### 12 Application of Part 3
> > (1) This Part does not apply to –

> > > > (a) a trust affecting property settled by an Act other than the [Administration and Probate Act 1935](/view/html/inforce/2026-04-12/act-1935-038) ; or

> > > > (b) a charitable trust.

> > (2) This Part does not derogate from any other power of the Court to vary or revoke a trust or to enlarge or otherwise vary the power of trustees.
