What it does
The Veterans’ Entitlements (Partner Service Pension , Retention of Eligibility) Determination 2019 is a legislative instrument made under subsection 38(2AD) of the Veterans’ Entitlements Act 1986. It commenced on 20 September 2019. The instrument sets out the circumstances in which the married or non-married former partner of a veteran retains eligibility for a partner service pension despite separation from the veteran for more than 12 months. Section 4 states that the purpose is to specify those circumstances for the operation of subsection 38(2AD) of the Act.
Section 6(1) provides that subsections (2) and (3) specify the circumstances for the purposes of subsection 38(2AD) of the Act. Subsection 6(2) requires that on the first day on which the former partner does not reside in the same residence as the veteran, referred to as the first separate residence day, the veteran must have a psychological or other mental health incapacity caused by one of five listed matters. Those matters are a war-caused injury or war-caused disease for which the Commission has determined entitlement to a pension, a defence-caused injury or defence-caused disease for which the Commission has determined entitlement to a pension as a member of the Forces or a Peacekeeping Force, a service injury or service disease within the meaning of the Military Rehabilitation and Compensation Act 2004 for which the Military Rehabilitation and Compensation Commission has determined to accept liability, a disease or disorder mentioned in subsection 85(2) of the Act for which the veteran is eligible for treatment, or a condition to which a determination under paragraph 88A(1)(a) of the Act applies.
Subsection 6(3) requires that the Commission is satisfied that, before the first separate residence day, the domestic environment shared by the former partner with the veteran was, because of the veteran’s behaviour, unsafe or abusive for the former partner or any child of the former partner. The instrument therefore operates as an exception to the general position under the Veterans’ Entitlements Act 1986 that separation exceeding 12 months ends eligibility for the partner service pension. It does so only where both the mental health incapacity condition and the prior unsafe or abusive environment condition are met.
