Vehicle Standard (Australian Design Rule 61/00 – Vehicle Marking) 2006

The primary duty‑bearers are manufacturers and importers of road vehicles who must ensure each vehicle they supply to the Australian market meets the marking requirements before it is sold or registered. This applies to every category listed in the applicability table: mopeds (LA, LB), motorcycles (LC, LD, LE), passenger cars (MA, MB, MC), omnibuses (MD, ME), goods vehicles (NA, NB, NC), and all trailers (TA to TD). In practice, the standard imposes design and assembly costs on original equipment manufacturers (OEMs) and on converters or body‑builders who modify vehicles. The compliance plate must be approved by the Administrator (an arm of the Department of Infrastructure), so manufacturers must interact with the regulator. Suppliers of aftermarket equipment may be affected indirectly if their components obscure registration plates (clause 61.6.1.1.3). State and territory road authorities rely on the VIN and compliance plate as the basis for registration, so the standard indirectly affects every vehicle owner and road user. The periodic VIN‑reporting obligation in clause 61.2.3 imposes an administrative burden on manufacturers to track every VIN assigned, which for small‑volume manufacturers or importers may be a disproportionate compliance cost. The alternative standard provisions (FMVSS 115, MP 55-1988) reduce the compliance burden for vehicles originally designed to US or Australian standards, but importers of vehicles from other markets (e.g. Japan, Europe) must still adopt the ISO structure unless they can satisfy the administrator that a different system is equivalent - the standard does not list that option, so those manufacturers face a stricter path.

Duty to assign a unique VIN (clause 61.2.1). The manufacturer must give every vehicle a VIN that complies with ISO 3779, 3780, and 4030, with the two Australian‑specific modifications. Alternatively, using FMVSS 115 or MP 55-1988 is deemed equivalent. The manufacturer must also furnish a list of all assigned VINs to the Administrator at agreed intervals (clause 61.2.3). This duty is ongoing and effectively requires a VIN management system.

Duty to affix a compliance plate (clause 61.3). Every motor vehicle and applicable trailer must bear an “Approved” compliance plate in a conspicuous position. The plate must be approved by the Administrator before it is attached, meaning the manufacturer must submit vehicle type approval documentation that demonstrates compliance with all relevant ADRs. This duty is a prerequisite for lawful supply.

Duty to mark the engine (clause 61.4). The identification number must be legible and permanently applied on the main component of the engine at the time of manufacture, located so it can be readily seen when the engine is installed. This duty applies only to motor vehicles (not trailers). It imposes a manufacturing step that may not be required in the vehicle’s home market if that market does not demand engine numbers.

Duty to affix a vehicle plate (clause 61.5) applies only to ME, NC and T group vehicles. The plate must contain prescribed information in English, with letters and numerals at least 2.5 mm high, and must be welded, riveted or permanently attached in a readily visible position. The manufacturer may optionally include additional information.

Duty to provide registration plate mountings (clause 61.6). The vehicle design must include provisions for mounting front and rear registration plates within the specified height ranges, and no part of the vehicle or equipment may obscure the plate. For L‑group vehicles, only rear plate mounting is required, with a lower height limit. Also, a label holder must be provided if there is no windscreen (non‑L‑group) or in a conspicuous position (L‑group). These are design‑phase duties: the manufacturer must engineer mounting points that comply, which may constrain styling or aftermarket accessories.

Duty to apply a visibility band (clause 61.7) if the vehicle is 2.2 m or more wide, has a tray‑type body, and lacks a rear marking plate under ADR 13. This is an additional manufacturing step.

Rights: The manufacturer has the right to elect between the primary ISO VIN requirements and the alternative standards (FMVSS 115 or MP 55-1988). The manufacturer may also add extra information to the vehicle plate at its discretion (clause 61.5.5). There is no explicit right to choose the location of the VIN beyond the left‑hand side allowance, but the relaxation in clause 61.2.1.3.1 gives more flexibility than the ISO standard would.

The standard itself does not create penalties. The enforcement framework is provided by the Motor Vehicle Standards Act 1989. Under that Act, it is an offence to supply a vehicle that does not comply with an applicable ADR. Penalties can include fines (currently up to 1,200 penalty units for an individual, or 6,000 for a body corporate, with the penalty unit value set by statute) and potentially injunctions to prevent supply. The Administrator (the Department of Infrastructure) audits compliance through random inspections, type‑approval reviews, and monitoring of VIN reports. Non‑compliance with marking requirements can result in a vehicle being denied a compliance plate, which in practice blocks registration. Because the standard is part of the national ADR system, the Commonwealth can also suspend or revoke a manufacturer’s approval to supply vehicles. In serious cases, importers may have to recall vehicles to retrofit marking plates or replace VINs, which is a costly corrective measure. The absence of explicit penalty provisions in the instrument does not reduce liability; rather, the standard operates as the technical yardstick against which compliance is measured. For example, if a vehicle lacks a VIN that meets the ISO requirements (or an accepted alternative), the manufacturer is in breach of the Act. For L‑group vehicles, the lower minimum height for registration plate mounting (300 mm) is a mandatory design requirement; failure to provide mounting within that range is a violation. Enforcement actions are at the discretion of the Administrator and may be influenced by the extent of the defect, the manufacturer’s cooperation, and whether the non‑compliance creates safety risks or facilitates theft and “rebirthing”.

This standard must be read in conjunction with the Motor Vehicle Standards Act 1989, which provides the legal authority and enforcement provisions. It also interacts with state and territory road transport legislation, because a vehicle cannot be registered in any Australian jurisdiction unless it bears a valid compliance plate and VIN meeting this ADR. The standard explicitly references external documents: ISO 3779:1983, ISO 3780:1993, ISO 4030:1983, FMVSS 115 (US), and Australian Standard MP 55‑1988. Those documents become mandatory to the extent referenced. The standard also references ADR 13 (Installation of Lighting and Light‑signalling Devices) in clause 61.7: if a vehicle already has a rear marking plate under that rule, the white band is not required. ADR 43/01 is listed as an Acceptable Prior Rule in the applicability table; this means a manufacturer may choose to comply with the older ADR 43/01 for some categories, provided the vehicle also meets clause 61.5 for heavy vehicles and trailers. This creates a layered compliance structure that may be complex for multi‑category manufacturers. The “Package 13 issue” mentioned in the applicability section is a procedural reference to a particular batch of ADR amendments; it does not alter the legal effect. The standard does not operate in isolation from the broader ADR system: vehicle categories are defined in the Vehicle Standard (Australian Design Rule Definitions and Vehicle Categories) 2005, as referenced in clause 61.1.1. That means a correct reading of this standard requires access to the definitions rule. The standard also implicitly interacts with trade practices law (e.g. the Australian Consumer Law) in that mis‑marking a VIN could amount to misleading conduct about the vehicle’s identity or origin.

The instrument as supplied is the original 2006 version, made on 3 September 2006 and commencing the day after registration. It repeals any previous instrument named “Australian Design Rule 61/00 - Vehicle Marking” that was made under section 7 of the Motor Vehicle Standards Act 1989 and still in force. It also repeals any instrument that solely created that rule, if no other standards remain in force from that instrument. This ensures a clean replacement. The applicability table carries a note about “Package 13 issue” permitting ADR 43/01 as an Acceptable Prior Rule - that indicates that the standard was part of a broader package of ADR updates (likely around 2005‑2006) that introduced this grandfathering. Because the instrument is a legislative instrument subject to disallowance, any subsequent amendments would be published on the Federal Register of Legislation. The text provided contains no later amendment information, so the current law may differ if the standard has been amended since 2006. A practitioner should check the Register for any amending instruments.

The standard itself contains no reference to any litigation. There is no case law directly interpreting ADR 61/00 noted in the instrument. In practice, disputes regarding vehicle marking typically arise in the context of stolen vehicle “rebirthing”, where the VIN or compliance plate has been forged or tampered with. In such cases, the standard’s requirements become evidentiary: if a vehicle does not have a properly affixed plate or a VIN in the correct location, it may be inferred that the vehicle has been altered or is unidentifiable. Civil litigation between manufacturers and the regulator is rare; most compliance matters are resolved administratively. There is no administrative appeals tribunal decision recorded in the standard. However, a manufacturer could challenge an Administrator’s decision to refuse approval of a compliance plate on the basis of non‑compliance with this ADR, under the Act’s merits review provisions. No such case is referenced.

Several features of this standard can trap the unwary:

• VIN location: left side only. Clause 61.2.1.3.1 says “it is permissible to locate the Vehicle Identification Number on the left‑hand side of the vehicle.” This is a relaxation of ISO 4030, but it only permits the left side; it does not require it. If a manufacturer places the VIN on the right side, that would still comply with ISO 4030 but may not comply with the Australian relaxation? Actually, the clause says “except that it is permissible to locate … on the left‑hand side” - this does not prohibit other locations, but read with the ISO requirement for the right side of the chassis, the Australian standard effectively allows moving it. Practitioners should verify the exact ISO requirement and whether any Australian‑specific deviation is mandatory.

• Clause 4.2 of ISO 4030 is not applicable in Australia. That clause likely deals with VIN location restrictions. Without it, Australian vehicles have more freedom, but the standard does not specify what replaces it.

• “Compliance plate” must be “Approved”. The standard does not define the approval process; it is in the parent Act. A manufacturer cannot simply stamp a plate; it must have prior approval from the Administrator. This adds bureaucratic lead time.

• Vehicle plate date of manufacture: “unless fitted with a ‘Compliance Plate’” - meaning if the vehicle already has a compliance plate that includes the date, the vehicle plate does not need to repeat it. However, the compliance plate date may not be the same as manufacture date (e.g. it could be the date of certification). The standard does not resolve this ambiguity.

• Height of registration plate: “no part … will be more than 1,300 mm from the ground.” There is no lower limit for non‑L‑group vehicles, but the plate must be mounted so that it is not obscured. A plate mounted very low (e.g. below the bumper) could be damaged or become unreachable, but the standard does not forbid it.

• L‑group vehicles: centre of rear plate not lower than 300 mm from the ground. That means the centre must be at least 300 mm up; there is no upper limit, but the plate must still be visible.

• Label holder for vehicles without windscreen: must be on left‑hand side. If the vehicle has a windscreen but no label holder, the standard is silent; but state law often requires a label to be affixed, so this may be an oversight.

• Clause 61.7 applies only to vehicles 2.2 m or more wide with a tray body and without a rear marking plate. If a vehicle has a rear marking plate, it is exempt from the white band. The white band must be “across the full width of the rearmost portion of the tray”. The standard does not specify the depth tolerance beyond “a uniform depth of at least 75 mm”.

• The alternative VIN standards (FMVSS 115, MP 55-1988) are deemed “equivalent in application” but only for the VIN requirements; they do not exempt the manufacturer from other clauses (e.g., compliance plate, engine number, vehicle plate). A manufacturer relying on FMVSS 115 must still put a compliance plate on the vehicle.

• “T group” vehicles (trailers) must meet clause 61.5 (vehicle plate) even if they comply with ADR 43/01 as an Acceptable Prior Rule. This is explicitly stated in the proviso: “provided that for ME, NC and T group vehicles the requirements of Clause 61.5 are met.” A trailer manufacturer cannot simply rely on the prior rule; the heavy‑trailer plate with Aggregate Trailer Mass and road‑train markings is compulsory.

• **The applicability table shows that very light trailers (TA) and light trailers (TB) have a “manufactured on or after” date of 1 July 1991, and Acceptable Prior Rule is “43/01 ” with asterisks. The footnote for the ** in the table says “provided that for ME, NC and T group vehicles the requirements of Clause 61.5 are met.” TA and TB are not T group? Actually T group includes TA to TD. The footnote applies to all T group vehicles. So even very light trailers must have a vehicle plate if manufactured after 1 July 1991, even if they comply with ADR 43/01. This is a trap: one may think a small box trailer only needs the compliance plate, but the standard requires a vehicle plate for all T group.

• The standard does not specify the language for the compliance plate, only for the vehicle plate (English). However, the compliance plate is likely to be required in English under the Act’s general principles.

A manufacturer or importer should implement a compliance plan that addresses each clause sequentially:

1. VIN assignment (clause 61.2): Obtain a World Manufacturer Identifier (WMI) from the Administrator or assign according to ISO 3780. Decide whether to comply with ISO 3779/3780/4030 (the primary path) or use FMVSS 115 or MP 55-1988 as the deemed equivalent. If using the ISO path, ensure the VIN is placed on the chassis or body on the left‑hand side (permissible relaxation). Ensure that clause 4.2 of ISO 4030 is not followed (it is dis‑applied). For the primary path, the VIN must comply with the content and structure of ISO 3779. If using FMVSS 115, ensure the US format is accepted - the standard deems it equivalent, so no separate Australian‑only VIN is required. Install the VIN so it is visible and not easily removable. Establish a system to record every VIN assigned and prepare to submit a list to the Administrator at agreed intervals (e.g. quarterly).

2. Compliance plate (clause 61.3): Obtain an approved compliance plate from the Administrator. This requires type‑approval of the vehicle model for all applicable ADRs (including this marking rule). Affix the plate in a conspicuous position - typically near the driver’s side door opening or inside the engine bay. The plate must be “Approved” before attachment; do not affix an unapproved plate.

3. Engine number (clause 61.4): Ensure the main component of the engine (usually the block) is stamped, cast, or laser engraved with a legible, permanent identification number at the time of engine manufacture. The number must be readily seen with the engine installed - avoid locations hidden by manifolds or accessories. This duty only applies to motor vehicles, not trailers.

4. Vehicle plate (clause 61.5) - applies only to ME, NC and T group: Design a durable label (metal or high‑strength plastic) containing: manufacturer’s name, vehicle model, VIN, date of manufacture (unless the compliance plate already shows it), Gross Combination Mass (for NC), maximum towing capacity (for ME), Aggregate Trailer Mass (for T), and if relevant, “ROAD TRAIN” or “B‑DOUBLE”. For trailers designed for road trains up to 125 t GCM, include “ROAD TRAIN TRAILER”. Use block letters and numerals at least 2.5 mm high, in English. Attach the plate permanently by welding, riveting, or equivalent (no adhesives that can be readily removed) in a prominent visible position. Additional details may be added.

5. Registration plate mountings (clause 61.6): Design the rear of the vehicle (all categories) to mount a registration plate such that no part of the plate is more than 1,300 mm above ground. For non‑L‑group vehicles, also provide a front mounting forward of the front axle, within the same height limit. For L‑group, the centre of the rear plate must be at least 300 mm from the ground. Ensure that no standard equipment, production options, or aftermarket accessories obscure any part of the plate. If the vehicle has no windscreen (e.g. some vans, light trucks), install a holder for the registration label on the left‑hand side, clearly legible from 6 m away. For L‑group, place the holder in a conspicuous position.

6. Tray visibility band (clause 61.7): For any vehicle (not just heavy vehicles) that is 2.2 m or more wide, has a tray‑type body, and has no rear marking plate under ADR 13, paint or attach a horizontal white or silver band at least 75 mm deep across the full width of the rearmost portion of the tray. Ensure the band is clearly visible.

7. Documentation and record‑keeping: Keep records of VIN assignments, compliance plate approvals, and vehicle plate specifications. Provide the VIN list to the Administrator as required. Type‑approval documentation should reference the applicable ADR and the alternative standards elected (if any). For vehicles using the Acceptable Prior Rule (ADR 43/01), note that only the vehicle plate requirement of clause 61.5 must still be met for the categories specified. Ensure the purchasing specifications for component suppliers (e.g. engine blocks, compliance plates) include the marking requirements.
