What it does
This instrument is a vehicle standard, formally titled Vehicle Standard (Australian Design Rule 79/00 , Emission Control for Light Vehicles) 2005 (ADR 79/00), determined by the Minister under subsection 7(1) of the Motor Vehicle Standards Act 1989 (text heading and signature page). The standard prescribes technical requirements for exhaust and evaporative emissions for light vehicles, with the stated purpose “to reduce air pollution” (clause 1.1). Mechanically, the standard does three things.
First, it sets the class of vehicles to which the rules apply: M1 and N1 category vehicles having a gross vehicle mass (GVM) less than or equal to 3.5 tonnes (clause 2.1). That fixes the scope to passenger vehicles and light commercial vehicles in those ADR categories.
Second, it fixes phased applicability dates based on fuel type, engine production dates and whether the vehicle is a “new model vehicle”. Those staged dates are given in clause 2.2 and the related definitions in clause 2.3. For diesel-engined new model vehicles the relevant start date is 1 January 2002 (clause 2.2.1 and 2.3.1); for other diesel engines 1 January 2003 (clause 2.2.2); for petrol/LPG/natural gas new-models 1 January 2003 (clause 2.2.3 and clause 2.3.2); for non-new-model petrol/LPG/natural gas engines 1 January 2004 (clause 2.2.4). Clause 2.4 makes clear that the dates in clause 2.2 prevail if they conflict with dates in Appendix A.
Third, the standard sets the compliance mechanics: vehicles “complying with the requirements of Appendix A of this vehicle standard, as varied by Part 5 and Part 6 of this vehicle standard, will be accepted as complying with this vehicle standard” (clause 4.1). Part 5 provides specific exemptions and modifications to the administrative provisions and certain approvals in Appendix A (clauses 5.1 to 5.5). Part 6 deems the technical content of UN ECE Regulation 83 (incorporating amendments up to and including the 04 Series) to be equivalent to the technical requirements of this standard, subject to the Part 5 variations (clause 6.1).
The standard also repeals earlier ADR 79/00 instruments in force at commencement, and instruments that amended ADR 79/00 if no other vehicle standards in those instruments remain in force (clauses 0.3.1-0.3.2). It commences the day after registration (clause 0.2.1) and carries an administrative date stamp (dated 8 December 2005). Practically, the instrument creates a compliance pathway that is either: (a) direct compliance with Appendix A as modified by the instrument; or (b) compliance by means of the specified equivalent UN ECE technical standard, with administrative deviations set out in Part 5.
