What it does
This instrument prescribes how the market value of real assets and real property must be worked out for the purposes of specified provisions of the Veterans’ Entitlements Act 1986, namely subparagraphs 52ZMAA(5)(a)(i) and (b)(i) and the related adjustment rules in subparagraphs 52ZMAA(5)(a)(ii) and (b)(ii). Its operative text is contained in section 5. The instrument also defines who qualifies as an accredited valuer for these purposes in section 4, and states its commencement and legal authority in sections 2 and 3 respectively. The instrument is titled the Veterans’ Entitlements (Pension Loans Scheme,Market Value) Determination 2022 (s 1).
Mechanically, section 5 establishes a hierarchy of methods for determining market value at the relevant event time: first, the sale price if the asset or property is sold before the event time; second, an agreed value if the Commission and the relevant person agree a value; third, where neither sale nor agreement applies, a recent accredited valuation within a three month window before the event time may be used provided the Commission is satisfied there has been no material change since that valuation day; and finally, if none of the earlier options apply, the market value is the value determined by an accredited valuer at the event time (s 5(2)(a)-(d)). Section 5 also gives the Commission power to reject or treat a sale price as not reflecting market value if it reasonably believes the sale price is reduced for reasons such as lack of good faith, unfair or unreasonable terms, lack of arm’s length dealing, or other circumstances; in that case an accredited valuer’s determination at the time of sale is used (s 5(3)). Section 5(4) prescribes how to reduce market value by any charges and encumbrances, with timing of the computation depending on which valuation pathway applied. Section 4 gives the accredited valuer definitions: certified practising valuer accredited by the Australian Property Institute, RICS Chartered Valuation Surveyor, or a person registered or otherwise authorised under the law of the State or Territory where the property is situated.
