Vehicle Standard (Australian Design Rule 95/00 – Installation of Tyres) 2018

This standard sets the technical rules for installing pneumatic tyres on Australian vehicles and the requirements manufacturers must meet for type approval. It applies mandatorily to new-model vehicles manufactured on or after 1 July 2019 (other vehicles may continue under ADR 42/04). It governs tyre fitment, matching carcass types per axle, minimum load- and speed-capacity, inflation pressure limits, spare-tyre rules, and allows UN Regulation No.142 as an alternative compliance route for passenger categories. It primarily affects vehicle manufacturers, importers and approval authorities.

This instrument, titled Vehicle Standard (Australian Design Rule 95/00 - Installation of Tyres) 2018, prescribes technical installation requirements for pneumatic tyres fitted to vehicles. The standard is determined under section 7 of the Motor Vehicle Standards Act 1989 (front page) and takes effect on the day after it is registered (cl 1.2.2). It applies as mandatory for all new model vehicles manufactured on or after 1 July 2019 (cl 3.1.1 and cl 3.4 table). For other vehicles there is no mandatory application date; they may either adopt this Standard or continue to comply with the prior Australian Design Rule 42/04 - General Safety Requirements (cl 3.1.2). The Standard expressly excludes temporary-use spare units from its application (cl 3.3).

Mechanically, the Standard imposes category-specific obligations. For L‑group vehicles (light motorcycles and mopeds), it requires that tyres fitted to a single axle have the same carcass construction (s 5.1.1), that the aggregate recommended load-carrying capacities of fitted tyres equal or exceed the vehicle’s GVM (s 5.1.2), and that maximum load ratings be drawn from specified international/industry manuals (s 5.1.3). For M‑group and N‑group vehicles (passenger cars and goods vehicles) it requires tyres normally fitted to be suitable to the model in dimensions, speed and load characteristics (s 5.2.1), mandates compliance of passenger car tyres with Australian Design Rule 23/… and commercial tyres with ADR 96/… (ss 5.2.2-5.2.3), places limits on the cold inflation pressures tyres may require to achieve rated GVM (s 5.2.4), and requires manufacturers to provide replacement‑tyre load and speed information (ss 5.2.2.3, 5.2.3.3). For T‑group vehicles similar fitment suitability rules apply and additional rules for retreaded tyres reference AS 1973-1993 (s 5.3.1-5.3.4).

The Standard adopts, as an alternative technical route for categories MA, MB and MC, the United Nations Regulation No. 142 on tyre installation incorporating the 00 series of amendments (cl 7.1 and Appendix A). The Standard also lists exemptions from specified administrative and approval process sections of Appendix A (cl 6.1), meaning that some UNECE approval procedures and annexes are not required for the Standard’s purposes. Appendix A (the Addendum incorporating Regulation No. 142) is included in full as part of the instrument; it contains definitions, detailed performance specifications, approval and conformity of production provisions, and annexed forms for information and approval marks.

The instrument therefore changes the mechanical compliance landscape by: setting category-specific technical requirements; tying tyre selection to ADR 23/… and ADR 96/… or to a set of named international/industry references for L‑group; allowing UNECE Reg 142 as an alternative technical standard for certain categories; excluding temporary spare units from coverage; and carving out several parts of the UNECE approval and administrative machinery from domestic application (cl 6.1). The instrument is dated 25 October 2018 and is named and cited in cl 1.1.1-1.1.2.

The Standard draws together a small number of core legal and technical concepts and maps them to vehicle categories. Key concepts are vehicle categories and applicability, tyre suitability and matching, load capacity, speed capacity, inflation pressure limits, alternative technical standards, exclusion of temporary-use spares, and limited adoption of UNECE approval procedures.

Vehicle categories and timing: The Standard applies to categories listed in cl 3.4 (L, M, N, T and trailer categories). A "new model" for mandatory application is a vehicle model first produced with a 'Date of manufacture' on or after the agreed date (cl 3.1.2 and table at cl 3.4). The rows in cl 3.4 show 1 July 2019 as the manufactured-on-or-after date for all categories listed. For vehicles not qualifying as new models there is no forced change; they may continue under ADR 42/04 (cl 3.1.2).
Tyre suitability and matching: For L‑group, tyres fitted to a single axle must have the same carcass construction though cords and plies may differ (s 5.1.1). For M/N/T groups, tyres "normally fitted to the vehicle" must be suitable with respect to dimensions, speed and load performance (ss 5.2.1 and 5.3.1). The UNECE text in Appendix A (Regulation No. 142) echoes and elaborates these fitment and space-envelopment checks (Appendix A, para 5.2.1).
Load capacity and GVM/GTM relationships: L‑group requires the sum of recommended tyre load-carrying capacities to be at least the vehicle GVM (s 5.1.2). Appendix A sets detailed criteria for maximum load ratings relative to axle mass, including single and dual formations and class distinctions C1 vs C2 (Appendix A, paras 5.2.2.1-5.2.2.2). Manufacturers must provide replacement-tyre load capacity information in the owner's handbook or other in-vehicle communication (Appendix A, para 5.2.2.3).
Speed capacity: Each tyre must bear a speed category symbol compatible with vehicle design speed (Appendix A, para 5.2.3.1). Exceptions are stated for temporary-use spares, snow tyres, special use tyres and vehicles with speed limiting devices; where exceptions apply, visible and permanent maximum speed warning labelling is required in the vehicle (Appendix A, paras 5.2.3.2.x).
Inflation pressure limits: The Standard places a manufacturer obligation not to fit tyres that require cold inflation pressures greater than 825 kPa for radial tyres and 700 kPa for other tyres to achieve the manufacturer’s rated GVM for M/N vehicles (s 5.2.4) and a similar prohibition to achieve GTM for T‑group (s 5.3.5).

This Standard allocates obligations primarily to vehicle manufacturers and indirectly affects tyre suppliers, vehicle importers, owners and repairers. The text identifies other actors involved in approvals where Appendix A is read in, including Technical Services and Type Approval Authorities, but clause 6.1 narrows the administrative elements of Appendix A that are required.

Manufacturers: The Standard explicitly imposes duties on manufacturers to fit appropriate tyres, not to fit tyres that require excessive cold inflation pressures to achieve rated GVM/GTM (s 5.2.4; s 5.3.5), to ensure suitability of tyre dimensions, speed and load characteristics (s 5.2.1; s 5.3.1), to supply appropriate passenger car tyres under ADR 23/… or commercial tyres under ADR 96/… for certain vehicles (ss 5.2.2-5.2.3), and to include replacement-tyre load and speed information in the vehicle owner’s handbook or other in‑vehicle communication (Appendix A, paras 5.2.2.3 and 5.2.3.3). L‑group vehicle manufacturers must ensure same carcass construction per axle (s 5.1.1) and that sum of tyre load capacities meets or exceeds GVM (s 5.1.2). Manufacturers of T‑group vehicles face retreaded-tyre technical compliance obligations referencing AS 1973-1993 (s 5.3.4).
Tyre suppliers and aftermarket: The Standard constrains the types of tyres that can be fitted as original equipment and as replacement tyres through the ADR cross-references and the UNECE technical requirements. For L‑group tyres the Standard requires maximum load ratings to comply with a specific list of manuals and international sources (s 5.1.3). For passenger car tyres on M/N/T groups there is an explicit requirement to meet ADR 23/… (s 5.2.2; s 5.3.2). This affects tyre manufacturers and suppliers who supply OE or replacement tyres for vehicles subject to the Standard.
Vehicle owners and repairers: Owners receive mandated information via the owner’s handbook or in‑vehicle communication about replacement tyre load capacities and speed ratings (Appendix A, paras 5.2.2.3 and 5.2.3.3). Repairers and fitment workshops are constrained by the requirement that tyres normally fitted be suitable to model type and that tyre sets on an axle be of the same type or carcass where required (s 5.1.1; ss 5.2.1 and 5.3.1).
Importers and compliance bodies: The Standard’s allowance for UNECE Regulation 142 as an equivalent technical standard for MA/MB/MC vehicles (cl 7.1) creates an option for vehicles approved under UNECE technical rules to be treated as meeting the ADR technical requirements, subject to the Standard’s carve‑outs. However the Standard exempts certain Appendix A approval and communication procedures (cl 6.1), which means domestic administrative approval processes may remain with Australian authorities rather than fully adopting UNECE approval mechanics.

The Standard creates duties primarily for manufacturers, accompanied by specific information‑provision duties and technical obligations, and it creates limited rights to rely on alternative standards and to claim exemptions in defined circumstances.

Manufacturers’ duties

Fitment suitability: For M-, N- and T‑group vehicles, manufacturers must ensure tyres normally fitted to the vehicle are suitable for the model in dimensions, speed and load performance (s 5.2.1; s 5.3.1). For L‑group vehicles, manufacturers must fit tyres to each axle that have the same carcass construction (s 5.1.1).
Load and inflation constraints: For L‑group vehicles the sum of recommended tyre load-carrying capacities must not be less than the GVM (s 5.1.2). For M/N vehicles manufacturers must not fit tyres that require cold inflation pressures greater than 825 kPa for radial tyres and 700 kPa for other tyres to achieve the manufacturer’s rated GVM (s 5.2.4). For T‑group the same caps apply to achieve the rated GTM (s 5.3.5).
Compliance with ADRs and referenced manuals: Passenger car tyres fitted to vehicles must comply with Australian Design Rule 23/… - Passenger Car Tyres (s 5.2.2; s 5.3.2 for new passenger car tyres on T group). Light truck or truck/bus tyres must comply with ADR 96/… - Commercial Vehicle Tyres (s 5.2.3; s 5.3.3). For L‑group vehicles maximum load rating must comply with one of the enumerated international manuals (s 5.1.3).
Information duties: The manufacturer must provide owner-facing information on replacement tyre load capacity (Appendix A, para 5.2.2.3) and replacement tyre speed capacity (Appendix A, para 5.2.3.3). Where special tyres (e.g. snow tyres, special-use tyres) are fitted that have lower speed categories than vehicle design speed, a prominent in-vehicle maximum speed warning label is required (Appendix A, paras 5.2.3.2.2-.2.4).
Retreaded tyre standards: For T‑group vehicles the use of retreaded tyres must comply with AS 1973-1993 (s 5.3.4).
Towing cases: Where trailer towing may cause rear tyre load ratings to be exceeded by up to 15 per cent for C1 tyres, the manufacturer must include handbook information on maximum permissible towing speed (not exceeding 100 km/h) and on recommended tyre pressure increases (at least +20 kPa), per Appendix A para 5.2.4.1.

Rights and alternative pathways

The published text contains direct references to conformity and penalties insofar as Appendix A (the incorporated UNECE Regulation No. 142) sets them out, but the ADR narrows the reach of those portions by explicit exemption.

What the instrument itself states

The Standard is a vehicle standard determined under section 7 of the Motor Vehicle Standards Act 1989 (front page). The instrument text does not itself specify criminal or civil penalty amounts or detailed enforcement procedures within the ADR text beyond cross-references to Appendix A. The ADR does, however, expressly state that compliance with certain parts of Appendix A is not required for its purposes (cl 6.1). The list in cl 6.1 includes Section 7 Conformity of production, Section 8 Penalties for non-conformity of production, Section 9 Production definitively discontinued, Section 3 Application for approval, Section 4 Approval, Section 6 Modification of vehicle type and extension of approval, Section 10 Names and addresses of Technical Services and Type Approval Authorities, and Annexes 1-3 (information document, communication and approval marks). By removing these from the list of required Appendix A parts, the ADR does not itself embed the UNECE sanction and approval mechanics referenced in those sections for the Standard’s purposes.

What Appendix A (Regulation No. 142) sets out

Where Reg 142 is applied in full, it contains conformity-of-production procedures (Appendix A, paras 7.1-7.3), and it permits withdrawal of an approval if conformity requirements are not met (Appendix A, para 8.1), with a duty to notify other Contracting Parties if approval is withdrawn (para 8.2). It also sets out the mechanism for assigning approval numbers, marking vehicles with an international approval mark and communicating approval decisions (paras 4.1-4.7 and Annex 3).

Practical enforcement implications from the text

Because cl 6.1 excludes many of Appendix A’s approval and penalty sections from being required for the ADR, the ADR does not, in its own terms, embed the UNECE withdrawal and notification procedures and the Annexed approval forms as mandatory processes. That creates an enforcement gap within the ADR text: the internal UNECE penalty and conformity machinery exists in Appendix A, but the ADR explicitly states that relevant parts need not be complied with for the Standard’s purposes. The Standard therefore leaves open which domestic enforcement mechanisms apply. The instrument itself was determined under s 7 of the Motor Vehicle Standards Act 1989, which implies that enforcement, penalties and compliance mechanisms under that Act and its administrative framework will be the primary domestic means of ensuring compliance, but those mechanisms are not described in the ADR text provided.

The instrument cross‑references and incorporates other legal instruments and technical standards. Its interactions fall into three categories: (1) interstate or international harmonisation via UNECE Regulation No. 142 and other international/industry manuals; (2) interaction with other Australian Design Rules; and (3) interaction with the Motor Vehicle Standards Act 1989 as the parent statutory authority.

Interaction with Australian Design Rules

ADR cross-references: The Standard requires, for passenger car tyres, compliance with Australian Design Rule 23/… - Passenger Car Tyres (s 5.2.2 and s 5.3.2). For commercial vehicle tyres it requires compliance with Australian Design Rule 96/… - Commercial Vehicle Tyres (s 5.2.3 and s 5.3.3). It also allows vehicles to remain compliant under ADR 42/04 - General Safety Requirements for non-new-model vehicles (cl 3.1.2). Those cross-references mean manufacturers must ensure tyre selections align with the technical provisions and any transitional schedules in ADR 23/… or ADR 96/…, as applicable.

International harmonisation and adoption of UNECE Regulation No. 142

Clause 7.1 deems the technical requirements of UN Regulation No. 142 (00 series of amendments) equivalent for the technical requirements of the Standard for MA, MB and MC vehicles. Appendix A reproduces Regulation No. 142 text including its definitions, specifications, tests, and requirements on load and speed capacities (Appendix A, paras 1-5). This supplies a harmonised technical route for vehicles meeting the UNECE’s technical criteria.
Limits of harmonisation: The ADR expressly limits the administrative and approval machinery of the UNECE instrument by excluding specified sections and annexes of Appendix A from being required for the Standard’s purposes (cl 6.1). Consequently, while the technical substance of Regulation 142 is available as an equivalent, its approval, marking and communication apparatus (Sections 3, 4, 6, 7, 8, 9, 10 and Annexes 1-3 of Appendix A) need not be used under this ADR. This produces a partial harmonisation: technical equivalence with UNECE Reg 142, but not necessarily direct mutual recognition of UNECE approval numbers, communications or administrative decisions within Australian domestic processes.

Interaction with Motor Vehicle Standards Act 1989

The instrument was determined under s 7 of the Motor Vehicle Standards Act 1989 (front page). That indicates the ADR is a delegated statutory instrument within the MVSA framework. The ADR itself does not reproduce MVSA enforcement provisions, licence conditions, or registration rules. Therefore, enforcement, penalties and domestic approval mechanisms outside the ADR text will be governed by the MVSA and related regulations and administrative instruments. The ADR does not set those MVSA procedural or sanction details out, but the opening statement ties the ADR legally to the MVSA as the authorising statute.

The instrument contains express timestamps and incorporated amendment information in its text and Appendix A. These are the amendment‑related facts recorded in the published Standard.

Instrument date and commencement provision: The Standard is titled Vehicle Standard (Australian Design Rule 95/00 - Installation of Tyres) 2018 and is signed and dated 25 October 2018 (front page). Clause 1.2.2 provides that the Standard "commences on the day after it is registered." The instrument therefore takes effect relative to its formal registration date rather than automatically on the signature date. The text does not record the registration date itself; it records only the signature and the commencement mechanism (cl 1.2.2).
Applicability dates: Clause 3.1.1 and the applicability table at cl 3.4 set 1 July 2019 as the manufactured-on-or-after date for "new model" vehicles across the categories listed. Where the clause refers to "the dates set out in clauses 3.1.1 to 3.1.2 and the table under clause 3.4," that establishes the key operational amendment or transition date for applying the Standard to new models.
Incorporation of UNECE amendments: Appendix A is presented as Addendum 141 - Regulation No. 142, with the heading "Incorporating by the Department of Infrastructure, Regional Development and Cities, all valid text up to: 00 series of amendments - Date of entry into force: 22 January 2017." The Appendix A preface therefore documents that the UNECE Regulation text included has been consolidated up to the 00 series amendments, which entered into force on 22 January 2017.
Edition references to external manuals and standards: The L‑group clause 5.1.3 lists a number of external publications with the edition year 2018 (Tyre and Rim Association of Australia Standards Manual - 2018; European Tyre and Rim Technical Organisation Standards Manual - 2018; Japan Automobile Tyre Manufacturers Association Year Book - 2018; US Tyre and Rim Association, Inc. Year Book - 2018) and includes ISO 5751-2:2010. Those edition dates identify which edition of external publications the Standard references at the time of making. The Standard does not itself provide an automatic mechanism for updating those external edition references.
Exemptions from UNECE approval procedural sections: Clause 6.1 sets out an explicit carve-out by listing Appendix A sections and annexes for which "compliance ... is not required for the purposes of this standard." That clause is itself a structural amendment choice in the ADR, limiting the adoption of Reg 142 to its technical content while excluding administrative and approval sections.

The instrument as supplied does not cite any judicial decisions, administrative appeals, or precedent cases. The text contains no litigation history, no references to disputes, and no court or tribunal rulings involving this Standard are mentioned in the document.

What the absence of litigation references means for practitioners

The Standard does not present any case law in its text, and no judicial interpretations, appeals tribunal decisions or enforcement litigation are recorded within the instrument. Consequently, there is no authoritative judicial construction supplied within the Standard itself to guide interpretation of ambiguous phraseology or to resolve conflicts between ADR provisions and administrative practice.
Because the ADR is determined under the Motor Vehicle Standards Act 1989 (front page), legal disputes about enforcement, interpretation of duties, or administrative processes would be brought against the regulatory decisions made under that Act or under subordinate administrative instruments. The ADR text does not set out those dispute resolution mechanisms or any statutory appeal paths; practitioners must consult the Motor Vehicle Standards Act, relevant instrument registers and agency policies to identify appeal procedures and enforcement decision routes.

Potential litigation vectors suggested by the text

Technical compliance disputes: The ADR imposes technical duties (tyre suitability, load and speed compatibility, inflation pressure limits), and disputes could arise about whether a vehicle’s tyre fitment complies with the ADR’s clauses (e.g. whether tyre load-carrying capacity sums meet GVM, or whether a tyre’s speed category is compatible with vehicle design speed). Where Appendix A Reg 142 procedures and Type Approval Authority decisions are used, the Appendix’s approval and communication model contemplates formal decision documentation (Appendix A, paras 3-4 and Annex 2). However cl 6.1 exempts many of those administrative sections, potentially creating uncertainty about the administrative decision process and therefore ground for procedural challenges if domestic approvals or refusals are taken.
Manufacturer information duties: The ADR requires manufacturer-provided information in the owner's handbook or other in-vehicle communication (Appendix A, paras 5.2.2.3 and 5.2.3.3). Disputes may arise over adequacy of information provided to vehicle owners, particularly where consumers or service workshops rely on handbook data.

The Standard contains a number of drafting and application features that can surprise practitioners if overlooked. These are concrete points where compliance risk or unexpected operational effects arise from specific clauses.

New‑model mandatory date and "no mandatory" clause for existing vehicles

Clause 3.1.1 sets 1 July 2019 for new model vehicles. Clause 3.1.2 then allows "all other vehicles" to either comply with this Standard or continue to comply with ADR 42/04. Practitioners must determine whether a vehicle is a "new model" as defined in cl 3.1.2 for the manufactured-on-or-after rule. The text defines a "new model" as a vehicle model first produced with a 'Date of manufacture' on or after the agreed date, and the table at cl 3.4 lists 1 July 2019. The operational "gotcha" is that a model-by-model determination is required; an incorrectly characterised model could lead to inadvertent non‑compliance.

Temporary-use spare units excluded

Clause 3.3 expressly excludes temporary-use spare units from the Standard. Appendix A (Reg 142) treats temporary-use spare tyres and run-flat tyres in separate provisions, but the ADR’s express exclusion of temporary-use spare units for the Standard’s purposes means that OE temporary spare rules may be handled differently. Practitioners should not assume that spare‑unit rules in Appendix A apply domestically unless explicitly adopted.

UNECE technical adoption but administrative carve‑outs

Clause 7.1 deems UNECE Reg 142 technical requirements equivalent for MA/MB/MC vehicles, but clause 6.1 exempts key Appendix A sections such as Application for approval, Approval, Conformity of production, Penalties for non-conformity and Annexes 1-3. That means the ADR adopts the UNECE's technical substance but not its approval, marking, testing and penalty apparatus. The practical consequence is that a UNECE approval number, communication form or mark may not be treated automatically as fulfilling domestic administrative documentation requirements. This partial adoption can cause confusion for manufacturers who expect direct mutual recognition.

Inflation pressure caps may constrain tyre choices and design

Sections 5.2.4 and 5.3.5 prohibit manufacturers from fitting tyres that require cold inflation pressures greater than 825 kPa for radial tyres and 700 kPa for other tyres to achieve rated GVM/GTM. That is a tight upper bound; vehicle design that previously relied on very high-pressure tyres to achieve load capacities will require reworking tyre fitment choices or design parameters. The cap is a technical limit that can affect OE tyre selection and may increase costs if larger sizes or more axles are required instead.

Compliance requires a vehicle‑by‑vehicle analysis of category, manufacture date and whether the vehicle is a new model, followed by technical checks, documentation updates and supply‑chain coordination. The following practical steps translate the Standard’s clauses into a compliance workflow.

Establish the vehicle status and applicable rule set

Determine vehicle category (cl 3.4 table and definitions referenced in cl 4.1.1). Confirm the vehicle’s "Date of manufacture" and whether it is a "new model" produced on or after 1 July 2019 (cl 3.1.1 and cl 3.1.2). If the vehicle is not a new model, note that ADR 42/04 remains an acceptable compliance route (cl 3.1.2), but consider future resale, registration and OE fitment expectations if choosing to retain ADR 42/04 compliance.

Identify the applicable tyre requirements by category

L‑group: Ensure that tyres fitted to an axle use the same carcass construction (s 5.1.1) and that the sum of tyre recommended load-carrying capacities is not less than the vehicle GVM (s 5.1.2). Verify the Maximum Load Rating of tyres against the specific referenced documents in s 5.1.3 (ISO 5751-2:2010 or one of the listed manuals).
M/N groups: Confirm that tyres normally fitted are suitable for vehicle model/type in dimensions, speed and load performance (s 5.2.1). Fit passenger car tyres complying with ADR 23/… if passenger car tyres are used (s 5.2.2). Fit commercial vehicle tyres complying with ADR 96/… if light truck or truck/bus tyres are used (s 5.2.3). Do not fit tyres requiring cold inflation pressures greater than the caps in s 5.2.4 to achieve GVM.
T‑group: Follow the analogous suitability rules in s 5.3.1 and ensure new passenger car tyres comply with ADR 23/… (s 5.3.2), commercial tyres with ADR 96/… (s 5.3.3), and retreaded tyres with AS 1973-1993 (s 5.3.4). Observe the cold inflation pressure limits in s 5.3.5 for achieving GTM.

Use the alternative UN Reg 142 technical route where appropriate

For MA, MB and MC vehicle categories you may rely on the technical requirements of UNECE Regulation No. 142 (00 series amendments) as equivalent to the ADR’s technical requirements (cl 7.1 and Appendix A). If choosing this path, gather the necessary test reports and technical evidence to demonstrate that tyre selection, speed category symbols, load indexes, and space/envelopment checks meet Reg 142 technical provisions (Appendix A, paras 5.2.1-5.2.3). Note cl 6.1’s carve-outs: do not assume you can rely on UNECE administrative approvals and marking procedures unless domestic acceptance is confirmed with the regulator.

5.2.1.2. All of the tyres normally fitted to one axle shall be of the same type.

5.2.1.3. The space in which the wheel revolves shall be such as to allow unrestricted movement when using the maximum permissible size of tyres and rim widths, taking into account the minimum and maximum wheel off-sets, within the minimum and maximum suspension and steering constraints as declared by the vehicle manufacturer. This shall be verified by performing the checks with the largest and the widest tyres, taking into account the applicable dimensional tolerances (i.e. maximum envelope) related to the tyre size designation as specified in the relevant UN Regulation.

5.2.1.4. The Technical Service and/or Type Approval Authorities may agree to an alternative test procedure (e.g. virtual testing) to verify that the requirements of paragraph 5.2.1.3. are met.

5.2.2. Load capacity

5.2.2.1. Subject to the provisions of paragraph 5.2.4. of this Regulation, the maximum load rating of every tyre as determined in paragraph 5.2.2.2. of this Regulation, including a standard spare unit (if provided), with which the vehicle is fitted shall be:

5.2.2.1.1. In the case of a vehicle fitted with tyres of the same type in single formation: at least equal to half of the technically permissible maximum axle mass for the most heavily loaded axle, as declared by the manufacturer of the vehicle.

5.2.2.1.2. In the case of a vehicle fitted with tyres of more than one type, in single formation: at least equal to half of the technically permissible maximum axle mass as declared by the manufacturer of the vehicle, in respect of the relevant axle.

5.2.2.1.3. In the case of a vehicle fitted with tyres of class C1 in dual (twin) formation: at least equal to 0.27 times the technically permissible maximum axle mass, as declared by the manufacturer of the vehicle, in respect of the relevant axle.

5.2.2.1.4. In the case of axles fitted with tyres of class C2 in dual (twin) formation: at least equal to 0.25 times, with reference to the load capacity index for dual application, the technically permissible maximum axle mass as declared by the manufacturer of the vehicle, in respect of the relevant axle.

5.2.2.2. The maximum load rating of a tyre is determined as follows:

5.2.2.2.1. In the case of tyres of class C1, the "maximum load rating" as referred to in paragraph 2.34. of Regulation No. 30 is taken into account.

5.2.2.2.2. In the case of tyres of class C2, the "table load-capacity variation with speed" as referred to in paragraph 2.29. of Regulation No. 54 is taken into account, which shows, as a function of the load-capacity indices and nominal-speed-category symbols, the load variations which a pneumatic tyre can withstand taking into account the maximum design speed of the vehicle.

5.2.2.3. The manufacturer shall provide in the vehicle owner's handbook, or by any other communication means in the vehicle the necessary information about replacement tyres load capacity.

5.2.3. Speed capacity

5.2.3.1. Every tyre with which the vehicle is normally fitted shall bear a speed category symbol.

5.2.3.1.1. In the case of a tyre of class C1, the speed category symbol shall be compatible with the maximum vehicle design speed and shall take into account, in the case of tyres of speed categories V, W and Y, the maximum load rating as described in Regulation No. 30.

5.2.3.1.2. In the case of tyre of class C2, the speed category symbol shall be compatible with the maximum vehicle design speed and the applicable load/speed combination derived from the "table load-capacity variation with speed" as described in paragraph 2.29. of Regulation No. 54.

5.2.3.2. The requirements of paragraphs 5.2.3.1.1. and 5.2.3.1.2. shall not apply in the following situations:

5.2.3.2.1. In the case of temporary-use spare units for which paragraph 5.2.5. of this Regulation applies.

5.2.3.2.2. In the case of vehicles normally equipped with normal tyres and occasionally fitted with snow tyres where in such a case the speed category symbol of the snow tyre shall correspond to a speed either greater than the maximum vehicle design speed or not less than 160 km/h (or both). However, if the maximum vehicle design speed is greater than the speed corresponding to the lowest speed category symbol of the fitted snow tyres, a maximum speed warning label, specifying the lowest value of the maximum speed capability of the fitted snow tyres, shall be displayed inside the vehicle in a prominent position readily and permanently visible to the driver.

5.2.3.2.3. In the case of vehicles equipped with special use tyres. However, if the maximum vehicle design speed is greater than the speed corresponding to the lowest speed category symbol of the fitted special use tyres, a maximum speed warning label, specifying the lowest value of the maximum speed capability of the fitted special use tyres, shall be displayed inside the vehicle in a prominent position readily and permanently visible to the driver.

5.2.3.2.4. In the case of vehicles equipped with an on-board system fulfilling a speed limitation function where in such a case the speed symbol of the tyres shall be compatible with the speed at which the limitation is set. However, if the vehicle manufacturer has foreseen that the maximum vehicle design speed is greater than the speed corresponding to the lowest speed category symbol of the fitted tyres, a maximum seed warning label, specifying the maximum speed capability of the tyres, shall be displayed inside the vehicle in a prominent position readily and permanently visible to the driver.

5.2.3.3. The manufacturer shall provide the necessary information about replacement tyres speed capacity in the vehicle owner's handbook or by any other communication means in the vehicle.

5.2.4. Special cases

5.2.4.1. In the case of vehicles which are designed to be capable of towing a trailer, the additional load imposed at the trailer coupling device may cause the rear tyre maximum load ratings to be exceeded in case of class C1 tyres, but not by more than 15 per cent. In such a case, the vehicle owner's handbook, or the other communication means referred to in paragraph 5.2.3.3., shall contain clear information and advice on the maximum permissible vehicle speed when towing a trailer, in any case not exceeding 100 km/h, and on the rear tyre pressure, at least 20 kPa (0.2 bar) above the tyre pressure(s) as recommended for normal use (i.e. without a trailer attached).

5.2.4.2. In exceptional cases, where vehicles are designed for conditions of use which are incompatible with the characteristics of tyres of class C1 or C2 and it is therefore necessary to fit tyres with different characteristics, the requirements of paragraph 5.1.1. of this Regulation shall not apply, provided that all of the following conditions are met:

5.2.4.2.1. The tyres fulfil the technical requirements and respect the transitional provisions of either Regulation No. 75 or Regulation No. 106; and

5.2.4.2.2. The type-approval authority and technical service are satisfied that the tyres fitted are suitable for the operating conditions of the vehicle. The nature of the exemption and motivation of acceptance shall be stated in the test report as well as on the communication form of Annex 2.

5.2.5. Spare wheels and tyres

5.2.5.1. In cases where a vehicle is provided with a standard spare unit, it shall be of the same size as the tyres actually fitted to the vehicle.

5.2.5.2. Every vehicle provided with a temporary-use spare unit or run flat tyres shall comply with the technical and transitional provisions of Regulation No. 64 with respect to the requirements concerning the equipment of vehicles with temporary-use spare units and run flat tyres.

If specific precautions have to be taken in order to fit a temporary-use spare unit to the vehicle (e.g. temporary use spare unit is only to be fitted on the front axle and therefore a front standard unit must first be fitted on the rear axle in order to address a malfunction of a rear standard unit) this shall be stated clearly in the vehicle owner’s handbook or any other communication means in the vehicle, and compliance with the appropriate aspects of paragraph 5.2.1.3. of this Regulation shall be verified.

6. Modification of vehicle type and extension of approval

6.1. Every modification to an existing vehicle type shall be notified to the Type Approval Authority which approved the vehicle type. The Type Approval Authority shall then either:

(a) Decide, in consultation with the manufacturer, that a new type approval is to be granted; or

(b) Apply the procedure contained in paragraph 6.1.1. (Revision) and, if applicable, the procedure contained in paragraph 6.1.2. (Extension).

6.1.1. Revision

When particulars recorded in the information documents of Annex 1 have changed and the Type Approval Authority considers that the modifications made are unlikely to have an appreciable adverse effect and that, in any case, the vehicle still complies with the requirements, the modifications shall be designated a "revision";

In such a case, the Type Approval Authority shall issue the revised pages of the information documents of Annex 1 as necessary, marking each revised page to show clearly the nature of the modification and the date of re-issue. A consolidated, updated version of the information documents of Annex 1, accompanied by a detailed description of the modification, shall be deemed to meet this requirement.

6.1.2. Extension

The modification shall be designated an "extension" if, in addition to the change of the particulars recorded in the information documents of Annex 1,

(a) Further inspections or tests are required; or

(b) Any information on the communication document (with the exception of its attachments) has changed; or

6.2. Confirmation or refusal of approval, specifying the alterations, shall be communicated by the procedure specified in paragraph 4.3. above to the Contracting Parties to the Agreement applying this Regulation. In addition, the index to the information documents and to the test reports, attached to the communication document of Annex 1, shall be amended accordingly to show the date of the most recent revision or extension.

6.3. The Type Approval Authority issuing the extension of approval shall assign a series number to each communication form drawn up for such an extension.

7. Conformity of production

7.1. Procedures concerning conformity of production shall conform to the general provisions defined in the 1958 Agreement, Schedule 1 (E/ECE/TRANS/505/Rev.3) and meet the following requirements:

7.2. A vehicle approved pursuant to this Regulation shall be so manufactured as to conform to the type approved by meeting the requirements of paragraph 5.;

7.3. The Type Approval Authority which has granted the approval may at any time verify the conformity of control methods applicable to each production unit. The normal frequency of such inspections shall be once every two years.

8. Penalties for non‑conformity of production

8.1. The approval granted in respect of a vehicle type pursuant to this Regulation may be withdrawn if the requirements laid down in paragraph 7. are not complied with.

8.2. If a Contracting Party withdraws an approval it had previously granted, it shall forthwith so notify the other Contracting Parties applying this Regulation by sending them a communication form conforming to the model in Annex 1 to this Regulation.

9. Production definitively discontinued

If the holder of the approval completely ceases to manufacture a type of vehicle approved in accordance with this Regulation, he shall so inform the authority which granted the approval, which in turn shall forthwith inform the other Contracting Parties to the Agreement applying this Regulation by means of a communication form conforming to the model in Annex 1 to this Regulation.

10. Names and addresses of the Technical Services responsible for conducting approval tests and of Type Approval Authorities

The Contracting Parties to the Agreement applying this Regulation shall communicate to the United Nations Secretariat the names and addresses of the Technical Services responsible for conducting approval tests and of the Type Approval Authority which grant approval and to which forms certifying approval or extension or refusal or withdrawal of approval are to be sent.
