51 Offence—constructing regulated utility service without operating certificate An unlicensed regulated utility commits an offence if— (a) the unlicensed regulated utility constructs infrastructure for the provision of a regulated utility service; and (b) an operating certificate is not in force in relation to the unlicensed regulated utility.
