What it does
This legislative instrument modifies the asset deprivation rules that apply when calculating a veteran’s or partner’s assets for the purposes of the Veterans’ Entitlements Act 1986 (the Act). It binds the Repatriation Commission (the Commission) to a set of decision-making principles when the Commission determines whether a transfer of property to a company or trust should be treated as a disposal of an asset for means testing purposes. Without these principles, the general asset disposal provisions in Subdivision B of Division 11 of Part IIIB and section 45UT of the Act would apply without the modifications set out here.
The instrument operates across five Parts. Parts 2 and 3 cover disposals that occur on or after 1 January 2002. Part 2 applies when an individual (not a company or trust) transfers property to a company or trust by way of capital contribution. It requires the Commission to take into account whether the individual was the sole attributable stakeholder of the company or trust, both before and after the transfer, and where there are multiple attributable stakeholders, to consider the income attribution percentage of each (sections 7, 8, 9). Part 3 covers disposals by a company or trust to an individual, specifically dividends or distributions, and requires the Commission to consider whether the amount is reasonable having regard to the individual’s asset attribution percentage (section 12). It also provides a safe harbour for “genuine investors” who receive dividends or distributions after making a genuine transfer of capital to the company or trust, provided the capital transfer meets four cumulative conditions: equivalent value shares or units, a right to capital on winding up, a right to dividends or distributions under constituent documents, and the individual is over 18 (section 13). Parts 4 and 5 deal with disposals that occurred before 1 January 2002, where the Commission must consider whether applying the asset disposal provisions would be unfair or unreasonable in the circumstances, having regard to whether the asset’s value has changed, whether the company or trust retains the consideration from an arm’s length sale, and whether the transferor is a member of a couple and the sole attributable stakeholder (sections 16, 17, 18, 19, 22, 23, 24). The instrument also repeals the previous principles contained in Schedule 5 to the Veterans’ Affairs (Legislative Instrument Re-making Exercise) Instrument 2014 (section 3A).
