Veterans' Entitlements (Pension Bonus Scheme – Non-accruing Members) Declaration 2018

Key legal objects and concepts in this instrument are defined by reference to the Veterans’ Entitlements Act 1986 and the Social Security Act. The declaration itself contains limited definitions and relies on the Act for many expressions (s 6). Principal concepts include:

• Non‑accruing member: The declaration makes particular factual categories “non‑accruing members” for the purposes of subsection 45TO(1) of the Act (s 3; s 7). The instrument does not reproduce subsection 45TO(1) or explain the full legal effect of that Act provision; it limits itself to declaring who falls within the non‑accruing label and for what period (s 7; s 8).

• Gainful work, passing the work test: These are defined terms in Part IIIAB of the Act. The declaration expressly adopts those meanings by reference (s 6). Several of the categories in s 7 hinge on incapacity to “pass the work test” for a bonus period, or on the availability of gainful work being reduced.

• Major disaster: The declaration adopts the Social Security Act s 23 definition of “major disaster” (s 6). Paragraphs 7(h) and 7(i) use this concept to catch periods where the amount of gainful work available is reduced by a major disaster and thus renders a member, or a partner who is a member, unable to pass the work test.

• Partner and related relational classifications: The instrument applies to members whose partners are participants in the workforce, who are or are not members of the scheme or its corresponding Social Security Act scheme, and who intend to become members (s 7(d)). The declaration treats partner circumstances symmetrically in several paragraphs where the partner’s inability to pass the work test triggers the member’s non‑accrual status (s 7(f), 7(i)).

• Special disaster and public health interventions: The instrument contains two named special provisions. Section 9 establishes retrospective and bounded treatment for Cyclone Larry (2006) effects; section 10 captures inability to pass the work test due to the COVID‑19 pandemic. The Cyclone Larry provision sets a not‑before date (1 March 2006) and a maximum duration (13 weeks) for non‑accrual that may be applied (s 9(2)(a)-(b)). The COVID‑19 clause declares members affected by COVID‑19 to be non‑accruing for a period ascertained under s 10(3); the instrument contains the coverage trigger but defers to the Act for the consequences (s 10(1)-(3)).

• Time limits on non‑accrual: Section 8 sets an overarching rule that a declared member is a non‑accruing member for the period during which the qualifying circumstance applies (s 8(1)). However, for particular paragraphs of s 7, s 8(2) imposes explicit maximum durations: 26 weeks for members covered by paragraphs 7(e) and 7(f) (leave and inability to pass the work test); and 13 weeks for paragraphs 7(g), 7(h) and 7(i) (bereavement and disaster reductions in work availability). Section 8(2A) allows for inclusion of a period of preparation for an impending disaster where gainful work is reduced as a result.

• Savings of declared persons: Section 5 provides transitional protection by taking anyone declared a non‑accruing member under the revoked 2007 declaration to be a non‑accruing member under this declaration as if declared by this instrument.

The main legal mechanism is therefore classification: the Repatriation Commission, exercising authority under s 45TO(1) of the Act (s 3), specifies factual circumstances that operate as legal triggers to pause or treat pension bonus accrual as non‑accruing for specified periods. Because the substantive effect of that status is governed by the Act, this instrument acts as the statutory input that feeds administrative eligibility and accrual calculations governed by the Act’s provisions and the relevant administrative rules.

The declaration directly affects members of the pension bonus scheme under the Veterans’ Entitlements Act 1986. The instrument’s s 7 enumerates the specific classes of member impacted. Those classes are:

• Community Development Employment Project participants, captured by reference to s 23 of the Social Security Act (s 7(a)); this places CDEP participants explicitly into the non‑accruing category while they remain in that status.

• Members in gaol, whose incarceration is the criterion (s 7(b)).

• Members undergoing psychiatric confinement when charged with an offence (s 7(c)).

• Members who were not workforce participants but whose partner was a workforce participant, the partner was not a registered member of the pension bonus scheme or the corresponding Part 2.2A Social Security Act scheme, and who intended to become registered members (s 7(d)(i)-(iii)); this paragraph captures a narrow domestic circumstance involving partner intentions and registration status.

• Members on paid or unpaid leave of any kind from gainful work who are unable to pass the work test for a bonus period in which any part of the leave is taken (s 7(e)). The corresponding partner circumstance is covered in s 7(f).

• Surviving members of a couple undergoing a period of bereavement and unable to pass the work test during a bonus period that includes that bereavement (s 7(g)).

• Members or partners whose available gainful work in a bonus period was reduced by a major disaster, making them unable to pass the work test; this appears in s 7(h) and s 7(i), with s 6 importing the Social Security Act s 23 definition of “major disaster”.

• Members who, during a compensation period (because they received compensation and a designated pension would not have been payable had they not reached pension age), are unable to pass the work test for a bonus period that falls within that compensation period (s 7(j) and s 8(3)).

The instrument therefore affects a mixture of individual members in constrained circumstances (incarceration, psychiatric confinement, bereavement), members and their partners in specified workforce or leave conditions, participants in particular social programmes (CDEP), and persons affected by disasters or compensation timing. The COVID‑19 provision (s 10) expands coverage to members or members’ partners who are unable to pass the work test due to the impact of the coronavirus known as COVID‑19.

Who pays and who decides. The declaration is made by the Repatriation Commission as the instrument‑making body under s 45TO(1) of the Act (s 3 heading and text). It does not itself appropriate funds. Any fiscal effect , additional or reduced pension bonus accrual liability , would be realised under the Act’s mechanisms and through the government appropriation and payments systems. Administrative decisions about whether an individual satisfies a declared category and the duration of non‑accrual would be implementing actions taken under the Act by the administering agency.

Indirectly affected actors include scheme administrators who must identify members falling within the declared classes, process claims and maintain records that correspond to the temporal rules in s 8, and where relevant apply the special rules for Cyclone Larry (s 9) and COVID‑19 (s 10). Employers and entities that provide evidence (for example, corrective institutions, hospital psychiatric services, Social Security agencies for CDEP status) will likely be asked to supply documentation, although the instrument itself does not prescribe evidentiary standards.

The declaration is a classificatory instrument; it creates statutory rights and duties only by reference to the Act. The instrument itself confers a statutory status (non‑accruing member) upon persons meeting the specified factual criteria and for specified periods (s 7; s 8). The practical effects of holding that status, including any right to preserve pension bonus eligibility or to suspend accrual during the declared period, are determined by subsection 45TO(1) of the Act and associated Act provisions and administrative practice. The declaration therefore performs the following legal functions that produce duties and rights indirectly:

• Right to be treated as non‑accruing: A person who fits one of the classes in s 7, and who falls within the relevant period rules in s 8, is declared to be a non‑accruing member “throughout the period” ascertained under s 8, or under the specific special provisions in s 9 and s 10. That declaration is a legal input into the Act’s machinery and gives the individual the statutory status that the Act recognises for certain consequences (s 7; s 8(1)).

• Administrative duty to apply the declaration: An administering body tasked with applying the Act must accept the declaration as the statutory basis on which to treat eligible persons as non‑accruing. The instrument creates a duty on agencies to apply the declared categories where relevant case facts are proved, subject to the Act’s decision‑making rules. The instrument itself does not create a new adjudicative pathway; it amends the universe of circumstances to which the Act’s pre‑existing rules apply (s 3).

• Time‑bound limits on the right: The right to treatment as non‑accruing for certain classes is limited in time. Section 8(2) prescribes maximum periods in which the declared status can apply for the paragraphs listed: 26 weeks for leave‑related categories (7(e), 7(f)); 13 weeks for bereavement and disaster reduction categories (7(g), 7(h), 7(i)). Section 9 separately fixes a maximum of 13 weeks for Cyclone Larry related inability to pass the work test, and sets 1 March 2006 as the not‑before date for being taken to be affected by preparation for the cyclone (s 9(2)(a)-(b)). These limits create an administrative boundary that decision‑makers must observe.

• Transitional right: Section 5 creates a transitional right by saving persons declared under the revoked 2007 declaration and treating them as if declared under this instrument. That produces a binding right in administrative practice, because the administering authority must treat those persons as covered by this instrument (s 5).

• Reliance on external definitions and tests: The instrument relies on definitions and tests in the Act and the Social Security Act (s 6). This means the substantive duties and rights , for example what it is to “pass the work test”, what constitutes “gainful work”, and the scope of “major disaster” , are defined elsewhere and must be applied in conjunction with this declaration.

What the instrument does not do (rights/duties it does not create directly):

• It does not itself create a new benefit, nor does it specify payments, rates, or administrative procedures for applying the non‑accruing status. Those are matters for the Act and agency practice.
• It does not prescribe evidentiary standards, appeal avenues or review processes; these are determined by the Act and general administrative law.

In short, this declaration produces a legal right for individuals in named circumstances to have their pension bonus accrual treated as non‑accruing for prescribed periods. The practical consequences of that status , whether it preserves entitlement, suspends calculation windows or otherwise affects benefit quantum , are determined under subsection 45TO(1) of the Act and related provisions.

The declaration itself contains no express penalties, sanctions or enforcement mechanisms. It is a regulatory declaration made under subsection 45TO(1) of the Veterans’ Entitlements Act 1986 (s 3); the instrument defines who is to be treated as a non‑accruing member for specified periods (s 7; s 8). Enforcement and penalties, to the extent they exist, flow from the Act’s statutory framework and the administrative apparatus that applies the Act.

What the instrument does with respect to enforcement:

• No new offence provisions are created: There are no provisions in the declaration imposing criminal, civil penalty or administrative fine offences for non‑compliance with the declaration’s terms. The instrument is silent on enforcement and therefore does not institute new sanctions (full text, s 1-s 10).

• Administrative application and review remains with the Act: Any legal remedies, review rights, or administrative sanctions that attach to incorrect application or to misstatement of facts will be governed by the Act and applicable administrative law. The declaration explicitly operates under subsection 45TO(1) of the Act, so the Act’s processes for making or varying decisions about accrual likely govern dispute resolution and enforcement (s 3).

• Declarations bound to legal limits: Time limits in s 8(2) and the specific caps in s 9 provide a statutory boundary that administrators must respect. Incorrect application beyond those temporally bounded rights could be subject to legal challenge under administrative law, but the instrument itself does not set the challenger’s remedies.

Practical enforcement considerations for administrators:

• Identification and proof: Administrators will need to identify eligible persons and apply the declared categories, which may require supporting documentary evidence. The instrument does not set admissible evidence standards. Where an administrator declines to accept non‑accruing status, remedies will be those provided by the Act and general administrative law (judicial review, merits review where available).

• Record‑keeping and audit risk: Because the instrument changes status for defined periods, agencies will need systems to track start and end dates of non‑accruing periods (s 8(1)-(3), s 9). Failure to track accurately could produce fiscal discrepancies and administrative error, but the instrument imposes no new auditing regime.

• Retrospective and special‑case coverage: The Cyclone Larry clause (s 9) and the COVID‑19 clause (s 10) introduce retrospective and event‑triggered application. Administrators must treat affected periods carefully; disputes about whether an inability to pass the work test was “due to the effects of Cyclone Larry” or “due to the impact of the coronavirus known as COVID‑19” will be questions of fact and causation to be resolved under the Act’s decision framework.

In sum, enforcement of the declaration’s effects is exercised through the Act’s administrative machinery and the existing dispute resolution and penalty framework contained in the Act and broader administrative law. The declaration does not itself prescribe penalties.

This instrument is explicitly cross‑referential. It operates only in conjunction with the Veterans’ Entitlements Act 1986 and parts of the Social Security Act. Key interactions are:

• Veterans’ Entitlements Act 1986, subsection 45TO(1): The declaration is made under that subsection (s 3). The substantive legal effects of being a non‑accruing member , including how accrual is calculated, preserved or suspended , are governed by the Act. This instrument does not replicate those provisions but specifies who qualifies as non‑accruing for Act purposes.

• Part IIIAB of the Act: The declaration imports technical definitions such as “gainful work” and “passing the work test” by reference to Part IIIAB (s 6). Those terms are central to many of the declared categories in s 7, so the application of the declaration depends on how the Act defines and applies those tests.

• Social Security Act 1991: The instrument adopts the meaning of “major disaster” from s 23 of the Social Security Act (s 6). Paragraph 7(a) also references a Community Development Employment Project participant “within the meaning of section 23 of the Social Security Act” (s 7(a)). Paragraphs 7(d) and 7(i) reference the corresponding scheme under Part 2.2A of the Social Security Act. Accordingly, the declaration operates in a layered way: it labels persons as non‑accruing only after importing tests and statuses that are defined in the Social Security Act.

• Revoked declaration (2007): Section 5 saves persons declared under the revoked Veterans’ Entitlements (Pension Bonus Scheme - Non‑accruing Members) Declaration 2007 by treating them as declared under this instrument (s 5). The instrument therefore functions as a continuity vehicle between instruments over time.

• Disaster law and emergency declarations: The instrument’s inclusion of major disaster as a trigger and the Cyclone Larry special provision (s 9) create a link between disaster events and pension bonus accrual rules. The definition of major disaster is sourced from the Social Security Act, but in practice application will engage emergency planning, state and federal disaster declarations and, in the COVID‑19 context, public health measures.

• Administrative law and review: Although not stated, decisions implementing this declaration will be made under the Act and subject to the general administrative law framework, including merits review and judicial review avenues available under other Commonwealth statutes and common law. Where the Act provides internal review or merits review rights, those will be the applicable mechanisms for challenging an administrative decision connected to the declaration.

• Interaction with compensation and pension age rules: Paragraph 7(j) references members who have “received compensation” and to whom “a designated pension would not have been payable during a period (the compensation period) if the member had not reached pension age and the pension was a compensation affected pension” (s 7(j)). This ties into compensation regimes that interact with pension rules, an interface governed by the Act and its definitions. Section 8(3) clarifies that a member in this category is a non‑accruing member during the compensation period where they cannot pass the work test.

In short, this declaration is not standalone regulatory law. It is a grafted instrument that alters how statutory concepts in the Veterans’ Entitlements Act and the Social Security Act operate by enlarging the circumstances in which members are to be classed as non‑accruing. Application therefore requires sequential legal steps: determine whether the member fits a declared category (this instrument), apply the Act’s definitions for the technical tests (Part IIIAB, Social Security Act), and then apply the Act’s substantive rules about accrual, eligibility and payment. That chained dependency increases administrative complexity because officers must be competent in multiple statutory regimes.

The compilation and endnotes record the instrument’s legislative history and amendments. Key entries are in the endnotes, which the compilation integrates:

• Initial instrument: Veterans' Entitlements (Pension Bonus Scheme - Non‑accruing Members) Declaration 2018, Instrument 2018 No. R4. It was registered on 28 March 2018 and commenced on 29 March 2018. Section 5 provides a savings provision for persons covered under the revoked 2007 declaration (Endnote 3; s 1; s 5).

• Amendment: Veterans’ Entitlements (Pension Bonus Scheme,Non‑accruing Members) Amendment Declaration 2021, Instrument 2021 No. R1. The compilation records registration details as 2 February 2021 (F2021L00092) with a commencement date of 25 December 2020 (Endnote 3). The amendment history table indicates that multiple provisions (s 2-s 10) were affected by the 2021 instrument (Endnote 4). The compilation’s front matter also notes that it includes amendments up to F2021L00092 and shows a compilation date of 25 December 2020.

• How the amendments operate in the compilation: The endnotes set out the legislation history and amendment history, indicating the instrument as compiled includes amending laws up to F2021L00092. The compilation notes may include underlining where amendments are uncommenced, and indicates that uncommenced amendments are listed in the endnotes (front matter).

• Content implications of the amendment: The addition of s 10, “Special provisions in relation to the impact of coronavirus known as COVID‑19”, is reflected in the text of the instrument in the current compilation. The Cyclone Larry provision (s 9) and the time limit articulation in s 8 are present in the compiled instrument. The amendment history table in Endnote 4 records that sections 2 through 10 were amended or added in F2021L00092, though the endnote’s shorthand requires consulting the amending instrument for specific drafting changes.

• Revocation and saving: The instrument explicitly contemplates continuity with the prior revoked declaration of 2007 and contains a saving provision (s 5). The 2007 instrument is described as “revoked declaration” and persons declared under it are taken to be declared under this 2018 instrument as if this declaration had had effect from the start.

Readers should consult the legislative history in the endnotes for exact registration, commencement and any transitional provisions, and the Legislation Register for the authoritative record of commencements and any uncommenced or prospective amendments. The compilation’s endnotes advise that any uncommenced amendments are shown underlined in the endnotes and that modifications by other laws may alter operation without amending the instrument text in the compilation.

The instrument and its compilation do not record any litigation decisions or judicial interpretations. The text includes no case citations and the endnotes do not list any litigation history entries (full text, endnotes). Consequently:

• There is no recorded judicial authority in this instrument about the construction, application, or validity of the declaration in any particular dispute. The instrument does not cite cases, nor does it summarise judicial outcomes.

• Any legal challenges to administrative decisions that rely on this declaration would arise under the Veterans’ Entitlements Act 1986 and general administrative law. Because the declaration is an exercise of subordinate legislative power under subsection 45TO(1), disputes are likely to involve statutory construction of the Act and the declared categories, but no reported decisions are referenced in the instrument.

• Practitioners seeking case law will need to search external databases for decisions that interpret subsection 45TO(1) of the Act, Part IIIAB (definitions of “gainful work” and the “work test”), or disputes where administrators applied the non‑accruing member declarations. The instrument itself supplies no litigation record or guidance.

For the purposes of compliance and litigation risk assessment, the absence of litigation in the instrument means administrative practice, tribunal determinations and judicial decisions will be key future sources of interpretive guidance. Until such authorities emerge and are recorded in updated compilations or case law repositories, administrative agencies will rely on the plain wording of the instrument, the Act’s definitions and their internal policy guidance.

This instrument contains several drafting features and cross‑dependencies that create traps for practitioners and administrators. These are concrete operational and legal points to watch, together with where the relevant text appears.

• Reliance on external definitions: The declaration imports “gainful work”, “passing the work test” and “major disaster” from Part IIIAB of the Act and section 23 of the Social Security Act (s 6). Practical application therefore requires officers to apply definitions located outside the instrument. Failure to apply the Act’s precise meanings could lead to incorrect categorisation (s 6; s 7).

• Time limits are asymmetrical and strict: Section 8(2) imposes explicit caps: 26 weeks for leave categories (7(e), 7(f)) and 13 weeks for bereavement and disaster reduction categories (7(g), 7(h), 7(i)). These statutory maxima are not administrative guidelines; they are legal limits. Treating those periods as flexible or as discretionary beyond the cap risks error (s 8(2)). By contrast, paragraph 7(j) is governed by the compensation period and s 8(3) allows whole or part of that period , the coverage of (j) is not subject to the same caps.

• Narrow drafting in partner‑intention clause: Paragraph 7(d) applies where a member “was not a participant in the workforce, but whose partner: (i) was a participant in the workforce; and (ii) was not a registered member of the pension bonus scheme or the corresponding scheme …; and (iii) intended to become a registered member …” (s 7(d)). The operative element is partner intent to register. That is a subtle factual threshold and may be difficult to prove. It is narrower than a general family‑based exception and requires contemporaneous proof of intention.

• Cyclone Larry retrospective window: Section 9 fixes a not‑before date of 1 March 2006 and a maximum of 13 weeks for Cyclone Larry-related inability to pass the work test (s 9(2)). For eligibilities that straddle that date or that fall before 1 March 2006, administrative outcomes may differ. The instrument explicitly says the date is the point from which people are taken to be affected by preparation for Cyclone Larry; administrators must be careful to apply the not‑before rule (s 9(2)(a)).

• COVID‑19 catchall with deferred period ascertainment: Section 10 declares members affected by COVID‑19 to be non‑accruing for a period “ascertained in accordance with subsection (3)”, but subsection (3) is not printed in the supplied extract. The compilation includes s 10(1)-(2) text but not s 10(3) content in the excerpt the user provided. Practitioners must therefore inspect the full instrument to see how the period is ascertained and whether there are temporal caps. The instrument as compiled in this exercise shows the coverage trigger but not the ascertainment rules in the provided excerpt (s 10(1)-(2)).

• Administrative evidence posture: The instrument does not set out evidentiary rules or processes for claiming non‑accruing status. Proof standards, documentary requirements and application windows are therefore determined by the Act and agency practice. This creates a risk that agencies impose informal evidence requirements that may not be authorised here; practitioners should proceed via the Act’s decision frameworks and seek review where necessary (s 3; s 6).

• Interplay with compensation rules: Paragraph 7(j) concerns members who have received compensation and to whom a designated pension would not have been payable had they not reached pension age. The intersection of compensation periods, pension age and “compensation affected pension” concepts is technical. Agents adjudicating these matters must map compensation timelines precisely to bonus periods, as s 8(3) ties non‑accrual to the compensation period in which a member cannot pass the work test.

• Continuity via saving provision: Section 5 takes persons declared under the revoked 2007 declaration to be non‑accruing members under this instrument “as if this declaration declared the person as a non‑accruing member.” That carries the risk of mismatch where the new instrument’s wording differs materially from the revoked instrument. Administrators should check whether the person’s factual circumstances still fall within the relevant current paragraph under s 7 and whether temporal limits apply under s 8.

• Amendment timing oddity: The endnotes list an amendment instrument registered in February 2021 with a commencement date in December 2020. Practitioners should be alert to the authoritative dates on the Legislation Register to confirm commencement and avoid applying an instrument prematurely or after its operative date (Endnote 3).

These are not abstract hazards. They create concrete administrative work: tracing definitions across statutes, calculating precise weeks of coverage, proving partner intent, mapping compensation periods, and locating the precise ascertainment rule for COVID‑19 periods. Each of these is a chokepoint where cases, reviews or litigation are most likely to arise.

Compliance involves two groups of actors: (1) scheme members or their representatives who wish to claim non‑accruing status, and (2) administrators and officials who must implement the declaration under the Act. The steps below are practical and derive directly from the instrument’s text and structure.

For scheme members or representatives:

1. Identify the applicable paragraph in s 7 that matches the factual circumstances. The instrument lists discrete categories: CDEP participation (s 7(a)), incarceration (s 7(b)), psychiatric confinement on charge (s 7(c)), partner‑status/intent situations (s 7(d)), leave‑related inability to pass the work test (s 7(e)-(f)), bereavement (s 7(g)), major disaster reductions in available gainful work (s 7(h)-(i)), and compensation period inability (s 7(j)). COVID‑19 related inability is covered in s 10. Correct classification is the first compliance step.

2. Establish the temporal window. For most categories, s 8(1) states non‑accrual applies “throughout the period during which the member is a member of the kind mentioned in the paragraph.” For categories in s 8(2) the member must be aware of statutory caps: 26 weeks for (e) and (f); 13 weeks for (g), (h) and (i). For compensation‑related (j) members, s 8(3) ties non‑accrual to the compensation period. Cyclone Larry has a specific not‑before date and 13 week cap (s 9). For COVID‑19, consult s 10(3) for the ascertainment of the period (s 10(1)-(3)).

3. Gather authoritative evidence. Although the declaration does not set evidentiary standards, applicants should prepare contemporaneous documentary evidence that maps to the declared category. Examples (depending on category) include:

   • Official documentation proving CDEP participant status (for s 7(a)), ideally from the Social Security agency.
   • Prison records for incarceration (s 7(b)).
   • Medical records and court records for psychiatric confinement on charge (s 7(c)).
   • Evidence of partner workforce participation and their registration intention or lack of registration for s 7(d).
   • Employment records showing leave dates and inability to pass work tests for s 7(e)-(f).
   • Death certificate and documents reflecting bereavement period for s 7(g).
   • Evidence of local disaster impact and reduction in available work for s 7(h)-(i), including, for Cyclone Larry, local disaster declarations and dates (s 9).
   • Compensation documentation and pension status for s 7(j).

4. Apply through the administering body following the Act. Because this instrument operates under subsection 45TO(1), applications must follow the Act’s processes. Keep contemporaneous records of applications, decision letters and internal review rights. Where an administering decision is adverse, invoke the Act’s review mechanisms and general administrative law remedies.

For administrators and officials:

1. Train decision‑makers on cross‑statutory definitions. Because the declaration imports Part IIIAB definitions and Social Security Act concepts (s 6), decision‑makers must be conversant with those external texts to apply the declaration correctly.

2. Implement precise period calculations. The statutory time limits in s 8(2), the Cyclone Larry cap and not‑before date (s 9), and compensation period rules (s 8(3)) require systems that can calculate entitlement windows to the week and map them to bonus periods. Introduce workflow controls so non‑accrual status automatically ends when the statutory cap is reached.

3. Set and document evidence standards. Although the declaration does not prescribe evidence, agencies should publish guidance on what documentation, certifications or verification steps are acceptable for each declared category. This reduces dispute and ensures consistent application.

4. Integrate with disaster response and public health frameworks. For s 7(h), s 7(i) and s 10, coordinate with emergency management and public health agencies to identify affected regions and periods where gainful work availability was reduced. For Cyclone Larry and COVID‑19, establish triggers that automatically flag potentially eligible members (s 9; s 10).

5. Preserve continuity for persons covered by the revoked declaration. Use s 5 to transition cases from the 2007 instrument into current case management, checking whether the person’s circumstances continue to meet a s 7 category and whether any caps apply.

6. Ensure audit and record‑keeping systems capture start and end dates, reasons for status grants, and documentary evidence. Because the instrument establishes time‑bounded legal statuses, poor record‑keeping will create remedial liabilities.

7. Review internal policies for appeals and errors. Where an incorrect decision is made, the Act’s review mechanisms will apply. Establish internal review pathways that align with the Act’s statutory procedures to reduce litigation risk.

8. Monitor legislative amendments and the Legislation Register. The endnotes indicate amendment activity (Endnote 3 and 4). Administrators must confirm commencement dates from the authoritative register to ensure they apply the current text; the compilation’s endnotes show that the 2021 amendment has registration and commencement dates that should be checked on the Legislation Register for accuracy (Endnote 3).

Practical compliance therefore requires alignment of factual proof, precise temporal calculation and inter‑agency coordination, together with clear published guidance that informs applicants what to submit and how decisions will be made.
