Veterinary Chemical Control and Animal Feeding Stuffs Regulations 2006

The Regulations deploy a small set of regulatory building blocks that determine lawful chemical use in animals. These concepts appear repeatedly and structure compliance obligations.

• Registered vs unregistered veterinary chemical product (regulation 2(1)). A registered veterinary chemical product is the baseline assumed lawful product and its approved label drives permitted use. An unregistered product is any product not registered, including human pharmaceuticals and agricultural chemical products (regulation 2(1) definition). The Regulations treat unregistered products more restrictively (regulation 5).
• Label instruction, label restraint and label precaution (regulations 2(1) and 14(1)). The "approved label" for a registered product is the primary permission instrument. A label restraint (regulation 2(1)) restricts situations in which the product can be used. A label precaution (regulation 14(1)) is typically phrased with mandatory language ("do not", "must not", "only") and cannot be overridden by a vet’s written statement when authorising non-veterinarian use (regulation 14(5)(a)).
• Trade species and major trade species animals (regulation 2(1)). The Regulations distinguish between trade species animals (a broad class including livestock, poultry, bees and aquaculture, and animals producing food or used as food) and major trade species (cattle, sheep, pig, domestic chicken or bee). Different rules apply to major trade species, including specific record‑keeping requirements (regulation 17).
• Single animal concept (regulation 2(4)). The term "single" is defined narrowly: an animal is "single" if it is uniquely identified and individually dealt with by a veterinarian, or if it is the only animal from a group on which the product is being used on that property (regulation 2(4)). This concept creates an exception allowing use of unregistered products on a single animal (regulation 5).
• Withholding period (regulation 2(1); Part 2 Division 3). The withholding period is the minimum time that must elapse between the last use and slaughter, milk/egg/honey release or fibre collection to ensure residues fall below APVMA‑permitted limits. A withholding period may be stated on the product label or in the veterinarian’s written statement; where they differ, the vet’s statement prevails (regulation 18).
• Authorisations: Chief Veterinary Officer, Director and APVMA (regulations 7, 9, 22). Prior written permission of the CVO allows use contrary to label or use of unregistered products on trade species animals (regulation 7). Separate prior written approval of the Director is required before any vet may use or prescribe an antibiotic on bees, hives or equipment (regulation 9). APVMA permits exempt compliance with the Regulations where the product is possessed, used or supplied under an APVMA permit (regulation 22(2)). Note the Regulations define APVMA and cross‑refer to Commonwealth law (regulation 2(1) definition).
• Record and notice duties. Veterinarians must provide and retain a written statement in specified cases (regulation 10). Non-veterinarians receiving such statements must pass them to the usual carer of the animal (regulation 15), keep them for three years (regulation 16), and keep treatment records (regulation 17). Sellers must give written notice of a withholding period to buyers if the period has not elapsed (regulation 20).
• Enforcement and evidentiary tools. Inspectors may require production and take copies of statements and records (regulations 11, 16, 17, 19). The form of a certificate of appointment and certificate of analysis are prescribed (Forms 3 and 4; regulations 49-50), indicating administrative evidentiary procedures for enforcement.

These core concepts create a regime where label instructions and official written statements govern permissible use and the timeline for animal products entering the food chain. Cross‑references to other instruments (Medicines and Poisons Act 2014 for "prescribe", the Agvet Code for "supply" and "reserved chemical product") indicate layered compliance obligations across statutory instruments (regulation 2(1)).

Primary regulated actors

• Veterinarians. Subject to bespoke duties: they may not inject registered products unless the label authorises injection (regulation 3), must generally adhere to label instructions when treating trade species animals (regulation 4), and face obligations when using unregistered products (regulation 5). They must provide a written statement when prescribing, supplying or recommending an unregistered product or a registered product for use other than the label permits (regulation 10), and retain a copy for three years (regulation 10(3)). Veterinarians also need prior written approval from the Director before using antibiotics on bees (regulation 9) and may rely on CVO written permission to deviate from label instructions or to use unregistered products on trade species animals (regulation 7).
• Persons who are not veterinarians (animal owners, stockpersons, farm workers, other handlers). Their actions are constrained: they must use registered products only in accordance with the approved label except where a veterinarian’s written statement permits otherwise (regulation 12), cannot use unregistered products except where authorised by a veterinarian’s written statement (regulation 13 and 14(6)), must keep treatment records for three years (regulation 17), and must ensure animals are identifiable during treatment and withholding periods (regulation 19). Where a treated trade species animal is supplied while a withholding period is current, the supplier must give written notice to the buyer (regulation 20).
• Buyers of trade species animals. They receive compulsory written notice about withholding periods if the animal was treated and the period has not elapsed (regulation 20). Both buyer and seller must retain a copy of that notice for three years (regulation 20(3)).
• Inspectors and analysts. Inspectors may require production of statements and records and take copies (regulations 11, 16, 17, 19). The form for an inspector’s certificate of appointment is prescribed (Form 3; regulation 49). Analysts may issue certificates of analysis using Form 4 (regulation 50), which is tied to the Act’s section 47.
• Chief Veterinary Officer (CVO) and Director. The CVO can give prior written permission to expand authorised use of registered products or permit unregistered products for trade species animals (regulation 7). A Director’s prior written approval is required for any antibiotic use on bees by veterinarians (regulation 9). The Regulations do not define "Director" within their text; where these terms appear they carry operational decision‑making authority that affects practitioners and handlers.
• Commonwealth/Regulatory agencies. The APVMA is defined and the Regulations acknowledge APVMA permits as an exemption to compliance under regulation 22(2). The definitions reference the Agvet Code of Western Australia for "supply" and "reserved chemical product" and the Medicines and Poisons Act 2014 for "prescribe" (regulation 2(1)), signalling compliance obligations that extend beyond these Regulations.

Indirectly affected parties

• Food processors, retailers and consumers face downstream risk if withholding periods are not observed, but the Regulations allocate obligations upstream to veterinarians, handlers and sellers (regulations 18-21).
• Suppliers and manufacturers of veterinary chemical products: while the Regulations focus on use and supply in practice, label content drives permitted use (see definitions and regulation 3-4). Label restraints and precautions carry legal effects in use authorisations (regulation 14(5)(a)).

Who pays

• Individuals and businesses on whose conduct the Regulations impose duties bear compliance costs: veterinarians absorb record‑keeping and authorization burdens, non‑veterinarian animal owners must identify animals and maintain treatment records, and suppliers must notify buyers and keep notices.
• Monetary penalties for breaches are principally fines imposed on offenders (many set at $5,000; some record‑production breaches carry $1,000; see regulations throughout).

Who decides

• The Chief Veterinary Officer and a Director have delegated discretion to authorise departures from label-labelled use and to approve antibiotics on bees respectively (regulations 7 and 9).
• APVMA permit decisions by a Commonwealth authority operate as an alternative authorising mechanism under regulation 22(2).

Behaviour change required

• Veterinarians must align prescribing and supply with label instructions or document and retain deviations (regulation 10).
• Non-veterinarian handlers must follow label instructions unless a veterinarian’s statement permits a different use and must maintain records and animal identification during withholding periods (regulations 12-17 and 19-21).

The Regulations list precise actor roles and allocate costs and decision rights, veterinarians and animal handlers are the primary regulated cohort, inspectors and central authorities serve as enforcement and authorising actors, and APVMA and other statutes operate as cross‑cutting regulators.

This section summarises obligations the Regulations create for the main players and identifies express permissions and authorising rights.

Veterinarians , duties and limited permissions

• Injection limitation: Must not use, prescribe, supply or recommend a registered veterinary chemical product by injection unless the approved label contains instructions for injection (regulation 3). Penalty $5,000.
• Label compliance on trade species: Must not use, prescribe, supply or recommend a registered veterinary chemical product on a trade species animal other than in the way stated on the approved label, subject to limited exceptions (regulation 4(1)). Exceptions include: a label that contains instructions for a major trade species listed (regulation 4(1)(a)); use on a single major trade species animal or any non-major trade species animal (regulation 4(1)(b)); or use authorised via regulation 7 (regulation 4(1)(c)). Injection remains impermissible unless label permits (regulation 4(2)). Penalty $5,000.
• Unregistered products: May not use, prescribe, supply or recommend an unregistered product on a trade species animal unless used on a single trade species animal or authorised under regulation 6 (low risk) or regulation 7 (CVO permission) (regulation 5). Penalty $5,000.
• Low risk chemical exception: Veterinarians may use an unregistered product wholly constituted of a low risk chemical (bicarbonate soda, common salt, or a reserved chemical product under the Agvet Code) when a pharmacologically equivalent registered product with instructions for the species is not reasonably available (regulation 6).
• CVO authorisation: May use a registered product in a way inconsistent with label instructions, or use an unregistered product on a trade species animal, with prior written permission of the Chief Veterinary Officer (regulation 7).
• Veterinary practice scope: Must prescribe or supply only in the course of practising their profession and for dealing with a particular condition of an animal under their care (regulation 8). Penalty $5,000.
• Antibiotics on bees: Must obtain prior written approval of the Director before using, prescribing, supplying or recommending an antibiotic for use on bees, hives or apiary equipment (regulation 9). Penalty $5,000.
• Written statement obligation: When prescribing or supplying off‑label registered products or unregistered products for trade species animals under their care, veterinarians must give a written statement with specified content (species, product amount, dosage, frequency, treatment period, manner of administration, withholding period, animal identification, names of person supplied and owner) and retain a copy for three years (regulation 10(1)-(3)). Penalty $5,000 for the duty and $5,000 for failing to keep a copy.

Non‑veterinarian persons , duties

• Use of registered products: Must use registered products only as instructed on the approved label unless allowed by regulation 14 (regulation 12). Penalty $5,000.
• Use of unregistered products: Prohibited from using unregistered products on trade species animals except if using per a veterinarian’s written statement (regulation 13, with exception per regulation 14(6)). Penalty $5,000.
• Use per veterinarian’s statement: May use registered or unregistered products in ways different from label, if that use is stated in the veterinarian’s written statement (regulation 14(2),(6)). However, they cannot act contrary to a label restraint or label precaution, nor inject unless label permits (regulation 14(5)).
• Passing statements: If the person given the veterinarian’s statement is not usually the person in charge, they must give a copy to the person usually in charge (regulation 15). Penalty $5,000.
• Record-keeping: Must keep written statements for three years (regulation 16(1)) and treatment records for three years when using veterinary chemical products on major trade species or on authorised uses of non-major species (regulation 17(1)-(3)). Penalties for non-compliance: $5,000 for failing to keep required records, and $1,000 for failure to produce them on inspector’s request (regulation 16(1), 16(3), 17(5)-(5)).
• Identification duties: Must keep written records to ensure treated animals are identifiable during treatment and withholding periods (regulation 19(2)-(4)). Failure is a $5,000 penalty and inspector enforcement is available (regulation 19(4)-(6)).
• Buyer notification: Suppliers of trade species animals must give written notice to buyers disclosing the withholding period or date it elapses, product name or active constituent, animal identification and date of treatment when the withholding period has not elapsed (regulation 20). Both parties must retain the notice for three years. Penalty $5,000.

Common standards , withholding period and observance

• Applicable withholding period: Exists when stated on a veterinarian’s written statement or on the product label; if they differ, the veterinarian’s statement prevails (regulation 18).
• Observance: Persons in charge must not slaughter, harvest products for human consumption, or release honey for human consumption before the withholding period has elapsed (regulation 21). Penalty $5,000.
• APVMA exemption: Persons possessing, using or supplying a product in accordance with an APVMA permit are not required to comply with provisions of this Part (regulation 22(2)).

Enforcement and evidentiary provisions

• Inspectors’ powers to require production, inspect and copy statements and records are provided across regulations 11, 16, 17 and 19; failure to comply attracts fines (regulations 11(2), 16(3), 17(5) and 19(6)).
• Certificates are prescribed for inspector appointment (Form 3; regulation 49) and for certificates of analysis (Form 4; regulation 50), which relate to sections of the Act cited in the Regulations.

Rights and discretion

• Discretionary authorisations rest with named officials: the CVO (regulation 7) and the Director (regulation 9). APVMA permit holders are given statutory relief from Parts of the Regulations (regulation 22(2)).

All duties and rights summarised above are set out in the numbered regulations cited. Penalties cited are those the Regulations prescribe.

Monetary penalties

• The Regulations use fixed monetary fines as the primary sanction. Substantive breaches of use, supply and identity obligations typically attract a penalty of $5,000. Examples include: using registered products by injection contrary to label (regulation 3), using registered or unregistered products contrary to permitted conditions (regulations 4-5), failing to provide or retain required written statements (regulation 10), failing to keep animals identifiable or to provide buyer notices (regulations 19 and 20), and contravening withholding‑period observance (regulation 21).
• Less serious procedural non-compliance, such as failing to produce statements or records to an inspector on request, attracts a $1,000 fine (regulations 11(2), 16(3), 17(5), 19(6)).

Inspection and production powers

• Named procedural powers allow inspectors to require production, inspect and copy statements and records: regulation 11 allows an inspector to require a veterinarian to produce statements given under regulation 10 and to inspect/take copies; regulation 16 provides analogous powers for persons given such statements; regulation 17 grants inspectors power to require production of treatment records; regulation 19 permits inspection and copying of identification records. These provisions create routine administrative enforcement channels.

Evidentiary mechanisms

• The Regulations prescribe formal forms for the certificate of appointment of an inspector (Form 3; regulation 49) and the certificate of analysis (Form 4; regulation 50). Both forms are tied to sections of the Act (regulation 49 cites section 37(2); regulation 50 cites section 47). These prescribed forms standardise evidence in enforcement or prosecutorial processes.
• The veterinarian’s written statement required by regulation 10 is itself an evidentiary instrument: it must contain specific particulars (product, dosage, withholding period, animal identity, names) and be retained for three years (regulation 10(2)-(3)). Inspectors may obtain copies under regulation 11.

Authorisations and exemptions as enforcement levers

• Prior written permission from the Chief Veterinary Officer (regulation 7) and Director approval for antibiotic use on bees (regulation 9) are express administrative authorisations without statutory appeal or review mechanisms specified in these Regulations. The Regulations do not detail internal procedures for granting or refusing those permissions; they establish that possession of such prior written permission authorises use that would otherwise be prohibited.
• APVMA permits displace compliance obligations with respect to the Part containing use and supply rules (regulation 22(2)). The APVMA is a Commonwealth statutory regulator defined in regulation 2(1).

Potential enforcement pathways suggested by the Regulations

• Inspection and document production: Inspectors can compel statements/records and take copies (regulations 11, 16, 17, 19). Failure to comply may expose the individual to monetary penalties.
• Prosecution for substantive breaches: Monetary fines are specified for contraventions; the Regulations do not in themselves set out criminal procedure, but the existence of specified fines indicates liability under the Act and Regulations enforceable in court or by administrative process as per the Act (those procedures are not detailed in these Regulations).
• Use of prescribed certificates in proceedings: Form 3 and Form 4 provide standardized documentation that an inspector is properly appointed and that an analyst’s results have been recorded.

Limitations and gaps in the Regulations as enforcement tools

• The Regulations prescribe fines but do not specify ranges, alternative sanctions or regulatory penalties such as licence suspensions. No administrative penalty regime is set out in this instrument.
• The Regulations rely on other legal instruments for certain definitions and authorities (e.g., "prescribe" under the Medicines and Poisons Act 2014, "supply" per the Agvet Code), meaning enforcement will interact with those regimes, but procedural cross‑references for combined enforcement are not described here.
• The Regulations leave unspecified details about how written approvals from the CVO or Director are issued, recorded, reviewed or published. That creates implementation and transparency considerations.

In sum, enforcement is document- and evidence‑centric: inspectors obtain records and certificates, veterinarian statements and retained records provide the trail, and prescribed forms supply standardised evidentiary material. The monetary fines are fixed and stated within the Regulations.

The Regulations contain explicit cross‑references and implied interactions with Commonwealth and State law that shape compliance in practice.

Express statutory cross‑references

• APVMA and Commonwealth law. The Regulations define APVMA as the Australian Pesticides and Veterinary Medicines Authority continued by the Agricultural and Veterinary Chemicals (Administration) Act 1992 of the Commonwealth (regulation 2(1)). Regulation 22(2) establishes that a person possessing, using or supplying a veterinary chemical product in accordance with a permit granted by the APVMA is not required to comply with the provisions of this Part, creating a direct statutory exemption where a Commonwealth permit applies.
• Medicines and Poisons Act 2014. The term "prescribe", when used in relation to a veterinary chemical product, is defined to mean issuing a prescription "in accordance with the Medicines and Poisons Act 2014" (regulation 2(1)). Consequently, prescribing conduct by veterinarians is governed simultaneously by the state Medicines and Poisons framework and these Regulations. Compliance therefore requires following both instruments.
• Agvet Code of Western Australia. The definitions of "supply" and "reserved chemical product" are tied to the Agvet Code. The "low risk chemical" definition in regulation 6 includes a reserved chemical product within the meaning of the Agvet Code, indicating that classification under the Agvet Code affects eligibility for the low risk exception.

Implicit interactions and administrative dependencies

• The label of a registered veterinary chemical product is a central legal instrument that dictates permitted uses (regulations 3-4, 12, 14). Label content is typically determined through registration processes administered by APVMA or state regulators. Thus, product registration and labelling regimes under Commonwealth and state law substantially determine permissible use under these Regulations.
• The Chief Veterinary Officer and the Director exercise authorisations (regulations 7 and 9). Their decision‑making may be informed by other administrative law requirements in the Public Service, and their approvals create exceptions to label constraints or product registration status. The Regulations do not set out review or appeal procedures for those administrative decisions; review rights may therefore be found in administrative law or the parent Act rather than these Regulations.
• The formality of prescriptions and supply: regulation 8 requires veterinarians to prescribe or supply only in the course of practising their profession for dealing with a particular animal condition. This requirement interacts with professional conduct rules, licensing and possible disciplinary frameworks under veterinary practice legislation or standards (referenced indirectly by the 2022 amendment title "Veterinary Practice"), although the precise disciplinary mechanisms are not detailed in the Regulations.

Evidence and prosecution interface

• The Regulations prescribe Forms 3 and 4 to standardise proof of inspector appointment and laboratory analysis (regulations 49-50). These forms facilitate enforcement actions under the Act by providing standardised documentation admissible under the Act’s procedures. They also link to Act sections (section 37 and section 47) without reproducing the Act’s enforcement or evidentiary procedures.

Transitional and repeal interactions

• The Regulations repeal earlier State instruments (regulation 51) and preserve documents, approvals and records in force under the former regulations via transitional provision regulation 52. This prevents regulatory gaps for approvals previously granted under repealed instruments, but requires practitioners to be aware of which approvals continue in force under the new statutory framework.

Operational compliance with other regimes

• Practitioners must coordinate with the Medicines and Poisons Act 2014 for prescribing, with the Agvet Code for supply and chemical classification, and with APVMA permit processes for any activity under APVMA permit. The Regulations’ defined terms make that multilayered compliance explicit (regulation 2(1)).

The Regulations therefore do not operate in a vacuum; they allocate duties that sit on top of registration, labelling, prescribing and supply frameworks administered by Commonwealth and state law. Practitioners need to understand the intersecting compliance obligations in those instruments as a practical matter.

The Regulations include a compilation table and marginal notes indicating amendments and deletions. The compilation table provides the following chronology (as reproduced in the Regulations):

• 2006: Veterinary Chemical Control and Animal Feeding Stuffs Regulations 2006 were published 8 December 2006 and commenced the same day (compilation table).
• 2011: Veterinary Chemical Control and Animal Feeding Stuffs Amendment Regulations 2011 were published 30 August 2011; some provisions commenced on 31 August 2011 (compilation table; note r. 2 references).
• 2013: Amendment Regulations 2013 (Gazette 5 February 2013) effected multiple changes, including deletion of Parts 3 and 4 and Schedules 1-5 (see marginal notes and the text indicating "Parts 3 and 4 (r. 23-48) deleted: Gazette 5 Feb 2013 p. 830" and "Schedules 1-5 deleted: Gazette 5 Feb 2013 p. 830"). The 2013 amendment appears to have altered the structure of the instrument and removed earlier substantive content.
• 2017: Agriculture and Food Regulations Amendment (Poisons) Regulations 2016 Pt. 5 were published 17 January 2017 and took effect 30 January 2017 per the compilation table (see also marginal note indicating regulation 2 amended: Gazette 17 Jan 2017 p. 405).
• 2022: Agriculture and Food Regulations Amendment (Veterinary Practice) Regulations 2022, Statutory Instruments SL 2022/98, Pt. 7, commenced 18 June 2022 (compilation table). Many individual regulations display annotation "[Regulation X amended: SL 2022/98 r. 18]" indicating specific textual amendments across the instrument (for example regulations 2, 3-11, 12-22, 49-52 and Schedule 6 forms).

Textual deletions and consolidation

• The instrument as currently presented shows that Parts 3 and 4 (regulations 23-48) were deleted in 2013, and that Schedules 1-5 and Forms 1-2 have also been deleted (marginal notes). What remains are the preliminary Part 1, Part 2 (Divisions 1-4) on veterinary chemical products and withholding periods, Part 5 general provisions (regulations 49-50), and Part 6 repeal and transitional provisions (regulations 51-52) plus Schedule 6 Forms (Forms 3 and 4). The 2013 deletion therefore materially reduced the volume of the instrument and consolidated the regulatory focus.

Relevant annotations in the text

• Many provisions carry square bracket annotations indicating the dates and statutory instruments that amended them. For example, regulation 2 was amended by Gazette 5 Feb 2013 p. 830; 17 Jan 2017 p. 405; SL 2022/98 r. 18. Multiple regulations have the annotation "SL 2022/98 r. 18", indicating a coordinated 2022 amendment affecting many clauses.
• Certain marginal notes indicate when specific parts were deleted or renamed (for instance the heading of Division 1 was amended SL 2022/98 r. 18).

Transitional continuity

• Regulation 52 preserves existing certificates of appointment and existing approvals, declarations, records and other acts in force under the former regulations at the time these Regulations commenced. It provides that a certificate of appointment in the form prescribed under the former regulations is taken to be in the prescribed form for the purposes of section 37(2) of the Act (regulation 52(2)-(3)). This transitional clause avoids enforcement or evidentiary discontinuities when prior forms were replaced by Forms 3 and 4.

What the compilation table does not show

• The Regulations, as provided, do not reproduce any explanatory memorandum, second reading speech or commentary that explains the policy reasons for the 2013 or 2022 changes. The compilation table and marginal notes identify timing and instruments only; substantive rationale for amendments must be extracted from those amending instruments or parliamentary materials not supplied here.

In short, the Regulations have been amended at least in 2011, 2013, 2017 and 2022, with the 2013 amendment deleting whole Parts and Schedules and the 2022 amendment making multiple textual changes. Practitioners must consult the compilation table and marginal notes to determine which provisions were restructured or removed at each amendment date and to confirm current textual versions.

The Regulations themselves do not contain or cite any case law, reported decisions or litigation history. There are no judicial decisions, administrative determinations or tribunal outcomes reproduced within the instrument that interpret or apply these Regulations. Accordingly:

• The source contains no recorded litigation, prosecutions or decisions that interpret its provisions. There are no cases named or referenced in the text of the Regulations.
• What the Regulations do provide are procedural and evidentiary building blocks that would commonly feature in enforcement proceedings: the veterinarian’s written statement (regulation 10), prescribed Forms 3 and 4 (regulations 49-50) for inspector appointment and analyst’s certificate of analysis, and inspector powers to require production and to copy records (regulations 11, 16, 17, 19). These elements would likely be used as evidence in a prosecution or administrative action, but the Regulations do not give examples or precedents of such use.
• The Regulations cite sections of the parent Act (for example, regulation 49 references section 37(2); regulation 50 references section 47), indicating that enforcement and evidentiary processes would be tied to the Act’s provisions. The Enforcement and procedural mechanics in litigation (pleading, burden of proof, admissibility of Forms 3 and 4) would therefore depend on the Act and general evidentiary law rather than on the Regulations alone.
• For practical purposes, potential litigants or defence counsel would need to combine the Regulations with the parent Act and with the Medicines and Poisons Act 2014, the Agvet Code and APVMA determinations to construct litigation arguments. The Regulations do not themselves set out appeal or review pathways for discretionary decisions by the CVO or Director.

Because the Regulations are silent on litigation history, anyone preparing litigation‑level advice or anticipating enforcement should:

• Extract the statutory offences, penalties and documentary requirements from the Regulations (notably those enumerated in regulations 3-5, 8-11, 12-21), and then
• Review the parent Act, administrative law principles and any contemporaneous cases under the parent Act to determine procedural rights, defences, and evidentiary standards.

In the absence of recorded precedent within the Regulations, advice must therefore be built from the text of the Regulations and from the Act and related regimes.

The Regulations contain a number of drafting features and intersections that can catch practitioners and regulated persons unprepared. The following points identify concrete traps and friction points that the text creates.

1. The veterinarian’s written statement prevails over the product label for withholding periods (regulation 18(2)). While labels generally control permitted use, regulation 18(2) states the written statement will determine the applicable withholding period where label and statement differ. Practically this means a veterinarian’s own instructions can lengthen or shorten the withdrawal timeline for food products; however, veterinarians should be cautious given that the label still governs other use restrictions and precautions.

2. Injection prohibition is strict (regulations 3 and 4(2)). Even a veterinarian cannot use a registered product by injection unless the approved label authorises injection (regulation 3). Regulation 4(2) reinforces that subregulation (1) does not permit injection unless the label allows it. The distinction between “use by injection” and other administration routes is therefore decisive.

3. "Single" animal exception is narrow (regulation 2(4) and regulation 5). The unregistered product exception for veterinarians is confined to a “single trade species animal” as defined. The "single" concept requires unique identification and individual treatment by a vet, or being the only animal in the group on that property on which the product is used. Misapplying the single‑animal exception risks a $5,000 penalty.

4. "Prescribe" and "supply" are defined by other statutes (regulation 2(1)). The meaning of "prescribe" is anchored to the Medicines and Poisons Act 2014 and "supply" to the Agvet Code of Western Australia. Compliance therefore requires cross‑checking those instruments. Failure to do so may produce technically non‑compliant prescriptions or supplies.

5. Low risk chemical carve‑out hinges on availability of a pharmacologically equivalent registered product (regulation 6(2)(b)). The veterinarian must judge that a pharmacologically equivalent registered product with instructions for the species is not reasonably available. The Regulations do not define “reasonably available”, creating potential dispute risk about supply chain realities and professional judgement.

6. Label restraints and label precautions are legally active (regulations 2(1) and 14(5)(a)). Even where a veterinarian’s written statement authorises non‑label use, a person, other than a vet, cannot act contrary to a label restraint or label precaution (regulation 14(5)(a)). This can frustrate attempts to rely on a vet’s instruction to override explicit label "must not" statements.

7. Antibiotic use on bees requires Director approval (regulation 9). This is an absolute precondition for veterinarians; the Regulations do not define the term "Director" in their text. Practitioners must find the statutory or administrative source that defines or locates the Director to obtain lawful approval. Acting without that approval attracts a $5,000 fine.

8. Records and notice retention periods are three years across several obligations (regulations 10(3), 16(1), 17(3), 19(4), 20(3)). Non-compliance attracts significant fines. Records must be producible to inspectors and are likely to be central in enforcement matters.

9. APVMA permit creates an exemption (regulation 22(2)) but the Regulations do not set out how APVMA permits interact with State enforcement practices in detail. A person operating under an APVMA permit should nonetheless be able to produce the permit to inspectors and should verify that the permit explicitly covers the activity at issue.

10. Divisions deleted and forms removed: earlier Parts 3 and 4 and Schedules 1-5 were deleted (marginal notes). If a practitioner relies on an older version of the Regulations, they must confirm that any previously relied content remains in force under transitional provisions (regulation 52 preserves some existing approvals) or has been repealed.

11. Sanctions are monetary only in the text; there are no explicit licence suspensions or administrative penalty regimes set out here. Enforcement therefore appears to proceed via inspections and prosecution for statutory offences under the Act and Regulations; the absence of alternative regulatory remedies may limit enforcement discretion or create reliance on prosecutorial outcomes.

12. Forms 3 and 4 are the prescribed formats for inspector appointment and certificate of analysis (regulations 49-50). Inspectors and analysts must use these forms when invoked in proceedings, evidence, or inspections. Failure to use prescribed forms could be argued to affect the validity of actions, although the Regulations do not state consequences for incorrect form usage.

13. The Regulations often reference the "owner" and "person in charge" and explicitly extend owner to someone in charge while owner is absent (regulation 2(3)). This matters for obligations like giving notice, because the person giving or receiving a statement may not be the owner, but still bears duties (e.g., passing a veterinarian’s statement to the person usually in charge is mandatory under regulation 15).

These concrete textual features create compliance traps that require procedural discipline around labelling, record keeping, seeking prior written authorisations and understanding cross‑statutory definitions.

This checklist sets out practical steps a veterinarian practice, farm operator, or supplier should take to satisfy the Regulations as currently framed. Each step cites the relevant regulation(s) to show the legal basis for the action.

For veterinarians

1. Check the approved label before each use, especially before injecting a product. Do not inject a registered product unless the label contains instructions for injection (regulation 3). Similarly, do not use a registered product on a trade species animal other than as the label allows unless you meet an exception in regulation 4.

2. Limit use of unregistered products. Use an unregistered product on a trade species animal only if the animal is a single trade species animal as defined (unique ID and individual treatment), or you have prior written permission from the CVO under regulation 7, or the product qualifies as a low risk chemical and no pharmacologically equivalent registered product is reasonably available (regulations 5-6, 7).

3. Maintain and provide a veterinarian’s written statement when required. When prescribing, supplying or recommending either off-label registered products or any unregistered product for a trade species animal under your care, give the person receiving the product a written statement that includes all items listed in regulation 10(2) (species, amount, dosage, frequency, treatment period, manner of administration, withholding period, animal identification, names and owner address). Keep a copy for three years (regulation 10(3)).

4. Respect the antibiotic/bee restriction. Obtain prior written approval from the Director before using, prescribing, supplying or recommending any antibiotic for bees, hives or apiary equipment (regulation 9).

5. Ensure prescriptions and supplies occur in the course of practising your profession and relate to a particular condition of an animal under your care (regulation 8).

6. If you intend to use a registered product in a way contrary to its label (other than injection), or wish to use an unregistered product on trade species animals, apply for prior written permission from the Chief Veterinary Officer and document the permission (regulation 7).

7. Be able to produce written statements on request. An inspector may require you to produce the statement under regulation 11(1). Failure to do so attracts a $1,000 penalty (regulation 11(2)).

For non‑veterinarians (owners, handlers, suppliers)

1. Adhere to label instructions. Use registered products only as the approved label directs unless you have a written statement from a veterinarian authorising otherwise (regulations 12 and 14).

2. Obtain and keep the veterinarian’s written statement when following off‑label or unregistered product prescriptions. If you are not usually in charge of the animal, give a copy to the person who is (regulation 15). Keep the statement for three years (regulation 16(1)).

3. Keep treatment records. For major trade species and authorised uses on non-major species, keep records of product used, identification details, dosage and administration dates for three years (regulation 17(1)-(3)). Be prepared to produce them to inspectors (regulation 17(4)-(5)).

4. Ensure animals are identifiable during treatment and withholding periods. Maintain written records to that effect and retain them for three years (regulation 19(2)-(4)). Identification may be by individual ID or as part of a group where applicable (regulation 19(3)).

5. Notify buyers when selling treated trade species animals whose withholding periods have not elapsed. Provide written notice with the withholding period (or date it elapses), product name (or active constituent), animal identification and date of treatment, and keep the notice for three years (regulation 20(2)-(3)).

6. Observe withholding periods. Do not slaughter animals, harvest milk/eggs/wool/fibre, or release honey for human consumption before the relevant withholding period has elapsed (regulation 21).

Administrative and cross‑regulatory compliance

1. Align prescribing and supply practices with the Medicines and Poisons Act 2014 and the Agvet Code where relevant. The Regulations define "prescribe" by reference to the Medicines and Poisons Act 2014 and refer to the Agvet Code for "supply" and "reserved chemical product" used in regulation 6 (regulation 2(1)). Ensure prescriptions and supplies meet the standards and record-keeping required by those instruments.

2. If relying on a pharmacological equivalence justification for low risk chemical use (regulation 6), document the unavailability of an equivalent registered product and the rationale that it is not "reasonably available". Keep contemporaneous evidence of efforts to source registered products.

3. If operating under an APVMA permit, retain the permit and be prepared to present it to inspectors. Regulation 22(2) exempts persons acting in accordance with APVMA permits from some Part requirements; keep the permit on the premises and a description of the activity it authorises.

4. Store records and statements for three years and index them so they are retrievable on inspection. Inspectors can require production and take copies (regulations 11, 16, 17, 19); failure to produce records can attract penalties.

5. If using a product for a use not stated on its approved label but authorised by the CVO or Director, retain the prior written permission and ensure the veterinarian’s documentation aligns with the CVO/Director permission. The Regulations require that CVO permission be prior and written (regulation 7).

Practical checklists and templates

• Implement templates for regulation 10 statements that capture all required elements (species, amount, dosage, frequency, treatment period, administration manner, withholding period, animal ID, person and owner name/address). Retain copies for three years.
• Maintain a treatment log keyed by animal ID or group ID with product name, batch number if available, date/time, dose and prescriber, to meet regulation 17 and 19 obligations.
• For sellers, create a standard buyer notice template that includes withholding period or its elapse date, product name/active constituent, animal ID and treatment date, and retain copies.

Training and governance

• Train staff and associates on the narrow definition of "single" animal, the restrictions on injection, the need for prior approvals, the definition of trade versus major trade species, and the retention and production duties.
• Implement an audit trail for approvals from the CVO, Director or APVMA permits; store them centrally and link them to the relevant treatment records.

In sum, compliance requires procedural discipline: confirm label instructions, secure and retain veterinarian statements, maintain three‑year document retention, ensure animal identification during withholding periods, use prescribed forms where relevant, and obtain prior written approvals for deviations. Each of these steps implements specific regulations cited above.
