What it does
This vehicle standard prescribes smoke-emission requirements for diesel-fuelled vehicles in Australia (cl 1.1). Mechanically, it (a) sets the classes of vehicles covered; (b) stages the dates from which new model vehicles and subsequently all vehicles must comply; (c) establishes exemptions for vehicles already subject to specified Australian Design Rules; (d) accepts compliance by reference to a technical Appendix (Appendix A) as varied by Part 5; and (e) recognises specified foreign regulatory regimes as alternative, deemed-equivalent technical standards.
Coverage is cast at the level of vehicle categories and dates. The standard applies to M and N category vehicles with diesel engines (cl 2.1). It applies to new model vehicles produced on or after 1 January 2002 (cl 2.2.1) and to all vehicles produced on or after 1 January 2003, other than the new model vehicles caught by cl 2.2.1 (cl 2.2.2). The instrument defines the contestable term “new model vehicle” as a model first produced with a date of manufacture on or after 1 January 2002 (cl 2.3), and supplies a definition for “date of manufacture” for that purpose (cl 3.1).
Exemptions are specified by mass and by compliance with existing Australian Design Rules. M and N vehicles with GVM less than or equal to 3.5 tonnes are exempt if they comply with ADR 79/04 (or a later series) (cl 2.5.1). Vehicles with GVM greater than 3.5 tonnes are exempt if they comply with ADR 80/03 (or a later series) (cl 2.5.2). The standard accepts compliance where vehicles meet the technical requirements of Appendix A as varied by Part 5 (cl 4.1). It also provides that administrative provisions related to obtaining UN ECE or US EPA approvals do not apply to this vehicle standard (cl 5.1).
Finally, the standard names specific foreign instruments as alternative standards deemed equivalent: UN ECE Regulation 24 incorporating the 03 series of amendments (cl 6.1), and, for M and N vehicles with GVM greater than 3.5 tonnes, particular Subparts of the USA Code of Federal Regulations, Part 86 (cl 6.2). The text supplied here does not reproduce Appendix A or Part 5, so the precise technical test procedures and numerical limits that implement the stated smoke-emission requirements are contained in those referenced parts rather than in the clauses quoted above.
