95 Negotiated customer contracts (1) This section applies to a contract, between a utility and a customer, for a utility service on terms other than those of the standard customer contract for the provision of the service by the utility. (2) The contract is unenforceable by the utility to the extent (if any) to which it is inconsistent with— (a) the conditions of the utility’s licence; or (b) the requirements imposed by or under this Act or a related law, including in particular, the requirements of each industry code or technical code that is applicable.
(3) Without limiting the operation of subsection (2), the regulations may provide for the core requirements to be ascertained by reference to— (a) the standard customer contract that would otherwise apply to the provision of the service by the utility; or (b) an industry code or technical code.
