Veterinary Practice Regulation 2018

The regulation builds on a set of conceptual building blocks drawn from the Veterinary Practice Act 2018: restricted acts, registration information and the governance transparency of the professional board. Key concepts, as defined or operationalised in the regulation, are:

• Restricted act of veterinary science: The regulation implements the Act’s power to declare particular veterinary acts restricted by listing the acts in schedule 1, part 1.2 (s 5). The schedule provides granular descriptions of invasive acts and procedures, and includes age thresholds and species-specific rules. The regulation therefore operationalises the statutory boundary between acts reserved for registered veterinary practitioners and acts that may be performed by others.
• Prescribed circumstance for tooth cleaning: The regulation creates a narrow prescribed circumstance under the Act’s definition of delegated or permitted acts (s 5A). Tooth cleaning on animals other than horses is permitted where two conditions are met: the operator holds a Certificate IV in Veterinary Nursing, and the animal is anaesthetised. The provision explicitly excludes horses from the exception, reflecting the separate, detailed treatment of equine dentistry in the schedule (sch 1, item 18).
• Technical definitions and standards linkage: The schedule defines "anaesthetic agent" by reference to the medicines and poisons standard and schedule 4 or 8 medicines, categorising anaesthetic agents to include narcoleptic agents, analgesics, sedatives and tranquillisers (sch 1, s 1.1). "Microchip" is defined by functional, compliance and coding requirements and cross-references AS 5019-2001 and AS 5018-2001. The regulation explicitly disapplies Legislation Act s 47(6) to those standards, which changes how the standards are treated in the text and means practitioners or boards must consult the standards directly for technical compliance (sch 1, s 1.2).
• Information exchange for registration mobility: A "letter of professional standing" is defined in part 3 and required from applicants who are or have been registered in another State (s 6, s 7). The regulation prescribes that the information contained in such a letter is information the board may share with corresponding authorities under the Act (s 8, referring to Act s 139). This concept facilitates inter-jurisdictional verification of registration status and conditions.
• Governance transparency through AGM requirements: Part 4 sets minimum procedures for the board’s annual general meeting. The board must give practitioners at least four weeks’ notice (s 10) and provide specific documents at the meeting (s 11), including reports on the board’s activities, fees payable by practitioners and any proposed fee increases or remuneration paid to board members. The presiding member must take comments from registered veterinary practitioners on agenda items including fee and remuneration proposals (s 13). The president presides, or the board elects a presiding member in the president’s absence (s 12), and the AGM may run with another board meeting (s 14).

These concepts interact: the restricted acts (schedule 1) define professional boundaries that shape compliance and liability, while the registration and information-exchange rules (pt 3) regulate practitioner mobility and verification. The AGM provisions (pt 4) impose disclosure and participatory mechanisms on the board, aimed at practitioner oversight of financial and governance matters. The definition of technical terms and reference to external standards imposes a compliance requirement that reaches beyond the regulation itself to the referenced standards and to the medicines and poisons framework in the Medicines, Poisons and Therapeutic Goods Act 2008.

The regulation affects multiple distinct groups directly, and others indirectly, through the allocation of regulatory tasks and information flows. The primary affected parties identifiable from the text are:

• Registered veterinary practitioners: The schedule identifies the acts reserved to veterinary practitioners (s 5, sch 1). Practitioners are affected in three principal ways. First, they are the class of persons authorised to perform the listed restricted acts, thus the regulation delineates which procedures mark the professional boundary. Second, AGM provisions require the board to provide practitioners with notice and specific reports and to receive comments from practitioners on matters such as fees and board remuneration (ss 9-13). Third, practitioners who are applying for registration after being registered in another State interact with the letter-of-professional-standing requirement (s 7).
• Veterinary nurses and other practice staff: The regulation defines a narrow permitted circumstance for a person holding a Certificate IV in Veterinary Nursing to carry out tooth cleaning on animals other than horses, subject to anaesthesia (s 5A). This creates a specific task that a certified veterinary nurse may perform, altering the scope of tasks available to non-registered veterinary practitioners where the listed conditions are satisfied. The regulation does not otherwise expand permitted acts for non-registered persons; most invasive acts and species-specific procedures remain restricted.
• Applicants for registration from other jurisdictions: Persons who are currently or have previously been registered as veterinary practitioners in another State must include a "letter of professional standing" with their application for registration under the Act (s 7). The letter must include the length of registration, registration number and any conditions imposed by the relevant authority (s 6). The letter’s contents are prescribed information for sharing under the Act, enabling correspondence between the ACT board and other State authorities (s 8).
• The Veterinary Board (the board): The board is assigned active duties by the regulation. It must call and run the AGM within a prescribed timeframe and supply specified documents and notices to registered practitioners (ss 9-14). The board is also the recipient and holder of letters of professional standing and authorised to share the prescribed information with corresponding authorities under the Act (s 8). The board must ensure compliance with procedural requirements and maintain governance transparency on fees and remuneration.
• Animal owners, farmers and industries: The schedule prescribes age thresholds and species-specific restrictions for common husbandry and husbandry-like procedures such as castration, tailing, de-horning, mulesing and others (sch 1, pt 1.2, items 5-13). Those engaged in husbandry, farmers, stock handlers, animal enterprises and service providers, are therefore affected because certain routine procedures may not be legally carried out by non-registered persons when the statutory thresholds are met, redirecting the performance of those tasks to registered veterinary practitioners unless an express exception applies.
• Manufacturers and suppliers of microchips and compliance assessors: The microchip definition in sch 1, s 1.1(c)-(d) ties the device to AS 5019-2001 and AS 5018-2001 and requires a unique identification number compliant with the international coding scheme. Manufacturers and suppliers must ensure devices meet those standards if they are to be lawfully inserted into horses (sch 1, item 14, s 1.1). The regulation disapplies Legislation Act s 47(6) in relation to those standards, meaning the standards are not fully reproduced in the regulation text and must be consulted independently (sch 1, s 1.2).
• Relevant authorities in other States: The board may share prescribed registration information, including letters of professional standing, with corresponding authorities, per Act s 139 as given effect by s 8 of the regulation. This affects administrative workloads and information exchange responsibilities of interstate registration authorities.

Indirectly, the regulation affects insurers, compliance officers, landlords of veterinary premises and persons providing allied services because the allocation of acts to registered practitioners alters professional liability profiles, required supervision standards, and who can lawfully perform or be paid to perform particular procedures.

The regulation’s effects are uneven. Some measures are profession-facing and organisationally concentrated, such as the AGM disclosure obligations (affecting the board and veterinary practitioners). Other measures impose diffuse compliance effects across commercial and agricultural sectors, for example where certain husbandry procedures must be performed by registered veterinary practitioners for animals above stated age thresholds (sch 1, items 5-13). The requirement to obtain or consult external Australian Standards for microchips creates a compliance cost concentrated on manufacturers and purchasers of devices suitable for equine implantation.

The regulation creates explicit duties for the board and for applicants, and implicitly allocates rights, principally practitioners’ participatory and informational rights in relation to board governance. Key duties and rights set out in the regulation include:

Duties of the board

• Call an annual general meeting within four months after the end of a financial year (s 9). This is a timing duty tied to the financial year, not discretionary.
• Give notice of the AGM to each registered veterinary practitioner including date, time, place or website, agenda and where further information can be obtained (s 10(1)). The board must publish the notice on its website and may use any other method it considers appropriate (s 10(2)). The notice period is at least four weeks (s 10(3)).
• Provide attendees with the agenda, a report of the board’s activities prepared by the president, and a president’s report that details fees payable by practitioners, any proposed fee increases, and any remuneration paid or payable to board members (s 11(a)-(c)). These are documentary disclosure duties to facilitate practitioner oversight.
• Ensure the presiding member (the president or an elected person in the president’s absence) takes comments from registered veterinary practitioners at the AGM on agenda matters, specifically including proposed increases in fees payable by practitioners and proposed increases in remuneration to board members (ss 12-13).
• Maintain and handle registration information in a way that enables sharing prescribed information in a "letter of professional standing" with corresponding authorities under the Act (s 8, relating to Act s 139).

Duties of applicants

• An applicant for registration who is or has been registered in another State must include a "letter of professional standing" with their application, containing the length of registration, registration number and any conditions imposed by the relevant authority (s 6, s 7).

Rights and participatory entitlements

• Registered veterinary practitioners have a right to receive notice of the AGM with specified information, and a right to have the board take comments at the meeting on agenda items including fee and remuneration proposals (ss 10-13). The regulation assures practitioners a mechanism for expressing views on financial governance, though it grants no express veto or binding decision-making power to meeting attendees over board decisions.
• Practitioners applying from other jurisdictions have a right, implicitly, to have their prior registration status considered via the letter of professional standing. The letter is to contain specified factual information and is treated as prescribed information for inter-jurisdictional sharing (s 6, s 8). This facilitates the right to have registration applications properly assessed against the applicant’s history.

Constraints and qualifications

• The regulation does not on its face create statutory licences or authorisations; those legal effects derive from the Veterinary Practice Act 2018. The regulation’s role is to define which acts are restricted and to set administrative and procedural rules relevant to registration and board governance (s 5, sch 1).
• The permitted circumstance in s 5A does not remove the restriction entirely. It creates a conditionally permitted act by non-registered persons holding a specific qualification, and only for animals other than horses and only where the animal is anaesthetised. The prescriptive conditions narrow the right to perform that act to a sub-class of non-veterinary personnel under tightly defined circumstances.
• The technical standards for microchips and the definition of anaesthetic agent refer to external instruments, such as the medicines and poisons standard and AS 5018/AS 5019. Compliance with those standards is a necessary part of meeting the regulation’s substantive definitions (sch 1, s 1.1). The regulation disapplies Legislation Act s 47(6) to the two Australian Standards, which affects how those standards are accessed and relied on (sch 1, s 1.2).

Overall, the regulation imposes documentary and procedural duties designed to reinforce registration integrity and governance transparency, and it reserves a defined set of invasive and clinically significant acts to registered veterinary practitioners, with narrowly framed exceptions.

The regulation itself primarily defines and prescribes rather than specifying enforcement mechanisms or penalty levels in granular terms. Enforcement and penalties for contraventions of the Act and its regulations are established within the Veterinary Practice Act 2018 and broader statutory frameworks. The republication preface provides a practical enforcement detail: the value of a penalty unit for an offence against this law at the republication date is $160 for an individual and $810 for a corporation (Legislation Act 2001, s 133). That figure is the statutory monetary measure used to calculate pecuniary penalties where the primary offence provision prescribes penalties in penalty units.

What the regulation does that affects enforcement

• Establishes restricted acts: By listing restricted acts in schedule 1, the regulation creates the substantive boundary that enforcement agencies and the board use to determine whether an unauthorised person has performed a restricted act. The Act’s enforcement provisions (not reproduced in the regulation) will reference that list to identify contraventions (s 5 and sch 1).
• Creates an evidentiary and administrative trail: The requirement that applicants who were registered in another State provide a letter of professional standing (s 7), and the prescription that the contents of that letter are shareable information (s 8), facilitate interstate verification of disciplinary history or registration conditions. That strengthens the board’s ability to enforce registration conditions by widening the evidence base and enabling correspondence with other authorities.
• Prescribes technical standards and definitions that bear on culpability: The definitions of "anaesthetic agent" and "microchip" determine whether a procedure falls within a restricted act. For example, if an act involves an anaesthetic agent as defined by the medicines and poisons standard, it falls within sch 1’s prohibited list where relevant. Enforcement therefore depends on technical qualification against those defined terms (sch 1, s 1.1).
• Requires procedural transparency that informs enforcement risk assessment: The AGM disclosure obligations (s 11) require reporting of fees and board remuneration, allowing practitioners to be informed about governance decisions that may have regulatory consequences. Providing opportunity for practitioners to comment at the AGM (s 13) increases the visibility of contested governance matters that might otherwise give rise to compliance or disciplinary disputes. However, the regulation itself stipulates no immediate sanction tied to AGM participation.

What the regulation does not do

• It does not set penalties in the regulation text for unauthorized performance of restricted acts. Penalties for contravening the Act’s restrictions are in the Act, not in this subordinate instrument. The republished law’s front matter gives the penalty unit values but not the number of penalty units applicable to particular offences. Practitioners and advisers therefore must consult the Veterinary Practice Act 2018 for precise penalty schedules and the enforcement framework, including who prosecutes offences and what remedial or disciplinary options the board possesses.
• It does not prescribe administrative enforcement procedures such as inspection powers, audit processes or evidentiary burdens; those are matters for the Act and for the board’s operational policies.

Operational enforcement implications

• The board will rely on the schedule to determine whether a given act is reserved and to assess any complaint about unauthorised practice. The clarity of itemised acts and age thresholds reduces factual ambiguity but requires careful factual inquiry in borderline situations, for example when an operation is not expressly listed but may be arguably encompassed by item 15’s broad list of body cavities and insertion sites (sch 1, item 15).
• The reliance on external standards and the medicines and poisons standard means enforcement often requires technical expertise and documentary proof, for example to show that a person administered a schedule 4 or schedule 8 medicine as part of a procedure, which would place the act within a restricted category (sch 1, s 1.1). This increases the administrative investigative burden on the board and enforcing agencies.

In sum, the regulation defines the substantive contours of enforceable conduct but delegates the imposition and calculation of penalties to the Act and to standard penalty-unit arithmetic. The regulation strengthens the administrative capacity to enforce through information-sharing and procedural transparency, while technical references in the schedule require access to external standards and regulatory instruments to determine non-compliance.

The regulation is tightly cross-referenced to the Veterinary Practice Act 2018 and to other statutes and instruments. The text expressly integrates external standards and legislative provisions, creating dependencies in several directions:

Primary statutory linkage

• Veterinary Practice Act 2018: The regulation is made under the Act and repeatedly cross-references its provisions. Section 5 is framed to give effect to Act s 7(1) by declaring particular acts listed in sch 1 part 1.2 as restricted acts. Part 3 registration information gives legal effect to Act s 16(2)(h) by specifying application materials (s 7), and s 8 references Act s 139(1)(b) regarding the sharing of registration information. Practitioners and administrators must therefore read the regulation in the context of the Act for the full regulatory scheme, including questions of licence, disciplinary powers, offences and penalties.
• Legislation Act 2001: The republished law’s notes and endnotes rely on the Legislation Act’s interpretation provisions, editorial amendment powers and the valuation of penalty units (Legislation Act, s 115, s 117, s 127; and s 133 for penalty units). The regulation disapplies a particular Legislation Act provision to the Australian Standards used in the schedule (sch 1, s 1.2).

Other statutory instruments and standards

• Medicines, Poisons and Therapeutic Goods Act 2008: The schedule’s definition of "anaesthetic agent" refers to the medicines and poisons standard under that Act and includes schedule 4 and schedule 8 medicines as in force from time to time (sch 1, s 1.1). This ties who can lawfully administer particular agents to the scheduling regime under the Medicines, Poisons and Therapeutic Goods Act 2008. Compliance therefore requires concurrent consideration of medicines scheduling and any licensing or authorisation for administering scheduled medicines.
• Australian Standards AS 5018-2001 and AS 5019-2001: The microchip definition requires devices to comply with those standards. The regulation disapplies Legislation Act s 47(6) for those standards, meaning the standards stand as external technical instruments the text references but does not reproduce. Practitioners and suppliers must consult the current versions of those Standards to ensure devices meet the legal definition of a "microchip" under the regulation (sch 1, s 1.1, s 1.2).

Administrative and information-exchange frameworks

• Inter-jurisdictional registration frameworks: The regulation supports the Act’s inter-jurisdictional information sharing by prescribing the contents of letters of professional standing and making that information shareable under Act s 139 (s 6-8). This creates a statutory pathway for the ACT board and relevant authorities in other States to exchange registration and disciplinary information, connecting the ACT regulatory regime to national mobility mechanisms.

Practical interaction effects

• The requirement that an anaesthetic agent be determined by the medicines and poisons standard means that whether an act requires a registered veterinary practitioner depends on two axes: the procedural description in sch 1 and the regulatory classification of the drug used. This creates a compliance interface where veterinary practice law and medicines regulation jointly determine lawful conduct.
• The microchip provisions mean that the legal permissibility of inserting a microchip into horses references device compliance with external AS standards. Those standards are not part of the regulation text and must be purchased or accessed elsewhere, which affects manufacturers and purchasers who must factor the cost of accessing standards into compliance planning (sch 1, s 1.2).
• The regulation’s AGM transparency obligations operate within the board’s general governance obligations under the Act, but the regulation prescribes specific documentary disclosures. Practitioners exercising their rights under the AGM provisions may base requests or challenges on both the regulation and relevant governance provisions of the Act.

In short, the regulation is embedded in a web of statutory interdependencies. Compliance and interpretation require cross-referencing the Veterinary Practice Act 2018 for enforcement and overarching powers, the Medicines, Poisons and Therapeutic Goods Act 2008 for definitions of anaesthetic agents, and the Australian Standards referenced for technical device specifications. Administrators and practitioners must treat the regulation as part of a combined legal and technical framework rather than a stand-alone rulebook.

The republished regulation includes a concise record of amendments and commencement dates in its endnotes. The material changes recorded up to the republication date (16 July 2025) are:

• Original instrument: Veterinary Practice Regulation 2018, SL2018-28, notified on the legislation register 20 December 2018. Sections 1 and 2 commenced 20 December 2018, with the remainder commencing 21 December 2018 (legislation history).
• Transport Canberra and City Services Legislation Amendment Act 2023 (A2023-27): Notified 7 July 2023. Section 1 and section 2 of that amending Act commenced 7 July 2023. Part 6 of that amending Act commenced 14 July 2023. The amendment effected by A2023-27 that is recorded in the amendment history includes the insertion of s 5A concerning tooth cleaning (A2023-27 s 25) and amendments to schedule 1 part 1.2 items (A2023-27 ss 26-30). The republication notes that the schedule amendments involved renumbering of paragraph items (item 18 pars renum R2 LA).
• Veterinary Practice Amendment Act 2025 (A2025-20): Notified 2 July 2025. Section 1 and section 2 of that amending Act commenced 2 July 2025. Section 20 of that amending Act (which amends the "Notice of annual general meeting" provision, s 10) commenced 16 July 2025. The remainder of part 3 of the amending Act was awaiting commencement as at the republication date (endnotes 3 and 4).
• Editorial and republication matters: The republished law follows the Legislation Act 2001 part 11.3 editorial amendment rules, with editorial changes and formal amendments possibly made by the Parliamentary Counsel’s Office when preparing the republication. The republication notes explicitly that editorial changes do not change the law’s effect but have effect as if made by an Act commencing on the republication date (Legislation Act, ss 115 and 117).

Concrete points from the amendment history that are relevant to practice

• The insertion of s 5A (tooth cleaning exception) occurred by A2023-27 and is recorded explicitly in the amendment history (s 5A ins A2023-27 s 25). That change creates a new prescribed circumstance under the Act, expanding permitted practical activity for Certificate IV veterinary nurses in narrowly defined cases.
• The AGM notice provision (s 10) was amended by A2025-20 s 20, which was brought into force on 16 July 2025. The republished s 10 requires the board to publish the notice on its website and use other methods the board considers appropriate and sets a four-week minimum notice period. The textual content in the republication reflects the amending Act’s changes as of 16 July 2025.
• Schedule 1 has been amended by A2023-27 ss 26-30. The republication indicates renumbering and clarifying subdivision of schedule items. Practitioners must consult the current schedule in this republication to see the operative list of restricted acts.

The endnotes also list earlier republications (R1 and R2) and indicate that some amending laws or parts of amending laws may be uncommenced. The republished text should therefore be read together with the legislation register entries for the amending Acts to establish precise commencement and any provisions still awaiting commencement. The republication date of 16 July 2025 is the operative snapshot for the version provided here.

The republished regulation does not include any case law or judicial decisions. The text and endnotes do not identify any judicial consideration, interpretation, or litigation relating to the regulation’s provisions. The material provided is an authoritative legislative text with its legislative and amendment history, but there are no recorded court judgments, tribunal determinations or disciplinary decisions reproduced in the republished instrument.

Implications of the absence of recorded litigation

• Interpretive uncertainty resides with the text and the board’s administrative guidance: Because there is no judicial gloss in this republication, points of statutory ambiguity, such as the scope of items that describe invasive insertions into "any other synovial cavity" (sch 1, item 15) or the line between a permitted "tooth cleaning" under s 5A and a restricted "dental procedure" for non-horse species (sch 1, items 17-18; s 5A),must initially be resolved through administrative practice, board guidance, or, ultimately, through judicial or tribunal processes if contested.
• Future litigation could focus on technical and factual classification issues: Disputes are more likely to turn on factual questions (was the animal anaesthetised as defined; did the device comply with AS standards; did the act constitute insertion into a specifically listed cavity) or on cross-instrument interpretation (interaction with medicines scheduling and with external standards). The regulation’s reference to external instruments such as the medicines and poisons standard and the AS codes suggests that contested matters may require expert evidence and technical documents that courts would need to interpret.
• Practitioners and advisers lack precedent at present: Where the regulation introduces novel permissions or carve-outs, notably s 5A for Certificate IV veterinary nurses and the updated schedule entries from A2023-27, there is limited or no judicial guidance to flesh out borderline cases. This increases reliance on the board’s policy statements and on internal compliance protocols until case law develops.

Administrative and disciplinary processes under the Act, not reproduced here, provide the operative enforcement and adjudicative pathways for disputes about restricted acts, registration conditions and professional misconduct. Any litigant or practitioner seeking clarity should consult the board’s published guidance and the Veterinary Practice Act 2018, and monitor for future tribunal or court decisions that interpret the regulation’s terms.

The regulation contains several detailed, technical provisions that can create pitfalls for practitioners, practice managers and industry participants if not carefully followed. The following items are concrete compliance "gotchas" drawn directly from the regulation text:

Prescribed external standards are not reproduced

• The definition of "microchip" requires compliance with AS 5019-2001 and AS 5018-2001, and the regulation explicitly disapplies Legislation Act s 47(6) for those standards (sch 1, s 1.1, s 1.2). Practitioners may assume the standard details are set out in the regulation. They are not. The regulation’s note states the standards may be purchased from standards.org.au. Failing to obtain and apply the current versions could mean using a device that does not meet the statutory definition of "microchip" for equine implantation.

Nuanced species distinctions on dental work and tooth cleaning

• The schedule prohibits dental procedures on any animal other than a horse (item 17), while item 18 lists restricted dental procedures on horses but excludes certain activities from restriction, such as cleaning, rasping, grinding or cutting the horse’s teeth (item 18(f)-(g)). Meanwhile s 5A permits tooth cleaning on animals other than horses, but only if done by a Certificate IV veterinary nurse and if the animal is anaesthetised. The result is a layered picture where "tooth cleaning" can be permitted for non-equines in narrow circumstances but where many dental acts remain restricted for all species. Confusion may arise when distinguishing "cleaning" from a dental "procedure" that goes below the gum line or uses power tools. The statutory text draws the boundary but requires careful factual assessment.

Anaesthesia and medicines scheduling

• The schedule defines "anaesthetic agent" by reference to the medicines and poisons standard and includes schedule 4 and schedule 8 medicines (sch 1, s 1.1). Whether an act is "one that, according to current standards of veterinary science practice, to avoid harm or suffering should not be undertaken without anaesthetising the animal" (sch 1, item 2) may depend on the scheduling classification of particular drugs and the board’s view of "current standards of veterinary science practice." Practitioners administering medicines must therefore ensure the drugs they use are permitted for their class of practitioner and that any use of schedule 4 or 8 medicines complies with broader medicines regulation.

Microchip insertion limited to horses

• Item 14 makes "insertion of a microchip into a horse" a restricted act. The definition of microchip includes specific technical requirements. The effect is that microchipping horses requires attention to device compliance and registration status. Microchipping of other species is not listed in item 14, potentially leaving room for other legal instruments or practice standards to cover different species; do not assume microchipping of all species is treated identically.

Age thresholds and species-specific husbandry procedures

• The schedule sets precise age thresholds for several husbandry acts (mulesing of sheep 12 months or older, tailing of sheep 6 months or older, de-horning of cattle 12 months or older, de-horning of goats one month or older, castration age thresholds by species, sch 1, pt 1.2, items 5-13). Failure to note the exact age threshold could expose non-compliant persons to enforcement action. These are bright-line rules and require accurate record-keeping of animal ages when planning procedures.

Insertion caveats and emergency allowances

• Item 15 broadly restricts insertion into many body cavities, but lists several express exceptions including insertion into the mouth or oesophagus of an animal except insertion of a tube into the oesophagus of a horse; insertion into the rectum of an animal except for horses; and an emergency rumen puncture in cattle or sheep via the left flank to relieve acute bloat if the animal is seen by a registered practitioner as soon as practicable after puncture (sch 1, item 15(a)-(d)). These exceptions are narrow and conditional. Operators relying on emergency exceptions must ensure immediate follow-up by a registered veterinary practitioner to remain within the exception.

Information sharing and privacy implications

• The regulation prescribes the contents of letters of professional standing and designates that information as shareable under the Act (s 6-8). Applicants should expect interstate authorities to exchange that information. Practices handling such letters should implement processes to collect and transmit the required content accurately. The regulation does not itself set privacy compliance machinery, so practitioners must coordinate with privacy obligations under other laws when handling and transferring such information.

Board discretion in notice methods

• Section 10(2) requires the board to publish AGM notice on its website and allows the board to use "any other way the board considers appropriate." The board therefore has discretion over additional notice methods. Practitioners should not assume multiple channels will always be used; reliance on, for example, email or print notices without checking the board website could lead to missed AGM notices.

No express binding effect of AGM comments

• Although s 13 requires the presiding member to take comments from practitioners on agenda items such as proposed fee increases and remuneration, the regulation does not state that comments have any binding effect on board decisions. Practitioners may be surprised if their input does not change outcomes. The right is participatory and informational, not a decision veto.

Penalties are not contained in the regulation

• Users should not look for offence-level penalty units attached to each prohibited act within the regulation. The regulation sets the substantive restrictions and identifies prescribed information and procedural duties, but the Act contains the offence provisions and precise penalty schedules. The republication front matter gives the monetary value of a penalty unit at the republication date, but not the quantity of penalty units tied to particular contraventions.

These gotchas emphasise that compliance is often a matter of precise factual alignment with the schedule’s wording, reference to external standards and medicines scheduling, and procedural rigor in board and applicant practices. Practitioners and managers should not assume broad equivalence between colloquial descriptions of procedures and the regulation’s specific statutory terms.

To operationalise compliance with the Veterinary Practice Regulation 2018 as republished to 16 July 2025, entities and individuals should adopt action-focused steps aligned to the regulation’s substantive demands. The following checklist maps specific provisions to practical tasks, with cross-references to the regulation where relevant.

1. Determine whether a proposed procedure is a restricted act

• Consult schedule 1, part 1.2 in full to determine whether the activity is listed (s 5, sch 1). Pay careful attention to species, age thresholds, and anatomical specifics. For example, check items 5-13 for age-limited husbandry acts, item 14 for microchip insertion into horses, item 17 for prohibition of dental procedures on non-equines, and item 18 for specified equine dental acts that are restricted.

2. For borderline clinical acts, secure technical confirmation

• Where a procedure might involve an "anaesthetic agent", consult the medicines and poisons standard under the Medicines, Poisons and Therapeutic Goods Act 2008 to confirm the drug’s scheduling and whether the agent falls within the schedule 4 or schedule 8 categories referred to in sch 1, s 1.1. This is necessary because the use of scheduled medicines affects whether an act is restricted under item 2 or other items that reference anaesthesia.

3. If intending to perform or allow a non-registered person to perform tooth cleaning on non-equine animals, ensure strict compliance with s 5A

• Confirm the person holds a Certificate IV in Veterinary Nursing. Maintain a copy of the certificate in the personnel file. Ensure the animal is anaesthetised during the cleaning and keep contemporaneous records documenting anaesthesia and monitoring. s 5A permits the act only where both conditions are satisfied.

4. For microchipping horses, meet the technical device requirements

• Purchase and consult AS 5019-2001 and AS 5018-2001 to ensure the microchip device complies with the functional, transmission, and unique identification number requirements (sch 1, s 1.1(c)-(d)). Because Legislation Act s 47(6) is disapplied (sch 1, s 1.2), the standards are not available in the regulation text. Maintain device compliance documentation and supplier warranties.

5. Prepare complete registration applications and letters of professional standing where required

• If an applicant is or has been registered in another State, obtain from the relevant authority a letter of professional standing as defined in s 6. Ensure the letter contains the length of registration, the registration number and any conditions imposed by the relevant authority. Attach this to the registration application under the Act, s 16, as required by s 7.

6. Implement information management procedures for sharing prescribed information

• Because s 8 prescribes that information in letters of professional standing is information the board may share under Act s 139(1)(b), establish secure administrative processes for receiving, storing and disclosing that information to corresponding authorities. Ensure compliance with any relevant privacy obligations when transmitting registration information interstate.

7. Prepare for AGM obligations and practitioner engagement

• The board must call an AGM within four months after the end of the financial year (s 9). Publish the notice on the board’s website at least four weeks before the meeting, and use other methods as the board considers appropriate to reach registered practitioners (s 10). Prepare and distribute (at or before the AGM) the agenda, the president’s activity report for the financial year, and the president’s report detailing fees payable, proposed fee increases, and remuneration paid or payable to board members (s 11). Ensure the presiding member is ready to take comments on fee and remuneration proposals (s 13). Keep minutes documenting notices, distribution of reports and practitioner comments.

8. Maintain auditable records of all procedures that intersect with restricted acts

• For any act that may be restricted, maintain contemporaneous clinical records demonstrating practitioner registration status, competence, client consent, anaesthesia records where relevant, devices used and their compliance, and post-procedure follow-up. This both supports compliance and provides evidence if enforcement inquiries arise.

9. Train staff and review practice policies

• Update practice policies and staff training to reflect the list of restricted acts. Ensure that non-registration staff understand the narrow scope of tasks they may legally perform, especially where s 5A creates a conditional permission. Train reception and administrative staff to capture and maintain documentation for registration applications, letters of professional standing, and device compliance certificates.

10. Liaise with suppliers and external authorities

• Confirm that suppliers of microchip devices can demonstrate compliance with AS 5018-2001 and AS 5019-2001. If the practice acquires medicines that may be schedule 4 or schedule 8, verify lawful procurement and administration pathways under the medicines and poisons framework.

11. Monitor amendments and board guidance

• The regulation has been amended since 2018 and may be subject to further amendment. Monitor the legislation register for updates and any board-issued guidance or policy documents interpreting schedule 1 items. The republished law indicates certain amending Acts had uncommenced parts as at the republication date; maintain surveillance for commencement notices.

12. Where uncertain, seek clarification from the board or obtain legal advice

• If the classification of an act is uncertain, seek written or formal guidance from the board or obtain legal advice. Given the lack of litigation history in the republished law and the reliance on technical standards, prudence favours clarifying borderline questions before acting.

Following these steps aligns practice operation with the regulation’s textual demands: ensuring that restricted acts are performed by authorised persons, that conditional exceptions are narrowly applied, that registration mobility documentation is correctly collected and shared, and that the board fulfils its transparency and AGM obligations.
