Vehicle Standard (Australian Design Rule 52/00 – Rear Fog Lamps) 2006

The ADR’s main legal and technical concepts are: (1) scope and object; (2) incorporation and variation of UN Regulation No. 38 (Appendix A); (3) an either/or compliance route; (4) targeted exclusions of UN administrative provisions; and (5) specific photometric, chromaticity and thermal test criteria.

Scope and object: The rule governs rear fog lamps used to increase rearward conspicuity by producing a red signal brighter than the rear position lamps (cl 2). The ADR does not itself determine when rear fog lamps are mandatory, optional, or prohibited; that determination is deferred to other ADRs , specifically ADRs 13/…, 19/… or 67/… (Applicability and implementation, cl 3.1). Therefore the ADR is technical rather than permissive or prescriptive about fitment regimes.

Incorporation of UN R38: Appendix A reproduces UN Regulation No. 38’s text and technical annexes (Definitions, General Specifications, Intensity, Test Procedure, Heat Resistance, Colour, Photometric Measurement, and Annexes 3-5 on measurement and conformity sampling). The ADR accepts UN R38’s technical substance for photometry, colour coordinates and testing voltages (Appendix A, paras 6-9, 7.1). Part 7 explicitly allows compliance by following any edition of UN R38 (Part 7.1).

Either/or compliance: Clause 3.1 sets a binary compliance route. A manufacturer, vehicle builder or parts supplier must either meet Appendix A’s technical requirements as modified by Parts 5 and 6, or meet one of the UN R38 editions identified in Part 7. Clause 3.1 therefore offers flexibility: regulators and industry can point to the UN Regulation editions or to the ADR’s adapted Appendix A technical text.

Targeted exclusions: Part 5 lists specific portions of Appendix A that do not apply to this ADR. Those exclusions eliminate the UN Regulation’s standard application and approval processes (Section 2 Application for approval, Section 3 Markings, Section 4 Approval), the UN’s conformity-of-production administrative provisions (Section 10 and Sections 11-13), most Annexes including the UN’s approval communication format (Annex 1) and arrangements of approval marks (Annex 2). It also excludes particular internal paragraphs in Annex 5 (paragraphs 2.3 and 3.3). Conversely Part 6 accepts Annexes 4 and 5 as acceptable procedures for demonstrating compliance. The net effect is that the ADR imports technical tests but not the UN’s approval/marking/publishing regime.

Technical thresholds: The ADR (through Appendix A) sets concrete technical limits: minimum luminous intensity across core axes of 150 candela (cd) (Appendix A para 6.2), maximum per light in any observable direction of 300 cd (para 6.3), apparent surface in reference axis direction cannot exceed 140 cm2 (para 6.5), chromaticity limits y < 0.335 and z < 0.008 (para 9), and specified test voltages for replaceable and non-replaceable sources (para 7.1). Heat resistance test: one-hour continuous operation after 20 minutes warm-up at 23°C ±5°C (para 8.1-8.3). Measurement procedures and tolerances are set out in Annex 3 and Annexes 4-5 (photometric measurement and sampling plan), subject to the ADR’s exclusions.

Key administrative concept: the ADR was made under section 12 of the Road Vehicle Standards Act 2018 (cover page). That situates this ADR within Australia’s national vehicle standards regime rather than the UN’s approval/communication framework, explaining why administrative provisions of UN R38 are excluded.

Directly affected parties are manufacturers of rear fog lamps and of vehicles that incorporate rear fog lamps; distributors and importers of lamps and completed vehicles; technical services and test laboratories that perform approvals and photometric testing; and the administrative authorities charged with type approval and vehicle standards enforcement under Australian law.

Manufacturers and brand-holders: Appendix A para 2.1 requires that the application or type documentation be submitted by the holder of the trade name or mark or their accredited representative. Although Part 5 of the ADR excludes certain UN administrative approval provisions, the ADR still expects manufacturers to meet the technical tests reproduced in Appendix A (Part 3.1). Manufacturers therefore face technical obligations: design to meet intensity, colour, heat-resistance and surface-area limits (Appendix A paras 6, 8, 9, 6.5), prepare drawings and samples for testing where an approval process is used (Appendix A para 2.2), and implement production quality controls consistent with Annexes 4 and 5 where those are adopted by the regulator (Part 6).

Vehicle manufacturers, fitters and importers: The ADR applies to rear fog lamps “fitted to vehicles in accordance with ADRs 13/…, 19/… or 67/… and required to comply with this ADR” (Requirements cl 3.1). Those other ADRs determine when a rear fog lamp is mandatory, optional or prohibited. Therefore vehicle manufacturers and importers must consult ADRs 13/…, 19/… or 67/… to know whether a given vehicle must have compliant rear fog lamps; if so, they must ensure the lamps as fitted meet the photometric and technical rules in Appendix A or the alternative UN R38 editions under Part 7.

Test laboratories and technical services: Appendix A contemplates technical services responsible for conducting approval tests and administrative departments (para 13), and Annex 3 sets measurement method details. Although the ADR excludes some administrative communications of Appendix A (Part 5), the technical measurement and sampling methods are adopted by the ADR (Part 6 accepts Annexes 4 and 5), so accredited test facilities and inspection services will be engaged for photometric verification, sampling and conformity demonstration.

Regulators and inspectors: The ADR was made under the Road Vehicle Standards Act 2018 (cover page). The ADR excludes large parts of Appendix A’s approval and penalty procedures (Part 5), signalling that Australian administrative enforcement (type approval, marking, withdrawal procedures) will be handled under domestic laws and administrative instruments. Regulators must therefore interpret and incorporate the ADR’s technical requirements into their approval and compliance processes, and decide whether to use Annexes 4 and 5 as the conformity procedure (Part 6).

Consumers and fleet operators: Indirectly affected; the ADR changes the technical standards applied to rear fog lamps on vehicles sold or registered in Australia, which affects lamp performance, replacement lamp market choice, and potentially after-market fitment work. Where the ADR accepts all editions of UN R38 as alternatives (Part 7.1), suppliers may choose lamps certified to particular UN R38 editions, affecting product availability and compatibility.

Who does not bear obligations under the ADR: certain administrative obligations in UN R38 are explicitly not adopted by the ADR (Part 5). In particular, the ADR does not itself implement the UN’s international approval mark, approval-number assignment, UN communication forms or the UN-prescribed withdrawal and penalty processes. Those administrative elements will be addressed under Australian domestic vehicle standards and approval processes.

Duties

Manufacturers and type holders must ensure that any rear fog lamp required to comply with this ADR meets the technical requirements set out in Appendix A, as modified by Part 5 and Part 6 (Requirements cl 3.1). The technical duties (drawn from Appendix A, where not excluded by the ADR) include:

• Photometry: ensure luminous intensity minima and maxima are met. Appendix A para 6.2 prescribes a minimum of 150 cd across the core H and V axes (±10° horizontally, ±5° vertically). Appendix A para 6.3 caps intensity at 300 cd in any observable direction per light; para 6.4 addresses single lights with multiple sources and failure modes.

• Apparent surface: ensure the apparent surface in the reference-axis direction does not exceed 140 cm2 (Appendix A para 6.5).

• Colour: certify the chromaticity coordinates lie within the limits y < 0.335 and z < 0.008, with specific measurement procedures set out in Appendix A para 9.

• Heat resistance: lamps must withstand one hour continuous operation after 20-minute warm-up at ambient 23°C ±5°C without visible distortion, deformation, cracking or colour change (Appendix A paras 8.1-8.3).

• Test voltages and procedures: tests on non-replaceable light sources must be made at the specified voltages (6.75 V, 13.5 V or 28.0 V) and tests on replaceable filament lamps conducted with standard lamps and voltages per Annex 3 and para 7.1.

• Demonstration of compliance: the ADR accepts the requirements and procedures in Annexes 4 and 5 as acceptable for demonstrating conformity (Part 6.1). Those Annexes set manufacturer-level control and inspector sampling procedures, including allowable photometric deviations (no measured value unfavourably deviates more than 20% as a general rule) and statistical criteria for sampling (Annex 4 and Annex 5).

• Documentation and testing: where the Australian administering authority requires evidence, manufacturers should be prepared to provide drawings, technical descriptions, and samples as prescribed in Appendix A para 2.2, subject to any domestic modifications. However, Part 5 excludes Appendix A’s Section 2 (Application for approval) and Section 3 (Markings), signalling that Australian application and marking requirements may differ.

Rights

• If the technical samples meet the Regulation’s technical requirements, under the UN text approval should be granted and an approval number assigned (Appendix A para 4.1-4.2). However, because the ADR excludes Appendix A Sections 2-4 (Part 5), the Australian granting of approvals, assignment of numbers, and marking regimes will be governed by domestic procedures. Appendix A still provides the model of how approvals operate internationally.

• Alternative compliance route: manufacturers have the right to comply by meeting any edition of UN Regulation No. 38 instead of the precise text of Appendix A, because Part 7.1 expressly accepts any editions of UN R38 as alternative standards.

Administrative duties and limits under the ADR

• The ADR excludes the UN’s administrative and penalty provisions (Part 5). That means duties such as reporting production discontinuation, names and addresses of technical services, and UN-style approval communications are not imposed by this ADR. Instead the ADR leaves these matters to Australian administrative mechanisms , the ADR itself was made under s 12 of the Road Vehicle Standards Act 2018 (cover page), which defines the legal basis for Australian approvals and enforcement. Practitioners must therefore consult the Road Vehicle Standards Act and relevant Australian administrative instruments for the domestic approval, marking and penalty framework.

• The ADR accepts Annexes 4 and 5 as “acceptable for demonstrating compliance” (Part 6.1). Those Annexes impose manufacturer-level testing and sampling duties if the administering authority adopts them.

Enforcement rights of the regulator

• While the UN text provides for withdrawal of approval where production does not conform (Appendix A para 11.1-11.2), the ADR explicitly excludes Appendix A Section 11 (Part 5). The ADR therefore does not itself confer the UN’s withdrawal/communication mechanisms; rather, domestic regulators exercise approval, compliance and enforcement powers under Australian law. The ADR thereby defines technical obligations but delegates administration and enforcement to the domestic legal framework (made under s 12 Road Vehicle Standards Act 2018).

The ADR’s text primarily sets technical standards and explicitly excludes many of the UN Regulation’s administrative penalty and withdrawal mechanisms. The ADR does not itself prescribe monetary fines or criminal penalties; instead it adopts technical test standards and defers administrative enforcement to Australia’s domestic vehicle standards framework.

What the ADR adopts and what it explicitly excludes

• Exclusions: Part 5 lists the Appendix A provisions that do not apply to this ADR, including Section 10 (Conformity of production), Section 11 (Penalties for non-conformity of production), Section 12 (Production definitely discontinued) and Section 13 (Names and addresses of technical services). Part 5 also excludes Section 2 (Application for approval), Section 3 (Markings) and Section 4 (Approval), plus Annex 1 and Annex 2 and specific paragraphs in Annex 5 (paragraphs 2.3 and 3.3). Because Section 11 (penalties) and the Annex5 paragraphs dealing with approval-withdrawal are excluded, the UN’s built-in penalty/withdrawal processes do not apply under this ADR as written.

• Adoption of conformity procedures: Part 6 states that the requirements and procedures set out in Annexes 4 and 5 of Appendix A are acceptable for demonstrating compliance with this ADR. Those Annexes specify sampling plans, manufacturer testing regimes and statistical acceptability criteria (for example, the Annexes set a general tolerance that no measured value should unfavourably deviate by more than 20% from regulated values; Annex 4 para 1.2.1; Annex 5 para 1.2.1). However, the ADR’s acceptance of these Annexes is for the purpose of demonstrating compliance; the ADR does not itself say that these Annexes create enforcement powers. Enforcement and penalties remain matters for domestic authorities.

Administering authority and legal basis

• The ADR was made under section 12 of the Road Vehicle Standards Act 2018 (cover page and compilation notes). That Act is the statutory source for approvals, compliance controls and penalties in Australia. Because the ADR excludes the UN’s penalty provisions, enforcement (including removal from the Australian market, revocation of approvals, penalties or recalls) will be administered under the Road Vehicle Standards Act and related subordinate instruments. The ADR itself therefore provides technical standards that regulators can enforce under domestic law.

Practical enforcement mechanisms that may be used (as implied by the ADR and Appendix A, but not enacted by the ADR)

• Technical testing and sampling: Annexes 4 and 5 (accepted by Part 6) provide a structure for manufacturer self-testing and inspector sampling, including statistical thresholds and procedures for repeated sampling (Annex 5). Regulators are likely to use these procedures to detect non-conforming production.

• Marking and identification: Appendix A includes detailed marking and approval-mark arrangements (para 4.3-4.5 and Annex 2). Those sections are excluded under Part 5, so Australia will rely on domestic marking and identification requirements. Failure to produce evidence of conformity or to comply with domestic marking/identification could trigger administrative actions under Australian law.

• Withdrawal of market authorisation or remedial steps: The UN text provides for withdrawal of approval where production does not conform (Appendix A para 11.1). The ADR excludes that provision; domestic authorities will use the enforcement tools available under the Road Vehicle Standards Act 2018 or other instruments to compel remediation, recall, or to stop supply.

No penalties in the ADR text

• This ADR does not itself specify fines, imprisonment, civil penalties or recall mechanisms. Practitioners should consult the Road Vehicle Standards Act 2018 and relevant administrative instruments for the statutory penalties and enforcement processes that will be used in Australia to address non-compliant rear fog lamps.

Statutory basis and regulatory architecture

• The ADR is made under section 12 of the Road Vehicle Standards Act 2018 (cover page). That Act provides the statutory authority to determine vehicle standards in Australia. The ADR supplies technical standards within that legislative framework. Administrative actions such as granting approvals, imposing penalties, recall orders or other corrective measures will be governed by the Road Vehicle Standards Act and associated regulations and administrative instruments, not by the ADR itself.

Interaction with other ADRs

• The ADR explicitly defers to other Australian Design Rules to decide when rear fog lamps are mandatory, optional, or prohibited. Applicability is determined by ADRs 13/…, 19/… or 67/… (Applicability and Implementation, cl 3.1). Practitioners must look to those ADRs for fitment and vehicle category rules. In practice this means a lamp can be technically compliant under ADR 52/00 but may only be required, permitted or prohibited on a given vehicle type depending on ADR 13/…, ADR 19/… or ADR 67/….

Substitution of UN Regulation cross-references

• The ADR contains conversion notes: where Appendix A references UN Regulation No. 48, the ADR instructs readers to read ADR 13/00 instead; where it references Regulation No. 37, read ADR 51/00 (Notes, Part 8). This substitution aligns UN references with Australian ADR equivalents for the regulation of lighting devices and filament lamp categories. That affects testing and categorisation of filament lamps since Regulation No. 37 categories (filament lamp categories) correspond to ADR 51/00 in the Australian regime.

International harmonisation and alternative standards

• Part 7 allows compliance with any edition of UN Regulation No. 38. That gives manufacturers and regulators flexibility to rely on UN R38-certified lamps or test reports. However, the ADR’s Part 5 exclusion of the UN administrative approval and marking procedures means that Australian acceptance of a UN R38 approval or mark will be a matter for domestic regulators; the ADR does not automatically import UN approval marks, numbering or UN communication forms.

Conformity procedures and international agreements

• Appendix A, as reproduced, references the Agreement E/ECE/324-E/ECE/TRANS/505/Rev.2 (Appendix 2 of the Agreement) for conformity of production procedures (Appendix A para 10). Part 5 excludes Appendix A Section 10 from applying to this ADR. Nonetheless Part 6 accepts Annexes 4 and 5 for demonstration of compliance. The ADR therefore imports the technical essence of international conformity criteria but not the UN’s conformity-of-production administrative matrix. Interaction with international approvals and bilateral recognition will depend on Australia’s domestic policies and whether regulators choose to accept UN approvals as evidence of compliance.

Administrative communications and marking

• Appendix A sets out detailed approval marks and communication forms (para 4.3, Annex 1 and Annex 2). Part 5 excludes these specific provisions. The ADR instead leaves marking and reporting conventions to Australian administration. Practitioners should therefore consult Australian marking requirements for lighting devices and any applicable importation and registration rules.

Interface with product safety and consumer law

• The ADR imposes technical requirements relevant to product safety (photometry, heat resistance, colour). However, consumer protection obligations, product safety recalls and civil liability (for defective products that cause injury or property damage) remain governed by consumer law and tort/common law in Australia. The ADR does not displace those laws; it sits alongside them as a technical standard that regulators and courts may use as evidence of conformity or non-conformity.

Summary

• The ADR supplies technical content and permits reliance on UN R38 editions, but excludes the UN’s administrative apparatus. Consequently it interacts with other Australian ADRs (for fitment rules), the Road Vehicle Standards Act 2018 (for statutory authority, approvals and enforcement), and domestic marking and product safety regimes. Practitioners should cross-check the ADR with ADRs 13/…, 19/… and 67/…, the Road Vehicle Standards Act 2018 and any administrative guidance or instruments issued by the Department responsible for vehicle standards.

The compilation notes and tables in the instrument record the ADR’s creation and subsequent amendment history. The ADR was originally made as Vehicle Standard (Australian Design Rule 52/00 - Rear Fog lamp) 2006, registered 24 July 2006 and commencing 25 July 2006 (Compilation notes: Table of Instruments). The compilation incorporates a Lighting Standards Amendment Instrument 2022 (No.1), registered 19 January 2023 and commencing 20 January 2023 (Table of Instruments; Compilation Date 20 January 2023).

Table of Amendments in the compilation identifies specific clauses affected by the 2022/2023 amendment instrument:

• Clause 4.1 was amended by Vehicle Standard (Australian Design Rule) Lighting Standards Amendment Instrument 2022 (No.1). The compilation lists cl 4.1 as “am” with that instrument noted (Table of Amendments).

• Clause 7.1 was likewise amended by the Lighting Standards Amendment Instrument 2022 (No.1).

• The Appendix A title was amended by the 2022 instrument (Appendix A - title am).

The Compilation Notes also list deletions made under the Legislation Act 2003 to clause numbering (for example 0.2 and 0.3 were deleted under the Legislation Act 2003, sections 48C and 48D). The compilation indicates clause renumbering symbols () where relevant.

Practical effect of amendments

• The compilation shows that the ADR has been updated by the 2022 Lighting Standards Amendment Instrument. The table entry “Clause affected: 4.1, How affected: am” indicates the substance or wording of clause 4.1 was altered. Clause 7.1's amendment implies a change in the ADR’s treatment of alternative standards or the technical adoption of UN Regulation No. 38,practitioners must compare the pre- and post-amendment texts for precise drafting changes.

• The Appendix A title amendment suggests either a typographical or structural change to how UN R38 is cited in the ADR. Because the compilation incorporates the 2023 version, the current operative text is as compiled on 20 January 2023.

No historical case law or litigation entries are recorded in the compilation notes. The instrument’s compilation record is administrative and does not show any judicial interpretation or dispute history.

How to track future amendments

• The compilation includes a Table of Instruments that lists the statutory instruments and their commencement dates. To track further amendments, consult federal registers of legislative instruments and the Department or the Office of Parliamentary Counsel consolidated instrument indexes, and the Road Vehicle Standards Act 2018 subordinate instrument registers. The ADR’s compilation note also identifies the compiling agency: Vehicle Safety Policy and Partnerships, Department of Infrastructure, Transport, Regional Development, Communications and the Arts.

This ADR compilation does not include any recorded litigation history or judicial decisions interpreting the Vehicle Standard (Australian Design Rule 52/00 - Rear Fog Lamps) 2006. The document itself contains no case references and the compilation notes do not list court determinations.

Relevant points for prospective litigation

• Administrative decisions under the Road Vehicle Standards Act 2018 which implement or enforce this ADR (for example, decisions to refuse approval, to withdraw Australian approval, to require remedial action, or to issue civil penalties) could give rise to merits review or judicial review challenges. The ADR, however, explicitly excludes UN R38’s administrative approval and penalty sections (Part 5 excludes Section 2, Section 3, Section 4, Section 10-13 of Appendix A). This exclusion means that administrative decision-making and remedies will be governed by Australian legislation and administrative law channels, not by the UN text.

• Technical disputes over photometric compliance would hinge on the technical measurements specified in Appendix A and Annex 3 (photometric measurement methodology). Evidence in any dispute would likely focus on measurement method conformity (Annex 3), sampling and statistical thresholds (Annexes 4 and 5), and whether the equipment and procedures used matched those required (Appendix A paras 7.1 and Annex 3). Part 6’s acceptance of Annexes 4 and 5 as acceptable for demonstrating compliance creates a potential locus for fact questions (i.e. whether a regulator accepted those procedures and whether they were properly applied).

• Because the ADR defers to domestic enforcement under the Road Vehicle Standards Act 2018, any judicial review of regulatory enforcement actions will require examining the exercise of discretion and procedural fairness under that Act and relevant administrative instruments. The ADR itself is a technical standard; remedies and penalties are sourced in domestic statute and administration.

Absence of reported litigation in the ADR text

• The compilation contains no report of judicial decisions, appeals, or administrative reviews citing this ADR. Practitioners seeking precedents or litigation outcomes must search court databases and administrative tribunal records for decisions referencing ADR 52/00, or decisions under the Road Vehicle Standards Act that turn on rear fog lamp compliance.

The ADR imports UN R38 technical requirements but excludes many of the UN’s administrative and approval procedures. That structural choice creates several practical pitfalls for manufacturers, importers and compliance professionals.

1. Administrative provisions excluded, so do not assume UN approval-equivalence

• Part 5 explicitly excludes Appendix A Sections 2-4 (Application for approval, Markings, Approval) and Sections 10-13 (Conformity of production, Penalties, Production discontinued, Names and addresses) and Annexes 1 and 2. Consequently a lamp bearing a UN-type approval mark does not automatically satisfy Australian administrative requirements. Regulators or customs may require domestic evidence of conformity or domestic marking. Practitioners must not assume automatic route-to-market based on a UN approval alone.

2. Annexes 4 and 5 accepted but some Annex5 paragraphs excluded

• Part 6 accepts Annexes 4 and 5 as acceptable for demonstrating compliance. However Part 5 excludes paragraphs 2.3 and 3.3 in Annex 5. Those paragraphs in Annex 5 concern the sampling outcomes that lead to withdrawal of approval. By excluding those paragraphs the ADR separates the technical sampling procedures from the UN’s automatic administrative consequence of approval withdrawal. Practitioners should therefore not rely on Annex 5’s full withdrawal matrix to predict automatic regulatory consequences; Australian regulators will determine remedial measures under domestic law.

3. Replaceable vs non-replaceable light sources change test methods and requirements

• Appendix A para 7.1 and Annex 3 distinguish tests for lamps with non-replaceable light sources from lamps with replaceable filament lamps. Colour verification and measurement conditions differ (Appendix A para 9 and Annex 3). Misunderstanding this distinction can lead to test failure or incorrect sampling. For example, non-replaceable source lamps must be tested at specified voltages applied to their power-supply input, and laboratories may require the manufacturer to supply special power supplies (Appendix A para 7.1).

4. Tight photometric tolerances and measurement method sensitivity

• The fundamental intensity range is narrow , minimum 150 cd and maximum 300 cd (Appendix A paras 6.2-6.3). Measurement tolerances and procedures (Annex 3) require suitable equipment (receiver subtends angle between 10' and 1°; Annex 3 para 2.2) and masking to avoid stray reflections (Annex 3 para 1). Apparent surface must not exceed 140 cm2 (para 6.5). In practice small design or testing deviations can produce non-conformity.

5. Sampling and statistical criteria may be applied

• Annexes 4 and 5 impose manufacturer-testing regimes and inspector sampling schemes with statistical acceptability rules, and a general 20% unfavourable deviation threshold (Annex 4 para 1.2.1; Annex 5 para 1.2.1). Even if a lamp passes core axes, it may still fail if outlying measurements within the rhombus (Annex 3 para 3) fall below thresholds. Manufacturers must implement production quality systems and statistical sampling to avoid batch rejection.

6. Grouped or combined lamps and marking intricacies

• Appendix A para 4.5 places conditions on grouped, combined or reciprocally incorporated lamps: each lamp within the unit must meet its specific Regulation requirements, and the approval mark(s) must be visible and indelible. While Annex 2 (approval mark arrangement) is excluded by Part 5, the technical requirement that each lamp in a combined unit satisfy relevant Regulations remains. Manufacturers integrating multiple lighting functions within a single housing must ensure each function meets its applicable standard.

7. Heat resistance test and ambient temperature constraints

• The heat resistance test requires one hour continuous operation following 20 minutes warm-up at 23°C ±5°C (Appendix A para 8.1). Temperature control during testing is material; non-compliance with environmental conditions can invalidate results.

8. Colour measurement temperature and method

• The colour coordinates are to be measured using a source at 2854 K (Appendix A para 9 and footnote). For non-replaceable sources the colourimetric characteristics must be verified with the light sources present (para 9). Failing to follow the specified colour-source temperature or to test with the lamp’s actual light source can cause non-conformity.

9. Divergence between UN and Australian regimes on approvals and communications

• The UN’s communication forms (Annex 1) and country distinguishing numbers (compilation notes footnote) are part of the UN approval ecosystem, but Part 5 excludes Annex 1 and Annex 2 from this ADR. Do not assume that procedures for notifying UN parties or the assignment of E-numbers and approval numbers will apply in Australia. Domestic marking and approval evidence requirements must be checked.

10. Liaison with domestic vehicle ADRs for fitment rules

• The ADR does not itself state when rear fog lamps are required; ADRs 13/…, 19/… or 67/… determine mandatory/optional/prohibited circumstances (cl 3.1). A lamp could be compliant with ADR 52/00 but not appropriate for a particular vehicle type under ADR 13/00, ADR 19/00 or ADR 67/00. Cross-referencing fitment ADRs is essential.

This section provides a practical checklist and procedural steps, grounded in the ADR and its Appendix A, for manufacturers, importers, fitters and compliance professionals to achieve and demonstrate compliance.

1. Determine applicability

• Check whether the vehicle in question is required or permitted to carry a rear fog lamp under ADR 13/…, ADR 19/…, or ADR 67/… (Applicability and Implementation, cl 3.1). The ADR 52/00 technical standard only applies to lamps fitted where those ADRs require or permit them.

2. Choose compliance route

• Decide to comply either with the technical requirements of Appendix A as varied by Parts 5 and 6 (Requirements, cl 3.1), or by meeting one of the editions of UN Regulation No. 38 (Part 7.1). Select an option and document it.

3. Design to meet the technical specifications

• Photometry: Ensure the lamp provides at least 150 cd in the core axes band (H ±10°, V ±5°) and does not exceed 300 cd in any observable direction (Appendix A paras 6.2-6.3).

• Apparent surface: Ensure apparent surface in the reference axis direction ≤ 140 cm2 (Appendix A para 6.5).

• Colour: Design light output to meet chromaticity limits y < 0.335 and z < 0.008 at the specified colour-temperature measurement conditions (Appendix A para 9).

• Heat resistance: Test lamp in a 23°C ±5°C ambient, one-hour continuous operation following a 20-minute warm-up; verify no perceptible deformation, cracking or colour change (Appendix A paras 8.1-8.3).

• Multiple light-source units: Ensure compliance under failure modes (Appendix A para 6.4): when a single source fails, the lamp must still meet minimum intensity; when all sources light, the maximum must not be exceeded.

4. Prepare technical documentation and samples

• Even though the ADR excludes Appendix A Sections 2-4, the Appendix A type-approval framework provides useful guidance. Prepare drawings (showing mounting, reference axis, centre of reference), a technical description (including filament lamp categories for replaceable lamps), and sample units for testing as would be customary (Appendix A para 2.2). Keep full documentation on test methods and production quality systems.

5. Testing: measurement methods and equipment

• Use measurement methods in Annex 3 on photometric measurements: avoid stray reflections, ensure measurement distances satisfy inverse-square law applicability, and use a receiver whose subtended angle from the reference centre is between 10' and 1° (Annex 3 paras 1-2).

• For lamps with non-replaceable light sources test at 6.75 V, 13.5 V or 28.0 V respectively, applying voltage to the input terminals of the lamp or its special power supply (Appendix A para 7.1).

• For replaceable filament lamps, use mass-production filament lamps at the specified test voltages, or use standard filament lamps operated at reference fluxes as provided in Appendix A paras 7 and Annex 3 para 4.

6. Production quality and sampling

• Adopt production-conformity procedures consistent with Annex 4 (minimum requirements for conformity of production control procedures) and Annex 5 (minimum sampling requirements) if the administering authority expects those to demonstrate compliance (Part 6.1). Key elements include:

  • Implement control testing that demonstrates photometric and chromatic characteristics remain within allowable deviations (Annex 4 para 1.2.1: no measured value unfavourably deviates by more than 20%).

  • Maintain statistical acceptability criteria and sampling records, and be prepared to perform repeated samples and alignment steps if initial batches fail (Annex 4 and Annex 5 set out sampling plans and repeat sampling procedures).

7. Marking, labelling and documentation for Australian administration

• Do not rely solely on UN approval marks or E-numbers for Australian market acceptance (Part 5 excludes Appendix A Sections 3 and 4, Annexes 1 and 2). Check with the relevant Australian administering authority about domestic marking, labelling or declaration-of-conformity requirements. Maintain records of tests, certificates, and quality system documents to provide evidence of compliance.

8. Liaise with Australian regulator

• Because the ADR excludes the UN’s administrative and penalty provisions (Part 5), contact the Australian authority responsible for vehicle standards (the Department of Infrastructure, Transport, Regional Development, Communications and the Arts or the delegated approval authority under the Road Vehicle Standards Act 2018) to learn the domestic application, approval and evidence-acceptance processes. Determine whether the authority will accept UN R38 approvals or test reports as evidence or will require domestic testing or registration.

9. Post-market surveillance and response plan

• Implement a post-market monitoring plan to detect production drift, field failures, or sampling-triggered non-conformity. Annex 4 requires manufacturers to carry out periodic conformity tests and to take steps to ensure conformity when sampling shows non-conformity. Even though Appendix A Section 11 penalties are excluded, Australian regulators can take remedial action under the Road Vehicle Standards Act, so prepare a plan for corrective actions including alignment of production, notifications, and recalls if necessary.

10. Cross-check fitment and vehicle-level compliance

• Confirm that the vehicle-level ADR (13/…, 19/…, 67/…) allows fitment of the lamp in the intended mounting position and that installation does not create non-compliance at the vehicle level (e.g. grouped/combined lamps must ensure each function meets its Regulation; Appendix A para 4.5).

Practical checklist (quick reference)

• Confirm vehicle ADR fitment rules (ADRs 13/…, 19/…, 67/…).

• Select compliance route: Appendix A technical text as varied by ADR, or a UN R38 edition (Part 7.1).

• Design lamp to meet Appendix A paras 6, 8, 9 (intensity, heat resistance, colour).

• Test with proper voltages and equipment per Appendix A para 7.1 and Annex 3.

• Implement production control and sampling per Annex 4 and Annex 5 (accepted under Part 6).

• Prepare documentation and be ready to present test reports to the Australian regulator; check domestic marking and approval evidence requirements (Part 5 exclusions).

• Maintain post-market surveillance and corrective action plans.

Following these steps and maintaining clear documentation of tests, production controls, and communications with the Australian authority materially reduces the risk of non-acceptance at entry or at market surveillance.
