What it does
This instrument specifies which forms of retirement income streams qualify as "asset‑tested income streams (lifetime)" for the purposes of the Veterans’ Entitlements Act 1986, and it sets rules for calculating the purchase amount and extent of those lifetime components when determining means for veterans’ entitlements. It takes effect on 1 July 2019 immediately after the commencement of Schedule 1 of the Social Services and Other Legislation Amendment (Supporting Retirement Incomes) Act 2019 (s 2). The legislative authority for the instrument is drawn from specified subsections of the Veterans’ Entitlements Act 1986 (s 3), namely subsection 5JE(3) and provisions in s 52BAA and s 52BAB.
Mechanically, the instrument does two discrete things. First, it describes three alternative contract or governing‑rules structures under which a product will be treated as including a "lifetime component" that is an asset‑tested income stream (lifetime) (s 5). Those structures are: a guaranteed minimum income for life packaged with an account‑based or allocated product (s 5(2)); a lifetime income stream packaged with an account‑based or allocated product where payments are financed in part by a specified collective fund and forfeitures (s 5(3)); and a lifetime income stream packaged with a term‑limited income stream (s 5(4)). Each paragraph sets out the concrete elements that must appear in the contract or governing rules for the treatment to apply.
Second, the instrument prescribes how the purchase amount for the lifetime component is to be determined for means‑testing purposes (s 6). If the lifetime component is financed wholly or partly by fees or charges, the purchase amount is the amount of those fees or charges paid by the individual (s 6(2)(b)(i)). If it is financed wholly or partly by contributions into a specified fund or investment option that the individual was required to pay into, the purchase amount is worked out by compounding contributions in accordance with formulas in the Veterans’ Entitlements Act (s 6(2)(b)(ii), (3) and (4)). Where the Commission is satisfied the lifetime component is not wholly financed by those means, the purchase amount becomes the value attributable to the individual as certified by an actuary who is a Fellow or Accredited Member of the Institute of Actuaries of Australia (s 6(5)).
