What it does
Mechanically, this Australian Design Rule mandates that specified passenger cars and light commercial vehicles be equipped with an Electronic Stability Control (ESC) system that meets the technical requirements referenced in the instrument. The operative prescription is that "Vehicles must be equipped with an Electronic Stability Control system meeting the requirements of Appendix A" (clause 5.1). The Rule applies directly to vehicles in ADR categories MA, MB, MC and NA for new models manufactured on or after 1 July 2019 (clause 3.1.1 and the Applicability Table under clause 3.3). For vehicles other than new models there is no mandatory nationwide application date: they may either comply with this Standard or continue to comply with the earlier ADR 31/03 or ADR 35/05, as applicable (clause 3.1.2).
The Standard treats several administration-related terms as defined elsewhere or with modified readings. The term "Approval Authority" in the text of Appendix A is to be read as "Administrator of Vehicle Standards", the office defined in the Motor Vehicle Standards Act 1989 (clause 5.2). The term "Technical Service" in Appendix A is to be read as "Manufacturer" (clause 5.3). Several administrative and approval-related parts of Appendix A have been expressly excluded from mandatory application under this national standard; in particular, Appendix A Sections 3, 4, 10, 11, 12, 13 and 14, and Annexes 1 and 2 are not required for the purposes of this Standard (clause 6.1).
The instrument also establishes two alternative equivalence routes. First, technical requirements set out in United Nations Regulation No. 140 (UN R 140/00) are deemed equivalent to Appendix A for ESC-equipped vehicles (clause 7.1). Second, United Nations Global Technical Regulation No. 8 (GTR No.8) is likewise deemed equivalent, subject to a list of specific exemptions to particular clauses of GTR No.8 (clause 7.2 and cl. 7.2.1). For certification purposes, the Standard accepts demonstration of compliance during a Conformity of Production assessment as satisfying certain Appendix A provisions (clause 6.2); the same deeming applies to certain paragraphs and annexes of the equivalent UN instruments (clause 7.1.1 and cl. 7.2.1.1).
