What it does
This instrument replaces the 2015 determination of the same name, setting out the criteria under which the Repatriation Commission may classify a lifetime income stream as asset-test exempt for the purposes of the Veterans’ Entitlements Act 1986 (the Act). Mechanically, it provides two sets of guidelines , one for public sector funds or public sector superannuation schemes (section 6), and one for private sector funds (section 7) , and authorises the Commission to determine that an income stream meeting those criteria is an asset-test exempt income stream. Being asset-test exempt means the value of that income stream (typically the purchase price or account balance) is excluded from the assets test that otherwise reduces or eliminates a veteran’s service pension or income support supplement. The instrument does not confer an automatic exemption; it gives the Commission a discretion to determine exemption. The conditions are narrow. In both sectors, the income stream must be a lifetime income stream (payments at least annually for the life of the primary beneficiary and any reversionary beneficiary); it must be a defined benefit income stream; and the fund must have been established before 20 September 1998. Additionally, the income stream must have been a superannuation pension under the Act as in force before 20 September 1998 (referred to as the “1998 Act”), and the value of that pension must have been disregarded in calculating the beneficiary’s assets under section 52 of that earlier version of the Act. For private sector funds only, section 7 adds a further requirement: the income stream must have become payable to the primary beneficiary or a reversionary beneficiary because of the primary beneficiary’s previous employment. The instrument contains no transitional provisions beyond repealing the 2015 determination (section 4). It commences the day after registration (section 2). The practical effect is to maintain the existing asset-test exemption for a closed class of pre-1998 defined benefit lifetime income streams, but to update the legislative vehicle under which the Commission makes those determinations.
