What it does
This instrument, titled Veterans’ Entitlements (Warlike Service) Determination 2019, declares which specified Defence Force service is to be treated as "warlike service" for the purposes of the Veterans’ Entitlements Act 1986. The instrument is made under subsection 5C(1) of that Act (see Authority, s 3), and Schedule 1 is the operative list that does the classification work (see Warlike service, s 6 and Schedule 1). The operative rule in Schedule 1 (paragraph 1) states the legal test in plain terms: for the purposes of the definition of warlike service in subsection 5C(1) of the Act, service in the Defence Force in an operation mentioned in an item of the Schedule is warlike service under the Act if the service (a) is in the area of operation mentioned in that item and (b) occurs during the period mentioned in that item.
Mechanically the Determination performs a single administrative-legal function: it maps named military operations, with defined geographic boundaries and temporal windows, onto the statutory label "warlike service" used in the Act. The Schedule contains 32 numbered items (Items 1-32). Each item provides an operation name or identifier, a short description of the nature of the operation, an area of operation (expressed variably as a country, territorial sea, superjacent airspace, coordinates or a polygon) and specific start and end dates (or an open-ended "on and after" commencement).
The Determination does not itself grant benefits, impose duties, create penalties, or specify administrative procedures for determining or paying entitlements. The instrument’s sole legal effect is classificatory: once a person’s service falls within an item’s geographic and temporal bounds and the person’s service is "service in the Defence Force", that service is to be treated as warlike service for the purposes of the Act. The instrument therefore changes who is captured by the statutory definition by setting the spatial and temporal boundaries that trigger whatever consequences the Act attaches to "warlike service". The instrument also contains formal definitions used within the instrument: "Act means the Veterans’ Entitlements Act 1986" and "NATO means the North Atlantic Treaty Organization" (see Definitions, s 5).
