Universities Accord (Student Support and Other Measures) Transitional Rules 2024

The instrument turns on a small set of defined concepts and counterfactual calculations. Those concepts are the pivot for any operational implementation, and they are defined within the instrument rather than by reference to external policy documents.

• Relevant Acts and relevant amounts. Section 4(2) identifies five “relevant Acts” and, for each, the particular category or categories of amount to which the transitional rule applies. The list is discrete: accumulated HELP debt (Higher Education Support Act 2003); accumulated AASL debt (Australian Apprenticeship Support Loans Act 2014); under the Social Security Act 1991, accumulated FS debt, amounts outstanding under FS contracts, and accumulated SSL debt; under the Student Assistance Act 1973, accumulated FS debt, amounts outstanding under FS contracts, and accumulated ABSTUDY SSL debt; and accumulated VETSL debt (VET Student Loans Act 2016). The instrument will therefore apply only to those statutory debt categories as defined by the listed Acts (s 4(2) table).

• RAold law and RAnew law. These are counterfactual monetary calculations. RAold law is what the relevant amount would have been for the financial year if calculated under the relevant old law, without taking account of this instrument and on the basis that there had not been a relevant waiver. RAnew law is the same counterfactual but under the relevant new law (s 4(1)). Both are specified as “what ... would have been” amounts, so the instrument requires administrators to reconstruct two no‑waiver scenarios for each affected financial year and person.

• Relevant waiver (RW). RW is defined by reference to indexation‑related waivers under section 63 of the Public Governance, Performance and Accountability Act 2013. Subsection 4(1) defines RW, in relation to a relevant amount and a financial year, as an amount attributable to the indexation of a person’s relevant amount that was waived under s 63 of the PGPA Act for that financial year. The instrument notes RW is expressed as a positive number. The definition therefore ties the transitional rule specifically to indexation waivers and to the PGPA Act mechanism.

• The recalculation rule. Section 5(2) contains the arithmetic core. For each relevant financial year (ending 30 June 2023 or 2024) in which a person had a relevant waiver, the recalculated relevant amount (RAre‑calc) is determined by comparing RW to the reduction in the relevant amount that would have resulted from the law change (RAold law minus RAnew law). If RW exceeds that reduction, the recalculation sets RAre‑calc to RAold law minus RW. If RW is less than or equal to that reduction, RAre‑calc is set to RAnew law (s 5(2)(a)-(b)). Section 5(3) prescribes that if waivers occurred in both financial years, the 2023 year is recalculated first and then the rule is applied for 2024.

Conceptually, the instrument is a reconciliation rule. It requires comparison of three values for each person and each applicable financial year: (1) the no‑waiver old‑law amount; (2) the no‑waiver new‑law amount; and (3) the indexation waiver amount actually granted under PGPA s 63. The rule then produces a single recalculated figure to replace the “relevant amount” for that year. The instrument does not alter the substantive definitions inside the relevant statute beyond how the transitional figure is to be computed.

The instrument directly affects persons who, for the financial years ending 30 June 2023 or 30 June 2024, had a “relevant waiver” of indexation under section 63 of the Public Governance, Performance and Accountability Act 2013 in respect of one of the “relevant amounts” listed in the table at s 4(2). Practically that will be persons who hold or held statutory student‑support debts or outstanding FS contract amounts of the types listed.

By reference to the instrument’s own table (s 4(2)) the affected categories are:

• Individuals with accumulated HELP debt under the Higher Education Support Act 2003 (Item 1).

• Individuals with accumulated Australian Apprenticeship Support Loans debt under the Australian Apprenticeship Support Loans Act 2014 (Item 2).

• Individuals with accumulated FS debt, amounts outstanding under an FS contract, or accumulated SSL debt under the Social Security Act 1991 (Item 3).

• Individuals with accumulated FS debt, amounts outstanding under an FS contract, or accumulated ABSTUDY SSL debt under the Student Assistance Act 1973 (Item 4).

• Individuals with accumulated VET Student Loans debt under the VET Student Loans Act 2016 (Item 5).

The instrument is framed in terms of persons and their “relevant amounts”. It does not distinguish by age, residency, or other status criteria beyond those embedded in the relevant Acts. The instrument affects debts or amounts only if an indexation waiver was applied in one of the two specified financial years. If no relevant waiver under PGPA s 63 existed in those financial years, the transitional rules in s 5 do not apply to that person for those years.

Who bears the operational and compliance burden is not described in express administrative language inside the instrument, but the rules impose computational obligations that will fall on the bodies responsible for administering the listed Acts. The instrument was made for the purposes of specific subitems of Schedules to the Act (s 5(1)), indicating that its purpose is transitional alignment across multiple statutory debt regimes. The instrument itself, however, does not identify which agency or official must perform the recalculations, notify affected persons, or update ledger balances. Therefore affected persons may experience adjustments to their statutory debts as a result of administrative recalculation, but the instrument contains no express personal or creditor notice obligations or appeal rights.

Finally, the instrument’s reach is temporal and discrete. It applies only to the two financial years ending 30 June 2023 and 30 June 2024 (s 5(2)), and if both years are involved s 5(3) requires the 2023 year be applied first. Persons with waivers outside those years are not covered by the instrument’s recalculation rule.

The instrument does not create new offences, express administrative decision‑making powers, or explicit rights of review. Its operative effect is computational: it prescribes how to recalculate a “relevant amount” when a person had a relevant waiver in the specified years. From the text, the key duties and rights , to the extent they are engendered by the instrument , are the following.

Duties placed by the instrument (implicit, computational)

• Recalculate relevant amounts for persons who had a relevant waiver in the specified financial years. Section 5(2) prescribes the formula for recalculation. The duty to apply that formula follows directly from the instrument’s operative clause: the person’s recalculated relevant amount “is given by” the formula. The instrument therefore imposes a computational requirement on whichever administrative body is responsible for maintaining the relevant statutory amounts.

• Apply the 2023 year first where waivers existed in both 2023 and 2024, as required by s 5(3).

• Use the instrument’s definitions for RAold law, RAnew law and RW when conducting the recalculation (s 4(1)). RAold law and RAnew law are to be computed as “what a relevant amount would have been … if it had been calculated under the relevant old law/new law without taking account of this instrument and on the basis that there had not been a relevant waiver.”

Rights implicit in the instrument (by operation of the rule)

• The instrument entitles affected persons to have their relevant amount set according to the arithmetic rule in s 5(2). That is, the recalculated amount must be either RAnew law (if RW is less than or equal to the difference between RAold law and RAnew law) or RAold law minus RW (if RW exceeds that difference). This is not framed as a discretionary power; the instrument states the recalculation in mandatory terms.

• Because the instrument is limited in scope and to specified years, an affected person’s recalculated amount for those years must follow the instrument’s formula rather than being determined solely by the underlying relevant Act’s ordinary calculation if a waiver occurred in those years.

What the instrument does not provide

• It does not provide an express process, timeline, or form of notice for advising persons of recalculation results. It does not create or describe internal review or merits review rights. It does not state which agency is responsible for communicating or enforcing the recalculated amounts. It does not alter the substantive rules in the listed Acts beyond prescribing how the transitional recalculation must be computed.

Operational consequences

• Agencies administering the listed Acts must, as a practical matter, identify persons to whom the recalculation applies, compute RAold law and RAnew law counterfactuals for each affected year and person, establish the RW amounts that were waived under PGPA s 63 for each year, apply the arithmetic rule in s 5(2), and then record the recalculated amounts. Those steps are implied by the wording but are not spelled out as duties with timelines or enforcement mechanisms within the instrument itself.

The instrument contains no provisions that create criminal offences, civil penalties, administrative sanction mechanisms, or enforcement pathways. There is no text in the instrument that prescribes penalties for non‑compliance by persons, institutions, or officials. The instrument is a transitional computational rule and does not, on its face, alter enforcement regimes that may exist within the relevant Acts for recovery of debts or breaches of those Acts.

Consequently:

• The instrument does not itself authorise or direct recovery action, garnishee, or other enforcement steps against persons arising from the recalculated amounts. Any enforcement mechanisms will continue to be governed by the substantive provisions in the relevant Act under which the debt or contract is established. The instrument does not amend those Acts directly; it prescribes how to compute a transitional figure where a relevant waiver existed for specified years (s 5).

• The instrument does not identify which official, agency, or body will be responsible for applying the recalculation, providing a notice to affected persons, or for initiating any debt recovery steps following recalculation. The absence of administrative process clauses creates implementation discretion for the bodies that administer the underlying statutes.

• There are no express administrative review or merits review procedures set out in the instrument. If affected persons wish to challenge a recalculated amount, they would need to rely on rights and procedures provided by the underlying Act or more general administrative law remedies outside this instrument. The instrument itself is silent on review, appeal or complaint handling.

Implementation risk and compliance burden

• The computational rule will require agencies to reconstruct counterfactual amounts (RAold law and RAnew law) and to identify the RW amounts tied to indexation waivers under PGPA s 63 for the two specified years. That reconstruction can be data‑ and resource‑intensive since RAold law and RAnew law are defined as what the amount “would have been” absent any waiver and absent taking account of this instrument (s 4(1)). Agencies will need systems and records sufficient to produce those counterfactuals and to apply the arithmetic in s 5(2).

• Because the instrument does not set a timetable for recalculation, agencies may have discretion about sequencing and timing, but they lack a statutory directive within this instrument to inform affected persons or establish a dispute process. That gap is an operational and legal risk for administrators.

In short, the instrument imposes a mandatory computational rule but leaves implementation, enforcement, notification, and review to the underlying statutory schemes or administrative practice, without specifying penalties or enforcement procedures itself.

The instrument operates as a transitional rule linked to the Universities Accord (Student Support and Other Measures) Act 2024 and to the statutory schemes that create the relevant debts. The instrument expressly states its authority and purpose relationships and references particular provisions outside its text.

Statutory authority and purpose

• The instrument is made under subitem 1(1) of Schedule 6 to the Universities Accord (Student Support and Other Measures) Act 2024 (s 3) and is made for the purposes of several subitems in Schedule 6 and Schedule 1 to the Act (s 5(1)). That means its legal basis is the Act and that it is intended to serve transitional purposes specified in the Act’s Schedules.

Interaction with the listed relevant Acts

• The instrument identifies five relevant Acts (s 4(2) table) and applies solely to the categories of amounts listed for those Acts. It does not purport to amend the substantive provisions of those Acts permanently. Rather, it prescribes how to calculate a “recalculated relevant amount” for the two specified financial years where an indexation waiver under PGPA s 63 was granted. Therefore, it functions as an interpretative or transitional overlay to the existing schemes for the limited task of making a recalculation.

Interaction with the PGPA Act

• The definition of “relevant waiver” depends on section 63 of the Public Governance, Performance and Accountability Act 2013 (s 4(1)). The instrument therefore imports the PGPA s 63 waiver mechanism as the source of the RW amounts. It does not reproduce or modify PGPA s 63. Administrators must identify the amounts waived under that PGPA provision for the applicable years and the instrument applies only to those waiver amounts that are “attributable to the indexation of a person’s relevant amount”.

Counterfactual calculations and non‑application of the instrument to those counterfactuals

• RAold law and RAnew law are explicitly described as counterfactuals calculated “without taking account of this instrument and on the basis that there had not been a relevant waiver” (s 4(1)). That language requires administrators to reconstruct amounts as they would have stood under the old and new legislative frameworks if neither the instrument nor the waiver existed. The instrument therefore interacts with the substantive calculation rules in the relevant Acts by requiring that those rules be applied in a hypothetical no‑waiver scenario.

Relationship to administrative procedure, notice and recovery regimes

• The instrument is silent about procedural interactions, such as notice to debtors, time limits for recalculation, or the suspension or acceleration of recovery processes while recalculation occurs. Practical interaction with the recovery mechanisms and dispute resolution procedures in the relevant Acts is therefore a matter of administrative practice or other law, not the instrument. The instrument does not displace the existing powers or processes in the underlying Acts except insofar as it prescribes the numerical outcome to be used for the specified financial years.

Summary interaction model

• The instrument functions as a narrow numerical reconciliation rule that sits atop existing statutory debt frameworks. It does not create new substantive debts or extinguish existing powers in the relevant Acts. Instead, it requires administrators to: (a) identify whether a person had a PGPA s 63 indexation waiver in the specified years; (b) calculate RAold law and RAnew law as counterfactuals under the respective statutory rules; and (c) apply the arithmetic rule in s 5(2) to set the recalculated amount that will then be used in whatever follow‑on processes the administering Act contemplates. The instrument therefore intersects with other laws primarily at the level of inputs and outputs to those Acts’ pre‑existing calculation and recovery mechanisms.

The instrument contains an internal commencement/amendment table and a short note about the table but does not record any subsequent amendments. The text relevant to amendment history is contained in s 2 and the accompanying commencement table and note.

• Original instrument and commencement. Section 2(1) and the commencement table state that the whole of this instrument commences immediately after this instrument is registered. The instrument is dated 9 December 2024, signed by the Minister for Education, Jason Clare. The commencement table contains the note that it relates only to the instrument as originally made and will not be amended to deal with later amendments of the instrument.

• Note about column 3. Section 2(2) records that information in column 3 of the commencement table is not part of the instrument and that such information may be inserted or edited in any published version. This is an administrative formality about the presentation of the instrument and does not operate as an amendment mechanism for substantive provisions.

• No subsequent amendments recorded within the instrument. The instrument text supplied contains no amending provisions, no later modification entries, and no schedule of variations. The only references to other instruments are to the Act under which the instrument is made and to the PGPA Act provision that defines the source of waivers. There is no express transitional clause modifying this instrument itself.

Because the instrument is short and targeted, and because it includes the commencement note that the table relates only to the instrument as originally made, the current state of the instrument as supplied is that of the original instrument. Any later amendments, if they exist, would need to be located in the official legislative register or amending instruments, which are not part of the supplied text. The instrument does not provide an internal chronology of changes beyond the initial commencement.

The instrument contains no litigation history. It is a recently made transitional rules instrument dated 9 December 2024. The text does not reference any judicial decisions, prior litigation, or precedent. It contains no internal disputes resolution procedures specific to the recalculation beyond mandating the formula in s 5(2) and the ordering rule in s 5(3).

Because the instrument is purely prescriptive about a numerical recalculation, any litigation arising from its application would arise from disputes about the calculation inputs (for example, whether a particular waiver constitutes a “relevant waiver”, the correct computation of RAold law or RAnew law in the particular statutory context, or alleged procedural failure to notify or properly apply the rule). The instrument itself does not provide a statutory rights of appeal or review mechanism. Any person disputing the application of the instrument would therefore need to rely on the remedies available under the underlying relevant Act, or on general administrative law avenues, none of which are created or modified within the instrument text provided.

At present, the instrument supplies no case law to cite. The statutory content is self‑contained and mechanical. Any litigation history that develops will depend on administrative implementation choices and on whether affected persons mount challenges in court to the computational outcome or the administration of the recalculation.

This instrument contains several technical features that may be surprising or easy to misapply if read quickly. The following are concrete, source‑grounded points to watch for when implementing, advising, or examining the consequences.

1. Narrow temporal scope. The recalculation rule applies only where a person had a relevant waiver in relation to the financial year ending on 30 June 2023 or the financial year ending on 30 June 2024 (s 5(2)). Waivers granted for other financial years are outside the instrument’s scope.

2. Relevant waiver is narrowly defined. RW is specifically “an amount attributable to the indexation of a person’s relevant amount that was waived under section 63 of the Public Governance, Performance and Accountability Act 2013 in relation to that financial year” (s 4(1)). Only waivers under PGPA s 63 that are attributable to indexation qualify. Waivers under other authorities, or waivers not tied to indexation, do not meet this instrument’s definition of RW.

3. Counterfactual calculations required. Both RAold law and RAnew law require administrators to compute what the relevant amount “would have been” under the old and new laws “without taking account of this instrument and on the basis that there had not been a relevant waiver” (s 4(1)). That means the recalculation demands two hypothetical, no‑waiver constructs and not merely use of recorded balances. Administrators may need to reverse the effect of previously applied waivers to reconstruct these counterfactual amounts.

4. The arithmetic rule is a two‑branch comparison, not a simple subtraction. The instrument prescribes RA recalculation by comparing RW to the difference RAold law minus RAnew law. If RW is greater than that difference, RAre‑calc equals RAold law minus RW; if RW is less than or equal to that difference, RAre‑calc equals RAnew law (s 5(2)(a)-(b)). An easy mistake is to assume the recalculation is always RAold law minus RW or always RAnew law; in fact the correct figure depends on the comparison outcome.

5. Ordering across two years. If RW was granted in both fiscal years (2023 and 2024), s 5(3) requires the 2023 year to be applied first. That ordering matters because the resulting recalculated amount for 2023 may affect how the calculation is approached for 2024, depending on how administrators interpret and implement the requirement to apply the rule first to 2023. The instrument leaves the exact administrative sequencing to the administering body.

6. RW is expressed as a positive number. The instrument notes RW is a positive number (s 4(1)). Practically, that confirms RW is treated as a subtraction component in the branch where RAold law minus RW is used, and not a negative or zero adjustment.

7. No procedural protections or specified notice. The instrument contains no express provision requiring administrators to notify affected persons, to provide reasons, or to pause enforcement pending recalculation. Any failure to provide notice or to give an opportunity to respond will be governed by the underlying Acts or general administrative law, not by this instrument.

8. Multiple statutory schemes with differing calculation mechanics. The relevant Acts listed in s 4(2) will each have their own calculation rules for debt accrual, indexation and contractual balances. Applying the instrument requires mapping the counterfactual concepts (RAold law and RAnew law) into each Act’s calculation mechanics. The instrument does not provide worked examples or specify which statutory provisions should be used to compute the counterfactuals.

9. The instrument does not state whether recalculated amounts are final. The instrument sets out how to compute a recalculated relevant amount for the specified years, but it does not say whether the recalculated figure is definitive for all purposes (for example, whether it is to be used for future indexation or for recovery thresholds). Those downstream effects will depend on the administering Act and administrative practice.

10. Potential for smaller than new‑law amounts. If RW exceeds the reduction implied by RAold law minus RAnew law, RAre‑calc will equal RAold law minus RW, which will be less than RAnew law (s 5(2)(a)). That means a person may, under the arithmetic, end up with a recalculated amount smaller than the new‑law counterfactual. That outcome is permitted by the instrument and arises when the earlier waiver exceeded the benefit that would have been delivered by the change from old law to new law.

These points are literal consequences of the instrument’s drafting and its defined terms. Administrative actors should not assume the instrument provides procedural detail beyond the numerical rule.

The instrument prescribes a single, mandatory computational rule but leaves many operational details unspecified. Compliance, practically speaking, is an administrative exercise. The following are concrete steps and considerations for an administering authority to implement the instrument faithfully and to manage legal and operational risk. These steps are framed as implementation guidance rooted in the instrument’s text; the instrument itself does not mandate particular procedural steps or timelines.

1. Identify affected persons and records

• Query records to identify all persons who had a waiver under PGPA s 63 attributable to indexation in the financial years ending 30 June 2023 and/or 30 June 2024 for any of the relevant amounts listed in s 4(2). Because “relevant waiver” is defined by reference to PGPA s 63, ensure database flags capture the source authority and the indexation component of the waiver. Maintain an auditable list with identifiers, relevant Act, account identifiers, and the waiver amounts recorded by financial year.

2. Extract and validate RW amounts

• For each identified person and year, extract the RW figure defined as the amount attributable to indexation that was waived under PGPA s 63. Confirm RW is recorded as a positive number consistent with s 4(1). Where waivers were partial or applied to multiple components, allocate RW only to the indexation element.

3. Reconstruct RAold law and RAnew law counterfactuals

• For each affected person and year compute RAold law and RAnew law as defined in s 4(1): what the relevant amount would have been if calculated under the old law and the new law, respectively, without taking account of this instrument and on the basis that there had not been a relevant waiver. That requires reversing the effect of previously applied waivers in historic records, and applying the applicable calculation rules from the old and new legislative frameworks as they would operate without waiver. Document the statutory provisions used for each counterfactual and retain workpapers that show the computation steps.

4. Apply the arithmetic rule

• For each person-year, compare RW with RAold law minus RAnew law (the reduction attributable to the law change). If RW > (RAold law − RAnew law), set RAre‑calc = RAold law − RW. If RW ≤ (RAold law − RAnew law), set RAre‑calc = RAnew law (s 5(2)(a)-(b)). Ensure all calculations are precise about rounding practices; retain the calculation logic and any rounding rules applied for auditability.

5. Sequence two‑year waivers correctly

• Where a person had waivers in both financial years, apply s 5(3) and implement the recalculation for the year ending 30 June 2023 first, then apply the rule for the 2024 year using any necessary inputs that follow from the 2023 recalculation. Include a documented rationale for the sequencing and any carry‑through effects between years.

6. Recordkeeping and audit trail

• Maintain a complete record of inputs (original ledger balances, waiver documentation showing PGPA s 63 authority and indexation attribution), counterfactual computations, the RW comparison, and the final RAre‑calc. The instrument’s reliance on counterfactuals makes a transparent audit trail essential to defend recomputed balances, especially if a debtor disputes the outcome.

7. Assess downstream impacts and coordinate across systems

• Determine which downstream processes rely on the recalculated relevant amount: for example, future indexation cycles, eligibility thresholds in other programs, or recovery triggers. The instrument does not specify these downstream effects; administrators must identify system updates, ledger adjustments, and any cross‑program implications, and ensure consistency with the relevant Acts’ substantive rules.

8. Communication and dispute handling

• Although the instrument does not require notice, good administrative practice suggests notifying affected persons of any material change to their debt balances, setting out the arithmetic applied and the basis for the recalculation (i.e., citing the instrument and the statutory sources used to compute RAold law and RAnew law). Establish a clear point of contact and an internal review pathway for disputes. Where an affected person wishes to challenge the calculation, advise them of the available remedies under the substantive Act or general administrative law channels, because the instrument itself is silent on review mechanisms.

9. Legal and policy liaison

• Coordinate with legal advisers to confirm the statutory provisions to apply when reconstructing RAold law and RAnew law for each category of debt. For complex or ambiguous calculations, consider obtaining formal legal advice or internal memoranda capturing the chosen interpretation and method.

10. Resourcing and timelines

• The instrument imposes no statutory timetable, but the computational and data work may be substantial. Allocate resources, prioritise cases with largest balances or highest risk of dispute, and set internal deadlines to avoid prolonged uncertainty for debtors and for the administering body. Document any policy judgments about sequencing or prioritisation.

In summary, compliance requires an administratively disciplined approach: identify affected persons via PGPA s 63 waiver records, reconstruct no‑waiver counterfactuals under old and new law, apply the two‑branch arithmetic in s 5(2) with the 2023 first if both years are affected, and keep a full audit trail for any downstream recovery or dispute. The instrument prescribes the numerical rule but leaves procedural implementation details to administrators and the substantive Acts.
