What it does
This legislative instrument, titled Veterans’ Entitlements (Non‑warlike Service) Determination 2019, performs a single legal function: it designates, for the purposes of subsection 5C(1) of the Veterans’ Entitlements Act 1986 (the Act), particular periods and places of Australian Defence Force service as "non‑warlike service" (s 1; s 3; s 6). The instrument contains a Schedule (headed "1 Non‑warlike service") that operates in two ways. First, it makes a role‑ and period‑specific declaration in relation to the Berlin Airlift: service as Royal Australian Air Force aircrew involved in the Western allies' humanitarian aid operation for West Berlin between 15 September 1948 and 29 August 1949 is specified as non‑warlike service (Schedule 1, para (a)). Second, it lists discrete operations by item number and specifies the operation name, the nature of the operation, the area of operation (sometimes with precise geographic coordinates, territorial limits, or radius rules) and the date period during which service in that area constitutes non‑warlike service (Schedule 1, para (b) and the table).
Mechanically, the Schedule creates a rule of classification. For operations listed in the table, the determination is expressed as conditional: service is non‑warlike service if (i) the service was in an area of operation mentioned in the relevant item and (ii) the service occurred during the period stated for that area of operation (Schedule 1, para (b)(i)-(ii)). The instrument thus sets objective factual predicates, operation name, area, and period, that must be met for classification under the Act. No duties, penalties, or new entitlements are created by the instrument itself; instead the instrument supplies the statutory fact of classification to be used within the Act’s framework (s 6).
The instrument was made under subsection 5C(1) of the Act, and it contains short definitions, including that "Act" means the Veterans’ Entitlements Act 1986 and "NATO" means the North Atlantic Treaty Organization (s 5). The instrument therefore functions as a legislative specification under the VEA’s delegated power: it identifies particular historical and contemporary deployments that, if an individual’s service record matches the itemised area and period (and role where stated), will be treated as non‑warlike service for purposes of the Act.
