Vehicle Standard (Australian Design Rule 10/00 – Steering Column) 2006

This instrument is a national vehicle standard made under subsection 7(1) of the Motor Vehicle Standards Act 1989. It sets two specific performance requirements for the steering column assembly of passenger cars (Vehicle Category MA) manufactured on or after 1 July 1988. Mechanically, the standard compels manufacturers to design and test the steering column so that (a) when struck by a rigid body block at 6.7 m/s in a longitudinal direction, the load exerted on the block never exceeds 11.1 kN (clause 10.2.1); and (b) in a barrier collision test at a minimum speed of 48 km/h, the rearward horizontal displacement of the top of the steering column and shaft relative to an undisturbed point on the vehicle does not exceed 127 mm (clause 10.2.2). Both tests must follow either the named SAE recommended practices (J944 or J944a for impact, J850 for barrier collision) or another ‘Approved’ procedure. A compliance shortcut exists: a vehicle that meets the displacement criterion (10.2.2) and shares its forward body structure and mechanical equipment with a tested passenger car need not be retested for that clause unless it incorporates structural or mechanical variations likely to affect compliance (clause 10.3). The standard also deems the technical requirements of three alternative international standards to be equivalent: ECE R12/00 or 12/01, FMVSS 203 (for the impact requirement), and FMVSS 204 (for the displacement requirement, provided the vehicle meets S5.1 of that standard). In effect, the rule prescribes a minimum crashworthiness benchmark for the steering column, but gives industry multiple compliance pathways, reducing duplication for vehicles already certified to foreign regimes. From an economic perspective, the standard imposes a direct compliance cost on every affected vehicle line: prototype destruction, test facility fees, engineering iteration, and certification paperwork. These costs are ultimately passed through to purchasers. The standard’s concentration on passenger cars alone means that other vehicle categories (such as light goods, heavy goods, trailers, motorcycles, and buses) are entirely exempt, regardless of steering column risk. This regulatory carve-out reflects a political or resource-limited scope and leaves open the possibility that certain vehicle occupants are not covered by this injury-minimisation rule. The stated purpose “to minimise crushing or penetrating injuries to drivers due to the Steering Column as a result of frontal impact” is the official rationale; a cost-benefit assessment would need to weigh the present value of injury cost avoided against the marginal increase in vehicle price and any reduction in design freedom or market entry.

The standard defines two key components. “‘Steering Column’ means a structural housing that surrounds a Steering Shaft.” “‘Steering Shaft’ means a component that transmits steering torque from the steering wheel to the steering gear.” (clause 10.1, incorporating the definitions in the Definitions and Vehicle Categories ADR). The concepts are deliberately narrow: the rule focuses on the housing that surrounds the torque-transmitting shaft, not the steering wheel itself or the energy-absorbing mechanisms beyond the column. However, the test in clause 10.2.1 encompasses “the steering device which is actuated by the driver”, which would include the steering wheel assembly attached to the column.

The two test regimes form the core mechanical concepts. Body block impact test: a rigid body block is propelled at 6.7 m/s (about 24 km/h) against the steering column assembly in a horizontal longitudinal direction relative to the top of the column. The block must be brought to rest without the load ever exceeding 11.1 kN. This is a force-capacity test: the column must absorb energy without generating a peak force above that threshold, mimicking a driver’s chest striking the steering assembly.

Barrier collision displacement test: the vehicle is crashed head-on into a fixed barrier at a minimum speed of 48 km/h. The rearward horizontal displacement of the upper end of the steering column and steering shaft relative to an undisturbed point on the vehicle must not exceed 127 mm, measured dynamically. A dummy may be used provided it does not contact the steering column assembly or steering wheel during the test (clause 10.2.3). If the actual impact speed exceeds 48 km/h, the measured displacement can be normalised by multiplying by the square of the ratio of nominal speed to actual speed or 53.1 km/h, whichever is lower (clause 10.2.4). The test vehicle must have a mass at least equal to its unladen mass (clause 10.2.5). The exemption in clause 10.3 allows variants to rely on the base model’s certification if the forward structure and major mechanical equipment are identical and no variation likely to affect compliance exists.

The concept of ‘Approved’ procedure appears in both test clauses. The standard does not define who approves or the criteria for approval, creating a potential bottleneck. Alternative standards are deemed equivalent: ECE R12 (covering both impact and displacement), FMVSS 203 (impact), and FMVSS 204 (displacement, with the S5.1 condition). The alternative standards route is a pragmatic recognition of global regulatory convergence, reducing the burden on manufacturers who already certify to US or UN/ECE requirements.

The standard directly affects any person or company that manufactures, assembles, or imports passenger cars (Vehicle Category MA) that are first supplied to the Australian market on or after 1 July 1988. This includes local manufacturers (such as the former Ford, Holden, Toyota operations) and importers of vehicles from overseas. The compliance obligation falls on the entity that holds the vehicle’s type approval or certification under the Motor Vehicle Standards Act. In practice, this means original equipment manufacturers, their Australian representatives, and independent importers of used vehicles (though used passenger cars built before 1988 are not captured). Vehicle designers and engineers within those companies must integrate the two test requirements into the steering column design and verify compliance through physical testing or alternative standard certification.

Testing laboratories that conduct body block and barrier collision tests are directly affected: they must be familiar with SAE J944, J850, and any ‘Approved’ procedures. The standard’s recognition of alternative foreign standards also affects compliance engineers who must verify equivalence and document that condition S5.1 of FMVSS 204 is met. The narrow applicability table means that manufacturers of all other vehicle categories (LA to LE, MB to ME, NA to NC, and TA to TD) are not required to comply with this rule. This creates a regulatory asymmetry: a steering column in a light goods vehicle (NA) may have identical crash performance to an MA vehicle but is not forced to meet the standard, potentially leaving drivers of those vehicles with less assured protection. While the standard’s official purpose is injury minimisation, the cost of compliance is borne by consumers of passenger cars through higher purchase prices, reduced model availability, and possibly slower introduction of innovative column designs that do not fit the 1960s-era test protocols. Smaller manufacturers or low-volume importers face disproportionately high per-unit testing costs, which can act as a barrier to entry. Occupants of non-passenger cars (vans, utes, off-road vehicles when registered as MB, MC, etc.) are not directly protected by this rule, though other ADRs may cover them.

The central duty is imposed by clause 10.2: the steering column assembly must satisfy the two performance criteria. This duty is not qualified by any cost or practicability defence. The entity responsible for placing the vehicle on the market must ensure, by physical test or by reliance on an equivalent standard, that the column meets the force limit and displacement limit. There is no duty regarding maintenance or repair; the standard applies at the point of manufacture or import. The duty extends to ensuring that any vehicle claiming the exemption in clause 10.3 does not incorporate “structural or mechanical variations likely to affect compliance” , a qualitative judgment that imposes a burden of proof on the manufacturer.

The standard confers several rights. The most important is the right to use an alternative standard: ECE R12/00 or 12/01, FMVSS 203, or FMVSS 204 (with the S5.1 condition) instead of the SAE procedures. This right substantially reduces duplication for manufacturers already certified to those regimes. The manufacturer also has the right to use an ‘Approved’ procedure other than the named SAE recommended practices, though the standard does not specify how approval is obtained or from whom, creating uncertainty. There is a right to rely on the exemption for derivative vehicles (clause 10.3), provided the forward body form and greater part of mechanical equipment are identical to a tested passenger car and no compliance-affecting variation exists. This right allows sharing of test evidence across a platform.

The displacement reduction formula in clause 10.2.4 gives manufacturers a right to normalise test results if the actual barrier impact speed exceeds 48 km/h. The formula uses the square of the speed ratio, capped at 53.1 km/h. This right is valuable for avoiding retests when speeds are slightly elevated. The standard also implicitly confers a right to design the column in any manner as long as the performance outcomes are met; it does not prescribe a particular energy-absorbing mechanism. Manufacturers have a right to use a dummy in the barrier test provided it does not contact the steering column assembly or wheel. Finally, the repeal clause (0.3) gives the right to rely on this version as the sole current national standard for steering column requirements; earlier inconsistent versions are no longer in force.

The instrument itself does not create penalties; enforcement is under the parent Motor Vehicle Standards Act 1989 (MVSA). Section 7 of the MVSA authorises the making of ADRs, and section 10A (as it stood at the time) prohibited the supply of a vehicle for the first time if it did not comply with applicable ADRs. Contravention of that prohibition is an offence. Penalties can include fines (the maximum monetary penalty for a corporation was increased over the years; at the time of this ADR’s making, the maximum penalty for an individual was 50 penalty units or imprisonment for one year, and for a body corporate 250 penalty units). The Department of Infrastructure, Transport, Regional Development, Communications and the Arts (or its predecessor) is responsible for enforcement. The department can also issue suspension or revocation of type approvals, require recall of non-compliant vehicles, or seek injunctions to prevent supply. In practice, enforcement for a single steering column non-compliance is rare; it typically emerges during type approval audit or following a serious accident investigation. The MVSA also provides for the Minister to exempt vehicles from compliance (type approval exemptions), which the manufacturer may apply for if they can demonstrate that compliance is impractical or that the vehicle is a low-volume import.

The ADR’s dependence on third-party test procedures and approval of equivalent standards means that enforcement often turns on the adequacy of testing documentation. If a manufacturer falsely claims equivalence to FMVSS 204 without meeting S5.1, that would be a supply of a non-compliant vehicle. The burden of proof in enforcement is on the regulator, but the manufacturer must maintain records demonstrating compliance. Criminal penalties risk creating a strong deterrence effect, but the low probability of detection for individual vehicles (versus model lines) may reduce the incentive to incur high testing costs for low-volume models. The regulator has discretion in enforcement, and historically the approach has been cooperative rather than punitive, but that does not change the legal exposure.

This ADR operates as a national standard under the Motor Vehicle Standards Act 1989. It is one of many Australian Design Rules; it does not override or modify other ADRs. Other ADRs may impose additional frontal impact requirements (for example, ADR 69/00 for full frontal occupant protection, ADR 73/00 for offset frontal impact). Compliance with this steering column rule does not guarantee compliance with those broader crashworthiness standards. The standard also interacts with state and territory road transport laws, which require that a vehicle be compliant with all applicable ADRs before it can be registered for road use. A steering column that fails this rule can prevent registration even if the vehicle otherwise passes state inspections.

The alternative standards provisions create an interaction with international regulatory regimes. ECE R12 (Rev. 1/00 or 1/01) and FMVSS 203/204 are treated as equivalent. Manufacturers exporting vehicles to multiple markets can consolidate testing. However, the standard freezes the equivalence to specific amendment series: ECE R12/00 or 12/01, and FMVSS 203 as amended 36 FR 232 December 2, 1971 and FMVSS 204 as amended 36 FR 232 December 2, 1971. Later revisions of those foreign standards are not automatically recognised; a manufacturer might still need to confirm that later versions remain substantially equivalent, adding regulatory risk. The condition in clause 10.4.3 (for FMVSS 204) requires that the vehicle meet “S5.1 of that standard”. FMVSS 204 S5.1 refers to the displacement limit of 127 mm (5 inches) in a 30 mph barrier test. So compliance with the US standard includes the same numerical limit.

The introduction of the Motor Vehicle Standards Act 1989 was replaced by the Road Vehicle Standards Act 2018 (RVSA) which came into effect on 1 July 2022. Under the RVSA, vehicle standards are continued as ‘national road vehicle standards’. This ADR, as an ADR made under the old Act, is taken to be a national road vehicle standard under the new regime. Therefore, the interaction with the RVSA is now the governing framework for enforcement and certification.

The instrument itself has no amendment history contained in the source text. It is a standard made on 31 July 2006, registered the next day, and it repeals all previous instruments with the name Australian Design Rule 10/00 - Steering Column that were in force at the time of commencement. That means this is a consolidation, not a first issue. The original ADR 10/00 likely dated from the 1970s or 1980s when the Australian Design Rules system was expanded. The standard’s technical requirements (SAE J944 from 1965/1968, J850 from 1963, barrier speed of 48 km/h, force limit 11.1 kN, displacement limit 127 mm) have not changed in decades. No amendments have been made to this instrument since its registration in 2006, according to publicly accessible sources (not inventoried here, but consistent with the text’s age). The repeal clause is broadly worded to catch any earlier instrument that created a vehicle standard with the name ADR 10/00, even if that instrument also created other vehicle standards, as long as no other standard from that instrument remains in force. This cleaning-up provision rationalises the legislative history. The standard has remained static, which is typical for a well-established safety requirement that is already embedded in global vehicle design. The static nature means that any subsequent scientific or engineering advances in steering column performance are not reflected unless a manufacturer voluntarily exceeds the minimum or relies on alternative standards that have evolved. The lack of amendment process does not impose ongoing compliance cost changes, but it also means the standard may be outdated relative to modern vehicle crash performance.

The source text contains no references to litigation, court cases, or tribunal decisions. Accordingly, no direct litigation history can be drawn from the instrument itself. Any legal disputes involving ADR 10/00 would likely arise in the context of enforcement proceedings under the Motor Vehicle Standards Act or the Road Vehicle Standards Act, or in civil liability claims where breach of a vehicle standard is alleged to constitute negligence or a breach of statutory duty. In Australia, a failure to comply with an ADR may be used as evidence of a defect or unsafe design in product liability litigation under the Australian Consumer Law (schedule 2 of the Competition and Consumer Act 2010). However, there is no publicly recorded leading case specifically on ADR 10/00 that has been cited in the instrument or in common law reports (as at the date of this standard’s making). The existence of alternative standards (ECE, FMVSS) means that most manufacturers have chosen those pathways, reducing the likelihood of non-compliance disputes. The exemption clause for derivative vehicles may produce disagreements between manufacturers and the regulator over what constitutes a “structural or mechanical variation likely to affect compliance”. These disagreements typically are resolved administratively rather than through litigation. The high cost of litigation and the relatively clear bright-line numerical limits (11.1 kN, 127 mm) make the standard less prone to interpretation battles than more open-ended safety standards. In the absence of specific case law, the standard operates largely through compliance assurance rather than judicial interpretation.

Several provisions in this standard are traps for the unwary. First, the applicability table: only passenger cars (MA) have a mandatory date (1 July 1988). All other vehicle categories are listed as “Not Applicable”. However, that does not mean those vehicles can ignore steering column safety; it means this particular ADR does not apply. Other ADRs might, and the absence of a specific steering column rule for, say, light goods vehicles (NA) means their steering columns are not tested under this criterion. A manufacturer might incorrectly assume that if a vehicle is not MA, it is entirely free from any steering column impact requirement.

Second, the exemption in clause 10.3 requires that “the forward part of the body form and the greater part of the mechanical equipment are the same as those in the said passenger car”. The phrase “the greater part of the mechanical equipment” is ambiguous - does it mean by weight, by number of components, or by function? A manufacturer relying on the exemption must be confident that no variation “likely to affect compliance” exists, which places a subjective judgment on the manufacturer. Regulators may later disagree.

Third, the displacement reduction formula in clause 10.2.4 uses the square of the ratio between nominal speed (48 km/h) and either the measured speed or 53.1 km/h, whichever is lesser. If the measured speed is, say, 55 km/h, the formula uses 53.1 km/h as the cap. The reduction is not linear; the capped ratio may produce a more generous reduction than intended, potentially allowing a displacement that would fail at precisely 48 km/h if the test speed were 55 km/h and the cap applied. The formula also requires dynamic measurement; if the test uses mechanical measurement, it may not be considered dynamic.

Fourth, the requirement that a dummy “may be used providing the dummy does not contact the Steering Column assembly or steering wheel during the test” (10.2.3) is a negative condition. If a dummy does contact the column, the test is invalid. Manufacturers must design the test to ensure the dummy is restrained or positioned so that no contact occurs, which can be difficult in a barrier crash at 48 km/h for a small driver. Contact could invalidate the test even if the column passes the displacement limit.

Fifth, the approved procedure route: the standard does not specify who can approve an alternative test procedure. In practice, the Administrator of the ADR system (now the Vehicle Safety Standards Branch within the Department) would need to approve. The approval process is not described, creating uncertainty and potential delay for manufacturers wishing to use more modern test methods (e.g., electronic data acquisition or different block geometry).

Compliance begins with confirming that the vehicle falls within Vehicle Category MA - passenger car - with a ‘Manufactured on or After’ date of 1 July 1988. Vehicles first manufactured before that date are not subject to this ADR. For MA vehicles, the manufacturer must decide which of the three compliance pathways to follow: (1) direct compliance with clauses 10.2.1 and 10.2.2 using the SAE prescribed tests; (2) compliance via an acceptable equivalent foreign standard; or (3) for a derivative vehicle, reliance on the clause 10.3 exemption.

Pathway 1 (Direct SAE testing): Engage a testing facility capable of conducting SAE J944 or J944a (body block impact) and SAE J850 (barrier collision). For the impact test, the body block must be propelled at 6.7 m/s in a horizontal longitudinal direction relative to the top of the steering column. The force on the block must never exceed 11.1 kN. For the barrier test, the vehicle is crashed at 48 km/h minimum, and the rearward displacement of the upper end of the column and shaft must be ≤127 mm, measured dynamically. The test vehicle’s mass must be at least its unladen mass. If a dummy is used, ensure it does not contact the column or wheel. If the actual test speed exceeds 48 km/h, apply the displacement normalisation formula from 10.2.4 (using 53.1 km/h as the cap). Document all test results and the test conditions.

Pathway 2 (Equivalent foreign standards): Provide evidence that the vehicle meets either ECE R12/00 or 12/01 (both impact and displacement requirements) or meets FMVSS 203 (impact) and FMVSS 204 (displacement with S5.1). The evidence should include a certificate of compliance, test reports from a recognised authority, and a declaration that the specific amendment versions are satisfied. Note that ECE R12/00 or 12/01 are not the same as later amendments; ensure the correct version. For FMVSS 204, S5.1 requires the displacement limit of 127 mm; the vehicle must have been tested in accordance with that standard. Keep records showing that the vehicle configuration is identical in all respects likely to affect compliance.

Pathway 3 (Exemption for derivatives): Only available if the vehicle in question shares its forward body structure and the greater part of its mechanical equipment with a passenger car that already meets clause 10.2.2. The manufacturer must document that the baseline vehicle has passed the barrier displacement test and that the derivative vehicle has no structural or mechanical variations likely to affect compliance. This is a subjective judgment; it is prudent to conduct a comparative engineering analysis. The exemption does not extend to the body block impact test (10.2.1) unless the derivative also shares the steering column assembly configuration.
