127 Immunity for Commissioners and staff (1) A Commissioner or any person appointed or engaged by the Authority is not liable for anything done or omitted to be done in good faith— S. 127(1)(a) amended by Nos 26/2019 s. 118, 17/2025 s. 4. (a) in carrying out a function under this Act or the regulations, the **Domestic Building Contracts Act 1995** or the **Professional Engineers Registration Act 2019** or regulations made under either of those Acts; or S. 127(1)(b) amended by Nos 26/2019 s. 118, 17/2025 s. 4. (b) in the reasonable belief that the act or omission was in the carrying out of a function under this Act or the regulations, the **Domestic Building Contracts Act 1995** or the **Professional Engineers Registration Act 2019** or regulations made under either of those Acts. (2) Any liability resulting from an act or omission that would, but for subsection (1), attach to a Commissioner or a person appointed or engaged by the Authority attaches instead to the Authority. S. 127AA inserted by No. 11/2023 s. 20. 127AA Immunity for Building Monitor and acting Building Monitor (1) The Building Monitor or an acting Building Monitor is not liable for anything done or omitted to be done in good faith— (a) in carrying out a function under this Act or the regulations; or (b) in the reasonable belief that the act or omission was in the exercise of carrying out a function under this Act or the regulations. (2) Any liability resulting from an act or omission that would, but for subsection (1), attach to the Building Monitor or an acting Building Monitor attaches instead to the State.
