Vehicle Standard (Australian Design Rule 44/02 – Specific Purpose Vehicle Requirements) 2006

The document organises technical obligations by vehicle function rather than by single technical domain. Core organising concepts that recur through the Standard are:

• Specific-purpose overlay onto category ADRs. ADR 44/02 is not standalone for many vehicles: clause 44.2 makes compliance with the general category ADRs mandatory where a specific-purpose vehicle falls into a category (for example NA/NB/NC). This creates a two-tier compliance structure: general category ADR obligations plus the specific-purpose add-ons.

• Class-based capacity requirements for tow trucks. Tow trucks are classified into Class 1-4 with numeric thresholds for load capacity, crane safe working load, gross combination mass and ancillary equipment (cl 44.4.1). The classification approach ties design requirements directly to the expected towing task (gross mass of towed vehicles) and to particular equipment (crane SWL, winch, tandem axles, air brakes for towed vehicles where specified).

• Delegation to recognised technical standards and external authorities. Frequent cross-references direct designers and manufacturers to Australian Standards (for example AS 1418 for cranes, AS 1425 for LPG systems, AS 3509 for LPG cylinders, AS 2444 for portable extinguishers, AS E38-1962 for portable warning signs) or to codes issued by industry bodies (the ALPGA code for caravan LPG installations) (cl 44.4.2.1; 44.6.1-2; 44.4.4; 44.4.3.3; 44.8.2). For crane equipment, approval by the "relevant authority supervising lifting appliances" is required (cl 44.4.2.1-2). The ADR therefore functions primarily as an aggregator and enforcer of external technical standards within the vehicle approval framework.

• Safety-critical technical minima for occupant evacuation in omnibuses. The omnibus provisions (cl 44.9) are granular: they specify types and numbers of emergency exits tied to occupant numbers, minimum aperture dimensions, siting across particular vehicle faces or roof, opening mechanisms and manual overrides, piecewise requirements for latches and steps, illumination and signage, and failure-warning systems linked to driver notification. The Standard sets measurable design thresholds (e.g. emergency door aperture height 1,250 mm; emergency window area 0.4 m2; escape hatch opening force ≤500 N) and measurable operational outcomes (top-mounted lamp visibility 200 m for emergency vehicles , cl 44.7.1).

• Marking, labelling and information obligations. Several provisions require permanent marks or labels that must survive the life of the vehicle and guide inspectors and users: tow truck class marking size and placement (44.4.2.3), engine bay markings for LPG installations with installer identity and installation date (44.6.3), 25 mm square reflective red labels on registration plates for LPG-equipped vehicles (44.6.4), and emergency exit inscriptions and retroreflective materials (44.9.5-8).

• Interface with other ADRs and with registration/operation. The ADR requires tow trucks to provide electrical connections so towed vehicles can comply with ADR 13/... (cl 44.4.3.2). It also treats articulated bus sections separately for exit-count calculations (44.9.1.2.1). These connect design obligations to operational and broader vehicle-regulatory frameworks.

Collectively, the main concepts show ADR 44/02 as a technical overlay to category ADRs that: (a) applies measured, equipment-based minima for safety-critical functions; (b) leans on Australian Standards and recognised codes for technical design; and (c) imposes marking and information duties intended to support inspection, emergency use and interoperability between vehicles.

The Standard creates obligations that will affect multiple classes of actors along the vehicle lifecycle. Principal stakeholders identifiable in the text include:

• Vehicle manufacturers and converters. Any manufacturer of a tow truck, pole-type trailer, LPG-fuelled vehicle, emergency vehicle, motorhome/caravan or omnibus must design and construct the vehicle to the ADR’s specified minima. Clause 44.2 explicitly requires that where specific purpose vehicles fall within ADR vehicle categories they "must also comply with all requirements of those vehicles as set out in individual Australian Design Rules", thus manufacturers and converters face combined obligations.

• Fitters and licensed installers of LPG systems. Clause 44.6.3 requires the vehicle to be marked with identification of the licensed or approved person or organisation that installed the LPG fuel system and the date of installation, and cl 44.6.1 requires conformity with AS 1425 (or the updated AS 1425). This imposes duties on installers to be licensed/approved and to maintain records sufficient to satisfy marking and traceability requirements.

• Tow truck operators. Operational behaviour is affected: tow trucks must be equipped with specific cranes, winches, spacer bars, chains, lighting and portable warning devices and be marked by class (cl 44.4). Operators must therefore ensure the right class of truck for the tasks they undertake, maintain the required equipment, and carry mandatory devices (portable warning devices, fire extinguisher) and lighting.

• Fleet managers and bus operators. Omnibus operators using MD3, MD4 and ME vehicles designed for more than 16 passengers will face design/fitment and maintenance rules for emergency exits, signage, illumination, escape aids and warning systems (cl 44.9). They also must manage interior layout (seat positioning) and ensure that emergency exits remain unobstructed and that warning devices for unsecured exits are always operational.

• Authorities that supervise lifting appliances and those approving modifications. The ADR requires crane approval by the "relevant authority supervising lifting appliances" (cl 44.4.2.1). That creates an interface between road vehicle regulatory approval and workplace/lifting appliance regulators.

• Registration and inspection authorities. Because the ADR links to category ADRs and to ADR 13/... for towed vehicle lighting compatibility (cl 44.4.3.2), registration and roadworthiness inspectors must check both the ADR 44/02 items and the applicable category ADR requirements. They will also check markings and labels (e.g. LPG label on number plates cl 44.6.4; tow truck class marking cl 44.4.2.3).

• Emergency services and community-service organisations. ADR 44/02 permits and limits the use of flashing lamps for police, ambulance and fire-fighting vehicles, defining colour and visibility (cl 44.7). This affects equipment procurement for emergency agencies and private organisations providing emergency community services that require priority travel.

• Owners of converted vehicles and importers. For vehicles that are converted post-manufacture (for example LPG conversions, motorhome/caravan retrofits), the ADR requires compliance with the referenced standards and marking obligations (cl 44.6.1-3; cl 44.8.2). Importers of second-hand vehicles must expect to ensure that conversions and markings comply with ADR 44/02 if they wish the vehicle to be eligible under Australian certification and registration regimes.

• Standards organisations and industry bodies. The ADR explicitly imports Australian Standards and an ALPGA code; these bodies are consequentially implicated because compliance with their documents is made mandatory for specific-purpose vehicles (cl 44.4.2.1; cl 44.6.1; cl 44.8.2).

Who pays and who decides: The primary economic burden falls on manufacturers, converters, operators and installers who must design, equip, label and maintain vehicles to the specified standards. "Who decides" on technical approvals is split: manufacturers decide technical solutions constrained by the ADR and referenced Standards, while some approvals must be obtained from named authorities (the relevant authority supervising lifting appliances for cranes, and approvals under "Approved" standing in the motorhome LPG clause , see cl 44.4.2.1 and cl 44.8.2). The enabling Acts (Motor Vehicle Standards Act 1989; Road Vehicle Standards Act 2018) determine the legal enforcement and registration consequences; ADR 44/02 provides the technical content that those regimes apply.

ADR 44/02 contains duties cast as mandatory requirements for design, equipment, marking and operation; it does not itself set out fines or criminal sanctions. Key duties and the textual source in the Standard are as follows:

• Dual compliance duty. Where a vehicle fits a vehicle category ADR and is a specific-purpose vehicle covered by ADR 44/02, it "must also comply with all requirements of those vehicles as set out in individual Australian Design Rules" (cl 44.2). Duty: meet both specific-purpose requirements and category ADRs.

• Tow truck class and equipment duties (cl 44.4):

  • Classification and capacity: choose and mark a class that provides the required load capacity and crane SWL (cl 44.4.1.1-4).
  • Crane standard and approval: design and construct cranes to AS 1418 parts 1 and 5 and obtain approval from the relevant authority supervising lifting appliances; locate and mount the crane as directed by that authority; provide means to support the load when raised (cl 44.4.2.1-3).
  • Tyre and towing control equipment: fit dual tyres on rear axle group and equip spacer bars and safety chains to enable efficient control of towed vehicles; spacer bars must be designed to minimise damage (cl 44.4.2.1-2).
  • Marking: mark the class conspicuously on the right-hand side with letters at least 50 mm high and 25 mm wide (cl 44.4.2.3).
  • Lighting and warning devices: fit a flashing amber light complying with cl 44.7, an adjustable white lamp for coupling illumination, electrical connection for towed vehicle lighting per ADR 13/..., and carry at least three portable warning devices per AS E38-1962 (cl 44.4.3.1-3).
  • Fire extinguisher: provide at least a 4.5 litre extinguisher per AS 2444 (cl 44.4.4).

• Pole-type trailer and drawing vehicle lighting duties. Fit side marker lamps on each side of the rearmost bolster and a front non-triangular reflex reflector on each side of the foremost bolster for both the trailer and the drawing vehicle where applicable (cl 44.5.1-2).

• LPG vehicle duties (cl 44.6):

  • Fuel system: meet AS 1425-1989 or the updated AS 1425 (cl 44.6.1).
  • Cylinders: comply with AS 3509-1988 (cl 44.6.2).
  • Engine-bay marking: clearly and permanently mark the engine bay with a statement of compliance, installer identity, and installation date (cl 44.6.3).
  • External labels: affix at least 25 mm square external red reflective labels to the front and rear registration plates (cl 44.6.4).

• Emergency community service vehicle duties (cl 44.7):

  • Lamp visibility: at least one lamp mounted on top must be visible in normal daylight up to 200 metres from any direction (cl 44.7.1).
  • Lamp colour: police/blue; ambulance/fire/red; other emergency community service vehicles/amber (cl 44.7.2).
  • Lamp positioning and driver visibility: additional lamps may be sited wherever they are not visible to the driver seated in the normal position (cl 44.7.3).
  • Colour uniformity: all flashing warning lamps fitted under this clause must be the same colour (cl 44.7.4).

• Motorhome and caravan duties (cl 44.8):

  • Doors: outward-opening or sliding doors only; at least one such door on left-hand side or at the rear (cl 44.8.1).
  • LPG equipment: comply with ALPGA code unless otherwise "Approved" (cl 44.8.2).
  • Fire extinguisher: provide extinguisher(s) selected and located per AS referred to in cl 44.4.5 (cl 44.8.3).

• Omnibus emergency-exit duties (cl 44.9):

  • Types and numbers: provide emergency exits by type and to the minimum number linked to occupant counts (cl 44.9.0-1; occupant table in cl 44.9.1.2).
  • Dimensions: meet the minimum aperture sizes for doors, windows and hatches (cl 44.9.5 table).
  • Siting: provide exits on three of specified surfaces or meet special siting rules for double-deck vehicles (cl 44.9.6).
  • Technical conditions: doors to open outwards, not be slide-in-cavity type, power-operated doors must be readily opened manually, outside handles ≤1,800 mm above ground, latches two-stage, footrests and self-supporting steps meeting spacing and height limits, windows operable from inside and outside and equipped with ejecting devices or be readily breakable with a breaking tool, escape hatches limited in opening force, etc. (cl 44.9.4).
  • Marking and signage: label emergency exits with "EMERGENCY EXIT" at specified letter sizes and materials and provide permanently illuminated internal EXIT signs and marked controls and instructions (cl 44.9.5-9).
  • Interior arrangements and access: maintain free passage dimensions and be able to pass a test gauge through emergency windows/hatches (cl 44.9.10).
  • Warning devices: provide visible and audible driver warnings if primary opening device activated or exit locked or not securely closed, with warnings operated by movement of the catch not only door movement (cl 44.9.12).

Rights are implicit rather than articulated in the ADR. The Standard confers rights in the form of permitted equipment and compliance routes. For example, emergency community service vehicles are permitted to be equipped with flashing lamps and to display the word "AMBULANCE" (cl 44.7.1-2). Motorhomes and caravans are permitted to use an ALPGA code for LPG installations in lieu of other approvals unless otherwise "Approved" (cl 44.8.2). Where the text says "may be equipped" (for ambulance signage or flashing lamps, cl 44.7.1 and 44.7.2), it creates a permissive right to fit those items subject to the technical requirements.

Note that the ADR explicitly leaves enforcement, registration, approvals and offences to the statutory frameworks that give the ADR effect; it does not itself set monetary penalties or administrative sanction schedules in the text provided.

The ADR text compiled here does not itself prescribe offences, penalties, or enforcement mechanisms. The instrument header records that the ADR was originally made under the Motor Vehicle Standards Act 1989 and is continued under the Road Vehicle Standards Act 2018. That linkage is the statutory mechanism by which ADRs generally become enforceable: the enabling Acts provide legal consequence for non-compliance with applicable ADRs and the administrative processes for vehicle certification, importation and registration. The ADR therefore supplies technical obligations that the regulating Acts implement through their own enforcement regimes.

Concrete in-text pointers relevant to enforcement and administrative interaction include:

• The ADR requires certain approvals from other authorities (for example, crane design, construction and marking must be "approved by the relevant authority supervising lifting appliances", and the crane "shall be located and mounted on the vehicle in the manner directed by the said authority" (cl 44.4.2.1-2)). These references create points where non-compliance is actionable by the relevant approval authority and may affect registration or operation.
• Multiple clauses require permanent markings and labels (e.g. tow truck class marking cl 44.4.2.3; LPG engine-bay marking cl 44.6.3; LPG reflective plates cl 44.6.4; emergency exit inscriptions cl 44.9.5). Inspectors and registration authorities will use these markings for conformity assessment.
• The ADR cross-references other ADRs and Australian Standards (for example ADR 13/..., AS 1418, AS 1425, AS 3509, AS 2444, AS E38-1962). Enforcement of compliance with ADR 44/02 will typically be operationalised by checking conformance to these referenced documents at inspection, certification and registration time.

Because the ADR does not specify sanctions or enforcement operating procedures, the text must be read with the enabling legislation and administrative instruments that implement registration, certification and enforcement regimes. The endnotes record the legislative instruments that have amended the ADR and the compilation history, but they do not add penalties. For an assessment of penalties and concrete enforcement pathways, one must consult the Motor Vehicle Standards Act 1989 and the Road Vehicle Standards Act 2018 and the relevant departmental or agency guidance that sets out certification, importation and registration procedures. The ADR itself, as compiled, defines the substantive technical obligations but leaves detection, sanction and remedial processes to the broader regulatory framework.

ADR 44/02 cross-references and depends upon multiple other legal and technical instruments. The text explicitly links to:

• Enabling statutes. The instrument was made originally under the Motor Vehicle Standards Act 1989 and continued under the Road Vehicle Standards Act 2018, as stated in the compilation header. Those Acts provide the statutory basis for ADRs and supply enforcement and administrative frameworks. The ADR does not restate penalties or offences; the enabling Acts do that work in practice.

• Other Australian Design Rules. Clause 44.2 requires that specific-purpose vehicles which fall within an ADR vehicle category comply with the category’s ADRs. The tow-truck clause requires electrical connections so that ADR 13/... requirements can be complied with by the towed vehicle (cl 44.4.3.2). These cross-ADR links mean compliance requires reading ADR 44/02 together with the relevant category ADRs and ADR 13/..., where pertinent.

• Australian Standards and industry codes. ADR 44/02 mandates compliance with specific Australian Standards and a code:

  • AS 1418 (Parts 1 and 5) for crane design, construction and marking (cl 44.4.2.1).
  • AS 1425-1989 or a later AS 1425 for LPG fuel systems (cl 44.6.1).
  • AS 3509-1988 for LPG fuel vessels (cl 44.6.2).
  • AS 2444 (Portable Fire Extinguishers - Selection and Location) for fire extinguishers (cl 44.4.4 and cl 44.8.3 referencing the standard in cl 44.4.5).
  • AS E38-1962 (Portable Warning Signs for Motor Vehicles) for portable warning devices for tow trucks (cl 44.4.3.3).
  • AS 1742-1975 for the reflective colour required for the LPG label on number plates (cl 44.6.4).
  • The "Code Governing the Installation in Caravans of Liquefied Petroleum Gas Equipment and Appliances" issued by the Australian Liquefied Petroleum Gas Association for motorhome and caravan LPG installations unless "Approved" otherwise (cl 44.8.2). These references mean that ADR compliance is contingent on current editions or the versions specified by ADR 44/02; the ADR expressly allows the updated AS 1425 in lieu of the 1989 edition (cl 44.6.1.1). The ADR therefore ties vehicle law to standards-setting instruments external to legislative text.

• Approval and supervising authorities. The Standard requires approval by the "relevant authority supervising lifting appliances" for crane compliance and mounting (cl 44.4.2.1-2). This creates an interaction with workplace health and safety or lifting-regulatory regimes that supervise lifting appliances. It also implies co-ordination between road vehicle safety/certification authorities and lifting appliance authorising agencies.

• Procedural and legislative framework for instrument changes. The endnotes reference the Legislation Act 2003 as affecting editorial practices (endnote 4 references sections 48C and 48D as repeals and substitutions in the compilation notes). The amendment history lists Vehicle Standard amendment instruments (2021 and 2025) , those instruments change ADR content and thus shift technical obligations or remove clauses, showing that ADR 44/02 operates within an evolving legislative-instrument landscape (endnotes 3 and 4).

Practical interoperability consequences from these interactions:

• Compliance assessments will require cross-referencing ADR 44/02 with the category ADR(s), the cited Australian Standards and any approvals or directions from supervising authorities. Non-conformance in any linked document may render a vehicle non-compliant under ADR 44/02 because the ADR imports those standards by reference (cl 44.4.2.1; cl 44.6.1).
• Where the ADR requires approvals from other authorities, manufacturers and owners must engage with multiple regulators; for example, crane approval and mounting directions come from the lifting authority while vehicle registration and ADR conformity are administered by road vehicle regulators (cl 44.4.2.1-2).
• The ADR’s reliance on external standards and codes means that changes to those standards (or to the ALPGA code) may affect ADR compliance in practice, subject to the ADR’s allowance of specific cited editions or later versions where permitted (cl 44.6.1.1).

The compilation endnotes record the instrument history and amendments. Key chronological items in the endnotes are:

• Original registration and commencement. The Vehicle Standard (Australian Design Rule 44/02 - Specific Purpose Vehicle Requirements) 2006 was registered 26 April 2006 and commenced 27 April 2006 (endnote 3).

• Vehicle Standard (Australian Design Rule) Amendment Instrument 2021 (No. 1). Registered 13 May 2021, commenced 14 May 2021. The endnote table records discrete amendment actions under that instrument, including additions and repeals of specific sub-clauses. For example, the amendment history log shows an addition (ad) at 44.6.1.1 by the 2021 instrument (endnote 4 table).

• Vehicle Standard (Australian Design Rule) Amendment Instrument No. 1 of 2025. Registered 5 December 2025 and commenced 6 December 2025 (endnote 3). The endnote 4 table indicates that this 2025 instrument amended various parts of ADR 44/02 including clause 44.2 (am), clause 44.3 (rs , repealed), several tow-truck subclauses (44.4.1.4.1 and .4.2 amended), and a later amendment at 44.9.8 (am) among others. The endnote table records "A am Vehicle Standard (Australian Design Rule) Amendment Instrument No. 1 of 2025" indicating multiple amendments under that instrument.

• Editorial changes linked to the Legislation Act 2003. The endnote table shows repute of 0.2 and 0.3 as repealed under the Legislation Act 2003 (sections 48D and 48C respectively) indicating editorial updates to the compilation framework.

The amendment table in endnote 4 lists provision-specific actions. Examples drawn from that table include:

• 44.2 , recorded as amended by Vehicle Standard (Australian Design Rule) Amendment Instrument No. 1 of 2025.
• 44.3 , recorded as repealed (rs) by Vehicle Standard (Australian Design Rule) Amendment Instrument No. 1 of 2025.
• 44.4.1.4.1 and 44.4.1.4.2 , recorded as amended by Vehicle Standard (Australian Design Rule) Amendment Instrument No. 1 of 2025.
• 44.6.1.1 , recorded as added (ad) by the 2021 instrument.
• 44.8.3 , recorded as rs (repealed) by the 2021 instrument, though the compiled text includes 44.8.3 referencing fire extinguishers (the compilation indicates that some repeals may have been editorially handled , the compilation is dated 06/12/2025 and includes the 2025 instrument).
• Multiple entries record the 2025 instrument as having amended clause 44.9.8 and others.

The endnotes serve as the official amendment log and should be consulted for precise dating and clause-level amendment tracking. For compliance and historical analysis, the practitioner should consult the amending instruments themselves (the 2021 and 2025 amendment instruments are recorded by date) and the Register for the full legislative instruments, including any commencement, transitional or saving provisions that might affect which version of a clause applied at a given time (endnote 1 and 3).

The compiled ADR text and its endnotes do not record any litigation history. The document names no judicial decisions, and the endnotes do not list any court cases or determinations interpreting the ADR. Where the text refers to approvals or supervising authorities, it does not specify any adjudicative or review procedure for disputes nor any case law.

Given the absence of named judicial material within the compiled text, there is no litigation history to summarise from this source. If a practitioner requires case law addressing interpretation, application or enforcement of ADR 44/02, they must search judicial and tribunal databases for cases that reference ADR 44/02, the Motor Vehicle Standards Act 1989, or the Road Vehicle Standards Act 2018. The ADR compilation as provided contains only the statutory and technical material and the amending instrument history; it contains no recorded court decisions.

Several provisions and structural features of ADR 44/02 present specific compliance risks, coordination points and potential practical traps for manufacturers, converters, fleet operators and inspectors. These "gotchas" are textually-grounded and directly traceable to the clauses:

• Dual-layer compliance. Clause 44.2 imposes a dual duty: specific-purpose vehicle requirements plus the vehicle category ADRs. A vehicle that meets ADR 44/02 alone may still fail to be compliant if it does not also meet its category ADR. Practitioners must always map a vehicle’s specific-purpose obligations onto the category ADRs applicable to its ADR category codes (SCOPE table and cl 44.2).

• Reliance on external standards and versions. The ADR imports multiple Australian Standards. Some clauses cite specific editions (for example AS 1418 Part 1 (1977) and Part 5 (1980) for cranes cl 44.4.2.1; AS 1425-1989 for LPG systems cl 44.6.1; AS 3509-1988 for cylinders cl 44.6.2). The ADR permits use of an updated AS 1425 in lieu of the 1989 edition (cl 44.6.1.1), but other references are to named editions. Practitioners must confirm which edition is mandated and whether the ADR allows later versions. Failure to use the correct edition may create a grounds for rejection at certification or registration.

• Crane approval interface. Crane design and mounting must be "approved by the relevant authority supervising lifting appliances" (cl 44.4.2.1-2). This creates a cross-regulatory approval point. If a manufacturer assumes road vehicle certification alone suffices, they can be non-compliant. Coordination with the lifting-appliance authority is mandatory for crane approval and mounting direction.

• Small but mandatory markings and labels. The ADR prescribes specific marking sizes that may not align with typical workshop practices: tow truck class markings must be at least 50 mm high and 25 mm wide on the right-hand side (cl 44.4.2.3), LPG label on registration plates must be at least 25 mm square and reflective red (cl 44.6.4). These small-format requirements are mandatory and may be overlooked in conversion and registration.

• Electrical compatibility to ADR 13/.... Clause 44.4.3.2 requires tow trucks to have equipment that can be placed on the towed vehicle and connected electrically to enable compliance with ADR 13/.... ADR 13/... is referenced without a full edition number in the compiled text; compliance requires determining the exact ADR 13 variant applicable to the towed vehicle and ensuring electrical interfaces meet that standard.

• Emergency-exit counting complexities. The omnibus emergency exit rules have multiple counting rules: a Service Door of at least 600 mm may count as two exits; windows and hatches can count as two if they meet larger dimensions; each rigid section of an articulated bus is treated as a separate section (cl 44.9.1.3; 44.9.1.3; 44.9.1.2.1). Practically, counting emergency exits for multi-section buses demands careful mapping of compartments, doors and windows to the clause rules. Overlooking the separation rule for articulated vehicles can create under-provision of exits.

• Requirements for manual override and non-slide-in-cavity doors. Emergency doors must not be slide-in-cavity type and power-operated doors must be readily opened manually (cl 44.9.4.1.2-3). Specifying doors that rely solely on power without a robust manual override will breach the ADR even if they function normally under power.

• Specific measurable thresholds for steps and footrests. Emergency doors and windows with bottom edges at specified heights require footrests no more than 500 mm apart and bottom treads no more than 1,000 mm above ground; doors with bottom edges over 2,000 mm must have self-supporting steps (cl 44.9.4.1.8-9; 44.9.4.2.5-6). Designers might need to supply custom egress devices not anticipated by standard bus fittings.

• Warning-device activation design detail. The warning device for emergency exits must be operated by the movement of the door or window catch or other device and not only by movement of the door or window itself (cl 44.9.12.3). Systems that monitor only door position sensors without catch monitoring may fail this requirement.

• Emergency lamp uniformity and visibility. For permitted flashing lamps, all flashing lamps on the vehicle must be the same colour (cl 44.7.4). Additionally, at least one top-mounted lamp must be visible up to 200 metres in daylight (cl 44.7.1). Selecting multiple lamp suppliers or aftermarket kits without ensuring colour consistency and daytime visibility can breach the ADR.

• LPG labelling on registration plates. Clause 44.6.4 requires an external label on the front and rear registration plates, reflective red and at least 25 mm square. Many registration plate vendors and State/Territory registration systems may have constraints about adding non-standard labels to plates. Practitioners must address how to affix the label without infringing plate law or damaging plate integrity.

• Ambiguities arising from "Approved" and unspecified references. The text uses "Approved" and references ADR 13/... without full specification in places (cl 44.8.2; cl 44.4.3.2). Where approval pathways or referenced ADR variants are not spelled out in the ADR text, manufacturers and certifiers must seek clarification from the regulatory authority to avoid misinterpretation.

• Amendment lag and transition. The amendment history shows changes in 2021 and 2025. Practitioners must check the Register and the enabling Acts for transitional provisions or differing commencement dates that could affect which version of a clause applied to a vehicle at a particular time (endnotes 3 and 4).

Each of the above is grounded in a specific clause and requires practical attention when designing, manufacturing, converting, certifying or operating vehicles covered by ADR 44/02.

This section provides a clause-referenced, practical compliance checklist and operational guidance for different affected vehicle types. The checklist is organised by vehicle type and by recurring compliance themes (design/structure; equipment; markings; approvals/documentation; and inspection/maintenance).

General first steps (applies to all specific-purpose vehicles)

• Determine whether the vehicle is a "specific purpose" vehicle under the ADR and whether it falls within a category ADR (see SCOPE table and cl 44.2). If it does, identify the relevant category ADR(s) and list all category-specific ADR obligations alongside ADR 44/02 obligations.
• Identify all Australian Standards and codes referenced by the ADR that apply to your vehicle (for example AS 1418, AS 1425, AS 3509, AS 2444, AS E38-1962, AS 1742-1975, ALPGA code) and obtain the specified edition or confirm whether a newer edition is acceptable as the ADR permits in specific instances (cl 44.6.1.1).
• Engage early with any supervising or approving authorities referenced in the ADR: for cranes, the relevant authority supervising lifting appliances; for LPG installations in motorhomes/caravans, the approving authority if departures from the ALPGA code are sought (cl 44.4.2.1; cl 44.8.2).

Tow trucks (cl 44.4)

• Class determination: choose the tow-truck class (Class 1-4) that matches the gross mass of vehicles you intend to tow (cl 44.4.1). Ensure load capacity and crane SWL thresholds meet the class definition (1.2 t & 1 t SWL for Class 1; 3 t & 2.5 t SWL for Class 2; GCM 18 t & 5 t SWL for Class 3; GCM 25 t & specified equipment for Class 4).
• Crane compliance and approval: design and construct cranes per AS 1418 parts 1 and 5 and obtain approval from the relevant lifting-appliance authority (cl 44.4.2.1-2). Ensure mounting conforms to that authority’s directions and provide means for supporting raised loads while under tow (cl 44.4.2.2-3).
• Equip and fit: dual tyres on rear axle group (cl 44.4.2.1); spacer bars and safety chains designed to minimise damage to the towed vehicle (cl 44.4.2.2); power-operated winch and air brake facilities for towed vehicles where required by class (cl 44.4.1.4).
• Lighting, electrical compatibility and warning devices: fit a flashing amber light per cl 44.7 (cl 44.4.3.1); provide an adjustable white lamp for coupling-area illumination (cl 44.4.3.1.2); ensure an electrical connection exists to enable compliance with ADR 13/... for the towed vehicle (cl 44.4.3.2); carry at least three portable warning devices complying with AS E38-1962 (cl 44.4.3.3).
• Fire safety: fit at least one 4.5 litre extinguisher conforming to AS 2444 (cl 44.4.4).
• Marking: conspicuously mark the tow truck class on the right-hand side with letters at least 50 mm high and 25 mm wide (cl 44.4.2.3).

Pole-type trailers and drawing vehicles (cl 44.5)

• Fit side marker lamps on each side of the rearmost bolster and front reflex reflectors (non-triangular) on each side of the foremost bolster of the trailer (cl 44.5.1).
• Where the drawing vehicle is fitted with bolsters, fit corresponding side marker lamps and front reflex reflectors on the drawing vehicle (cl 44.5.2).

LPG-fuelled vehicles (cl 44.6)

• Fuel system: ensure the LPG fuel system meets AS 1425-1989 or the updated AS 1425 where permitted (cl 44.6.1). Obtain the Standard and confirm the edition the ADR requires.
• Cylinders: ensure LPG storage cylinders comply with AS 3509-1988 (cl 44.6.2).
• Markings and records: permanently mark the engine bay with a statement of compliance, the identification of the licensed/approved installer and the date of installation (cl 44.6.3). Maintain installer records to ensure traceability and evidence for inspection.
• Plate labels: affix external reflective red labels at least 25 mm square to the front and rear registration plates to indicate LPG equipment (cl 44.6.4). Coordinate with the vehicle registration authority regarding plate modification rules.

Emergency community service vehicles (cl 44.7)

• Lamp selection and siting: if fitting flashing lamps for priority travel, ensure at least one lamp is mounted on top and is visible in daylight to 200 m from any direction (cl 44.7.1). Choose lamp colours per role: blue for police, red for ambulance/fire, amber for other community emergency vehicles (cl 44.7.2).
• Consistency: ensure all fitted flashing lamps on the vehicle are identical in colour (cl 44.7.4).
• Driver visibility: if additional lamps are mounted, ensure none of their lenses are visible to the driver seated normally (cl 44.7.3).

Motorhomes and caravans (cl 44.8)

• Door design: install only outward-opening or sliding doors for vehicles with cooking/living facilities, with at least one such door on the left-hand side or rear (cl 44.8.1).
• LPG installations: install LPG systems per the ALPGA code unless an alternative "Approval" is obtained; if using the ALPGA code, maintain documentation of conformity (cl 44.8.2).
• Fire extinguishers: provide extinguishers selected and located in accordance with the AS referenced in cl 44.4.5 (cl 44.8.3).

Omnibuses emergency exits and signage (cl 44.9)

• Determine applicability: ADR 44/02 applies to MD3, MD4 and ME vehicles designed for more than 16 passengers (cl 44.9 intro). Confirm vehicle class and design passenger capacity.
• Count emergency exits: use the occupant-based table in cl 44.9.1.2 to determine the total number of emergency exits required for each deck or compartment (less than 26 occupants → 4 exits; 26-36 → 5 exits; greater than 36 → 6 exits). Treat each rigid section of an articulated bus as a separate section (cl 44.9.1.2.1).
• Aperture dimensions and siting: ensure emergency doors, windows and escape hatches meet the minimum dimensions in cl 44.9.5 and are sited on three of the specified surfaces for each compartment (cl 44.9.6).
• Door and window hardware: fit doors that open outwards, are not slide-in-cavity type, and have outside handles ≤1,800 mm above ground (cl 44.9.4.1.2-4). Ensure emergency door internal operation includes sequential movement of two separate devices where the door is not a Service Door (cl 44.9.4.1.6).
• Latches and evacuation aids: latches must be two-stage if fitted (cl 44.9.4.1.7). Provide footrests with spacing ≤500 mm for bottom edges 1,000-2,000 mm above ground and self-supporting steps for edges >2,000 mm, with the bottom step ≤1,000 mm above ground (cl 44.9.4.1.8-9; cl 44.9.4.2.5-6).
• Emergency windows: provide ejecting devices or ensure operation by one adult instantaneously or use readily-breakable safety glass with an attached breaker (cl 44.9.4.2.1). Ensure lower edge ≤1,000 mm above interior floor-to-ground relation (cl 44.9.4.2.4).
• Escape hatches: ensure sliding or erectable type, opening force ≤500 N, and location along longitudinal centre line (cl 44.9.4.3).
• Marking and illumination: mark emergency exits externally and internally with "EMERGENCY EXIT" at required lettering sizes and on retroreflective/self-illuminating material; internal EXIT signs must be permanently illuminated while operating and for at least 15 minutes after power loss (cl 44.9.5-6).
• Controls and instructions: mark emergency controls with self-illuminating/retroreflective material and place clear instructions on or near controls (cl 44.9.7-8).
• Interior access geometry: ensure aisle and doorway access meets the cylinder test geometry in cl 44.9.10.1 and that the test gauge specified can be passed through emergency windows/hatches (cl 44.9.10.2).
• Warning devices: fit audible and visible driver warnings that activate when primary opening devices are operated, when exits are locked from outside, or when not securely closed; the warning must be driven by catch movement rather than door position alone (cl 44.9.12).

Documentation and inspection readiness

• Maintain installation certificates, test and approval records for cranes, LPG installations, fire extinguishers and lighting. For LPG systems, maintain the engine-bay marking and records identifying the installer and date of installation (cl 44.6.3).
• Prepare to present conformity documentation to the registration or approval authority that shows compliance with cited Australian Standards and other ADRs as required by cl 44.2 and the clauses specific to each vehicle type.
• Where approval from another authority is required (lifting-appliance authority, approvals for deviations from ALPGA code), obtain those approvals and retain written evidence to present during vehicle certification or inspection (cl 44.4.2.1; cl 44.8.2).

Maintenance and operational practices

• Operators must confirm that warning lamps, emergency-door warning systems and illumination remain operational and that portable warning signs, fire extinguishers and LPG markings are maintained in good condition (cl 44.4.3.3; cl 44.4.4; cl 44.6.3-4; cl 44.9.6).
• For omnibuses, incorporate routine checks of emergency exits, latches, ejection devices, illumination and driver warning circuits into fleet maintenance schedules given the operational safety role of these systems (cl 44.9.4-12).

Regulatory engagement and change control

• Track amendments: the ADR has been amended (notably by instruments in 2021 and 2025 , endnotes 3 and 4). Check the Register for intervening instruments, commencement details and any transitional arrangements that may affect compliance dates.
• Seek clarification from the administering department where ADR references are ambiguous (for example unspecified ADR 13/... edition or use of "Approved" without a defined approving entity in this text) before assuming compliance routes (cl 44.4.3.2; cl 44.8.2).

Following this clause-referenced checklist and documenting approvals, labelling and conformity evidence should put manufacturers, converters and operators in a position to demonstrate ADR 44/02 compliance in certifying and registering specific-purpose vehicles.
