Veterans’ Affairs (Australian Participants in British Nuclear Tests (Treatment) – Claims, Applications and Lodgements Procedures) Determination 2006

The Determination organises a small set of administrative concepts that determine how procedural access to the Act’s benefits is exercised. The main concepts are:

• Claim: used as a catch-all term to cover a claim, application, request or notice under the Act; defined pragmatically as the matters to which the procedural rules apply (s 4(1)). The Determination treats all such communications as “claims” for the purpose of the procedures it prescribes.

• Writing and lodgement: a claim must be in writing and is only taken to have been made when lodged at a Department office in Australia (s 4(1)). This creates a binary rule: the communication is not effective until written and physically lodged at an Australian office.

• Incorporation by reference: the Determination takes subsection 5T(2) of the Veterans’ Entitlements Act 1986 to apply to a claim as if the claim could be made under that Act (s 4(2)). That imports procedural modalities approved under the VEA to this regime, subject to the content of subsection 5T(2) as in force from time to time.

• Secretary-approved forms: for two substantive entry points the Determination requires the use of forms approved by the Secretary of the Department , treatment claims under s 8 of the Act and travel claims under s 21 (s 4(3)(a) and (c)). The Secretary therefore controls template content and any changes to it.

• Minimum content of particular notices and requests: Schedules 1-3 prescribe the minimum information required in notices of withdrawal for treatment or travel claims, requests for review of Commission decisions, and notices of withdrawal of those review requests (s 4(3)(b), (d)-(f); Schedules 1-3).

• Third-party representation and approval: Schedule 4 allows claims to be made by another person on behalf of a claimant with the claimant’s approval or, alternatively, with the Commission’s approval; where a claimant is incapacitated, the Commission may approve a person to make the claim (Schedule 4, paragraphs 1-2).

• Claimant identity rule: where a claim is made on behalf of another person, the person on whose behalf the claim is made is treated as the claimant (Schedule 4, paragraph 3). This clarifies who is the legal actor for purposes of entitlement and procedural rights.

• Cure and back-dating discretion: Schedule 4 allows the Commission, in narrowly defined circumstances, to treat a later-compliant lodgement as having been received on the date of an earlier non-compliant lodgement, subject to notification and a three-month corrective window (Schedule 4, paragraph 4).

These concepts work together to convert substantive entitlements created by the Act into an intake and processing architecture controlled by the Department and the Commission. The Secretary and the Commission are the nodes of administrative control: the Secretary approves forms; the Commission approves third-party lodgements for incapacitated claimants and may exercise back-dating discretion.

The Determination affects a defined set of actors connected to the Australian Participants in British Nuclear Tests (Treatment) Act 2006. It affects:

• Potential claimants: any person who would make a treatment claim under s 8 of the Act or a travel claim under s 21, and any person who seeks to withdraw such claims or to request review of Commission decisions under ss 9, 22, 24 and 28. The Determination prescribes how those persons must present their claims and what content must be provided in relevant notices (s 4(1), s 4(3), Schedules 1-3).

• Representatives and third parties: persons who seek to act on behalf of claimants are affected because Schedule 4 allows claims to be lodged by another person only with the approval of the claimant or the Commission (Schedule 4, paragraph 1). Where the claimant is physically or mentally unable to approve, the Commission may itself approve a representative (Schedule 4, paragraph 2).

• The Department of Veterans’ Affairs: the Determination designates Department offices in Australia as the exclusive lodgement points for claims and gives the Secretary the power to approve the forms for treatment and travel claims (s 4(1), s 4(3)(a), (c)). The Department is therefore the administrative centre for receipt and initial processing.

• The Repatriation Commission (the Commission): defined in the Determination as the Repatriation Commission continued under s 179 of the Veterans’ Entitlements Act 1986 (s 3). The Commission is given procedural authority: it may approve persons to lodge claims on behalf of incapacitated claimants (Schedule 4, paragraph 2) and may exercise discretion to treat corrected claims as effective as of an earlier non-compliant lodgement date under the conditions in Schedule 4, paragraph 4. The Commission is also the decision-maker whose determinations may be the subject of review requests prescribed in Schedule 3 (s 4(3)(e)).

• The Secretary: as the officer approving forms for certain claims, the Secretary exercises rulemaking control over form content , which affects claimants and their advisers (s 4(3)(a), (c)).

Actors not listed in the Determination remain outside its direct scope. The Determination does not address who funds any payment, or the substantive criteria for entitlement, and does not set timelines for Commission decisions. It also does not set out remedies, penalties or enforcement mechanisms for non-compliance with its documentary and lodgement requirements; those mechanisms, if any exist, would be found in the Act or VEA rather than in this Determination.

This Determination imposes a small set of duties and confers procedural rights, expressed by the form and content requirements and by the Commission’s discretionary powers. The principal duties and rights are:

Duties

• Duty to submit claims in writing and to lodge them at a Department office in Australia. A claim is only taken to have been made when it is lodged at such an office (s 4(1)). The duty is categorical: written form and physical lodgement are prerequisites to legal effectiveness under the Determination.

• Duty to use Secretary-approved forms for certain claims. A treatment claim (s 8 of the Act) and a travel claim (s 21 of the Act) must be in the form approved by the Secretary (s 4(3)(a) and (c)). The Determination therefore places a gatekeeping duty on claimants to obtain and use the current approved form.

• Duty to include specified information in withdrawal notices and review requests. Notices of withdrawal for treatment and travel claims must contain the details listed in Schedules 1 and 2, respectively, and review-requests and withdrawal-of-review notices must contain the details in Schedule 3 (s 4(3)(b), (d)-(f); Schedules 1-3). The Determination prescribes minimum content for these communications.

Rights and procedural entitlements

• Right to lodge by proxy with approval. A claimant may have another person lodge a claim on their behalf if the claimant approves, or if the Commission approves that arrangement (Schedule 4, paragraph 1). Where a claimant is incapacitated, the Commission may itself approve an agent to lodge the claim (Schedule 4, paragraph 2). This is a procedural right to have an agent act on the claimant’s behalf subject to approval requirements.

• Right to be treated as the claimant. If a claim is made by another person on behalf of someone else, the person on whose behalf the claim is made is legally treated as the claimant (Schedule 4, paragraph 3). This protects claimant identity for procedural and entitlement purposes.

• Right to corrective back-dating in limited circumstances. The Commission may, in narrow cases, treat a later-compliant lodgement as having been received on the date of an earlier non-compliant lodgement when either the Department had not notified the person that an appropriate form was necessary, or the person corrects the form within 3 months after such notification (Schedule 4, paragraph 4). This provides a limited protection against loss of precedence or time-sensitive effects where procedural form compliance is cured promptly.

Discretion and administrative control

• Secretary’s control of form content. The Secretary’s approval of forms places a degree of administrative control over the shape of claims. This is a delegated procedural power that alters how claimants must present material (s 4(3)(a), (c)).

• Commission discretion in approvals and back-dating. The Commission has discretion to approve third-party lodgements for incapacitated persons and to exercise the corrective back-dating power set out in Schedule 4(4). Those are exercises of administrative discretion rather than absolute rights.

Not included

• The Determination does not specify time limits for the Commission’s decision-making, does not prescribe appeal mechanisms beyond the review-request content, and does not create penalties for non-compliance. Those substantive and enforcement matters remain for the Act or for other applicable legislation.

The Determination prescribes procedural requirements but does not itself create criminal, civil penalty or administrative sanction provisions. It is silent on fines, sanctions, or direct enforcement measures for failing to comply with its procedural prescriptions. Accordingly:

• No penalties specified. There are no penalty provisions, monetary sanctions or administrative fines contained in this Determination. The text defines how claims are to be made and what they must contain but does not provide for sanctions where those requirements are not met.

• Effect of non-compliance is procedural, not penal. The primary legal consequence established is functional: a claim is only taken to have been made when it is written and lodged at a Department office in Australia (s 4(1)). Non-compliant communications therefore lack efficacy until the requirements are met. That is a negative enforcement mechanism based on non-recognition rather than an imposed penalty.

• Commission discretion as remedial mechanism. The Determination permits the Commission to treat a later-corrected claim as effective as of an earlier non-compliant lodgement date in two limited circumstances (Schedule 4, paragraph 4). This is a remedial discretion which can mitigate adverse consequences for claimants who initially lodge in the wrong form or otherwise non-compliantly, if the correction occurs in the windows set out.

• Approval regime for representatives as control measure. Schedule 4 requires the claimant’s approval or the Commission’s approval for third-party lodgements (Schedule 4, paragraph 1), and allows Commission approval in cases of claimant incapacity (Schedule 4, paragraph 2). These approval gates function as administrative control rather than an enforcement sanction. Where approval is refused or absent, the third-party lodgement will not be treated as effective on behalf of the claimant.

• Interaction with other statutory enforcement frameworks. Because this Determination is procedural and does not itself prescribe penalties, any sanctioning or enforcement regime would arise from the Act, the Veterans’ Entitlements Act 1986 to the extent applied by the Determination, or other Commonwealth statutes. The Determination does not set or repeat those penalty provisions.

Practically, the Determination’s enforcement effect is to make timing and form matters determinative of whether a communication counts for procedural purposes. Failure to comply makes the communication legally ineffective until corrected or until the Commission exercises its limited corrective discretion. There is no textual basis in the Determination for monetary penalties, suspension powers, or criminal liability.

The Determination explicitly imports, references and interacts with two identified statutory sources: the Australian Participants in British Nuclear Tests (Treatment) Act 2006 (the Act) and the Veterans’ Entitlements Act 1986 (VEA), as well as with the administrative apparatus of the Repatriation Commission and Department of Veterans’ Affairs.

Direct interactions

• Enabling statute: the Determination is made under section 6 of the Act, and therefore operates as a procedural instrument subordinate to that Act (instrument preamble). It implements the Act’s power to prescribe procedures for making claims, applications and giving documents.

• Veterans’ Entitlements Act 1986: the Determination takes subsection 5T(2) of the VEA in force from time to time, including any matter approved by the Commission under that subsection as at the commencement of the Determination, to apply to a claim as if the claim could be made or given under the VEA (s 4(2)). The Determination thus imports procedural provisions of the VEA regime by reference and enables any existing Commission approvals under VEA subsection 5T(2) at commencement to apply to claims under the Act.

Institutional interactions

• Department of Veterans’ Affairs: the Determination requires claims to be lodged at offices of the Department in Australia (s 4(1)), making the DVA the intake point. The Secretary of the Department has the power to approve the forms for certain claims (s 4(3)(a), (c)). This creates an administrative link between the Determination and departmental forms and processes.

• Repatriation Commission: the Determination defines the Commission in its terms (s 3) and assigns it certain procedural powers, including approval of agents for incapacitated claimants and discretion to back-date corrected claims in limited circumstances (Schedule 4, paragraphs 2 and 4). It also links review-requests to decisions made by the Commission (s 4(3)(e) and Schedule 3).

Scope limits and implied interactions

• Procedural not substantive: the Determination does not alter or define substantive entitlements, nor does it substitute for substantive provisions in the Act or other statutes. Its function is to regulate the form and lodgement of claims arising under the Act.

• Reliance on VEA procedure: by making VEA subsection 5T(2) apply, the Determination creates ongoing dependence on that VEA provision as it changes over time. The phrase “in force from time to time” (s 4(2)) means that future amendments to subsection 5T(2) of the VEA would also affect the procedural regime for these claims unless separately altered by the Determination or the Act.

• Administrative law overlay: while the Determination sets documentary requirements, it operates within the broader administrative law framework that governs agency decision-making, including principles of natural justice, reviewability and judicial oversight. The Determination does not itself speak to procedural fairness in decision-making, but the importation of VEA procedure and the Commission’s review role suggest that other statutes and common law remedies will interact with and potentially qualify how the Determination is applied.

• No duplication of penalties or enforcement: the Determination does not create penalties; therefore any enforcement sanctions would derive from the Act or other applicable legislation. The text does not expressly displace or pre-empt other Commonwealth laws except by prescribing the procedural route for claims under the Act.

In short, the Determination is tightly focused on intake and form. Its principal statutory interaction is the incorporation by reference of subsection 5T(2) of the VEA and the dependence on Commission approvals under that subsection as at commencement, as well as ongoing administrative collaboration with the Department and the Commission pursuant to the Act.

The source material supplied records the original instrument and its formal details but does not record any subsequent amendments. The relevant recorded facts in the instrument are:

• Instrument identity and maker: Veterans’ Affairs (Australian Participants in British Nuclear Tests (Treatment) - Claims, Applications and Lodgements Procedures) Determination 2006, Instrument No. S29/2006, made by Mark Sullivan, Secretary of the Department of Veterans’ Affairs, pursuant to section 6 of the Australian Participants in British Nuclear Tests (Treatment) Act 2006 (instrument preamble and signature).

• Date of making: the instrument is dated 13 December 2006 (instrument preamble).

• Commencement: the Determination commences on the day after it is registered on the Federal Register of Legislative Instruments (s 2).

• No amendments recorded in the instrument: the Determination, as supplied, contains no express amendment schedule, savings or transitional provisions other than those within Schedule 4 dealing with back-dating corrected claims. There is no text in the supplied instrument indicating that it amends a prior Determination or that it will be amended by other instruments.

Practical consequence for researchers and practitioners

• If you need to know whether the Determination has been amended since the date shown, the Determination itself does not provide that history. The instrument includes a commencement mechanism tied to registration but does not include later amendment records. To establish subsequent changes you must consult the Federal Register of Legislative Instruments or the Department’s consolidated instrument list to see whether replacement or amending determinations have been made after 13 December 2006.

• The Determination imports subsection 5T(2) of the Veterans’ Entitlements Act 1986 “in force from time to time” (s 4(2)). That means that any amendments to that VEA subsection after the Determination’s commencement will, by the Determination’s terms, alter the procedural regime for claims under this Act without a separate amendment to the Determination. The Determination therefore has a built-in mechanism for evolving its application in line with changes to the referenced VEA provision.

Because the supplied text contains only the original instrument and no subsequent amendment instruments, the amendment history in this source is limited to the instrument’s creation and commencement. Any later legislative or administrative changes are not recorded in the provided material.

The supplied Determination contains no references to judicial or tribunal decisions, no citations of litigation involving the instrument, and no recorded challenges, appeals or case law interpreting its provisions. The text does not purport to summarise or append judicial authority.

Implications for practice

• Absence of recorded litigation in the instrument: there are no cases named in the Determination, and no footnotes or appendices refer to litigation. The Determination stands as an administrative procedural instrument without an attached litigation history in the supplied material.

• Need to search external repositories for case law: because the Determination itself does not include litigation or judicial guidance, practitioners seeking interpretive guidance on ambiguous or contested aspects of the Determination (for example, the scope of the Commission’s discretion under Schedule 4(4), or what constitutes lodging at a Department office in Australia under s 4(1)) will need to consult tribunal or court decisions, administrative law reports, or the Department’s practice statements external to this instrument.

• Where to look: the Determination refers to the Repatriation Commission and the Veterans’ Entitlements Act 1986. If questions arise about the interplay between the Determination and subsection 5T(2) of the VEA, authorised decisions under that subsection, or Commission practice, relevant decisions might appear in cases that interpret the VEA and Commission practice. None of that material is included here.

In sum, the Determination, as supplied, contains no litigation history. Practitioners requiring precedent-based interpretation will need to consult external legal databases or administrative law records to identify any Commission or court decisions construing these procedural provisions.

The Determination contains several features that can cause operational or legal surprises if overlooked. The following are concrete, source-grounded points to watch for:

1. Effective lodgement is location-bound and written-only (s 4(1)). The Determination states a claim “is to be in writing and is only taken to have been made or given, as the case requires, when it is lodged at an office of the Department of Veterans’ Affairs in Australia.” That means an email, facsimile, or an overseas posting may not, on the Determination’s face, constitute effective lodgement unless the Department treats such communications as lodged at an Australian office. Do not assume electronic receipt equals lodgement unless the Department’s practice or an applied provision of subsection 5T(2) of the VEA makes explicit allowance.

2. Forms approved by the Secretary are mandatory for two key claim types (s 4(3)(a), (c)). A treatment claim under s 8 of the Act and a travel claim under s 21 must use the Secretary-approved form. Failure to use the approved form risks the communication not being treated as an effective claim. There is a limited cure mechanism (Schedule 4, paragraph 4), but it depends on notification timing and a three-month correction window.

3. Third-party lodgement needs approval (Schedule 4, paragraph 1). Another person cannot validly make the claim on behalf of a claimant unless the claimant approves or the Commission approves. Agents and advocates should secure written approval or Commission authorisation in advance.

4. Incapacity approval lies with the Commission (Schedule 4, paragraph 2). If a claimant is physically or mentally unable to approve a representative, only the Commission may approve another person to lodge the claim on the claimant’s behalf. This is an administrative gate that may create delay in urgent cases.

5. Who is the claimant is fixed by statute when a claim is lodged on behalf of another (Schedule 4, paragraph 3). If an advocate or agent lodges a claim for someone else, the person on whose behalf the claim is made is the legal claimant, not the agent. That matters for rights, confidentiality, and subsequent review procedures.

6. Timely correction windows matter (Schedule 4, paragraph 4). If a person first lodges in a form other than the appropriate form and later makes the claim in the appropriate form, the Commission may treat the later claim as received on the earlier date only if either the Department had not notified that the appropriate form was necessary at the time of the earlier lodgement, or the compliant claim is made within 3 months after the person had been notified. If a person is notified and does not correct within three months, back-dating is not available under this provision.

7. Withdrawal notices have minimum content (Schedules 1 and 2). Notices of withdrawal for treatment or travel claims must include the name and address of the withdrawing person and, for travel claims, details of the claim (Schedules 1-2). Omitting those details may render the notice non-compliant.

8. Review-requests require grounds and decision identification (Schedule 3 Part 1). A request for review under s 24 must identify the decision to be reviewed and specify the grounds for review (Schedule 3 Part 1). A deficient review-request risks being ineffective or delayed.

9. No penalties specified here. Because the Determination provides no penalty regime, administrative consequences are limited to non-recognition of non-compliant communications and to Commission discretion. Do not assume criminal or civil penalties are attached to breaches of the procedural requirements by reading this Determination alone.

10. Dependence on VEA subsection 5T(2) creates evolution risk (s 4(2)). The Determination takes subsection 5T(2) of the VEA to apply “in force from time to time.” That means later amendments to the VEA procedure could change how claims under this Act are processed without any update to this Determination. Practitioners should monitor changes to the referenced VEA subsection.

These are not legal conclusions about entitlement. They are concrete operational points derived from the Determination’s text. Ignoring them can lead to delays, loss of effective lodgement date, or the need for Commission discretionary intervention.

This section sets out stepwise, source-grounded compliance actions and practical record-keeping recommendations based on the Determination’s text.

Step 1 , Confirm claim type and applicable form

• Identify whether the communication is a treatment claim under s 8 of the Act, a travel claim under s 21, a withdrawal (ss 9 or 22), a request for review under s 24, or a withdrawal of a review-request under s 28 (s 4(3)). The Determination treats all such communications as “claims” for procedural purposes (s 4(1)).

• For treatment claims and travel claims, obtain and use the form approved by the Secretary of the Department of Veterans’ Affairs (s 4(3)(a), (c)). The Determination requires those two claim types to be in the Secretary-approved form.

Step 2 , Prepare the claim in writing and include required details

• Ensure the claim is in writing (s 4(1)). Draft the claim so that it complies with any content requirements. For withdrawal notices and review-related communications, include the specific items listed in the Schedules:

  • Schedule 1 (notice of withdrawal of treatment claim): include the name and address of the person withdrawing the claim and, if appropriate, the name and address of the person on whose behalf the claim is being withdrawn.

  • Schedule 2 (notice of withdrawal of travel claim): include the name and address of the person withdrawing the claim, and details of the claim.

  • Schedule 3 Part 1 (request for review): include the name and address of the person requesting review, the decision to be reviewed, and the grounds for review.

  • Schedule 3 Part 2 (withdrawal of request for review): include the name and address of the person withdrawing the request and details of the decision originally sought to be reviewed.

Step 3 , Lodge at a Department office in Australia

• Lodge the written claim at an office of the Department of Veterans’ Affairs in Australia. The Determination provides that a claim is only taken to have been made when it is lodged at such an office (s 4(1)). If there is any doubt whether an electronic communication is treated as lodged at a Department office, seek confirmation from the Department or use a physical lodgement to preserve the effective date.

Step 4 , Use authorised representatives correctly

• If someone else will lodge on the claimant’s behalf, secure the claimant’s approval in writing, or obtain the Commission’s approval (Schedule 4, paragraph 1). If the claimant is physically or mentally unable to give approval, apply to the Commission for approval of a person to make the claim on the claimant’s behalf (Schedule 4, paragraph 2).

• Maintain records that demonstrate claimant approval or Commission authorisation. The Determination treats the person on whose behalf the claim is made as the claimant (Schedule 4, paragraph 3). Records are necessary to prove authority.

Step 5 , Preserve initial lodgement evidence

• If a claim is initially lodged in a form other than the appropriate form, preserve the evidence of the initial lodgement date and any Departmental notifications about form requirements. Schedule 4 paragraph 4 allows the Commission to treat a subsequent compliant claim as having been received on the earlier date where certain conditions are met, namely absence of prior written notification about the appropriate form, or correction within three months of notification.

Step 6 , Where review is sought, state the decision and grounds

• For review-requests under s 24, specify the decision to be reviewed and articulate the grounds for review in writing (Schedule 3 Part 1). For withdrawal of review-requests, include the details required in Schedule 3 Part 2.

Step 7 , Follow up and obtain written acknowledgements

• On lodgement, seek written acknowledgement from the Department that the claim has been received at a Department office in Australia. An acknowledgement that confirms the lodgement location and date will be material if a later determination is needed on effective lodgement date.

• If lodging through a representative or awaiting Commission approval for representative action, obtain written Commission approval and retain copies. That will be necessary if the Commission’s approval powers are later questioned.

Step 8 , Monitor related VEA subsection changes

• Because the Determination imports subsection 5T(2) of the Veterans’ Entitlements Act 1986 “in force from time to time” (s 4(2)), monitor legislative or administrative changes to that VEA provision which may alter procedural steps or permit electronic lodgement formats that the Determination by itself does not authorise.

Record-keeping checklist

• Copy of the signed, written claim or notice.

• Evidence of the date and place of lodgement at a Department office in Australia (acknowledgement slip, stamp, email confirming reception at a Department office).

• If applicable, the Secretary-approved form used for treatment or travel claims.

• If a representative lodged the claim, the claimant’s written approval or the Commission’s written approval.

• Any correspondence from the Department notifying a person that an appropriate form is required.

• If a correction was required, documentation proving the date on which the compliant form was subsequently lodged, to support any request for back-dating under Schedule 4 paragraph 4.

Practical notes

• Where an urgent clinical or travel need exists, do not rely on informal or electronic lodgement without confirming that such communications qualify as lodgement at a Department office in Australia under current Department practice or VEA subsection 5T(2) as applied.

• If in doubt about the Secretary-approved form to use, contact the Department to obtain the latest approved template before lodging; failing to do so risks the need to rely on Schedule 4 paragraph 4 remedial discretion.

Following these source-based steps and maintaining careful lodgement records will align practice with the Determination’s procedural requirements and preserve the options the Determination provides for remedial back-dating or Commission approval where incapacity is an issue.
