What it does
This notice is a subordinate instrument that creates a time-limited, statewide exemption for certain agricultural vehicles and agricultural combinations from specified provisions of the Vehicle Operations Regulations. It takes effect on 1 December 2024 and remains in force for three years from that date (commencement: s 2; duration: s 4). The Transport Commission made and sealed the notice on 13 November 2024 and it was notified in the Gazette on 20 November 2024; administration is vested in the Department of State Growth (signature and administration statements in the instrument).
Mechanically, the notice exempts persons using, or causing or permitting the use of, an agricultural vehicle or an agricultural combination from particular regulations in the Vehicle Operations Regulations, namely regulation 10(1), regulation 11, regulation 13, regulation 14(1) and (3), regulation 15(2) and regulation 16(2)(a) (s 5(2)). The exemptions are explicitly conditional: the notice replaces (for agricultural vehicles/combinations) the application of those regulations with a set of dimensional, equipment and safety conditions that must be met for the exemption to operate (s 5(3)(a)-(q)). The notice also identifies limits on bridge use where the exemption does not authorise use of particular bridges if height or width limits are exceeded (s 6).
The instrument is interpretive and referential in form. It imports meanings from the Vehicle and Traffic Act 1999 and from the Vehicle Operations Regulations where those definitions apply to words used here (s 3(2)). It is designated as rules for the purposes of the Acts Interpretation Act 1931 (s 3(3)). The exemptions therefore operate within the broader regulatory architecture rather than replacing it: the notice removes the application of listed regulations to agricultural vehicles/combinations but leaves substantive compliance obligations as set out in the notice and in other provisions of the Vehicle Operations Regulations and the Act.
