.

Termination complexity. The termination mechanism in s 5 is not straightforward. Proclamations can be revoked, and the amendment reference can be terminated separately. Section 6(1) preserves laws made under the amendment reference even after that reference terminates, unless the initial reference is also terminated. This means a partial termination may not fully restore State control - the Commonwealth laws already made under the amendment reference continue in force. The only way to completely undo the Commonwealth regime is to terminate both references, but even then, laws made under the initial reference and under the amendment reference (which are preserved by s 6(1)) may remain. The effect is that termination is not a simple off‑switch; the Commonwealth water regime could continue to operate even after Victoria purports to withdraw its referral. This is a trap for State officials who might assume termination fully reclaims legislative sovereignty.

Critical human water needs ambiguity. The definition in s 3 is broad and undefined. “Prohibitively high social, economic or national security costs” is not quantified or tied to any objective metric. This gives the Commonwealth wide latitude to designate any water use as critical if failure to provide it would cause high costs. The term “social costs” could encompass environmental, cultural, or community cohesion objectives, potentially overriding private water rights. It also allows the Commonwealth to characterise water allocations to particular industries or regions as matters of “national security”. This definition creates significant uncertainty for entitlement holders about the security of their water access.

Tabled text dependency. The initial reference is defined by reference to a text tabled in the South Australian Parliament on 23 September 2008. That text is not reproduced in the Victorian Act. Proving its content in legal proceedings relies on a certificate from the Clerk of the South Australian House (s 7). If that certificate is unavailable or contested, the scope of the initial reference becomes uncertain. The Act also does not provide a mechanism for updating the tabled text if the Commonwealth wishes to amend the Parts; the amendment reference covers only “express amendments” of those Parts, not wholesale replacement. This means the initial reference is frozen to the 2008 text, while the Commonwealth may continue to amend those Parts using its own powers or the amendment reference. Over time, the initial reference may become a historical artifact.

Scope creep via “substantially”. The initial reference allows the Commonwealth to include the initial referred provisions “in the terms, or substantially in the terms, set out in Schedule 1 of the tabled text” (s 4(1)(a)). The word “substantially” provides a degree of flexibility. The Commonwealth could argue that a provision that departs from the tabled text is still “substantially” the same, especially if the difference is minor or technical. This gives the Commonwealth a buffer against challenges based on textual variation, and places the onus on a challenger to show the difference is material.

Interaction with Commonwealth’s own powers. The referral is only effective to the extent the matter is not already within Commonwealth legislative power (s 4(2)(a)). This means that if the High Court later expands Commonwealth power through interpretation - for example, through the corporations power or the external affairs power - the referral becomes redundant, and Commonwealth laws that may have originally required the referral could now be supported by another head of power. This reduces the effectiveness of Victoria’s termination rights: even if Victoria terminates the reference, the Commonwealth may continue to rely on its own constitutional powers to maintain the same laws. The amendment reference in s 4(4) expressly preserves that outcome.

No sunset clause. The Act does not set a fixed expiry date. The references continue indefinitely unless the Governor in Council exercises the termination power. This creates a situation where the Victorian Parliament has permanently (in practical terms) ceded legislative power over a vital resource, subject only to a political decision to terminate. The compliance burden falls on water users who must navigate Commonwealth rules that may change without Victorian input.

Limited transparency for the amendment reference. The amendment reference covers “express amendments” of the listed Parts. But the Commonwealth might also make substantive changes through instruments (rules, plans, determinations) that are not “express amendments” of those Parts - for example, by inserting new definitions or new provisions outside the listed Parts but still affecting water management. Section 4(4)(b) allows such instruments to operate. Water users may not easily track whether a change is made under the referral or under the Commonwealth’s own powers, affecting their ability to predict regulatory stability.

Risk of double regulation. Although the referral aims for a single Commonwealth regime, State laws may continue to apply in areas not covered by the referral (such as urban water charging or groundwater outside the Basin). Water users operating across the Basin may need to comply with both Commonwealth and State laws, with potential inconsistencies that are not resolved by this Act.

For the Victorian Government. The primary compliance obligation is to ensure that any proclamations terminating the references under s 5 are properly gazetted and comply with the revocation provisions. If partial termination is intended, the government must carefully consider the effect of s 6 on continuation of existing Commonwealth laws. Government officials should also monitor Commonwealth legislative activity to verify that any amendment to the Commonwealth Water Act falls within the “referred subject‑matters” or is otherwise supported by Commonwealth constitutional power. If the Commonwealth enacts a law that appears to exceed the referral, the State may decide to challenge it, but must consider the political and operational consequences.

For water users and entitlement holders. The most direct compliance pathway is to understand the Commonwealth Water Act and its instruments as they apply to the Murray-Darling Basin. This includes water resource plans, water charging rules, water trading rules, and any orders made under the critical human water needs provisions. Entitlement holders should track amendments made under the amendment reference, as these may alter the terms of their water access rights, transformation requirements, or trading opportunities. It is prudent to seek legal advice before entering into water trades that may be affected by Commonwealth rules, particularly if the trade involves transformation of an entitlement (a referred subject‑matter).

For legal practitioners and compliance professionals. When advising a client on a water-related matter in the Victorian part of the Murray-Darling Basin, the first step is to determine whether the Commonwealth Water Act applies to the specific issue. If the issue is within the scope of the referral (for example, water charging or transformation of entitlements), the Commonwealth law prevails over any inconsistent Victorian law. Practitioners should obtain a copy of the tabled text (the South Australian document) to assess whether a Commonwealth provision is “substantially” within the initial reference. This may require requesting a certificate from the Clerk of the South Australian House under s 7 for evidentiary purposes if litigation is anticipated.

For businesses involved in water trading or charging. The Act enables the Commonwealth to set uniform charging rules and trading frameworks. Compliance with those rules is mandatory, and businesses should review the Commonwealth Water Act and any instruments, such as the Basin Plan or water charge rules. Given the broad definition of critical human water needs, businesses should assess the risk that their water allocation could be reduced in favour of critical needs. That risk is not easily mitigated, but understanding the criteria and engaging with the Basin Authority may help.

For accountants and auditors. Water entitlements may be recognised as assets on balance sheets. Changes to Commonwealth law under the referral can affect the value, tradeability, and security of those assets. Accountants should monitor amendments to the Commonwealth Water Act that alter transformation rules or impose new charges, as these may trigger impairment or revaluation. The interaction with the Water Act 1989 (Vic) as amended by this Act should also be verified to ensure that asset recognition and tax treatment are consistent with applicable law.

For all stakeholders. The termination mechanism under s 5 is a political safety valve, but it is not a compliance tool. No private party can force the Governor in Council to terminate the reference. Therefore, reliance on the referral being wound back is misplaced. The practical compliance approach is to treat the Commonwealth regime as permanent unless and until a termination proclamation is published. Keeping track of the Government Gazette for any such proclamation is advisable, but the more immediate compliance burden is managing day-to-day obligations under the Commonwealth Water Act as it evolves.
