What it does
This instrument, the Veterans’ Entitlements (Attributable Stakeholders and Attribution Percentages) Principles 2025, prescribes mandatory decision-making principles for the Commission when it makes three kinds of determinations under the Veterans’ Entitlements Act 1986 (the Act): (a) that an individual is not an attributable stakeholder of a company or trust (see Pt 2, s5); (b) that an attributable stakeholder’s asset attribution percentage in relation to a company or trust is a specified percentage lower than 100 per cent (see Pt 3, s14); and (c) that an attributable stakeholder’s income attribution percentage in relation to a company or trust is a specified percentage lower than 100 per cent (see Pt 4, s23). The instrument is made under paragraph 52ZZZQ(a) of the Act (s3) and commences the day after registration (s2).
Mechanically, the instrument does not alter statutory attribution rules in the Act itself. Instead it sets out the circumstances and particular matters the Commission must consider when exercising those specified discretions. For each of the three decision-types the instrument requires the Commission to consider the relationship between the individual and the company or trust, and to assess a menu of circumstances that may bear upon whether the individual should be treated as an attributable stakeholder or whether attribution percentages should be reduced from 100 per cent (see ss6, 14(2), 24(2)). The prescribed circumstances are substantially parallel across Parts 2 to 4 and include: legal structure; administrative arrangements; capacity to exercise effective control; the nature, value and timing of any contribution to the company or trust; past distributions and the frequency and likely future value of distributions; benefits derived from assets or income of the entity; existing attribution to the individual under the Act or the Social Security Act; and any other circumstance affecting involvement with activities or administration of the company or trust (see ss7, 8, 9, 10, 11, 12, 13; equivalents in Pt 3 ss16-22; Pt 4 ss25-31).
