The determination operationalises eligibility for counselling under s 92 of the Veterans’ Entitlements Act 1986 by specifying who counts as a class of person for subparagraph 92(1)(a)(iii). Key conceptual building blocks are definitions and cross-references to other veterans’ law instruments and to the Commission’s opinion.

Core concepts and how the instrument uses them:

• Service member (defined in Part 1, s 5): This is a central construct. The instrument defines “service member” as a person who is not a veteran under paragraph (a) of the Act’s definition of veteran, a member of the Forces, or a member of a Peacekeeping Force, but who falls into one of several categories: (a) a member or former member of the Australian Defence Force with an accepted mental health disability; (b) a person who as a member rendered border protection service, Australian or overseas disaster zone service, or submariner service; (c) a member or former member involved in a training accident; (d) a person medically discharged from the ADF; (e) a member killed in a service-related incident; or (f) a veteran by reason only of being a Commonwealth/allied veteran who satisfies s 37(3) and is undertaking a vocational rehabilitation program under the Veterans’ Vocational Rehabilitation Scheme (s 5, definition of service member).

• Accepted mental health disability: For non-veteran service members, this is a mental health condition for which liability has been accepted under the Military Rehabilitation and Compensation Act 2004 (MRCA) or compensation received under the DRCA (Safety, Rehabilitation and Compensation (Defence-related Claims) Act 1988). The instrument expressly ties medical acceptance under those regimes to counselling eligibility for non‑veteran service members (s 5, accepted mental health disability).

• NLHC service member and White Card holder (mental health condition): NLHC service member refers to someone whose claim for mental health treatment on a non-liability healthcare basis has been accepted under the Veterans’ Entitlements (Expanded Access to Non-Liability Health Care for Mental Health Treatment) Determination 2017 (s 5). A White Card holder is expressly defined to include NLHC service members or those provided with a White Card for an accepted mental health disability (s 5).

• Gold Card and Treatment Principles: The instrument recognises Gold Card and Treatment Principles concepts as markers of entitlement for certain family relationships to receive counselling services (s 5 definitions). Gold Card denotes a Repatriation Health Card indicating eligibility under veterans' law for treatment (subject to Treatment Principles).

• Family member and related relationship concepts: The instrument provides its own definition for "family member", with scope (parent, partner, former partner, child, former child or sibling) and permits the Commission to treat others as family members "in the opinion of the Commission" (s 5). Definitions such as former child, former partner, sibling and break‑up date are used to set time-limited entitlements (for example the five-year rule in s 7).

• Discretionary factual findings by Commission: Several eligibility concepts are expressed as dependent on the Commission’s opinion, e.g. whether an area was a disaster zone or whether a training accident occurred and constituted a serious injury (s 5, Australian or overseas disaster zone service; training accident). That embeds administrative discretion in factual determinations relevant to eligibility.

• Cross-references to other legislative instruments and schemes: The instrument expressly connects eligibility to the MRCA, DRCA, the Veterans’ Vocational Rehabilitation Scheme, the NLHC Determination 2017, the SHOAMP health care scheme and the Defence Abuse Reparation Scheme (DART). Eligibility for counselling can therefore be contingent on status under those separate statutory schemes (s 5 definitions; Part 2 s 6(b),(c),(d)).

Mechanically, these concepts establish the perimeter of who may be offered counselling through the Open Arms arrangement. They are not abstract policy labels: they change who can receive a particular service under Part V of the Act by reference to defined administrative and statutory statuses and to Commission determinations.

The instrument affects a defined, enumerated set of people by making them eligible to be provided counselling services under subparagraph 92(1)(a)(iii) of the Act. The affected groups are listed in Part 2, s 6 and are implemented through the definitions in Part 1, s 5. Who pays and how services are funded is not spelled out in the instrument, but the preamble establishes that the Repatriation Commission, by arrangement with Open Arms, is the delivery vehicle for counselling to these classes.

Directly affected individuals and classes (Part 2, s 6):

• Service members as defined (s 6(a), Part 1 definition): non‑veteran or non-members-of-the-Forces persons who meet the subcategories (accepted mental health disability; border protection, disaster zone, submariner service; training accident involvement; medically discharged; killed in service-related incident; or vocational rehabilitation participant under s 37(3)). This is a broad class that captures people whose status sits outside the Act’s primary veteran/member categories but who nonetheless have a nexus to ADF service.

• NLHC service members (s 6(b)): people accepted under the NLHC Determination 2017 for non-liability health care for mental health.

• Registered DART complainants (s 6(c)): persons registered under the Defence Abuse Reparation Taskforce for access to reparation payments or other outcomes.

• SHOAMP participants (s 6(d)): persons in Group 1 or Group 2 under the Study of Health Outcomes in Aircraft Maintenance Personnel health care scheme; the note clarifies that Group 2 may include family members or ex-partners of the primary participant.

• Dependants and family members linked to service members or veterans (s 6(e)-(n)): children, former children, partners, former partners, and family of those killed in service‑related incidents; family of members who died by suspected suicide; family of registered DART complainants; specific relationships tied to Gold Card and White Card holders. Paragraph 6(o) extends counselling eligibility to "partner or former partner of a veteran or a person within a class specified in paragraph 6(a), 6(b) or 6(c)" and was treated as having commenced on 1 July 2017 (see item 2(2)).

Indirectly affected parties and organisational actors:

• The Repatriation Commission: the instrument allocates to the Commission the role of implementing the eligibility rules and making factual determinations where the text invokes the Commission's opinion (Part 1 definitions). The Commission also engages the delivery partner (Open Arms) by arrangement.

• Open Arms (Departmental counselling service): named in the preamble as the service provider in the approved arrangement. The instrument effectively authorises the Commission to provide counselling via Open Arms to the listed classes.

• Families and former partners receiving time-limited or conditional coverage: former partners’ counselling eligibility is explicitly time-limited (s 7), which affects former partners who must establish break-up dates or co-parenting responsibility to determine access.

Groups explicitly not extended by this instrument:

• Veterans, members of the Forces and members of Peacekeeping Forces and their dependants are noted in the instrument as not being covered here because they may be provided with counselling under subparagraphs 92(1)(a)(i) and (ii) by virtue of being veterans or members (Part 2 note 1). Thus the instrument targets groups outside the conventional veteran/member categories, bringing certain alternative statuses within the counselling net.

Who decides and who administers eligibility: the Commission takes the ultimate operational decisions in areas where the instrument uses the Commission’s opinion, and the preamble shows that delivery is arranged with Open Arms under an approved arrangement. The instrument therefore shifts certain service access decisions into administrative processes run by the Commission in collaboration with Open Arms (preamble; Part 1 definitions; Part 2).

The instrument creates administrative rights to be provided counselling services for the specified classes and places obligations and decision-making powers on the Repatriation Commission and, in practice, on the delivery agent. The instrument itself is not a statute of private law rights and duties; instead it is a statutory determination that defines which classes of persons may be furnished counselling under the Act through the approved arrangement.

Rights created or clarified by the instrument:

• Right to counselling access: Individuals in the classes identified in Part 2, s 6 (for example service members, NLHC service members, registered DART complainants, SHOAMP participants, certain family members, partners and former partners, Gold Card and White Card related persons) are specified for the purposes of subparagraph 92(1)(a)(iii), making them eligible to be provided counselling through the Commission’s arrangements (Part 2, s 6).

• Time-limited rights for former partners: A former partner’s right to be provided counselling is limited to either five years from the break-up date or, where the former partner shares co-parenting responsibility for a child aged 18 or younger with the veteran or relevant person, for the duration of that co-parenting responsibility (s 7). That creates a temporal duty on the Commission or the delivery agent to apply timing rules when assessing applications.

Duties and administrative discretions:

• Duty to apply definitions and administer eligibility: The Commission must apply the definitions set out in Part 1, s 5 when determining whether a person falls into a listed class, because the determination operates by specifying classes of persons. The instrument leaves particular factual determinations to the Commission’s opinion for certain definitions , for example whether particular service was rendered in an area that "in the opinion of the Commission" was a disaster zone (s 5, Australian or overseas disaster zone service), whether a training accident occurred and whether it caused a "serious injury" (s 5, training accident), and whether a person should be treated as a family member (s 5, family member). Those clauses create administrative discretion in fact-finding that the Commission must exercise.

• Duty to rely on external statutory statuses: Several rights depend on statuses established under other statutes or instruments. For example, accepted mental health disability requires acceptance under the MRCA or payment under the DRCA (s 5, accepted mental health disability). NLHC status requires acceptance under the NLHC Determination 2017. Registered DART complainant status depends on registration under the Defence Abuse Reparation Scheme (s 5; Part 2, s 6(c)). These cross-system linkages impose duties on administrators to verify statuses under other schemes before granting counselling access.

• Delivery duty via approved arrangement: The preamble indicates that the arrangement with Open Arms is the vehicle for providing counselling under this determination. That places an operational duty on the Commission to coordinate service provision with Open Arms in accordance with the arrangement the delegate approved (preamble).

Rights not specified by the instrument:

• The instrument does not specify the form, duration or intensity of counselling services; it refers to "treatment" concepts elsewhere only by defining Gold Card and Treatment Principles (s 5). It does not establish appeal rights, timeframes for application decisions, or a merits review process within the instrument itself. Those procedural rights, if any, derive from the Act or administrative law, not the determination text.

Practical effects for applicants and administrators:

• Applicants must demonstrate or hold the qualifying statuses set out in definitions (e.g. Gold Card, White Card, NLHC acceptance, DART registration) or be discovered as falling within a class the Commission recognises. Administrators must apply statutory definitions and Commission opinion-based tests and coordinate with Open Arms to arrange counselling services. The determination therefore operates primarily as a grid of eligibility rules and administrative duties to apply those rules.

The instrument contains no criminal or civil penalty provisions, and it does not prescribe enforcement mechanisms in the form of sanctions, fines, or statutory offences. Its effect is to define, under subsection 92(2) of the Act, the classes of persons eligible to be provided counselling services and to authorise the Commission to provide such services by arrangement with Open Arms. Enforcement in the conventional statutory penalty sense is therefore not part of this instrument.

Administrative enforcement and operational compliance:

• Administrative gatekeeping: The instrument delegates factual determinations and eligibility gatekeeping to the Commission. Where eligibility depends on an assessment expressed as "in the opinion of the Commission" (for example whether an area was a disaster zone, whether a training accident occurred and caused a serious injury, and whether a person should be treated as a family member), eligibility is enforced by administrative decision-making. That means that access to counselling for those categories is contingent on the Commission’s administrative findings. The instrument therefore enforces eligibility by reference to administrative gatekeeping rather than by imposing penalties (Part 1 definitions).

• Contractual compliance via arrangement with Open Arms: The instrument's preamble records the approval of an arrangement between the Commission and Open Arms to provide counselling services. Compliance with the instrument’s requirements will therefore be operationalised via that arrangement. Contractual or administrative sanctions for failure to supply counselling would be matters of the arrangement and Departmental/Commission governance, not the instrument itself.

• Cross-system verification as compliance filter: The instrument ties several eligibility classes to status under other schemes (MRCA acceptance, DRCA compensation, NLHC determinations, DART registration, Gold Card/White Card status). The need to verify those statuses is the mechanism by which the Commission and Open Arms enforce the instrument’s eligibility rules. Where a person lacks the prerequisite status, the administrative consequence (denial of counselling) is the enforcement outcome.

No statutory penalties or review provisions in instrument:

• The instrument does not set out internal review or appeal pathways for determinations made under it. Any review or merits appeal would thus be governed by the Act, by administrative law (including the Administrative Decisions (Judicial Review) Act 1977, where applicable), or by departmental grievance procedures. The instrument itself is silent on remedies for incorrect administrative denial or delayed access.

Operational risk of non-provision:

• Because the instrument does not create penalty provisions, the only enforcement lever for a claimant denied counselling would be administrative review/merits review or judicial review of the Commission’s decision-making, if grounded on jurisdictional error or failure to apply the instrument correctly. The instrument does not prescribe such pathways.

In sum, enforcement is administrative and operational: the Commission applies definitions and statuses, coordinates with Open Arms under an approved arrangement, and supply or denial of counselling is the de facto enforcement outcome. The determination does not create statutory offences or penalty regimes.

The instrument explicitly cross-references multiple existing statutes and instruments and depends on those instruments for definitions or eligibility triggers. Its legal effect is interstitial: it specifies which classes of person under related laws become eligible for counselling under s 92 of the Veterans’ Entitlements Act 1986. The instrument therefore operates as part of a network of veterans’ and defence-related statutory provisions.

Direct statutory and instrument references:

• Veterans’ Entitlements Act 1986 (the Act): The instrument is made under subsection 92(2) of the Act (s 3) and specifies classes for the purposes of subparagraph 92(1)(a)(iii) (Part 2, s 6). The instrument also refers to s 81 (in notes) to explain how the Act already treats veterans, members of the Forces and Peacekeeping Force members as eligible under other paragraphs (see Part 1 notes and Part 2 note 1). It refers to subsection 37(3) of the Act as relevant for inclusion of certain persons undertaking Veterans’ Vocational Rehabilitation (Part 1, s 5, service member(f)).

• Military Rehabilitation and Compensation Act 2004 (MRCA) and DRCA (Safety, Rehabilitation and Compensation (Defence-related Claims) Act 1988): The instrument conditions eligibility for persons with an "accepted mental health disability" on acceptance of liability under the MRCA or compensation under the DRCA (Part 1 definition of accepted mental health disability). It also imports the MRCA definition of “service-death” via s 28 and s 29(3) references (Part 1, definitions of killed in a service-related incident and service-death note). By tying eligibility to MRCA or DRCA determinations, the instrument ensures that an administrative finding or compensation outcome under those regimes acts as a prerequisite to counselling entitlements under s 92 in the non‑veteran/service member space.

• Veterans’ Entitlements (Expanded Access to Non-Liability Health Care for Mental Health Treatment) Determination 2017 (NLHC Determination 2017): NLHC service member status is defined by acceptance under that determination (Part 1, s 5), meaning the instrument depends on acceptance from a separate legislative instrument for rights to counselling.

• Veterans’ Vocational Rehabilitation Scheme: The instrument includes persons undertaking rehabilitation under that scheme where they meet conditions in subsection 37(3) of the Act (Part 1, s 5(f)). Hence vocational rehabilitation status under the scheme interacts with counselling eligibility.

• Defence Abuse Reparation Scheme (DART): The instrument makes registered DART complainants (those registered and accepted to access reparation or other outcomes) eligible for counselling (Part 2, s 6(c)). In doing so, the instrument imports the registration/acceptance processes and outcomes under the DART scheme as eligibility triggers for counselling services.

• SHOAMP health care scheme: SHOAMP participants are specifically included (Part 2, s 6(d)). The instrument thereby interacts with the health care outcomes and classifications within the SHOAMP scheme.

Practical cross-system consequences:

• Eligibility cascades: The instrument makes counselling eligibility contingent on findings and administrative states produced by other laws and instruments. For example, a person seeking counselling as an "accepted mental health disability" service member must have that status recognised under the MRCA or DRCA. Thus administrative decisions under MRCA/DRCA or under the NLHC Determination 2017 have downstream consequences for access to services under the Act.

• Commission opinion and statutory overlap: For certain factual issues (disaster zone service, training accidents, family membership), the instrument gives the Commission the opinion-based fact-finding role (Part 1, definitions). These subjective determinations interact with the legal determinations under other statutes (e.g., MRCA or DRCA), potentially creating coordination needs between statutory decision-makers.

• Treatment Principles and service scope: The instrument references the Treatment Principles made under s 90 of the Act and the MRCA Treatment Principles under that Act (Part 1, Treatment Principles definition). That linkage suggests that the content and scope of treatment provided under this counselling determination should align with those Treatment Principles, thereby importing standards or limits from those instruments into the counselling provision context.

• Non-duplication and coverage boundaries: The instrument explicitly excludes veterans, members of the Forces and Peacekeeping Force members as classes under this instrument because those persons are covered under other paragraphs of s 92 (Part 2, note 1). This helps define boundaries across overlapping entitlements under the Act.

Legal and administrative coordination required:

• Administrators must verify statuses under the MRCA, DRCA, NLHC Determination, DART registration and SHOAMP participation before granting counselling under this instrument.

• Because several determinations and standards are made "in the opinion of the Commission", inter-agency coordination may be required where other specialist decision-makers have made determinations relevant to eligibility (for example, MRCA decisions about service-death or DRCA determinations about injury).

In short, the instrument functions as a connector between the counselling provision power under s 92 of the Act and a series of other statutory or instrument-based statuses. Implementation therefore requires coordination across multiple legal regimes and administrative decision-making loci.

The instrument itself contains its limited amendment history and effect on prior instruments. It expressly revokes the Veterans' Entitlements (Counselling) Extended Eligibility Determination (No. 2) 2017 (s 4). It also treats one provision, paragraph 6(o) of Part 2, as having retrospective commencement to 1 July 2017 immediately after the commencement of the 2017 instrument (s 2(2)). That is the only retrospective/retroactive element recorded in the instrument.

Key amendment steps recorded in the text:

• Revocation of prior instrument: Section 4 states that the Veterans' Entitlements (Counselling) Extended Eligibility Determination (No. 2) 2017 is revoked. The revocation replaces the earlier extended eligibility determination with the 2021 determination's new classes, definitions and structure. The instrument does not reproduce the prior instrument’s text, so one must compare the two instruments externally to identify precise changes in class scope or drafting, but the 2021 instrument is the operative determination after revocation.

• Commencement timing and retrospective effect: Section 2 provides that the instrument is taken to have commenced on the day after it is registered, subject to subsection (2) which treats paragraph 6(o) as having commenced on 1 July 2017 immediately after the commencement of the earlier determination (No. 2) 2017. In practice, that means that the extension in paragraph 6(o) , partner or former partner of a veteran or a person within classes 6(a), 6(b) or 6(c) , is treated as having had effect from 1 July 2017 (following the earlier instrument) even though the rest of the instrument commences upon registration.

• Definitions and incorporations: The instrument as made in 2021 integrates and updates a range of definitions (Part 1, s 5). Those definitions may differ from the 2017 instrument, but the instrument does not provide a line-by-line amendment table. The revocation indicates full replacement rather than a simple amendment.

• No subsequent amendments or variations are recorded within the text: The instrument text does not itself record later amendments or variations. Any subsequent changes to eligibility would require the Commission to make a further determination under subsection 92(2) of the Act and publish a new instrument. The instrument’s own approach to referencing other legislative instruments (e.g. NLHC Determination 2017 and MRCA Treatment Principles) anticipates that those instruments may be amended over time and are incorporated "as in force from time to time" (Part 1 definitions), making some aspects of eligibility responsive to changes in related instruments.

Practical implications of the revocation and retrospective clause:

• The revocation consolidates the 2021 eligibility rules and removes the earlier instrument as the operative text, shifting the legal point of reference for counselling eligibility to this instrument.

• The retrospective treatment of paragraph 6(o) could affect claims or administrative processes that arose between 1 July 2017 and the registration date of this instrument. The text expressly takes paragraph 6(o) to have commenced 1 July 2017, so an administrative decision-maker applying the instrument should treat that category as having been in force from that earlier date (s 2(2)). The instrument does not specify transitional administrative processes; those would be matters for Commission policy or departmental practice.

This is the complete amendment history contained in the instrument: revocation of the 2017 Determination and retrospective commencement for paragraph 6(o).

The instrument itself contains no record of litigation. It is an administrative determination made under subsection 92(2) of the Veterans’ Entitlements Act 1986. The text does not cite any judicial decisions, does not reproduce appeals or review outcomes, and contains no statement about past or pending litigation.

What the instrument does show relevant to potential litigation:

• Administrative fact-finding and discretionary terms: Several eligibility elements depend on facts to be found "in the opinion of the Commission" (for example, whether an area was a disaster zone, whether a training accident occurred and was a "serious injury", and whether a person should be treated as a family member). These opinion-based determinations are precisely the kind of discretionary administrative findings that can generate disputes and potentially be the subject of judicial review if a person asserts jurisdictional error, failure to take into account relevant considerations, taking into account irrelevant considerations, or denial of procedural fairness. The instrument itself does not create a review mechanism but places decision-making within the Commission where judicial review avenues may exist under general administrative law.

• Cross-reliance on other statutory determinations: Because eligibility can depend on MRCA/DRCA acceptance or DART registration, disagreements about whether a person has the requisite status under those systems might give rise to collateral litigation or administrative review in those regimes, which would in turn affect counselling eligibility. The instrument does not itself set dispute resolution pathways, but the dependency means disputes about MRCA or DRCA findings could have consequential effects for access to counselling under this instrument.

• Time-limited entitlements and evidentiary disputes: The five-year limit for former partners (s 7(a)) or the co-parenting exception (s 7(b)) can cause contestation over dates (break-up date) or the existence/duration of co-parenting responsibility. Such disputes are factual and might be the subject of merits review or judicial review if procedural or legal error is alleged.

Absence of litigation record in instrument:

• The instrument contains none of its own litigation records, outcomes, or references to feedback or judicial interpretation. Any litigation history relevant to the operation of this determination would need to be sought in court records or administrative decisions concerning the Commission, Open Arms, MRCA/DRCA or the NLHC/DART/SHOAMP schemes.

For practitioners, the main observable litigation risk from the instrument stems from administrative law challenges to Commission fact-finding or cross-system status determinations rather than from statutory penal enforcement. Practitioners should therefore look to administrative law jurisprudence, the Act, and decisions under related schemes for litigation precedents that could be used to challenge eligibility decisions influenced by this determination. The instrument itself provides no litigation map.

This instrument contains a number of drafting and operational features that create practical pitfalls for claimants, administrators and service providers. These follow directly from the instrument’s text.

1. Eligibility by cross-referenced status rather than by event alone: Several classes require that a person have a pre-established status under another law or instrument. For example, "accepted mental health disability" requires MRCA acceptance of liability or DRCA compensation (Part 1, accepted mental health disability). An NLHC service member must be accepted under the NLHC Determination 2017 (Part 1, NLHC service member). If a claimant has suffered the same harm but lacks formal recognition under these regimes, they may be ineligible despite an apparent nexus to service. The instrument therefore makes formal determinations under other schemes gatekeepers to counselling.

2. Commission opinion as determinative factual test: Terms such as "Australian or overseas disaster zone service", "training accident", and the ability to treat "another person" as a family member are explicitly subject to the Commission’s opinion (Part 1 definitions). That creates an evidentiary and administrative risk: eligibility can be denied as a matter of administrative assessment rather than strict statutory threshold. Applicants face uncertainty because the instrument does not stipulate criteria or procedural steps for those opinion-based assessments.

3. Veterans and members of the Forces expressly excluded from this instrument: The instrument notes that veterans, members of the Forces and members of a Peacekeeping Force and their dependants are not covered by this instrument because they are eligible under other paragraphs of s 92 (Part 2 note 1). Practically, an applicant who is a veteran may be wrongly directed to this determination instead of being assessed under the veteran-specific pathways; administrators must therefore triage applicants accurately to the correct statutory pathway.

4. Timing and retrospective effect confined to paragraph 6(o): Paragraph 6(o) (partner or former partner of a veteran or a person within 6(a)-(c)) is treated as having commenced on 1 July 2017 (s 2(2)). The instrument does not state whether other transitional rules apply or how to treat applications made before registration. Practitioners must be alert when dealing with services or claims spanning the 2017-2021 period, particularly for former partners.

5. Former partner time limit and co-parenting exception: Former partners are eligible for five years from the break-up date or longer if they have co-parenting responsibility for a child aged 18 or younger (s 7). Determining break-up dates and co-parenting responsibility is often fact-intensive; the instrument does not set procedural mechanisms for establishing those facts. Parties should expect evidentiary requests and possible disputes about dates and parental responsibility.

6. "Family member" can be expanded in Commission’s opinion: The instrument defines "family member" in a closed list but allows the Commission to treat "another person, who in the opinion of the Commission, should be treated as a family member" (s 5, family member). That creates a potential unpredictability for people whose relationships do not fit conventional categories; outcomes will depend on demonstrable relationships and the Commission’s view.

7. No procedural detail about service scope or review rights: The instrument specifies who may be provided counselling but neither describes the type, length, or clinical scope of counselling nor specifies appeal or review processes for adverse eligibility decisions. Those institutional gaps can cause uncertainty about what counselling will be provided and how to challenge denials.

8. Delivery arranged with a particular provider: The preamble records an approved arrangement with Open Arms for delivering counselling (preamble). Where Open Arms’ operating guidelines impose eligibility conditions or clinical thresholds, there can be additional administrative layers beyond this instrument. The instrument does not make Open Arms’ policies part of the instrument itself; however, in practice, service delivery depends on Open Arms’ operational rules.

9. Multiple overlapping eligibility routes create administrative complexity: Some persons may qualify by several paths (e.g. a person could be an NLHC service member and also fall within the "service member" definition). Administrators must avoid double-counting but must also ensure applicants are not lost amid overlapping routes.

10. No penalties for denial; remedy rests on administrative law: The instrument contains no penalty or review procedure. Remedy for disputed denials will be through administrative law channels, and the instrument’s reliance on Commission opinions could raise threshold issues for review (jurisdictional error versus merits review).

These "gotchas" are not speculative; they arise from the instrument’s reliance on cross-referenced status requirements, opinion-based factual determinations, time-limits, and the absence of procedural detail.

Compliance for different actors (claimants, the Commission, Open Arms and other providers) involves following the definitions, verifying cross-referenced statuses and documenting factual prerequisites that the instrument makes decisive. The instrument itself sets the categories and the tests; practical compliance is about evidencing those tests.

For claimants seeking counselling:

• Identify which class under Part 2, s 6 you allege to fall within. Work from the definitions in Part 1, s 5. For example, determine if you are a "service member" under the instrument by checking whether you have an accepted mental health disability under the MRCA/DRCA, rendered border protection/disaster/submariner service, were involved in a training accident, were medically discharged, were a member killed in a service-related incident, or meet the s 37(3) vocational rehabilitation criteria.

• If eligibility depends on MRCA or DRCA acceptance, secure documentary evidence of that acceptance or compensation decision (the instrument makes those statuses preconditions , Part 1 accepted mental health disability).

• For NLHC status, confirm acceptance under the Veterans’ Entitlements (Expanded Access to Non-Liability Health Care for Mental Health Treatment) Determination 2017. The instrument defines NLHC service member as such an acceptance (Part 1).

• For DART, produce confirmation of registration and acceptance to access a reparation payment or other outcome.

• For SHOAMP, confirm your Group 1 or Group 2 participant status, including evidence of family or ex-partner relationships where relevant.

• For family members, former partners or former children, compile proof of relationship status, break-up date (for former partners), co-parenting arrangements and dates for children. Remember the five-year limit for former partners absent co-parenting responsibility (s 7).

• For Gold Card and White Card status, obtain official documentation that you hold the Repatriation Health Card (Gold or White) or the departmental record showing the White Card for mental health.

For administrators at the Repatriation Commission:

• Apply the statutory definitions in Part 1, s 5 when assessing applications. Where a definition ties eligibility to acceptance under another Act or instrument (MRCA, DRCA, NLHC Determination, DART, SHOAMP), require verified documentation or proof.

• Where the instrument uses the phrase "in the opinion of the Commission" for factual categories (Australian or overseas disaster zone service; training accident; family member), develop and publish internal guidance and evidentiary protocols to ensure consistent exercise of administrative discretion and to reduce arbitrary outcomes. Document decisions thoroughly to be defensible in administrative review or judicial scrutiny.

• For former partner applications, institute a process for determining break-up dates and co-parenting responsibility evidence; maintain records of decisions and the rationale for start and end dates for eligibility.

• Coordinate with Open Arms under the approved arrangement to align intake, eligibility checks, referral and clinical acceptance procedures. Clarify whether Open Arms requires additional clinical thresholds beyond statutory eligibility and put these on notice to applicants.

• Ensure Commission staff are trained on cross-system verifications (MRCA, DRCA, NLHC, DART, SHOAMP) and that liaison processes exist with the decision-makers in those regimes to resolve status questions.

For Open Arms and service providers:

• Accept and process referrals from the Commission for persons in the enumerated classes. Require the Commission’s eligibility confirmation or the documentation relied upon to establish the person’s status under the definitions in the instrument.

• Align service delivery practices with the Treatment Principles referenced in the instrument (Part 1, Treatment Principles definition), noting that the instrument ties Gold Card coverage and treatment to those principles.

• Maintain administrative records linking clinical episodes to the eligibility class relied upon to justify provision under this instrument, including retention of evidence of MRCA/DRCA acceptance, DART registration or NLHC acceptance where relevant.

For legal advisers and advocates:

• When assisting clients, gather documentary proof of the precise statuses the instrument imports , MRCA/DRCA decisions, NLHC acceptance, DART registration, SHOAMP participation, Gold/White Card documentation, break-up dates and parental responsibility. Frame submissions to the Commission around the statutory definitions.

• Where the Commission’s opinion-based factual determinations are adverse, consider administrative review avenues and challenge routes grounded on jurisdictional error or failure to follow lawful procedures. Document procedural and evidentiary errors in the decision process.

Practical operational checklist for compliance:

1. Map the claimant to the exact paragraph in s 6 and identify the definitional prerequisites in Part 1, s 5.

2. Gather documentary proof of the prerequisite status (MRCA/DRCA acceptance, NLHC acceptance, DART registration, SHOAMP status, Gold/White Card, or relationship proof).

3. Prepare evidence to address Commission opinion factors where relevant (e.g. contemporaneous service records, training accident reports, deployment records, family law orders for co-parenting).

4. If a claim is denied due to lack of status, identify whether an alternative route exists (e.g. veterans’ entitlement under other parts of s 92, or appeal/remedy under the other regime such as MRCA/DRCA).

5. For administrators, implement consistent eligibility checklists and record rationales for opinion-based determinations.

Following these steps aligns practice with the instrument’s internal logic: the determination creates eligibility by reference to specific statuses and Commission opinion-based factual tests, and compliance requires verifying and documenting those preconditions.
