What it does
This vehicle standard, titled Vehicle Standard (Australian Design Rule - Harmonisation) 2012, establishes when compliance with a national Australian Design Rule (ADR) may be met by reference to United Nations Regulations adopted under the 1958 Agreement. The instrument is made under section 12 of the Road Vehicle Standards Act 2018, and its stated scope is to implement "the harmonisation and mutual recognition elements of the 1958 Agreement within Australia" (clause 2). Mechanically, it does two things.
First, it creates a rule of equivalence: where an ADR specifies a United Nations Regulation as an "alternative standard", and Australia "applies" that United Nations Regulation, a new vehicle or vehicle component that complies with the United Nations Regulation in force will be "taken to comply" with the ADR (clause 4.1). That is, compliance with the specified UN Regulation substitutes for compliance with the ADR, subject to the non-application conditions in clause 4.2 (for example, where the UN Regulation is no longer valid or Australia ceases to apply it).
Second, it enables mutual recognition of approvals issued by other Contracting Parties to the 1958 Agreement. Where an ADR specifies a United Nations Regulation as an alternative standard, a type that has been approved in accordance with Article 2 of the 1958 Agreement by a Contracting Party applying that Regulation will be taken to comply with the ADR, provided the approval corresponds to the correct version of the Regulation (clause 5.1). Clause 5.1 sets out version-matching rules depending on whether Australia applies the UN Regulation or not. Clause 5.2 excludes approvals that are invalid, cancelled, withdrawn, or subject to remedial action under Article 4 of the 1958 Agreement.
The instrument thereby links domestic ADRs to international UN Regulations and to third party approvals under the 1958 Agreement. It does not itself set technical specifications for vehicles; rather it prescribes the conditions under which specified UN Regulations or foreign approvals are treated as satisfying ADR requirements. Definitions used in the standard are aligned with the Road Vehicle Standards Act 2018 unless a contrary intention appears (clause 3.2).
