Veterans' Entitlements (Special Disability Trust) Guidelines 2021

The Guidelines establish definitional and decision‑making concepts that guide both trustees and the Commission. Key concepts appear in Part 1 and are used throughout Parts 2-4.

• Approved fees (s 5): defined as fees charged for the daily care of the principal beneficiary or itemised ancillary fees related to the beneficiary’s care and accommodation, but only where those fees are charged by (a) a registered provider as defined in subsection 11(2) of the Aged Care Act 2024 providing a service in the service group specified in paragraph 8(3)(b) of that Act, or (b) an institution, hostel or group home for which Commonwealth/State/Territory funding is provided under an agreement nominated by the Commission under subsection 52ZZZWA(3) of the Act. The definition ties the concept of approved fees to two external sources: the Aged Care Act 2024 and nominated inter‑governmental funding agreements (s 18). Consequently, what counts as an approved fee depends on the contemporaneous content of those instruments.
• Trust (s 5): for these Guidelines, “trust” means a trust that would be a special disability trust if not for a contravention of a requirement of Division 11B of Part IIIB of the Act. The instrument therefore focuses on trusts that are candidate special disability trusts but for one or more contraventions; it does not redefine “special disability trust” itself.
• Waiver notice (s 5): the term adopts the same meaning as in paragraph 52ZZZWH(1)(a) of the Act; the Guidelines specify when the Commission may give waiver notices, conditions to attach, and periods during which they operate (Parts 3 and 4).
• Reasonable care needs (ss 6-7): the Guidelines define “care need” as a reasonable care need if one of the enumerated conditions applies,if it arises from the beneficiary’s disability, is for medical/dental costs, or is to pay approved fees, and the need is met in Australia (s 7). This is a tightly circumscribed list intended to delimit permitted uses of trust income and assets that directly respond to disability‑related care.
• Reasonable accommodation needs (ss 8-10): the Guidelines set out specific rules about property and accommodation. An accommodation need is reasonable if it arises from the disability, or if it satisfies the criteria in subsections (2)-(4) (s 9). These criteria treat acquisitions and rentals from non‑immediate family members as permissible, allow trust‑owned property to be occupied by the beneficiary or rented at market value with rent used for the beneficiary, and permit maintenance and payment of rates/taxes subject to the same occupancy or market‑rent test (s 9). The Guidelines expressly exclude acquisitions or rentals from immediate family members (s 10).
• Other purposes primarily for beneficiary (ss 11-13): the Guidelines classify other permissible purposes that are not primary care or accommodation needs. The decision‑maker must consider whether expenditure not related to reasonable care/accommodation nevertheless benefits the beneficiary’s health, wellbeing, recreation, independence and social inclusion (s 12). By contrast payments to immediate family members, or payments to a carer other than for reasonable care needs or the other purposes identified in s 12, are to be treated as not primarily for the beneficiary (s 13).
• Waiver rules (Part 3, ss 14-17): set out the conditions under which the Commission may give waiver notices, including a de minimis rule for unauthorised use of trust funds (s 15(1)(d): not more than $5,000 in a financial year can be used for a purpose other than those permitted), and specific circumstances where transfers caused by court proceedings, prior trusts or delayed transfers may be waived (s 15(5)). The Commission must also consider statutory declaration requirements where the trustee’s deed cannot be varied and the trust was created before 2011 (s 16).
• Nominated agreements (s 18): lists bilateral NDIS agreements (each State and Territory) and the National Health Reform Agreement, as the agreements nominated for the purposes of subsection 52ZZZWA(3) of the Act. This list anchors which funding arrangements qualify institutions for the approved fees definition.

The Guidelines therefore operate as a classificatory regime: they translate broad statutory requirements in Division 11B into a set of practical, often quantitative or categorical tests trustees and the Commission must apply when deciding permitted trust uses and waiver eligibility.

The Guidelines explicitly address multiple parties and their interactions. The principal affected actors are:

• Trustees of special disability trusts (and trusts that would be special disability trusts but for contraventions) , the Guidelines speak directly to trustees by prescribing what the trust’s primary purposes must be and by setting the framework for the Commission to give waiver notices (see s 14). Trustees are the immediate duty‑holders for complying with Division 11B and the Guidelines’ elaboration of permissible expenditure (ss 6-13). The Guidelines also impose procedural obligations on trustees as conditions in waiver notices, for example statutory declaration requirements (s 16).
• The principal beneficiary of the trust , the Guidelines define the permissible purposes in terms of the principal beneficiary’s reasonable care and accommodation needs and other benefits primarily for that beneficiary (ss 7, 9, 12). The substantive scope of what the beneficiary can receive from the trust is shaped by these tests.
• The Commission , the Guidelines repeatedly vest decision‑making power in the Commission to give waiver notices, decide conditions, and set periods of effect (ss 14-17). The Guidelines therefore regulate administrative discretion rather than create a private right.
• Immediate family members , the Guidelines restrict transactions with immediate family: property acquired or rented from an immediate family member cannot be a reasonable accommodation need (s 10); payments to immediate family are a relevant factor for determining whether other purposes are not primarily for the beneficiary (s 13(a)). The Guidelines therefore impose limits on related‑party transactions using trust assets.
• Registered providers and institutions funded under specified agreements , the approved fees definition (s 5) identifies providers under the Aged Care Act 2024 and institutions receiving Commonwealth/State/Territory funding under nominated agreements (s 18) as permissible payees for approved fees. This affects residential care providers, hostels and group homes because their funding arrangements determine whether their charges qualify as "approved fees".
• Transferors and prior trusts , the waiver regime recognises transfer timing and prior trust structures when assessing contraventions under paragraph 52ZZZWE(1)(b) of the Act. The Commission may waive contraventions where assets were transferred in the course of court proceedings, where there was an intended handover to a special disability trust but timing/mistakes occurred, or where a prior trust failed to qualify for reasons beyond the transferor’s control (s 15(5)).
• Government agencies responsible for related instruments , because the Guidelines draw on the Aged Care Act 2024, NDIS SDA Rules 2020 and nominated bilateral agreements, agencies responsible for those instruments affect the legal landscape and therefore indirectly affect trustees and providers (s 5, s 9(5), s 18).

Who pays and who benefits: trustees control trust assets that pay for the beneficiary’s needs; the beneficiary gains through permitted expenditure categories; providers (approved providers, hostels, group homes) may receive fees set out as “approved fees” provided they meet the instrument‑linked criteria; immediate family members are explicitly limited as potential recipients. The Commission pays no monetary costs but bears administrative costs in processing waiver applications and enforcing compliance; trustees bear compliance and evidence‑gathering costs.

The Guidelines also create differential treatment based on trust vintage and deed amendability. Trusts created before 1 January 2011 with unvaryable deeds are treated specially regarding waiver periods and statutory declaration requirements (ss 15(4), 16(2)-(3), 17(4)-(6)). That produces different decision processes and potentially different administrative burdens for trustees depending on their trust’s creation date and whether the trust deed can be varied.

The Guidelines do not create criminal offences; instead they allocate duties and shape administrative rights under the Act. The central duties and rights arising from the Guidelines are administrative and fiduciary in nature.

Duties of trustees:

• Duty to ensure primary purpose of the trust is to meet the reasonable care and accommodation needs of the principal beneficiary, as interpreted by the Guidelines. This requirement is the one the Guidelines are intended to assist the Commission to apply, by specifying what counts as reasonable care needs (s 7) and reasonable accommodation needs (s 9). Trustees must align trust expenditure with those categories.
• Duty to avoid acquiring or renting property from immediate family members if the acquisition or rental is presented as a reasonable accommodation need (s 10). The Guidelines make such transactions per se not reasonable accommodation needs.
• Duty to ensure any expenditure described as approved fees meets the two‑part definition (s 5): it must be a daily care or related itemised fee, and it must be charged by an eligible provider (either a registered Aged Care Act 2024 provider in that service group, or an institution funded under a nominated agreement).
• Duty to maintain evidence the Commission may require. If trustees seek a waiver, the Commission may require statutory declarations stating that the trust is a special disability trust and that trustees will comply with Subdivision A of Division 11B of Part IIIB of the Act (s 16(3)). Trustees of trusts created between 20 September 2006 and 1 January 2011 with unvaryable deeds may be required to declare compliance with section 52ZZZWB before 1 January 2011 (s 16(2)(b)(ii)-(3)).
• Duty to comply with any conditions attached to a waiver notice. Section 16(1) requires the Commission to consider including a condition that the waiver ceases if trustees cease to comply with conditions.

Rights and administrative procedures:

• Right to apply for a waiver of contraventions. The Commission may give a waiver notice if satisfied of certain matters (s 15(1)). Trustees have the right to apply for extensions to waiver periods (s 17(3)) and to be informed of conditions attached to waivers (s 16).
• Eligibility for waiver when contraventions are small. The Guidelines create a monetary threshold that can support a waiver: contraventions involving use of income and assets for non‑permitted purposes do not automatically preclude a waiver if the total non‑permitted use in the financial year does not exceed $5,000 and, considering all circumstances (including frequency), the requirement should be waived (s 15(1)(d)(i)-(ii)). For that purpose the Guidelines clarify the list of purposes that count for this threshold (s 15(2)).
• Right to have contraventions considered favourable where transfer timing was affected by court proceedings or intent shown to transfer before the end of a statutory period (s 15(5)).
• Procedural expectations where the trust deed cannot be varied and was created before 1 January 2011: the Commission may require a statutory declaration covering several matters relating to trust structure and compliance (s 16(2)-(3)).

Commission’s powers and constraints:

• The Commission may decide to give waiver notices, set conditions and specify waiver periods in accordance with the Guidelines (ss 14-17). Section 15(7) clarifies that section 17 does not apply to waiver notices given under s 15(5) (special transfer circumstances), signalling a narrower or different treatment for those waivers.
• The Commission must consider particular matters when deciding conditions to include in waiver notices , for example, the need for the waiver to cease if the trustees cease complying with attached conditions (s 16(1)). For trusts with pre‑2011 unvaryable deeds, the Commission must consider requiring statutory declarations (s 16(2)).

Concrete duties are therefore mostly descriptive: trustees must keep and produce evidence to show that expenditures are for permitted purposes, avoid prohibited related‑party property transactions, and observe conditions attached to waivers. The Guidelines also give trustees a defined administrative right to seek and obtain waivers when particular thresholds or circumstances are met.

The Guidelines outline administrative enforcement mechanisms rather than criminal or civil penalties. They frame how the Commission may respond to contraventions and what remedial instruments are available. The document does not itself create fines or criminal sanctions; instead it specifies discretion in issuing waiver notices and conditions.

Primary enforcement tool in the Guidelines

• Waiver notices (Part 3, ss 14-17): the central enforcement mechanism provided by the Guidelines is the waiver notice. The Commission may decide to give a waiver notice where specified conditions are met (s 15(1)). A waiver notice operates to waive particular contraventions for specified periods (s 17 sets periods). Section 16 requires the Commission to consider particular conditions to attach to waiver notices and contemplates automatic cessation of the waiver where trustees cease to comply with those conditions (s 16(1)).

Administrative limits and thresholds

• De minimis exception for waiver eligibility (s 15(1)(d)): the Commission may grant a waiver for contraventions involving use of trust income/assets for non‑permitted purposes provided that total non‑permitted use in that financial year does not exceed $5,000 and, having regard to all circumstances, the requirement should be waived. The Guidelines specify which types of purposes are to be considered for that $5,000 threshold (s 15(2)).
• Frequency rule (s 15(3)): the Guidelines instruct that contraventions are considered frequent where the Commission proposes to notify trustees of a contravention of the kind in s 15(1)(d) and trustees have previously been notified in the same or the previous financial year; frequency is a factor the Commission must consider in deciding waiver eligibility.

Special circumstances (s 15(5)-(6))

• The Commission may waive contraventions linked to asset transfers where the contravention occurred because of court proceedings, where transfers to a first trust occurred but that first trust was not a special disability trust, or where transfers occurred after a statutory period but the transferor can show intent to transfer earlier (s 15(5)). The Commission may do so provided there is no fraudulent conduct and other specified matters are satisfied (s 15(6)).

Periods of waiver (s 17)

• For trusts created on or after 1 January 2011 and most trusts created before that date whose deeds can be varied, waiver notices may have effect for up to 3 months from the start time under paragraph 52ZZZWH(2)(a) of the Act (s 17(2)); the Commission can extend, on application, for further periods up to 3 months each, but only up to a total of 12 months (s 17(3)).
• For trusts created before 1 January 2011 where the trust deed cannot be varied, waiver notices (other than for a contravention of subsection 52ZZZWF(1)) may be indefinite if the notice does not state an end time (s 17(5)(a)), or for the stated time (s 17(5)(b)). A waiver related to contravention of subsection 52ZZZWF(1) is limited to 3 months (s 17(6)).

Procedural conditions and proof (s 16)

• The Commission must consider requiring statutory declarations from trustees in certain circumstances (s 16(2)-(3)). Those declarations must state explicitly that the trust is a special disability trust, trustees’ inquiries into the beneficiary’s eligibility, the primary purpose of the trust, and compliance with determinations made under subsection 52ZZZWC(2) of the Act (s 16(3)). The effect is to shift evidentiary burdens onto trustees seeking waiver relief.

What the Guidelines do not specify

• The Guidelines do not set out penalties, sanctions or enforcement actions other than waivers. They do not, in this instrument, specify remedial steps the Commission must take where a waiver is not given (for example, recovery of payments, referral for prosecution, or civil remedies). Any such measures would be in the Act or other instruments; the Guidelines deliberately confine themselves to waiver criteria and procedural matters.

Practical enforcement consequences

• A trustee facing a Commission decision that a trust contravenes Division 11B is effectively subject to administrative conditions via the waiver mechanism: the Commission can permit continued use of trust assets conditionally or for a limited time rather than immediately disqualifying the trust. That provides a remedial pathway, but it comes with administrative obligations (statutory declarations, compliance with conditions) and temporal constraints (3 months/12 months/indefinite depending on trust vintage; ss 16-17).

The enforcement architecture in the Guidelines therefore privileges administrative remediation and conditional cure over immediate punitive measures in many cases, but the Guidelines also build in de minimis caps, frequency checks, and statutory declaration requirements to constrain repeated or material contraventions.

The Guidelines are expressly cross‑referential to several other Commonwealth instruments and to the Veterans’ Entitlements Act 1986 itself. These interactions materially affect interpretation and operation.

Interaction with the Veterans’ Entitlements Act 1986

• The Guidelines are made under and operate for specified purposes under the Act. Multiple provisions recite their purpose as being “for the purposes of paragraph 52ZZZWB(4)(a) of the Act” (ss 6, 8, 11) or “for the purposes of subsection 52ZZZWH(4) of the Act” (s 14). Thus the Guidelines are interpretive and procedural adjuncts to Division 11B of Part IIIB of the Act and must be read in conjunction with the statutory text of those provisions. They do not supplant or alter the Act’s substantive statutory requirements.

Interaction with the Aged Care Act 2024

• The approved fees definition (s 5) imports the concept of “registered provider (within the meaning of subsection 11(2) of the Aged Care Act 2024) who is providing to the principal beneficiary a service in the service group specified in paragraph 8(3)(b) of that Act”. That import means that changes to the Aged Care Act 2024, changes to provider registration rules, or changes to what services fall within the referenced service group will affect which providers’ charges qualify as approved fees under the Guidelines. The Commission and trustees will need to track the Aged Care Act 2024 to determine whether particular providers qualify.

Interaction with NDIS instruments

• Section 9(5) expressly provides that a property that is “specialist disability accommodation” within the meaning of the National Disability Insurance Scheme (Specialist Disability Accommodation) Rules 2020 may be a property to which s 9 applies. This recognises that the NDIS SDA regime is relevant to what counts as reasonable accommodation needs. Further, s 18 nominates bilateral NDIS agreements between the Commonwealth and each State/Territory as agreements relevant to determining which institutions qualify for approved fees under s 5. The practical effect is that NDIS policy and funding structures will influence the permissible use of special disability trust funds for accommodation.

Interaction with intergovernmental funding agreements

• Section 18 nominates the bilateral NDIS agreements and the National Health Reform Agreement. Those agreements are the ones the Commission will look to when determining whether an institution, hostel or group home receives funding that qualifies it for the approved fees definition (s 5(b)(ii)). Changes to those agreements, or their interpretation, can change which institutions qualify.

Interaction with Commonwealth administrative law and statutory instrument practice

• The Guidelines themselves are a legislative instrument; they will be subject to the usual administrative law doctrines and judicial review where a decision maker (the Commission) misapplies the Guidelines or the Act, although the Guidelines do not themselves purport to set out rights to merits review. The Guidelines’ frequent use of discretionary language (for example the Commission “may decide to give a waiver notice”) means outcomes will turn on the Commission’s factual reasoning mapped against the Guidelines' criteria.

Interaction with trust and property law

• The Guidelines constrain transactions involving trust assets: property acquisitions from immediate family members are excluded from being reasonable accommodation needs (s 10). That constraint interacts with trust law principles concerning related‑party dealings and fiduciary duties: trustees must avoid self‑interested transactions or at least be prepared to justify them to the Commission and to demonstrate they do not fall within the Guidelines’ prohibited categories.

Transitional interaction with prior Guidelines

• Section 20 provides that things done under the 2011 Guidelines that could be done under the 2021 Guidelines are taken to have effect under the 2021 Guidelines. This ensures continuity for certain prior decisions and instruments given under the earlier instrument and avoids generating new invalidity issues simply because the instrument was replaced.

Consequences of cross‑references

• The use of external definitions means trustees and their advisers cannot interpret the Guidelines in isolation. For example, what constitutes an approved fee depends on registration under the Aged Care Act 2024 and on institutions’ funding status under the nominated agreements. That creates ongoing compliance costs and a moving target if those other instruments are amended. The Guidelines themselves were amended in 2025 to reflect changes to the Aged Care Act (see endnotes), demonstrating that interaction in practice (Endnote 3, Endnote 4).

In short, the Guidelines function as an interpretive bridge between the Act’s abstract requirements and the operational realities of aged care registration, NDIS accommodation rules and intergovernmental funding arrangements. Trustees and advisers must therefore track at least three legal streams to stay compliant: the Act, the Guidelines, and the external instruments they import.

The compiled instrument includes an amendment that took effect after its original making. The endnotes provide the concrete amendment record.

Key dates and instruments:

• The Veterans’ Entitlements (Special Disability Trust) Guidelines 2021 were registered 29 September 2021 (F2021L01346) and commenced 30 September 2021 (Endnote 3).
• A subsequent amending instrument, the Veterans’ Entitlements (Treatment and Other Matters) Amendment (Aged Care Act 2024) Instrument 2025, was registered 28 October 2025 (F2025L01276) and commenced 1 November 2025 (Endnote 3). The compilation date in the copy provided is 1 November 2025, and the compilation incorporates the amendment F2025L01276 into the text.

Nature of the 2025 amendment (from Endnote 4 and internal text)

• Section 5 of the Guidelines (definitions) was amended by F2025L01276 (Endnote 4). That amendment alters the definition of “approved fees” to cross‑refer to the Aged Care Act 2024 and to the concept of registered providers in that Act (s 5 definition now refers to subsection 11(2) of the Aged Care Act 2024 and to the service group in paragraph 8(3)(b) of that Act). The amendment therefore updates the approved fees concept to align with reformed aged care legislation.
• The endnotes indicate other editorial changes: section 2 was repealed (s 2 rep LA s 48D) and Schedule 1 was repealed (Sch 1 rep LA s 48C). Those repeals appear to be editorial or consequential changes due to the format and compilation rather than substantive policy alterations, but they are recorded in the amendment history (Endnote 4).

Transitional and application provisions

• Section 19 states the Guidelines apply to special disability trusts established before, on or after the instrument’s commencement (s 19). That confirms prospective and retrospective application to existing trusts.
• Section 20 preserves things done under the 2011 Guidelines that could have been done under the 2021 Guidelines (s 20). This provides a continuity mechanism so past administrative steps (notices, applications, instruments) remain valid under the new instrument where they fall within the new rules.

Practical effect of amendments

• The 2025 amendment demonstrates the Guidelines’ sensitivity to changes in externally referenced law, here the Aged Care Act 2024. Where Parliament or other agencies revise upstream regulatory regimes (for example aged care provider registration), the Guidelines are expected to be updated to preserve coherence. Trustees must therefore watch both legislative instruments and subordinate instruments amending the Guidelines.

The endnotes list further editorial and legislative details (Endnotes 1-4). For a practitioner advising trustees, the immediate practical consequence is that the approved fees definition now references the Aged Care Act 2024, and trustees should consult that Act for provider eligibility and service group definitions when justifying payments as approved fees.

The compiled Guidelines do not contain or reference any judicial decisions and the text contains no litigation history. The instrument itself is administrative guidance; it describes decision‑making criteria and processes but does not report litigation, judicial interpretations, or case law.

What the text says about legal proceedings

• Section 15(5)(a) explicitly contemplates contraventions that occurred as a result of court proceedings relating to a transferred asset. That provision recognises that judicial processes can affect trust qualification and provides a pathway for waivers when court action is the reason an asset transfer contravened the Act’s timing or form requirements. However, the Guidelines do not supply examples of cases, nor do they cite judicial authorities.

Implications for practitioners

• Because the Guidelines govern administrative discretion, the scope for litigation will principally arise where a trustee or beneficiary alleges the Commission misapplied the Guidelines or failed to properly exercise the discretion conferred by the Guidelines and the Act. Any judicial review claim will centre on statutory interpretation, reasonableness, procedural fairness, and whether the Commission stayed within the constraints the Guidelines prescribe (for example by applying s 15’s $5,000 threshold correctly, or by properly considering frequency under s 15(3)).
• The document contains procedural requirements (statutory declarations in s 16) that may form subject matter for contested decisions if the Commission refuses a waiver or imposes conditions the trustee disputes. Again, the Guidelines themselves do not record any litigation.

Conservative reading

• In the absence of reported cases in the instrument, advisers must assume that legal challenges to Commission decisions are possible but will be governed by the Act, the Guidelines, and general administrative law. Any litigation history will therefore be found in external sources , administrative law judgments involving the Commission and Division 11B of Part IIIB of the Act , none of which are referred to in the text provided.

In short, the Guidelines do not mention litigation; they provide decision standards the Commission must apply in a way that is reviewable under general administrative law principles, but any concrete litigation landscape must be researched outside this instrument.

Several features of the Guidelines create practical traps and implementation risks trustees and advisers should note. These are concrete points grounded in the text.

Approved fees depend on external instruments (s 5)

• The definition of approved fees ties qualifying fees to registered providers under the Aged Care Act 2024 (subsection 11(2)) and to institutions funded under agreements nominated by the Commission (s 5(b)(ii), s 18). If a provider charges for daily care but is not a registered provider under the Aged Care Act 2024 (or if the service does not fall into the referenced service group), the charge may not be an approved fee. Trustees cannot treat any residential or group home charge as approved without checking provider registration status and relevant funding agreements.

Immediate family prohibition for property transactions (ss 9(2)(a), 10)

• Section 9(2)(a) requires that property be acquired or rented from a person who is not an immediate family member for the acquisition/rental to be a reasonable accommodation need. Section 10 makes clear acquisitions from immediate family members are not reasonable accommodation needs. Trustees may inadvertently disqualify accommodation expenditures by buying or leasing property from family members; conversely, renting from family at below market rent will not be rescued by s 9 because rents must be at market value if not used for accommodation (s 9(2)(b)(ii), s 9(3)(b)(ii), s 9(4)(b)(ii)).

Market rent and use of rental income (ss 9(2)(b)(ii), 9(3)(b)(ii), 9(4)(b)(ii))

• Where property owned by the trust is not used for the beneficiary’s accommodation, the Guidelines allow renting at market value only if the income is used for the beneficiary’s benefit. Trustees must track rents, demonstrate market rates and evidence the rental income is applied for the beneficiary. Rental below market or diversion of rental income risks a finding of non‑compliance.

De minimis $5,000 cap , scope and frequency (s 15(1)(d))

• The $5,000 threshold for permissible use of income and assets for non‑permitted purposes in a financial year is strictly limited: it applies only to the total use for a purpose other than those listed in s 15(2). Trustees should not assume the Commission will waive contraventions simply because they are small in amount; waiver still requires the Commission to be satisfied, in light of all circumstances (including frequency), that the requirement should be waived (s 15(1)(d)(ii)). The Guidelines also define “frequent” contraventions as those where trustees have been notified of a prior contravention in the same or the previous financial year (s 15(3)). Multiple small breaches over time risk denial of waiver on the basis of frequency.

Statutory declarations for older, unvaryable deeds (s 16)

• Trustees of trusts created before 1 January 2011 whose deeds cannot be varied may be required to provide statutory declarations enumerating a list of compliance matters (s 16(2)-(3)). Failure to provide the statutory declaration may prevent the Commission from granting a waiver, and producing it creates exposure because the declaration must assert compliance and may be relied upon in future review.

Waiver period complexity (s 17)

• Waiver periods differ by trust vintage and deed amendability. For trusts created on or after 1 January 2011 (or pre‑2011 trusts with amendable deeds), waiver notices can last up to 3 months and be extended to a total of up to 12 months on application (s 17(2)-(3)). For pre‑2011 trusts with unvaryable deeds, waivers can be indefinite where the notice does not state an end time (s 17(5)(a)), except for waivers related to contraventions of subsection 52ZZZWF(1) which are limited to 3 months (s 17(6)). Trustees who assume identical treatment across different trust vintages may be surprised.

Transfers and multiple trusts (s 15(5))

• Complex transfer chains , transferor to first trust to final special disability trust , can be waived only in narrow circumstances. The Commission may waive contraventions where the transferor transferred assets within the statutory timeframe to a first trust intended to be a special disability trust but that first trust failed qualification, provided there was no fraudulent conduct and other matters are satisfied (s 15(5)(b)-(6)). Trustees relying on post hoc cures should document intent and timing to meet the evidentiary bar.

Interaction with NDIS and aged care regimes (ss 9(5), 18)

• The Guidelines explicitly allow Commonwealth NDIS and aged care instruments to affect trust treatment. Trustees must therefore be conversant with NDIS SDA Rules 2020 and the Aged Care Act 2024, and with the specific bilateral agreements and the National Health Reform Agreement listed in s 18. Changes to those instruments can alter whether accommodation or provider fees count as permitted expenditures.

No direct remedy for non‑waivable contraventions in Guidelines

• The Guidelines lay out waiver processes but do not explain consequences or recovery mechanisms when a waiver is refused. Trustees must therefore be ready for administrative uncertainty: refusal may trigger an adverse administrative finding under the Act that the Guidelines do not itself remedy.

Evidence burden and timing

• The Guidelines anticipate documentary and declaration evidence for waivers and compliance claims (s 16). Trustees will need contemporaneous records showing the disability nexus, medical/dental invoices, provider registration status under the Aged Care Act 2024, property purchase/rent records, market rental evidence if applicable, and documentation of fund use. Lack of records is a practical risk.

In short, the principal practical gotchas arise from cross‑references to other statutory regimes, restrictions on related‑party property transactions, the $5,000 de minimis and frequency conditions for waivers, evidentiary requirements for older trusts, and the segmented waiver periods depending on trust vintage and deed flexibility. Trustees and advisers should map trust activities against these specific text provisions to avoid unintended non‑compliance.

The Guidelines set out clear decision criteria the Commission will apply. Trustees and advisers can convert the text into an operational compliance checklist. Below are practical compliance steps grounded in the Guidelines’ provisions.

1. Establish and document the beneficiary nexus for each expenditure

• For any payment claimed to meet a “reasonable care need” (s 7), ensure contemporaneous documentation shows the need arises from the beneficiary’s disability, or is for medical/dental costs, or is an approved fee. Keep medical records, care plans, invoices, prescriptions and practitioner notes that show the nexus to disability and that the service was provided in Australia (s 7(b)). The requirement that the need be met in Australia should be evidenced by provider location records and proof of payment in Australia.

2. Vet providers against the Aged Care Act 2024 and nominated funding agreements

• Before characterising a payment as an “approved fee” (s 5), confirm the provider is a registered provider under subsection 11(2) of the Aged Care Act 2024 and delivers services in the service group referenced in paragraph 8(3)(b) of that Act, or confirm the institution, hostel or group home is funded under one of the nominated agreements listed in s 18. Keep copies of provider registration, service group classification, and any relevant contractual or funding documentation evidencing an institution’s funded status.

3. Property and accommodation transactions , avoid immediate family transfers and document market rates

• Do not purchase or rent property from an immediate family member if you intend to treat that acquisition or rent as a reasonable accommodation need (s 9(2)(a), s 10). If trust property is rented out, ensure rents are set at market value and evidence the rental income is used for the beneficiary’s benefit (s 9(2)(b)(ii), s 9(3)(b)(ii), s 9(4)(b)(ii)). Keep valuations, rental market comparables, leases and bank records showing rent flow into trust accounts and subsequent distribution/use for the beneficiary.

4. Separate payments to carers and family members from beneficiary‑primary purposes

• Section 13 disqualifies some payments as “other purposes primarily for the benefit” where they are to immediate family or to carers except where payments are for reasonable care needs or the other purposes in s 12. If the trust pays family members or carers, document the basis: is it payment for actual care services that meet a reasonable care need, or is it for other beneficiary‑centred purposes (s 12)? Keep time sheets, service agreements, care plans and invoices.

5. Track and limit non‑permitted expenditures to $5,000 per financial year where possible

• If there has been inadvertent use of trust income or assets for non‑permitted purposes, quantify the total and ensure it does not exceed $5,000 in the relevant financial year if seeking a waiver under s 15(1)(d)(i). Even if under $5,000, be prepared to justify the context and frequency, because the Commission must also be satisfied that the requirement should be waived (s 15(1)(d)(ii)). Document the nature of the expenditure and reasons why it occurred.

6. Avoid repeated contraventions

• Because contraventions are treated as “frequent” when there has been a previous notification in the same or previous financial year (s 15(3)), trustees should treat any notice of contravention seriously and rectify practices promptly to avoid losing waiver eligibility on frequency grounds.

7. Prepare statutory declarations where required

• For trusts created before 1 January 2011 with deeds that cannot be varied, be ready to produce the statutory declaration described in s 16(3) confirming matters such as that the trust is a special disability trust, the trustees’ reasonable inquiries into eligibility, the primary purpose of the trust, and compliance with any Commission determinations under subsection 52ZZZWC(2) of the Act. If the trust falls within the specified vintage (20 Sept 2006 to 1 Jan 2011) and the only contravention relates to the purpose of the trust despite prior compliance, be ready to provide a declaration that the trust complied with s 52ZZZWB before 1 Jan 2011 (s 16(2)(b)).

8. Manage waiver applications proactively

• If a contravention occurs, prepare a waiver application that addresses the elements in s 15: show the contravention is of a covered provision, is not fraudulent, that trustees did not cause contraventions under subsection 52ZZZWF(1) where that is relevant, and, if relying on s 15(5) for transferred assets, demonstrate court proceedings, transfer timing and intent as required. Include documentary proof that supports each factual claim, and attach statutory declarations where the Guidelines contemplate them.

9. Monitor inter‑governmental agreements and related Acts

• Because approved fees and SDA accommodation references rely on the Aged Care Act 2024, the NDIS SDA Rules 2020, and the bilateral agreements in s 18, trustees should monitor changes to those instruments. Keep an annotated register of provider registrations, relevant bilateral agreements and the National Health Reform Agreement to ensure payments remain within the eligibility definitions.

10. Maintain robust recordkeeping and governance

• The Guidelines’ evidentiary demands and the Commission’s discretion favour trustees who maintain clear, contemporaneous records of decisions to expend funds, valuation evidence, invoices, leases, care plans, and minutes of trustee meetings. Implement trustee governance policies that require independent valuations for property transactions, conflict‑of‑interest registers for related‑party deals, and independent advice where large purchases or transfers are contemplated.

11. Seek early advice and plan for transitions

• Before buying property or entering into leases or long‑term arrangements for the principal beneficiary’s accommodation, obtain legal and financial advice to ensure the transaction complies with ss 9-10. Where transfers of assets are contemplated as part of estate or family planning, document intention and timing to preserve waiver eligibility under s 15(5)(c) if transfers slip beyond statutory windows.

12. Where in doubt, consult the Commission

• The Guidelines give the Commission discretion and detailed criteria; early consultation with the Commission can reduce the risk of adverse findings and increase the likelihood that necessary waivers are granted on acceptable conditions.

Compliance in practice therefore requires proactive documentation, cautious related‑party dealings, ongoing monitoring of external instruments (Aged Care Act 2024, NDIS SDA Rules, bilateral agreements), and careful use of the waiver process when inadvertent contraventions occur. Trustees who follow the checklist above will be best placed to demonstrate alignment with the Guidelines and to secure conditional relief where required.
