VET Student Loans (Courses and Loan Caps) Amendment Determination (No.4) 2022

The instrument rests on three primary mechanical concepts: course eligibility lists, loan caps per provider-course pairing, and transitional protection for existing approved loans.

1. Course eligibility lists

• The Determination being amended is a list-based instrument: specific vocational education and training course codes and titles are enumerated in table rows across multiple parts (Part 1, Part 2, Part 3) of Schedule 1 to the 2016 Determination. This instrument modifies those enumerated lists by adding and omitting rows. For example, in Schedule 1, Part 1 the instrument adds item “8A” for FNS50922 Diploma of Banking Services Management and omits several other diplomas (see Schedule 1, paragraphs 1-3 of this instrument). In Part 2 and Part 3 it both adds sizeable blocks of courses and omits others (see Schedule 1, paragraphs 4-9).
• The listed course codes are the primary identifiers used in the tables. The instrument does not itself define course eligibility criteria beyond listing course codes and titles; inclusion or exclusion from the Determination is what changes the legal treatment under the VET Student Loans framework established by the parent Determination.

2. Loan caps per provider-course pairing

• Schedule 3 of the 2016 Determination is a table linking approved course providers, course codes, course titles and an explicit dollar amount described in the table (shown in this instrument as a column with dollar figures). This instrument adds rows to Schedule 3 specifying provider-course combinations and associated caps (for example, Bendigo Kangan Institute, 22594VIC Diploma of Justice, $10,000), and omits certain previously listed provider entries (see Schedule 1, paragraphs 11-13).
• The presence of a row in Schedule 3 with a dollar amount creates an explicit monetary cap associated with that approved provider-course pairing. The instrument therefore changes the set of provider-course pairings subject to a fixed loan cap and changes some caps where an existing entry for the same provider and course is omitted and a new entry with a different cap is added.

3. Transitional protection and administrative operation

• The instrument authorises the Secretary to continue to pay amounts under section 19 of the VET Student Loans Act 2016 for certain students whose loans were approved prior to the commencement even if the course is omitted by this Determination (see s 5). The instrument identifies the particular numbered items of Schedule 1 to this instrument (items 2, 5, 8 and 12) as the relevant omissions that are covered by transitional protection. Those numbered items correspond to the subparagraphs in Schedule 1 that execute mass omissions of rows from the 2016 Determination (see Schedule 1, paragraphs 2, 5, 8 and 12).
• The instrument repeatedly instructs that affected tables be renumbered “starting at 1” after the additions and omissions. That renumbering is an administrative operation: the substance of addition/omission remains the same regardless of numbering but administrative records and cross-references elsewhere may need updating.

Legal bases and limits

• The instrument is made under s 16 of the VET Student Loans Act 2016 (s 3). It expressly references section 19 of that Act as the source of the Secretary’s power to pay loan amounts in the transitional protection clause (s 5). The instrument’s scope is confined to amending the tables of the 2016 Determination; it does not purport to amend the Act itself or set policy outside the enumerated schedule rows.

This instrument affects several distinct groups by altering the set of courses and the list of approved course providers with loan caps under the VET Student Loans Determination. The primary affected parties are:

• Students (current and prospective) who rely on VET Student Loans as a funding mechanism. Students seeking loans after 1 January 2023 will be affected by the amended lists and caps: courses newly added to the Determination will be available for loans where the provider and cap entries apply (where relevant), and courses omitted from the Determination will not be available for new VET student loans under the Determination after commencement. Students who had loans approved prior to commencement for courses listed in the specific omitted-item paragraphs (items 2, 5, 8 or 12 of Schedule 1 to this instrument) may continue to receive loan payments, provided the Secretary had approved the loan before commencement and the student had not completed the course (see s 5). The instrument therefore creates a split in treatment: pre-approved loans for the omitted rows (as described) may receive continued payments; new loan approvals for the same omitted courses after commencement will be governed by the amended Determination and, in many cases, will no longer be available.

• Approved course providers (registered training organisations, TAFEs, universities and other listed providers). Providers whose entries are added in Schedule 3 of this instrument gain an explicit approved provider-course-cap entry in the Determination (see Schedule 1, paragraph 11). Providers whose rows are omitted in Schedule 3 lose those specific entries. Omissions can remove a provider’s specified loan-cap entitlement for a course entirely, or remove a provider-course entry that previously existed with a particular cap and may be reinserted with a different cap (see, for example, Box Hill Institute’s 10118NAT Diploma of Social Media Marketing, which is removed at one cap and reinserted at another). Providers will therefore see changes to which of their courses attract VET Student Loan support, and to the maximum loan amount approved for particular courses.

• The Commonwealth (Secretary administering VET Student Loans) and the Minister. The instrument is made by the Minister and gives the Secretary authority, under the transitional clause, to continue payments for certain pre-approved loans (s 5). The Secretary’s administrative workload will include processing the changes, mapping pre-approved loans to the items covered by the transitional clause, and implementing amended loan caps and eligible provider lists from 1 January 2023.

• Intermediaries and compliance officers (university and RTO compliance units, student administration teams, industry advisors). Operational teams who manage enrolments, loan applications, and reporting will need to update systems to reflect the new course lists, new or amended loan cap amounts, and the renumbering of item numbers. They must identify any continuing obligations in relation to students whose loans were approved prior to commencement and ensure correct application of section 19 payments where the Secretary has approved a pre-commencement loan (s 5).

• Prospective employers and sector training planners. While the instrument does not itself regulate employment or training delivery beyond loans, changes in loan eligibility and caps for particular qualifications can influence student choices and provider offerings, which in turn affect labour supply into certain occupations; that is an indirect effect that follows from the changes to eligibility and caps contained in the instrument.

The instrument does not explicitly list stakeholder consultations or transitional supports other than the Secretary’s discretion to continue payments for pre-approved loans in the specific cases identified in s 5. The practical effect is that students and providers must identify whether they are covered by added entries, omitted entries, or the transitional protection and act accordingly.

The instrument itself is an amending Determination and does not impose novel duties beyond changing the statutory lists and authorising certain administrative conduct. The key duties and rights arising from this instrument, grounded in its text, are:

Duties and actions required by the Secretary/administration

• The Secretary may continue to pay loan amounts for certain students who had loans approved before commencement for courses listed in items 2, 5, 8, or 12 of Schedule 1 to this instrument, provided those students had not completed the course at commencement (s 5). The instrument therefore creates an administrative duty on the Secretary to identify qualifying pre-commencement approvals and, exercising the discretion granted (the Secretary “may continue to pay”), to determine whether to make payments under section 19 of the VET Student Loans Act 2016 for those loans after commencement.
• The instrument requires the administrative machinery that implements the 2016 Determination to be updated to reflect added and omitted rows and to renumber table items as specified in multiple places in Schedule 1. Practically, that is an administrative duty to ensure records, databases and any public schedules contain the corrected lists and numbering.

Rights and obligations for students

• Students have a potential right to continued loan payments if, before commencement, the Secretary approved a VET student loan for them for a course listed in items 2, 5, 8, or 12 of Schedule 1 to this instrument and they had not completed the course at commencement; in that case the Secretary may continue payments under s 19 of the VET Student Loans Act 2016 (s 5). That right is conditional (it is the Secretary’s discretion to continue payments) rather than absolute; it depends on the loan having been approved before 1 January 2023 and the specific course being one of those listed in the specified omitted-item paragraphs.
• For students seeking loans after 1 January 2023, the list of eligible courses for VET Student Loans and the approved provider-cap pairings will be those reflected in the amended Determination once implemented; the instrument does not create a separate entitlement beyond the amended schedules.

Provider duties and entitlements

• Providers listed in Schedule 3 additions gain an explicit entry linking a provider, a course code and a loan cap (see Schedule 1, paragraph 11). That creates an expectation that the provider may offer that course to students using VET Student Loans up to the specified cap, subject to the procedural and legal rules under the VET Student Loans Act and the parent Determination (the instrument does not restate those procedural rules; it simply amends the schedule).
• Providers whose entries are omitted lose the specific schedule entry that previously recorded a provider-course-cap pairing. The instrument does not itself state additional administrative obligations such as de-enrolment, but omission implies the provider cannot rely on that schedule entry for new student loan approvals after commencement.

Other duties implied by the instrument

• The renumbering instructions impose an administrative obligation on the operator of the Determination to produce a coherent, renumbered table across Parts 1-3 and Schedules 2-3. That administrative exercise is necessary so that future references to table item numbers in internal systems and in other instruments align with the new numbering.

Statutory rights referenced

• The instrument references section 19 of the VET Student Loans Act 2016 as the statutory vehicle under which the Secretary may continue to pay loan amounts for protected pre-commencement approvals (s 5). The instrument is itself made under s 16 of that Act (s 3). Those cross-references are the only parts of the Act cited in the instrument; the instrument relies on the parent Act for the underlying legal framework governing loans and payments.

In sum, the instrument creates rights for certain pre-existing loan applicants (conditional continuation at the Secretary’s discretion), changes provider-course loan-cap entitlements by addition or omission, and imposes administrative duties of updating lists and numbering on the relevant Commonwealth administrative agency.

The instrument is an amending Determination that changes eligibility lists and loan-cap entries. It does not itself prescribe penalties, sanctions or criminal offences. The instrument contains no express enforcement or penalty provisions. Its operative enforcement implications flow indirectly from the framework of the VET Student Loans Act 2016 and the parent Determination (the instrument is made under s 16 of that Act, see s 3), which are the legal sources that set out offences, administrative sanctions, debt recovery, or repayment terms for VET Student Loans. This instrument does not alter or enumerate those sanctions; it changes which courses and provider-course pairings are captured by the Determination. Therefore:

• There are no penalties or enforcement clauses in the text of this instrument. Any consequences for non‑compliance by providers or students with loan rules (fraud, improper enrolments, failure to meet provider obligations under the VET Student Loans regime) remain governed by the VET Student Loans Act 2016 and the broader legislative and regulatory framework under which that Act operates. The instrument does not amend or add to those enforcement mechanisms.

• The instrument shifts the universe of courses and provider entries to which the VET Student Loans scheme applies via the Determination. Enforcement of the loan caps and eligibility for loans after commencement will therefore be a matter for the administrative processes that implement the Act and Determination: verifying student eligibility for a particular course, ensuring the correct loan cap is applied, and ensuring a provider is properly approved for the course-cap combination listed in Schedule 3.

• The Secretary’s discretion under s 5 to continue paying loan amounts for certain pre‑commencement approvals is permissive (“may continue to pay”); the instrument does not provide a right to payment beyond that discretionary power. How the Secretary exercises that discretion (including whether any administrative conditions are attached) is an internal administrative question governed by the Act, not by this instrument’s text.

• Any disputes about the Secretary’s exercise of discretion under s 5, or about whether a particular pre-commencement approval falls within the protected items, would be litigable only under the Act and general administrative law principles; nothing in the instrument creates or excludes access to remedies. The instrument itself is silent on appeal, review or objection procedures.

Because the instrument contains no penalty provisions, compliance and enforcement will depend on existing Act-based mechanisms and administrative implementation by the Secretary and related agencies. Entities affected should consult the VET Student Loans Act 2016 and associated administrative guidance for the applicable enforcement regime; the instrument simply changes the target lists for those enforcement mechanisms to apply to.

This instrument explicitly amends the VET Student Loans (Courses and Loan Caps) Determination 2016. The only cross-references within the instrument are to the VET Student Loans Act 2016: the instrument is made under section 16 of that Act (s 3), and the transitional protection references payment under section 19 of the Act (s 5). The instrument therefore operates within the legislative architecture established by the 2016 Determination and the VET Student Loans Act 2016.

Concrete interaction points:

• Parent Determination: the instrument alters the 2016 Determination’s schedules by adding and omitting rows and by changing numbering. The substantive effect is to change which courses and which provider-course-cap pairings are incorporated into the statutory instrument that governs VET Student Loans. The instrument does not, by its own text, change the substantive obligations, repayment regimes, eligibility criteria, or enforcement measures contained in the VET Student Loans Act 2016 or in other pieces of regulation; it modifies the lists those instruments use.

• VET Student Loans Act 2016: the instrument was made under s 16 of the Act (s 3). It refers in the transitional clause to s 19 of the Act as the source under which the Secretary may pay loan amounts for qualifying pre-commencement approvals. The instrument thus interacts procedurally with the Act by altering the content of an instrument made under the Act; it does not purport to change or override the Act’s substantive provisions.

• Administrative instruments and guidance: the renumbering instructions and table modifications will require administrative updating of ministerial determinations, departmental websites and provider-facing guidance documents. The instrument itself notes that the commencement table “relates only to the provisions of this instrument as originally made” and that the table will not be amended to deal with later amendments (s 2 note). That administrative caveat signals that amended or consolidated versions will need separate management.

• Accreditation/training package laws and codes: the instrument lists course codes (for example, national course codes such as FNS50422, 11087NAT, AVI50222). The instrument operates by listing those codes in schedules. The instrument itself does not amend training package rules, accreditation standards or the establishment of course codes by the relevant regulator; rather, it references those codes to indicate which qualifications are caught or not caught by the VET Student Loans Determination. The practical interaction therefore is that a course’s inclusion in the Determination becomes a factor in loan availability for that course under the VET Student Loans Act, while the production and approval of the course code itself remains the responsibility of course accreditation systems external to this instrument.

• Provider registration laws: the addition or removal of provider entries with loan caps (Schedule 3 changes) interacts operationally with provider registration, but the instrument does not directly change provider registration or registration standards. It identifies approved course provider entries for the purposes of the Determination; registration and quality assurance remain governed by other laws and regulatory instruments.

What the instrument does not do

• The instrument does not amend the VET Student Loans Act 2016 itself beyond being made under s 16. It does not create or vary criminal offences, does not change repayment schedules or income‑contingent loan mechanics, and does not enact provider registration changes. It only adjusts the schedule lists and loan caps contained in the 2016 Determination.

Users , students, providers and administrators , should therefore read this instrument in tandem with the 2016 Determination and the VET Student Loans Act 2016 to understand the combined legal effect: this instrument changes the list of covered courses and provider-cap pairings, while the Act and the 2016 Determination continue to govern eligibility rules, loan mechanics, repayment and enforcement.

This instrument is a single amending Determination dated 15 December 2022 and titled VET Student Loans (Courses and Loan Caps) Amendment Determination (No. 4) 2022 (s 1). It expressly amends the VET Student Loans (Courses and Loan Caps) Determination 2016 by the schedule of changes set out in the Schedule 1 to the instrument (s 4). The instrument commenced in full on 1 January 2023 (s 2(1)).

Key amendment mechanics and record provisions:

• The instrument carries a commencement table in s 2. That table states “The whole of this instrument” commences 1 January 2023. The instrument also includes a note to that commencement table that the table “relates only to the provisions of this instrument as originally made” and “will not be amended to deal with any later amendments of this instrument” (s 2 note). This indicates that future amendments to the Determination will be captured as separate instruments and that the present instrument’s commencement metadata remains static as originally published.

• The instrument amends the 2016 Determination across multiple enumerated paragraphs within Schedule 1 to this instrument (the Schedule of Amendments). Each numbered paragraph in Schedule 1 instructs an addition or omission of specific rows in specific parts of the 2016 Determination, and several paragraphs instruct renumbering of item numbers “starting at 1” for the affected tables. The renumbering requirement appears in paragraphs 3, 6 and 9, and paragraph 13 renumbers Schedule 3 entries.

• The Schedule lists both course-code additions and omissions. For example, Schedule 1, paragraph 1 adds an item “8A” for FNS50922 Diploma of Banking Services Management in Part 1; paragraph 2 omits a set of rows from Part 1 (including BSB52015 Diploma of Conveyancing and BSB60215 Advanced Diploma of Business); paragraph 4 adds a set of rows to Part 2 and paragraph 5 omits other rows from Part 2; paragraph 7 adds many rows to Part 3 and paragraph 8 omits a list of rows from Part 3.

• Schedule 2 is also amended by adding AVI50222 (Schedule 1, paragraph 10). Schedule 3 is amended by adding provider-course-cap rows (Schedule 1, paragraph 11) and omitting specific provider rows (Schedule 1, paragraph 12), followed by renumbering (Schedule 1, paragraph 13).

Transitional provision recorded in amendment history

• The instrument contains a specific transitional clause (s 5) to protect certain pre‑commencement loan approvals. That clause explicitly identifies that if the Secretary had approved a VET student loan for a student for a course of study listed in items 2, 5, 8, or 12 of Schedule 1 to this instrument, and the student had not completed the course, then the Secretary may continue payments under section 19 of the Act after commencement. Those item numbers correspond to the paragraphs in Schedule 1 that omit rows. The clause is therefore a recorded transitional mechanism in this amended Determination and forms part of the instrument’s amendment history.

Record and publication notes

• Section 2(2) notes that any information in column 3 of the commencement table is not part of the instrument, and that such information may be inserted or edited in any published version of the instrument. That is an operational note about the published instrument and does not change substantive amendments.

• The instrument is dated 15 December 2022 and signed by the Minister for Skills and Training, Brendan O’Connor, indicating the formal administrative step for making the amending Determination on that date.

This instrument is one in a sequence of amending Determinations to the 2016 Determination. The present instrument is self-contained in terms of the additions and omissions it specifies; it does not include a consolidated version of the 2016 Determination after amendment. For legal certainty, users should consult the base 2016 Determination together with this and any subsequent amending Determinations to obtain the current operative lists.

The instrument itself contains no litigation history. It is an administrative amending Determination made under section 16 of the VET Student Loans Act 2016 (s 3). The text contains no reference to any court decisions, tribunal determinations, appeals or legal challenges relating to this instrument.

What that implies for practitioners

• The instrument’s text does not record any litigation, judicial review or administrative appeal relating to it. If disputes were to arise from the Secretary’s exercise of discretion under the transitional clause (s 5), or from disagreements over whether a pre‑commencement loan approval falls within the items protected, those matters would proceed under the applicable provisions of the VET Student Loans Act 2016 and general administrative law. The instrument does not provide a new appeal or review mechanism, and it does not identify any past or pending litigation.

• Because the instrument effects changes to eligibility and provider‑cap listings, the most likely litigation or dispute pathways (if they occur) would be:

  • judicial review of an administrative decision by the Secretary relating to whether a particular prior approval qualifies for continuation of payments under s 5 (the instrument itself gives the Secretary a discretion to continue payments; whether and how that discretion is exercised could generate reviewable administrative decisions),
  • contractual or commercial disputes between students and providers about enrolments and financial arrangements arising from the sudden removal or addition of loan eligibility, though such claims would rely on the parties’ contracts and the broader statutory framework,
  • statutory review claims seeking clarification of the Determination’s application to particular course codes or provider‑course pairings, if the instrument’s changes cause ambiguity.

• None of these dispute scenarios are recorded in the instrument. The absence of recorded litigation within the instrument is a simple statement of fact: no litigation history is included in the text provided.

Practitioners should therefore check administrative guidance, departmental notices and any consolidated Determination versions for operational clarifications, and monitor administrative decisions made by the Secretary under the Act where the transitional clause and the changed schedules are applied.

The instrument contains a number of concrete drafting and implementation features that create practical risks and compliance points to watch for. These are matters of mechanics and operational interaction grounded in the instrument’s text.

1. Renumbering of table items

• The instrument repeatedly instructs renumbering of item numbers “starting at 1” after additions and omissions in multiple parts (see Schedule 1, paragraphs 3, 6 and 9, and paragraph 13 for Schedule 3). Renumbering can cause downstream confusion where internal systems, external guidance, or references in other instruments or documents use item numbers rather than course codes. The instrument does not provide a consolidated table; it leaves it to administrators to implement renumbering. Practitioners should not rely on item numbers alone , use course codes and course titles as the primary identifiers.

2. Transitional protection is limited and conditional

• Section 5 protects only those students whose loans were approved before commencement and who had not completed the course, and only where the loan was for a course of study listed in items 2, 5, 8 or 12 of Schedule 1 to this instrument. Those four numbered items are the paragraphs that omit rows from Parts 1, 2, 3 and Schedule 3 respectively, so the protection applies to the omitted rows in those paragraphs. The protection is permissive: the Secretary “may continue to pay” under s 19 of the Act. There is no automatic right to continued payments in the instrument itself; whether payments continue is a matter of the Secretary’s discretion and administrative practice. Students and providers should therefore not assume automatic continuation for every omitted course.

3. Apparent changes in loan caps for the same provider-course pairing

• Schedule 3 shows additions and omissions that, taken together, alter loan caps for the same provider and course in some instances. For example, Box Hill Institute with course 10118NAT Diploma of Social Media Marketing appears in the omissions list at a $10,000 cap and in the additions list at $15,000. Similar pattern exists for other entries (for example, TAFE NSW CUA51220 Diploma of Ceramics appears removed at $10,000 and added at $15,000). Practically, that means caps have been amended by omission and re-addition rather than by a direct replacement line. Providers must check whether their course-cap entries have changed and ensure financial counselling and student information reflect the new cap from commencement.

4. Multiple versions of the same course code or overlapping codes

• The instrument adds multiple course codes that are sequential versions (for example, FNS50417 and FNS50422 Diploma of Payroll Services are both added to Part 2). Both versions appearing in the schedule may create parallel eligibility for different course versions. Providers and administrators should verify which version a student is enrolled in and which loan cap applies. Course-code specificity matters; do not assume that a common course title covers all versions.

5. Removal of a course entry does not necessarily mean immediate debt forgiveness or reversal for existing students

• The instrument’s transitional clause clarifies that pre-approved loans may continue to be paid, but it is limited to specific omitted items. For other removals not covered by that clause the instrument does not specify transitional outcomes; the default is that the Determination no longer lists that course for new approvals. Existing loans not covered by s 5 may be governed by the Act and by earlier administrative approval terms, but the instrument does not instruct an outcome beyond the specific s 5 protection.

6. Scope of Schedule 2 addition is narrow but potentially significant

• Schedule 2 receives an added row for AVI50222 Diploma of Aviation (Commercial Pilot Licence - Aeroplane) (Schedule 1, paragraph 10). The instrument does not define any loan cap in Schedule 2; practitioners should confirm how Schedule 2 entries interact with Schedule 3 provider-cap entries and the parent Determination rules. Do not assume Schedule 2 entries automatically carry a financial cap; cross-check Schedule 3 provider entries.

7. Omitted provider rows may be for courses that persist elsewhere

• The instrument omits provider rows that relate to specific provider-course-cap pairings but also adds many provider entries. Some omissions remove outdated provider-cap entries that are replaced by updated ones elsewhere in the additions. Careful comparison of course codes, provider identifiers and caps is required to determine the effective treatment for each provider-course combination.

8. No consolidated schedule attached

• The instrument does not present a consolidated version of the amended 2016 Determination. Implementers will need to consolidate the base 2016 Determination together with this amending Determination (and any others) to determine the operative list. That increases the risk of mismatch between published lists on different platforms.

9. Administrative interpretation of “approved” loans

• Section 5 requires that the Secretary “approved a VET student loan for a student” before commencement. Practitioners should treat “approved” as a fact susceptible to administrative record verification: evidence of approval date is crucial to determine whether a student falls within s 5 protection.

10. Cross-jurisdictional training package changes

• The instrument relies on course codes (NAT, VIC, WA, etc.). Changes in national or state course codes after this instrument may produce divergence between the Determination and current course accreditation. The instrument does not address future recoding; providers must monitor both training package updates and the Determination.

In summary, attention to course codes and dates of approvals is essential. Do not rely on item numbers. Confirm caps for provider-course pairings by cross-referencing Schedule 3 additions and omissions as part of implementation.

For providers, student administration teams and compliance officers, the instrument creates a discrete set of compliance and operational actions required to implement the changes effectively as of 1 January 2023. The following practical checklist is grounded in the instrument’s text.

1. Map affected courses and students

• Identify all courses offered by your organisation that match the course codes and titles added or omitted in Schedule 1 to this instrument (see the Schedule 1 paragraphs for the full lists). Use course codes (for example, FNS50922, 11087NAT, AVI50222, etc.) as the canonical identifiers. Do not rely solely on course titles.
• For each student with an existing VET Student Loan approval, verify the date the Secretary approved the loan. If approval occurred before 1 January 2023 and the loan was for a course listed in the omitted-item paragraphs (the instrument’s Schedule 1 paragraphs 2, 5, 8 or 12), flag the student as possibly eligible for continued payments under s 5. Retain evidence of the Secretary’s approval date and the student’s completion status at commencement.

2. Confirm whether your provider-course pairing appears in Schedule 3 after amendment

• Check Schedule 3 additions (Schedule 1, paragraph 11) to see if your organisation and course are entered with an explicit dollar cap. If your provider-course pairing is added, note the loan cap amount and update counselling, fee schedules and student communications accordingly.
• If an entry that formerly existed for your provider-course pairing has been omitted (Schedule 1, paragraph 12), confirm whether a replacement entry with a different cap exists in the additions; if not, understand that the provider no longer has that provider-course-cap entry in the Determination and that this may affect new student loan approvals.

3. Update internal systems and public communications

• Update enrolment systems, student loan application modules, billing systems and any external communications or prospectuses to reflect that certain courses are no longer eligible for VET Student Loans under the 2016 Determination as amended by this instrument, and that certain courses/providers have revised loan caps as listed in Schedule 3 additions.
• Ensure staff in admissions, finance, counselling and compliance are briefed on the date of commencement (1 January 2023) and on the transitional clause mechanics (s 5) so they can advise existing students correctly.

4. Document and retain records of loan approvals and correspondence

• For any student for whom a loan was approved prior to 1 January 2023 for a course listed in the omitted-item paragraphs, preserve the approval documentation and the student’s completion status at commencement. These records will form the evidentiary basis for any decision by the Secretary to continue payments under s 19 as permitted by s 5 of this instrument.

5. Apply loan caps accurately

• When approving or processing VET Student Loans for new enrolments after commencement, apply the caps in Schedule 3 (as amended) to the provider-course pairing. If a provider-course pairing is not listed in Schedule 3 after amendment, do not assume a loan cap applies; instead, seek departmental guidance or confirm the Determination’s consolidated position.

6. Use course codes rather than item numbers

• Because the instrument requires renumbering of item numbers across several parts, rely on course codes and provider identifiers rather than item numbers. Maintain a crosswalk between pre‑commencement item numbers and the new numbering if your documentation references item numbers.

7. Seek departmental clarification where ambiguity arises

• The instrument does not supply a consolidated table or address all transitional edge cases. If there is ambiguity about whether a particular course is covered, whether a provider-course pairing carries a cap, or whether a pre‑commencement loan approval qualifies under s 5, contact the administering department for departmental advice and confirmation.

8. Revise financial advice and student information

• Students who were planning to enrol in courses that are removed from the Determination should receive clear guidance about the availability of VET Student Loans for their course options and any alternative funding arrangements. For courses where loan caps have changed, communicate the new cap clearly and explain any implications for student fees and upfront costs.

9. Ensure audit and compliance testing

• Integrate the changes into internal compliance audits and test cases to verify that loan approvals, student billing and reporting operate correctly under the amended lists and caps. Pay particular attention to cases where course code versions coexist in the schedules.

10. Monitor further amending instruments

• The instrument notes that its commencement table will not be amended for later changes (s 2 note). Further amendments to the Determination may follow. Maintain a process to incorporate subsequent amending Determinations and to prepare consolidated lists for operational use.

In short, compliance requires a methodical cross-referencing exercise using course codes, evidence of pre‑commencement approvals, verification of Schedule 3 caps for provider-course pairings, careful record‑keeping for transitional protection claims, and active coordination with departmental guidance where the Determination’s consolidated effect is unclear. The instrument’s text provides the change list and the transitional protection rule; implementing entities must operationalise those directions in administrative systems and student interactions.
