#### 32 Using premises as gambling premises—offence by operator 32 Using premises as gambling premises—offence by operator > > (1) The operator of any premises must not knowingly allow the premises to be used as gambling premises. > > > > Maximum penalty— > > > > > • for a first offence—50 penalty units or imprisonment for 12 months (or both), > > > > > • for a second or subsequent offence—500 penalty units or imprisonment for 2 years (or both). > > > (2) For the purposes of this section, a person is the operator of premises if the person— > > > > > (a) is employed by, or is acting for or on behalf of, the owner or occupier of the premises, or > > > > > (b) has the care or management of the premises, or > > > > > (c) is, in any manner, conducting a business on the premises.
