Plain English Summary

7/10 complexity

This instrument amends the VET Student Loans (Courses and Loan Caps) Determination 2016 by moving, adding and removing many course listings across the three loan‑cap bands, changing provider‑specific approved courses, renumbering items, and increasing certain maximum loan amounts (several $10,000 caps to $15,000; some $5,000 to $10,000). It affects students, approved providers and training organisations by changing which courses are eligible for VET Student Loans and the loan limits available; transitional rules let the Secretary continue payments for previously approved, incomplete loans.

What it does

This instrument, the VET Student Loans (Courses and Loan Caps) Amendment Determination (No. 1) 2020, amends the VET Student Loans (Courses and Loan Caps) Determination 2016 by changing the lists of eligible courses and adjusting maximum loan amounts for specified approved/provider-course entries. The instrument (a statutory instrument made under the VET Student Loans Act 2016, s 3) operates by: (a) adding and omitting particular course entries in the three loan cap bands in Schedule 1 (Parts 1-3); (b) adding and omitting entries in Schedule 3 (approved courses for specific providers); (c) substituting maximum loan amounts for a number of Schedule 3 table items (see Schedule 1, item 12, the amendments table); and (d) renumbering the affected tables so item numbers start at 1 after the amendments (Schedule 1, items 3, 6, 9 and 13).

Commencement is automatic: the whole instrument commences on the day after the instrument is registered (s 2(1)). The instrument expressly states it is made under the VET Student Loans Act 2016 (s 3), and that the 2016 Determination is amended as set out in Schedule 1 to this instrument (s 4). The instrument includes a targeted transitional rule (s 5): where, before commencement, the Secretary approved a VET student loan for a student for a course of study listed in items 2, 5 or 8 of Schedule 1 to this instrument and the student had not completed the course, the Secretary may continue to pay loan amounts under s 19 of the VET Student Loans Act 2016 on or after commencement in relation to that loan and course.

Mechanically, the Schedule 1 amendments operate by (i) inserting new rows into the band tables and Schedule 3; (ii) omitting specified existing rows from the band tables and Schedule 3; and (iii) substituting figures in the Schedule 3 maximum-loan-amounts table (Schedule 1, item 12). Several omissions are extensive (for example a long list of course codes is removed from Loan Cap Band 1 and Band 2) while many additions reappear in different bands (for example a number of diplomas and advanced diplomas are added to Band 2 or Band 3). The Schedule 3 table amendments substitute higher maximum loan amounts for multiple item entries (the amendments table in Schedule 1, item 12 shows many $10,000 entries replaced by $15,000 and some $5,000 entries replaced by $10,000). After the additions/omissions/substitutions, relevant tables are renumbered to start at item 1 (see Schedule 1, items 3, 6, 9 and 13).

Immediate checklist for providers and advisers

Confirm commencement date. The instrument commences the day after registration (s 2(1)). Identify that registration date and schedule operational changes to take effect from the instrument’s commencement.
Cross-check course codes, not only item numbers. Use course codes (for example BSB61218, LGA50404, 10759NAT etc) listed in Schedule 1 when reconciling present approvals, because the instrument both amends course lists and renumbers items. Map each affected pre- and post-amendment item precisely.
Identify whether any existing student loans fall within the s 5 transitional clause. Section 5 applies only to loans approved before commencement for courses listed in items 2, 5 or 8 of Schedule 1 to this instrument where the student had not completed the course. Practically: (a) obtain a list of pre-commencement approvals; (b) determine which approvals correspond to items 2, 5 or 8 as set out in the instrument as made; (c) decide whether to seek continuation of payments from the Secretary where the Secretary’s discretion permits; (d) document the mapping and maintain records supporting qualification for the transitional continuation of payments.
Update enrolment agreements, marketing and student information. Ensure all student-facing documents which reference course eligibility or maximum loan amounts reflect the amended Determination and new Schedule 3 figures where applicable. Remove or correct any references to old item numbers.
Update internal administrative systems and databases. Because the instrument renumbers several tables, update any databases that store Determination item numbers. If your systems rely on item numbers as keys, implement a robust mapping from old item numbers to the renumbered indices and document the mapping.
Reconcile Schedule 3 maximum loan amounts. Identify which provider-course entries in your organisation are affected by the substitutions in Schedule 1, item 12. For those entries, record the new maximum loan amounts (some $10,000 entries replaced by $15,000, some $5,000 entries replaced by $10,000). Ensure loan application screens and calculations use the substituted figures.
Check whether any of your provider-course approvals were omitted in Schedule 3 or had caps lowered. Omitted entries (Schedule 1, item 11) mean the specific provider-course approval is no longer listed in Schedule 3; do not approve loans for that provider-course combination after commencement unless a separate approval exists.
Train staff on mapping rules and transitional scenarios. Admissions, compliance and finance teams must understand the narrow scope of s 5 and how to apply the amended caps.
Retain audit and mapping evidence. Keep contemporaneous records of decisions to continue or stop payments for pre-commencement approvals, including mapping evidence between pre- and post-amendment item identifiers, course codes and client communications.
Liaise with the Secretary’s office where ambiguity exists. If a provider or student cannot map a pre-commencement approval to the Schedule 1 item numbers specified in s 5, seek a written administrative clarification from the Secretary’s office to avoid disputes.

Practical compliance examples derived from the instrument

If you are a provider listed in the new Schedule 3 rows (for example Chisholm Institute items 5A/5B, Holmesglen 7A, Swinburne 27A, TAFE Queensland 27B), ensure that you apply the maximum loan amounts stated in those new entries ($15,000 for some, $10,000 for others) to loan applications for those courses from commencement.
If your provider previously relied on a Schedule 3 entry now omitted (Schedule 1, item 11), do not accept new students on the basis of that omitted Schedule 3 approval for loans. Seek alternative approvals where available, or advise prospective students of funding changes.
For a student whose loan was approved before commencement for a course listed in items 2, 5 or 8 of Schedule 1 to this instrument and who has not completed the course, document the original approval and seek to have the Secretary continue payments under s 19 pursuant to s 5. Keep a contemporaneous record of the student’s incomplete status at commencement to prove eligibility for transitional payments if required.

Risk mitigation and governance

Allocate a project lead to manage Determination updates and item number mapping. That lead should coordinate legal, compliance, enrolments and IT.
Run a reconciliation between pre-commencement approvals and the amended Schedule 1 lists to flag which student loans may be affected.
Update student-facing web pages and FAQs promptly on and after the commencement date to reduce misinformation risk.
Conduct a legal review of enrolment contracts that reference previous maximum loan amounts or item numbers to identify potential contractual inconsistencies or the need for remedial communication with current students.
Ensure financial reporting teams understand that increased maximum loan amounts in Schedule 3 (as substituted in Schedule 1, item 12) may change the maximum potential loan draw amounts for particular provider-course entries; consider scenario modelling for budget reporting where significant student cohorts are affected.

Monitoring and review

Monitor communications from the Department responsible for VET Student Loans post-registration for any administrative guidance on mapping, transitional payment applications and implementation timetables.
Keep records of any departmental clarifications and integrate them into internal compliance manuals.
Review internal controls annually or at the next compliance audit to ensure the mapping and new caps continue to be correctly applied.

By following these steps and documenting the mapping between old and new item numbers and course codes, providers and advisers can reduce the operational risk arising from the amendments, apply the new maximums correctly where substituted, and manage the narrow transitional opportunities preserved by s 5.
