Australia (Acts) Request Act 1985

The principal legal concepts in the instrument are sovereignty transfer, removal of imperial legal residuals, entrenchment of State legislative competence, and finality of domestic judicial decisions.

Sovereignty transfer: the Schedules declare that no Act of the United Kingdom passed after commencement shall extend to the Commonwealth, a State or a Territory as part of Australian law (First Schedule, cl 1; Second Schedule, cl 1). This is a categorical statement that, after commencement, UK parliamentary Acts will not operate as Australian law by virtue of prior imperial connection.

Removal of imperial residuals: the Colonial Laws Validity Act 1865 is disapplied for laws made by State Parliaments after commencement (First Schedule, cl 3(1); Second Schedule, cl 3(1)). The instrument also provides that State laws will not be void or inoperative because of repugnancy to the law of England or to UK Acts and that State Parliaments may repeal or amend such UK Acts or subordinate instruments insofar as they form part of State law (First Schedule, cl 3(2); Second Schedule, cl 3(2)).

Entrenchment of State legislative competence and "manner and form": the Schedules declare that State Parliaments have "full power" to make laws for peace, order and good government with extra‑territorial operation and include legislative powers formerly exercised by the UK (First Schedule, cl 2(1)-(2); Second Schedule, cl 2). However, section 6 of the Schedules preserves a "manner and form" rule so that any State law respecting the constitution, powers or procedure of a State Parliament is of no force unless made in such manner and form as the State Parliament itself may from time to time require (First Schedule, cl 6; Second Schedule, cl 6). That provision creates a mechanism by which a State can prescribe particular legislative processes for laws affecting its parliamentary constitution or internal procedure.

Finality of judgments: the Schedules terminate appeals to Her Majesty in Council from Australian courts, and repeal UK enactments that provided for such appeals insofar as they remain part of Australian law (First Schedule, cl 11(1)-(3); Second Schedule, cl 11(1)-(3)). Limited transitional exceptions preserve appeals already instituted or where leave was granted before commencement (First Schedule, cl 11(4); Second Schedule, cl 11(4)).

Crown and Governor roles: the Schedules reallocate exercise of Her Majesty's powers in respect of a State to the Governor (First Schedule, cl 7(1)-(2); Second Schedule, cl 7(1)-(2)), with exceptions for appointment and termination of appointment, and when the Sovereign is personally present (First Schedule, cl 7(3)-(4); Second Schedule, cl 7(3)-(4)). The Premier is specified as the adviser to Her Majesty on State matters (First Schedule, cl 7(5); Second Schedule, cl 7(5)).

Protection of higher constitutional instruments: the Schedules expressly state that their provisions are subject to the Commonwealth of Australia Constitution Act and the Constitution of the Commonwealth and that State legislation cannot be given effect to the extent it would repeal or be repugnant to those instruments or to the Statute of Westminster 1931 (First Schedule, cl 5; Second Schedule, cl 5). There is also a special procedure for repeal or amendment of the Act or the Statute of Westminster in their application to Australia, requiring a Commonwealth Act passed at the request or with the concurrence of the Parliaments of all States (First Schedule, cl 15; Second Schedule, cl 15).

Definitions and commencement particulars are supplied (First Schedule, cl 16-17; Second Schedule, cl 16-17). The Victorian Act itself is a state-level instrument that makes the formal request and consent (ss 3-5) and attaches the full texts of the requested Commonwealth and UK measures as Schedules.

Primary institutional actors affected, under the text, are: State Parliaments and Governments, the Governors of the States, the Commonwealth Parliament and Government, the Parliament of the United Kingdom (as the addressee of the request), Australian courts (including litigants within those courts), and persons or entities relying on laws previously derived from UK legislation.

State Parliaments and executives: the Act, via the Schedules, increases the formal legislative autonomy of State Parliaments by declaring their powers to include extra‑territorial legislation and powers previously exercised by the United Kingdom (First Schedule, cl 2; Second Schedule, cl 2). It also relieves State laws of the Colonial Laws Validity Act 1865 and a requirement of conformity with English law (First Schedule, cl 3; Second Schedule, cl 3). States therefore are the direct beneficiaries of broader constitutional legislative capacity in respect of their own laws; the text expressly contemplates State action to prescribe "manner and form" requirements for certain State laws (First Schedule, cl 6; Second Schedule, cl 6).

State Governors and the Crown's representation: the text designates the Governor as Her Majesty's representative in each State and provides that, subject to stated exceptions, Royal powers in relation to a State are exercisable only by the Governor (First Schedule, cl 7(1)-(2); Second Schedule, cl 7(1)-(2)). The Premier is the adviser to Her Majesty regarding these powers (First Schedule, cl 7(5); Second Schedule, cl 7(5)). The exceptions include the power to appoint or terminate appointment of a Governor (First Schedule, cl 7(3); Second Schedule, cl 7(3)) and the Sovereign's capacity to act when personally present in a State (First Schedule, cl 7(4); Second Schedule, cl 7(4)).

Litigants and courts: the termination of appeals to Her Majesty in Council removes a route of appellate relief for parties in Australian courts (First Schedule, cl 11; Second Schedule, cl 11). The Schedules repeal UK enactments that enabled such appeals insofar as they were part of Australian law (First Schedule, cl 11(2)-(3); Second Schedule, cl 11(2)-(3)). Transitional exceptions are narrow and confined to appeals instituted before commencement or where leave was granted before commencement (First Schedule, cl 11(4); Second Schedule, cl 11(4)).

Users of UK‑derived law and regulated sectors: laws and subordinate instruments that formed part of the law of a State only because of their origin in UK statutes are affected. The Colonial Laws Validity Act 1865 is disapplied for future State laws (First Schedule, cl 3(1); Second Schedule, cl 3(1)). Merchant shipping law is specifically affected by the repeal of ss 735 and 736 of the Merchant Shipping Act 1894 insofar as they are part of State law (First Schedule, cl 4; Second Schedule, cl 4). The text therefore affects persons and industries operating under legal regimes earlier implemented by or dependent on UK statutes.

The Commonwealth and the United Kingdom: the Act is a request by a State to the Commonwealth Parliament and a consent/request to the United Kingdom Parliament (ss 3-5). The Commonwealth is therefore a direct addressee of the request to enact a Commonwealth Australia Act in the First Schedule's terms; the United Kingdom is asked to enact the measure in the Second Schedule's terms. The Schedules also preserve the primacy of the Commonwealth Constitution and the Commonwealth of Australia Constitution Act (First Schedule, cl 5; Second Schedule, cl 5).

Administrative actors: the Secretary of State (UK) and Australian proclamation mechanisms are identified for commencement of the respective Acts (First Schedule, cl 17; Second Schedule, cl 17). State legislatures are required to consider and adopt any "manner and form" requirements they choose to impose (First Schedule, cl 6; Second Schedule, cl 6).

Indirectly affected are legal advisers, government legal services and public authorities required to implement or adjust to the removal of UK oversight, the change in appellate landscape and the added clarity on State legislative competence.

The instrument allocates legal authority, prescribes limits on external interference, and creates procedural requirements for certain State laws. It does not create new private civil liabilities or criminal offences; rather it confers, removes and clarifies public powers and legal effects.

Requests and consents: the Victoria Act records the State Parliament's formal request that the Commonwealth Parliament enact an Act set out in the First Schedule (s 3). It also records the State Parliament and Government's request and consent that the United Kingdom Parliament enact the Act set out in the Second Schedule (s 4), and a request and consent that the Commonwealth Parliament enact the Act in the terms of the Second Schedule (s 5). Those provisions are duties of the State Parliament and Government to request and consent; they are not statutory duties imposed on private persons.

State legislative powers and rights: the Schedules declare that State Parliaments possess full power to make laws for peace, order and good government with extra‑territorial effect (First Schedule, cl 2(1); Second Schedule, cl 2(1)). They also declare that State Parliaments have all legislative powers that the UK might previously have exercised for the peace, order and good government of the State (First Schedule, cl 2(2); Second Schedule, cl 2(2)). Those clauses are statements of the States' legislative rights under the requested Acts.

Protection from imperial invalidation: from commencement, the Colonial Laws Validity Act 1865 shall not apply to laws made after commencement by State Parliaments (First Schedule, cl 3(1); Second Schedule, cl 3(1)). State laws made after commencement shall not be void or inoperative on the ground of repugnancy to English law or UK Acts; State Parliaments may repeal or amend such Acts in so far as they form part of State law (First Schedule, cl 3(2); Second Schedule, cl 3(2)). Those clauses protect the validity and enforceability of future State laws.

Manner and form constraint: despite the expanded State legislative powers, a law made after commencement by a State Parliament "respecting the constitution, powers or procedure of the Parliament of the State" is of no force unless it is made in such manner and form as may be required by a law of that Parliament (First Schedule, cl 6; Second Schedule, cl 6). This clause effectively allows each State Parliament to set procedural or entrenchment requirements for specific sorts of domestic constitutional changes. It is a self‑referential device that places a precondition on the validity of certain State laws.

Her Majesty and Governors: the Schedules direct that Her Majesty's representative in each State is the Governor and that, subject to specific exceptions, all powers and functions of Her Majesty in respect of a State are exercisable only by that Governor (First Schedule, cl 7(1)-(2); Second Schedule, cl 7(1)-(2)). The choice of adviser to Her Majesty for the exercise of those powers is given to the Premier of the State (First Schedule, cl 7(5); Second Schedule, cl 7(5)). The exceptions are limited to appointment and termination of Governors and to Her Majesty acting while personally present (First Schedule, cl 7(3)-(4); Second Schedule, cl 7(3)-(4)).

Finality of appeals: the Schedules remove appellate access to Her Majesty in Council, making no appeals lie from or in respect of decisions of Australian courts subject to limited transitional exceptions (First Schedule, cl 11(1)-(4); Second Schedule, cl 11(1)-(4)). The effect is to close that external appellate channel as from commencement, except for appeals already instituted or where leave had been granted prior to commencement.

Protection of the Constitution and Statute of Westminster: the Schedules provide that their declarations are subject to the Commonwealth of Australia Constitution Act and the Constitution of the Commonwealth and do not give force to State Acts that would repeal or be repugnant to those instruments or to the Statute of Westminster (First Schedule, cl 5; Second Schedule, cl 5). They also set out a special method for repeal or amendment of the Act or the Statute of Westminster as it applies to Australia, requiring a Commonwealth Act passed at the request or with the concurrence of the Parliaments of all the States (First Schedule, cl 15; Second Schedule, cl 15).

Definitions and commencement: the Schedules define key terms (First Schedule, cl 16; Second Schedule, cl 16) and provide commencement mechanisms: the requested Commonwealth Australia Act specifies commencement by proclamation (First Schedule, cl 17), while the UK Act version contemplates commencement by order of the Secretary of State (Second Schedule, cl 17(2)).

In summary, the Act and its Schedules create public rights and duties about who may legislate and how, remove foreign oversight mechanisms and appellate avenues, and introduce a mechanism by which State Parliaments can prescribe the form of future State constitutional laws.

The instrument contains no criminal offences, penalty schedules or administrative fines. Enforcement in the sense of the Act is legal and structural rather than penal: compliance is realised through legal effect and judicial application, not through regulatory penalties.

Judicial enforcement and legal effect: the key enforcement mechanism is the allocation of legal validity. For example, a law made by a State after commencement is not subject to UK disallowance, reservation or suspension (First Schedule, cls 8-9; Second Schedule, cls 8-9). Similarly, the disapplication of the Colonial Laws Validity Act 1865 (First Schedule, cl 3(1); Second Schedule, cl 3(1)) is a mechanism that changes the criteria by which Courts and authorities assess the validity of State laws made after commencement. Courts will therefore apply domestic doctrine consistent with those clauses when adjudicating challenges to State laws.

Appeals and finality: the Schedules remove the right to appeal to Her Majesty in Council from Australian courts in nearly all cases (First Schedule, cl 11; Second Schedule, cl 11). The effect of that removal is that the High Court and Australian appellate courts become functionally final in the Australian judicial hierarchy for matters not otherwise within the High Court's exclusive jurisdiction. The only enforcement‑relevant exceptions are transitional: appeals instituted before commencement and appeals for which leave was granted before commencement may proceed (First Schedule, cl 11(4); Second Schedule, cl 11(4)). Determination of whether a given proceeding falls inside those exceptions will be a matter for courts.

Interpretation and scope: the Schedules include interpretive clauses defining "appeal", "Australian court", "court", "decision", "Governor" and other terms (First Schedule, cl 16; Second Schedule, cl 16). The precise application of those definitions will determine enforcement scope. For example, the definition of "Australian court" excludes the High Court in the First Schedule (First Schedule, cl 16(1): "Australian court means a court of a State or any other court of Australia or of a Territory other than the High Court"). That definition shapes whether the s 11 removal of appeals to Her Majesty in Council affects decisions of particular courts.

No administrative enforcement agency: no clause creates an agency or administrative enforcement regime to police compliance. The Act relies on existing state and federal institutions, parliaments to make laws consistent with the new arrangements, and courts to interpret and apply them.

Procedural constraints as legal enforcement: the "manner and form" requirement (First Schedule, cl 6; Second Schedule, cl 6) is a preventive legal constraint: laws affecting the constitution, powers or procedure of a State Parliament are of no force unless made in the manner and form the Parliament prescribes. Compliance is enforced by courts when asked to adjudicate validity; failure to observe the prescribed manner and form results in legal invalidity.

Protection against repugnancy claims: the Schedules make express that State laws after commencement cannot be void on repugnancy grounds to English law or UK Acts, and the States may repeal or amend such UK Acts insofar as they are part of State law (First Schedule, cl 3(2); Second Schedule, cl 3(2)). That provision removes a ground of judicial invalidation that formerly operated through the Colonial Laws Validity Act; courts will therefore be constrained from invalidating State laws on those repugnancy grounds for laws made after commencement.

In sum, enforcement is achieved through the modification of the substantive and procedural rules applied by courts and by altering the legal architecture of external UK oversight and appeal routes. There are no express criminal or civil penalties created by the Act or its Schedules.

The Schedules explicitly describe interactions with constitutional instruments, pre‑existing UK statutes, State constitution Acts and the Statute of Westminster. These interactions are specified, limited and subject to preservation clauses.

Primacy of the Commonwealth Constitution and Commonwealth of Australia Constitution Act: the Schedules state that clauses expanding State legislative powers and removing UK legislative effect are subject to the Commonwealth of Australia Constitution Act and to the Constitution of the Commonwealth (First Schedule, cl 5; Second Schedule, cl 5). They also expressly provide that nothing in the relevant clauses operates to give effect to a provision of a State Act that would repeal, amend or be repugnant to the Australia Act being enacted, the Commonwealth of Australia Constitution Act, the Constitution of the Commonwealth or the Statute of Westminster 1931 (First Schedule, cl 5(b); Second Schedule, cl 5(b)). This means the requested measures are drafted to coexist with the higher constitutional text, preserving the constitutional hierarchy.

Statute of Westminster: the Schedules repeal certain provisions of the Statute of Westminster 1931 in so far as they are part of the law of the Commonwealth, a State or a Territory: specifically, sections 4, 9(2) and (3) and 10(2) (First Schedule, cl 12; Second Schedule, cl 12). At the same time, s 5 preserves the Statute of Westminster from being overridden in a way inconsistent with the Constitution, and s 15 sets a special procedure for repeal or amendment of the Act or the Statute of Westminster insofar as it applies to Australia (First Schedule, cl 15; Second Schedule, cl 15). Thus the Schedules selectively alter the application of the Statute of Westminster while also protecting it against incompatible State action.

Colonial Laws Validity Act 1865 and English law: the Schedules disapply the Colonial Laws Validity Act 1865 for State laws made after commencement (First Schedule, cl 3(1); Second Schedule, cl 3(1)), and remove the ground that a law is void for being repugnant to English law or UK Acts (First Schedule, cl 3(2); Second Schedule, cl 3(2)). That shifts the legal baseline for validity of State laws from an imperial standard to a domestic one, subject to the Constitution and other preserved instruments.

Merchant Shipping Act 1894: the Schedules repeal sections 735 and 736 of the Merchant Shipping Act 1894 insofar as they are part of State law (First Schedule, cl 4; Second Schedule, cl 4). The immediate legal effect is to remove particular merchant shipping provisions from the corpus of State law, though the Schedules do not on their face create recreative State or Commonwealth replacements.

State constitutional Acts: the Schedules expressly amend provisions of the Constitution Acts of Queensland and Western Australia to remove references to Signet, Great Seal of the United Kingdom and to alter text about Governors and sign manual procedures (First Schedule, cls 13-14; Second Schedule, cls 13-14). These are specific interactions where the requested Acts map onto existing State constitutional texts and remove references to United Kingdom instruments or procedures.

Manner and form and State law: section 6 of the Schedules interacts with a State Parliament's internal lawmaking procedures by conditioning the validity of laws respecting the constitution, powers or procedure of the parliament on compliance with such manner and form as the State may require (First Schedule, cl 6; Second Schedule, cl 6). That provision interacts with entrenched or procedural constraints contained in State statutes or constitutions and provides a mechanism for State Parliaments to create or maintain internal entrenchments.

Appeals and enabling UK enactments: the Schedules repeal UK Acts that provided for appeals to Her Majesty in Council insofar as those enactments are part of Australian law (First Schedule, cl 11(2)-(3); Second Schedule, cl 11(2)-(3)). The specific enactments listed include the Australian Courts Act 1828 (s 15), Judicial Committee Acts and the Colonial Courts of Admiralty Act 1890 (First Schedule, cl 11(3); Second Schedule, cl 11(3)). This shapes the appellate architecture by removing the statutory hooks that previously enabled external appeals.

Method of amendment/repeal: the Schedules provide that this Act or the Statute of Westminster insofar as they apply may be repealed or amended only by a Commonwealth Act passed at the request or with the concurrence of all State Parliaments, and only in that manner (First Schedule, cl 15(1); Second Schedule, cl 15(1)). They further provide that a Commonwealth Act repugnant to these instruments will be deemed to repeal or amend them to the extent of the repugnancy (First Schedule, cl 15(2); Second Schedule, cl 15(2)). However, s 15(3) preserves the ability of the Commonwealth to act pursuant to a constitutionally valid alteration effected by referendum under s 128 of the Constitution (First Schedule, cl 15(3); Second Schedule, cl 15(3)). This establishes a higher procedural barrier and a special intergovernmental interaction for amendment.

Interpretation clauses and exclusions: the Schedules define key terms and, notably, define "Australian court" to exclude the High Court for certain purposes in the First Schedule (First Schedule, cl 16(1)). That definition interacts with the scope of the s 11 abolition of appeals to Her Majesty in Council.

In short, the requested Acts are drafted to remove certain UK legal effects and appellate remedies while preserving the superior status of the Commonwealth Constitution and the Statute of Westminster to the extent specified, and to require special procedures for future alteration of the arrangement. Interaction with existing State constitutional Acts is direct and in some cases prescriptive (Queensland and Western Australia amendments).

The Victoria Act as provided contains its own endnotes. According to the endnotes in the supplied text, the Australia Acts (Request) Act 1985 was assented to on 6 November 1985 and came into operation on 6 November 1985 (Endnotes: Minister's second reading speech and General Information). The endnotes also state that there are no amendments made to the Australia Acts (Request) Act 1985 by Acts and subordinate instruments as at the date of publication (Endnotes: Table of Amendments). The explanatory details section in the endnotes contains no entries.

Within the Schedules themselves, the First Schedule is the text of the proposed Australia Act 1986, which includes a provision on commencement: "This Act shall come into operation on a day and at a time to be fixed by Proclamation" (First Schedule, cl 17(2)). The Second Schedule, being the text of the requested UK Act, sets different commencement mechanics: "This Act shall come into force on such day and at such time as the Secretary of State may by order made by statutory instrument appoint" (Second Schedule, cl 17(2)). These are internal commencement clauses in the requested Acts; their operation depends on subsequent proclamations or statutory instruments as appropriate.

The Schedules also contain clauses specifying a special methodology for repeal or amendment of the Act or the Statute of Westminster insofar as they apply to Australia. Clause 15 provides that repeal or amendment may be effected only by a Commonwealth Act passed at the request or with the concurrence of the Parliaments of all the States and only in that manner, except that changes effected by an alteration of the Constitution under s 128 are not limited (First Schedule, cl 15; Second Schedule, cl 15). That is an entrenchment-like procedural rule that fixes a higher bar for future change.

No further statutory amendment history is recorded in the supplied text. The endnotes assert there were no amendments to the Victoria Act up to the date of the version (Version No. 003 as at 9 August 2012). Any later amendments or litigation developments would not be recorded in the supplied material and are therefore outside the scope of this document.

The supplied Act text and endnotes do not record any cases, judicial decisions, or litigation history concerning the Australia Acts (Request) Act 1985 or the text set out in its Schedules. The Schedules include specific definitions and transitional exceptions for appeals to Her Majesty in Council (First Schedule, cl 11(4); Second Schedule, cl 11(4)), but the text does not reference any judicial determinations or case law.

Because the instrument operates primarily by recording requests and by setting out model texts for requested Commonwealth and UK Acts, litigation arising from the text would ordinarily be against actions taken under the enacted Commonwealth or UK Acts rather than against this Victorian request Act itself. The supplied text contains no judicial history, and the endnotes list no litigation or explanatory case annotations.

Legal practitioners working on matters arising under the operative Commonwealth Australia Act or the Australia (Request and Consent) Act passed elsewhere must consult judicial decisions interpreting those Acts and any subsequent amendments; however those are not present in the provided source and therefore are not discussed here. The definitions and transitional provisions in the Schedules, for example the special exceptions that preserve certain appeals to Her Majesty in Council (First Schedule, cl 11(4); Second Schedule, cl 11(4)), create discrete legal questions that could give rise to litigation, but no cases are cited or summarised in the supplied text.

The text contains several specific drafting features that produce operational or legal subtleties. These are points where practitioners and officials should pay close attention to wording, sequencing and transitional detail.

1. Request versus enactment: the Victoria Act (ss 3-5) simply records the State's request and consent; it does not by itself enact the substantive Australia Acts. The Schedules contain the model texts that the State requests the Commonwealth and UK Parliaments to enact. Practically, the legal effects in Australia depend on those other legislatures enacting the text; the Victorian Act alone is a formal intergovernmental instrument.

2. Commencement differences and transitional windows: the First Schedule (Commonwealth model) requires proclamation for commencement (First Schedule, cl 17(2)), while the Second Schedule (UK model) gives the Secretary of State power to appoint commencement by statutory instrument (Second Schedule, cl 17(2)). Those different mechanisms mean the timing of when particular clauses take effect can vary between the Commonwealth and UK enactments, which matters for transitional appeals and for which laws are "made after the commencement" for the purposes of disapplication of the Colonial Laws Validity Act (First Schedule, cl 3(1); Second Schedule, cl 3(1)).

3. Scope of "Australian court": in the First Schedule, the definition of "Australian court" excludes the High Court (First Schedule, cl 16(1): "Australian court means a court of a State or any other court of Australia or of a Territory other than the High Court"). The s 11 abolition of appeals to Her Majesty in Council therefore does not operate identically across all Australian courts unless the term is interpreted otherwise in context. Practitioners must track that definition when advising on whether an appeal to Her Majesty in Council was potentially available at the relevant time.

4. Narrow transitional exceptions for appeals: s 11(4) (First Schedule; Second Schedule) preserves only appeals instituted before commencement or where leave was granted before commencement. A party whose leave application was pending at commencement but not yet granted might thereby lose a potential appeal route. The precise temporal cut‑offs will be litigation points requiring careful docket and filing date analysis.

5. Manner and form entrenchment: cl 6 (First Schedule; Second Schedule) provides that laws respecting the constitution, powers or procedure of a State Parliament shall be of no force unless made in such manner and form as may from time to time be required by law made by that Parliament. This is a permissive entrenching device that allows a State Parliament to require particular procedures (for example super‑majorities or referenda) for changes to parliamentary powers. The "may from time to time" language is self‑referential and could be used to create or alter entrenchment requirements; legal challenges could arise over whether a State Parliament has validly prescribed or varied such requirements.

6. Preservation of the Commonwealth Constitution and Statute of Westminster: cl 5 (First Schedule; Second Schedule) preserves the primacy of the Commonwealth Constitution and related Acts. That means State legislation extended under cl 2 cannot lawfully repeal or be repugnant to the Constitution or the Commonwealth of Australia Constitution Act; any attempt to do so would face immediate constitutional invalidity. Practitioners must not assume the Schedules grant States unlimited powers; they are expressly constrained by these preservation clauses.

7. Appointment and termination of Governors: cl 7(3) (First Schedule; Second Schedule) excludes the appointment and termination of Governors from the general rule that Her Majesty's powers are exercisable only by the Governor. The text therefore preserves a residual Crown role in the appointment and removal process. Any State reform of the office of Governor touching this power should account for this exception.

8. Specific State constitutional amendments: the Schedules contain express amendments to the Constitution Acts of Queensland and Western Australia (First Schedule, cls 13-14; Second Schedule, cls 13-14). Those textual amendments remove references to Signet and Great Seal and alter specific subsections. Practitioners should check the exact textual changes when advising on those State constitutions.

9. Repeal/amendment procedure trap: cl 15 establishes a special method for repeal or amendment of the Act or the Statute of Westminster as they apply to Australia, requiring a Commonwealth Act passed at the request or concurrence of all State Parliaments (First Schedule, cl 15(1); Second Schedule, cl 15(1)). Practitioners need to be aware that normal Commonwealth legislative processes may be insufficient to repeal these instruments as to Australia absent the special intergovernmental concurrence, with the exception that changes effected by constitutional alteration under s 128 are unaffected (First Schedule, cl 15(3); Second Schedule, cl 15(3)).

10. Definitions control: the Schedules' definitions determine coverage for key terms such as "appeal", "decision", "court" and "Governor" (First Schedule, cl 16; Second Schedule, cl 16). Close attention to the definitions will be necessary in litigation or compliance advice.

These drafting points create specific legal consequences rather than theoretical risks. Practitioners should therefore map dates, filing statuses, existing instruments and State constitutional texts against the Schedules' language when advising clients or designing implementation steps.

Compliance for different actors is different in nature: for State Parliaments and Governments it is an exercise in legislative and constitutional housekeeping; for litigants and courts it requires procedural and substantive adjustments; for public authorities it requires updating legal references and processes.

For State Parliaments and Governments

• Make and record the formal request and consent: the Victoria Act itself records the State's request and consent (ss 3-5). Other States should ensure their own parliamentary instruments match the wording required for requests to the Commonwealth and the UK if they intend to adopt the same scheme.

• Review and, where necessary, amend State constitutional Acts: the Schedules propose specific amendments to the Constitution Acts of Queensland and Western Australia (First Schedule, cls 13-14). A compliance checklist should include a survey of State constitutions and statute books to identify and remove or revise references to Signet, the Great Seal of the United Kingdom, or other archaic Crown instruments, where the requested UK/Commonwealth Acts require.

• Establish or confirm "manner and form" requirements: cl 6 (First Schedule; Second Schedule) makes laws respecting the constitution, powers or procedure of a State Parliament of no force unless made in the manner and form prescribed by that Parliament. Each State should create a clear statute or parliamentary standing order that specifies what manner and form is required for those laws, including whether entrenchment (for example, super‑majorities or referenda) is intended and how it operates. The text contemplates that such "manner and form" laws may be made before or after commencement.

• Update executive processes relating to Governors: cl 7(5) identifies the Premier as the adviser to Her Majesty; cl 7(3) preserves the Crown's role in appointment/removal of Governors. Administrative processes should be reviewed to reflect that, in general, Royal powers will be exercised by Governors and that the Premier is the adviser to Her Majesty on State matters (First Schedule, cl 7(1)-(2), (5); Second Schedule, cl 7).

• Audit State references to UK statutory instruments and English law: cl 3(2) permits State Parliaments to repeal or amend UK Acts or subordinate instruments insofar as they form part of State law. States should prepare a statute‑by‑statute audit to identify laws that currently rely on UK statutes or subordinate instruments, in particular those made valid only by imperial connection, and determine legislative strategies for repeal, amendment or domestication.

For Commonwealth and Federal Agencies

• Coordinate commencement and proclamation steps: the First Schedule requires proclamation for commencement (First Schedule, cl 17(2)). Agencies responsible for proclamation and subsequent administrative steps must align timing with State governments and manage the transitional window for appeals and other temporal operational matters.

• Maintain constitutional supremacy: the Schedules preserve the Commonwealth Constitution and the Commonwealth of Australia Constitution Act (First Schedule, cl 5). Commonwealth agencies should ensure any exercise of power or legislative drafting remains consistent with those instruments.

For courts and litigants

• Audit pending appeals and leave applications: s 11 (First Schedule; Second Schedule) removes appeals to Her Majesty in Council except for appeals instituted before commencement or where leave was granted before commencement (First Schedule, cl 11(4)). Courts and practitioners must identify which appeals fall within the transitional exceptions. That requires careful tracking of filing dates, leave applications and petitions outstanding at the commencement date.

• Adjust appellate strategy and advice: with the removal of Her Majesty in Council as an appellate route, litigants should consider domestic appellate remedies. Counsel must advise clients about finality, potential new grounds for seeking High Court review (where available), and the changed cost‑benefit calculus of pursuing appeals.

For regulated industries and private actors

• Identify dependencies on UK law: merchant shipping is explicitly affected via the repeal of sections 735 and 736 of the Merchant Shipping Act 1894 insofar as they form part of State law (First Schedule, cl 4). Businesses should map regulatory obligations and rights that derived from those UK provisions and plan for domestic replacement or clarification from State or Commonwealth authorities.

General implementation steps for compliance

1. Inventory: compile a comprehensive inventory of State statutes, subordinate instruments, constitutional provisions and administrative practices that reference UK Acts, Signet, Great Seal or external appeals.

2. Drafting programme: for items requiring domestic replacement or adjustment, prepare legislative drafts and transitional arrangements so that removal of UK effect does not create gaps in governance or regulatory coverage.

3. Manner and form statute: each State should prepare or confirm a "manner and form" statute or standing orders that clearly define how laws respecting a State Parliament's constitution, powers or procedures will be made, including whether the State intends to entrench certain provisions and the mechanism for doing so.

4. Communications and training: inform judicial officers, court registries, legal practitioners and government legal teams about the change to appeals and to the grounds of repugnancy; update practice directions where courts require it.

5. Procure proclamations and UK instruments: coordinate with the Commonwealth and the UK for the precise timing of proclamations or statutory instruments fixing commencement dates, and ensure intergovernmental communication to avoid mismatch timing that could create legal uncertainty.

6. Audit pending litigation: identify appeals and petitions that might be affected by the commencement cut‑offs and take immediate procedural steps, including filing urgent applications where appropriate, in line with the transitional provisions.

7. Statute book maintenance: once the Commonwealth and UK Acts are in force, update consolidated statutes, annotation, legal databases and guidance materials to reflect the repeal of the listed UK enactments and the inapplicability of the Colonial Laws Validity Act to post‑commencement State laws.

8. Public law compliance: ensure that appointment procedures, advice to the Crown and the exercise of executive functions at State level are aligned with the changed allocation of powers (First Schedule, cl 7).

Practitioners advising clients should document dates of commencement, the precise wording of any "manner and form" requirements adopted by State Parliaments, and the status of any pending appeals to Her Majesty in Council. The Act and Schedules produce legal effects through reallocation and redefinition of authority; compliance is therefore largely documentary, procedural and legislative rather than regulatory or licensing centred.
