Universities Accord (Australian Tertiary Education Commission) (Consequential and Transitional Provisions) Act 2026

The Act introduces and reassigns a small number of statutory concepts and mechanics. All concept descriptions below are grounded in the Act text and the Schedule amendments.

• ATEC. The Act inserts a definition into the TEQSA Act: "ATEC means the Australian Tertiary Education Commission as established by the Universities Accord (Australian Tertiary Education Commission) Act 2026" (Schedule 1, item 6). Where the TEQSA Act previously referred to the Higher Education Standards Panel, those references are replaced with "ATEC" (Schedule 1, items 5, 11-12, 14).
• Mission based compacts. The Act replaces s 19‑110 of the HE Support Act with a provision that requires a mission based compact, or a default mission based compact, under the Universities Accord Act to be in force between ATEC and a higher education provider that is a Table A provider or a Table B provider "in respect of each year for which a grant is paid to the provider under this Act for a period that includes that year" (Schedule 1, item 1).
• Table A and Table B providers. The amended s 19‑110 specifically applies to higher education providers that are Table A or Table B providers; the Act does not redefine those categories but makes them the class of providers for which compacts must be in force when grants are paid (Schedule 1, item 1).
• ATEC Commissioner. The Act enlarges the list of authorised recipients of certain personal and HE Support Act information to include "an ATEC Commissioner (within the meaning of the Universities Accord (Australian Tertiary Education Commission) Act 2026)" (Schedule 1, items 2 and 4 amending paragraphs in s 179‑15 and s 238‑5 respectively). The inserted phrase ties disclosure power to the office of ATEC Commissioner as defined in the separate Universities Accord Act.
• Advisory and review duties for ATEC. The Act establishes new obligations in the TEQSA Act for ATEC to advise and make recommendations to the Minister and to TEQSA on the Higher Education Standards Framework, and to consult specified stakeholders before advising the Minister (new s 58A). It also requires ATEC to review the standards that make up the Framework at least once every five years and to notify TEQSA at least 30 days prior to a review (new s 58B) (Schedule 1, item 13).
• Transitional legislative instruments. The Act empowers the Minister to make rules by legislative instrument for matters required or permitted by the Act or necessary to give effect to it, including transitional matters and savings (Schedule 2, Part 2, item 3(1)-(2)). The Act sets express constraints on the content of those rules (item 3(3)).

The Act is narrowly scoped: it does not itself create definitions for Table A/B, does not set the substantive content of mission based compacts, and does not provide the text of the Universities Accord Act. It therefore shifts institutional responsibilities and disclosure capacities into the ATEC frame while preserving the continuity of pre‑existing compacts and enabling the Minister to make transitional legislative instruments within specified limits.

The Act reallocates roles and alters information flows; the parties directly affected can be read from the precise amendments.

• Higher education providers that receive grants under the Higher Education Support Act. The new s 19‑110 requires a mission based compact, or a default mission based compact under the Universities Accord Act, to be in force between ATEC and any higher education provider that is a Table A provider or a Table B provider for each year in which a grant is paid to the provider under that Act (Schedule 1, item 1). Practically, Table A and Table B providers receiving grants have a compact condition synchronized with grant years.
• The Australian Tertiary Education Commission (ATEC) and its Commissioners. The Act inserts a definition of ATEC into the TEQSA Act (Schedule 1, item 6). It expressly permits disclosure of personal information and HE Support Act information to an "ATEC Commissioner" (Schedule 1, items 2 and 4). It also creates advisory and review obligations on ATEC under TEQSA (new ss 58A and 58B, Schedule 1, item 13).
• The Tertiary Education Quality and Standards Agency (TEQSA). TEQSA is the statutory regulator whose references to the Higher Education Standards Panel are replaced by ATEC; the Act also expressly contemplates TEQSA being consulted by ATEC and being advised by ATEC on matters relating to the Higher Education Standards Framework (new s 58A(1)(b)-(2)(a)).
• The Minister and State/Territory Ministers responsible for higher education. ATEC must advise and make recommendations to the Minister on making and varying the Higher Education Standards Framework. Before doing so ATEC must consult, among others, "the Minister for each relevant State and Territory responsible for higher education" (new s 58A(1)(a) and (2)(b)). The Act also gives the Commonwealth Minister the power to make transitional legislative instruments to carry out the Act (Schedule 2, item 3(1)).
• Higher education student and provider representative bodies. ATEC must consult higher education provider representatives and higher education student representatives before advising the Minister on standards framework matters (new s 58A(2)(c)-(d)).
• Privacy and information handlers. The Act’s amendment to s 179‑15 of the HE Support Act extends the class of persons who may be disclosed personal or HE Support Act information to include ATEC Commissioners, and Schedule 2 specifies that the change applies to disclosures on or after commencement regardless of when the information was obtained (Schedule 1, item 2; Schedule 2, item 2).
• Administrators and legal advisers. Public servants and legal counsels administering grants, compacts and TEQSA processes will need to apply the new ATEC references, ensure compacts remain in force as required, and monitor the Minister’s legislative instruments made under the transitional power (Schedule 2, item 3).

Indirectly, anyone with an interest in the content of the Higher Education Standards Framework will be affected because ATEC now has an express advisory and review role in relation to the Framework and is required to consult a specified set of stakeholders before advising the Commonwealth Minister (new ss 58A-58B). The Act also affects the institutional pathway through which certain personal and HE Support Act information may be disclosed, by adding the ATEC Commissioner as a permitted recipient.

The Act creates a small set of statutory duties, rights to information disclosure and rule‑making authorities. All duties and rights below are taken from the text of the Act and the Schedule amendments.

Compacts and grant condition duty

• Mission based compacts requirement. The replaced s 19‑110 of the HE Support Act requires that "A mission based compact, or a default mission based compact, under the Universities Accord (Australian Tertiary Education Commission) Act 2026, must be in force between the Australian Tertiary Education Commission and a higher education provider that is a Table A provider or a Table B provider in respect of each year for which a grant is paid to the provider under this Act for a period that includes that year" (Schedule 1, item 1). The duty is on the legal relationship to be in force; the Act links the compact requirement directly to grant years.
• Continuity of existing compacts. A mission based compact that was in force immediately before commencement continues in force as if it were a mission based compact under s 27 of the Universities Accord Act, and remains in force for the balance of the period specified in the compact subject to s 35 of the Universities Accord Act (Schedule 2, Part 1, items 1(1)-(2)). The effect is a saving that preserves existing compact terms unless and to the extent the Universities Accord Act (s 35) provides otherwise.

ATEC duties and rights

• Advice and recommendation duty. The Act requires ATEC to "advise and make recommendations to the Minister" on making and varying the Higher Education Standards Framework and on other matters relating to the Framework, if requested by the Minister or on ATEC’s own initiative (new s 58A(1)(a)). It also requires ATEC to advise and make recommendations to TEQSA on matters relating to the Framework, again if requested or on ATEC’s own initiative (new s 58A(1)(b)).
• Consultation obligation before advising the Minister. Before advising and making recommendations to the Minister, ATEC must consult TEQSA, the relevant State and Territory Ministers, higher education provider representatives, higher education student representatives and any other person or body ATEC considers necessary (new s 58A(2)).
• Periodic review duty. ATEC must review the standards that make up the Higher Education Standards Framework at least once every 5 years and must give TEQSA written notice at least 30 days before a review (new s 58B(1)-(2)).

Information disclosure rights

• Disclosure to ATEC Commissioners. The amendments add an ATEC Commissioner to the list of persons who may be provided with personal information and HE Support Act information under s 179‑15 of the HE Support Act and to the list of authorised recipients in the HE Support Act’s s 238‑5 (Schedule 1, items 2 and 4). Schedule 2, item 2 makes the amendment apply to disclosures on or after commencement whether the information was obtained before, on or after commencement, creating a forward‑looking disclosure entitlement that applies irrespective of when the information was obtained.

Rule‑making authority and constraints

• Ministerial rule‑making power. The Minister may make rules by legislative instrument for matters required or permitted by this Act or for matters necessary or convenient to carry out or give effect to the Act, including transitional matters and any saving or application provisions (Schedule 2, Part 2, item 3(1)-(2)).
• Constraints on rules. The rules may not create an offence or civil penalty, create powers of arrest, detention, entry, search or seizure, impose a tax, set an amount to be appropriated from the Consolidated Revenue Fund, or directly amend the text of this Act or the Universities Accord Act (Schedule 2, item 3(3)(a)-(e)).

Other structural changes

• Substitution of ATEC for the Panel in TEQSA Act text and repeal of Panel definitions. The Act removes the Panel definitions and related paragraphs and replaces references to the Panel with "ATEC" in several provisions (Schedule 1, items 5-12, 15). The legal effect is to assign the statutory references and functions in those clauses to ATEC.

What the Act does not do (express limitations)

• The Act does not itself create new offences or civil penalties, nor does it create executive coercive powers; the Schedule expressly prevents the Minister from making rules with those contents (Schedule 2, item 3(3)). The substantive content of mission based compacts, the internal organisation of ATEC and the terms of the Universities Accord Act are outside this Act’s text; responsibilities are linked to those external provisions (see the repeated cross‑references to the Universities Accord Act in Schedule 1 and Schedule 2).

This Act is principally consequential and transitional; it neither creates new criminal offences nor establishes new penalty regimes. The text contains express constraints on the rule‑making power that affect enforcement options.

• No new offences or civil penalties in rules. The Minister’s power to make rules by legislative instrument under Schedule 2, Part 2, item 3(1) and (2) is subject to an express prohibition: the rules may not "create an offence or civil penalty" (item 3(3)(a)). That limits subordinate legislation as an enforcement instrument in this transitional package.
• No coercive powers in rules. The Act prohibits the rules from providing powers of "arrest or detention" or "entry, search or seizure" (Schedule 2, item 3(3)(b)(i)-(ii)). This prevents the transitional instruments from conferring coercive investigatory or custodial powers beyond existing statutory authorities.
• No taxation or appropriation in rules. The Act prohibits rules from imposing a tax, setting an amount to be appropriated from the Consolidated Revenue Fund or directly amending the text of this Act or the Universities Accord Act (Schedule 2, item 3(3)(c)-(e)). These constraints limit the fiscal and constitutional reach of subordinate instruments made under the Act.
• Enforcement remains via amended Acts. Any regulatory or compliance enforcement that previously flowed from the HE Support Act or the TEQSA Act will continue under those Acts but with modified references and institutional interlocutors. For example the compact requirement for Table A/B providers is now framed as a condition linked to grants (Schedule 1, item 1), but the Act does not itself set a penalty for failing to have a compact in force; enforcement mechanisms (if any) will therefore arise from the primary legislation and the Universities Accord Act into which compacts are now embedded.
• Repeal of Part 9 of the TEQSA Act. The Act repeals Part 9 of the TEQSA Act (Schedule 1, item 16) and repeals paragraph 134(1)(h) (item 15). The text of those provisions is not reproduced in this Act, so the practical enforcement effect requires examination of the pre‑existing TEQSA Act provisions to establish whether penalties or enforcement mechanisms have been removed, modified or relocated by the repeal. The Act itself does not state the content of the repealed provisions.
• Disclosure and administrative compliance. The Act permits disclosure of personal and HE Support Act information to an ATEC Commissioner by amending s 179‑15 and s 238‑5 of the HE Support Act (Schedule 1, items 2 and 4). Schedule 2, item 2 specifies that these amendments apply to disclosures on or after commencement even if the information was collected earlier. That creates an administrative right to receive information for ATEC Commissioners from HE Support Act data flows; the statute does not itself create penalties tied to misuse, but disclosure and data handling will remain subject to existing privacy, secrecy and statutory obligations in the HE Support Act and other applicable legislation.

In short, the Act imposes no new criminal or civil penalty instruments itself, it restricts what the Minister may prescribe by rules, and it reallocates institutional responsibilities and authorised recipients for information. Any enforcement consequences therefore derive from the amended primary Acts and the separate Universities Accord Act rather than from this transitional instrument.

The Act is expressly consequential: it makes amendments to two primary Commonwealth Acts and interacts with the Universities Accord Act by reference. The interaction points are narrow and should be treated as textual reallocations rather than substantive policy rewrites within this instrument.

Interactions with the Universities Accord (Australian Tertiary Education Commission) Act 2026

• Dependent commencement. This Act commences at the same time as the Universities Accord Act (s 2(1) and the commencement table). The Act repeatedly references mission based compacts and ATEC as defined in the Universities Accord Act, so operational details of compacts and the meaning of "ATEC Commissioner" depend on the separate statute (Schedule 1, item 1; Schedule 1, items 2 and 4; Schedule 1, item 6).
• Continuity of compacts linked to Universities Accord Act provisions. The transitional saving for mission based compacts continues them "as if they were a mission based compact under section 27 of the Universities Accord (Australian Tertiary Education Commission) Act 2026" and explicitly makes that continuation subject to section 35 of the Universities Accord Act (Schedule 2, Part 1, items 1(1)-(2)). The effect is that this Act defers to the Universities Accord Act for the legal character, ongoing governance, and possible variation or termination powers regarding compacts.

Interactions with the Higher Education Support Act 2003

• Compact requirement tied to grant payments. The Act substitutes a new s 19‑110 in the HE Support Act requiring mission based compacts (or default mission based compacts) under the Universities Accord Act between ATEC and Table A/B providers for each year a grant is paid (Schedule 1, item 1). This links grant eligibility or grant conditions under the HE Support Act to compacts administered under the Universities Accord Act.
• Disclosure regime expansion. The Act amends s 179‑15 and s 238‑5 of the HE Support Act to authorise disclosure of personal and HE Support Act information to an ATEC Commissioner (Schedule 1, items 2 and 4). The Schedule 2 application provision makes the amendment apply to disclosures on or after commencement even if the data was collected earlier (Schedule 2, item 2), affecting how existing data holdings under the HE Support Act may be shared with ATEC.
• Administrative consistency. Several HE Support Act amendments simply change cross‑references to incorporate ATEC and ATEC Commissioners into the statutory architecture. These operate as an institutional substitution, not as an independent substantive reform within the HE Support Act itself.

Interactions with the Tertiary Education Quality and Standards Agency Act 2011

• Substitution of Panel with ATEC. The amendments to the TEQSA Act replace references to the Higher Education Standards Panel with ATEC and repeal the Panel definitions (Schedule 1, items 5-9, 11-12, 15). The Act then adds a new Division with duties for ATEC to advise the Minister and TEQSA and to review the Higher Education Standards Framework every five years (Schedule 1, item 13 adding ss 58A and 58B). The net effect is a transfer of the Panel′s advisory role and statutory references to ATEC, subject to any procedural detail set out in the Universities Accord Act itself.
• Removal of Part 9 and a paragraph from s 134. The Act repeals Part 9 of the TEQSA Act and removes paragraph 134(1)(h) (Schedule 1, items 15-16). The practical legal consequences require reading those provisions in the pre‑amendment TEQSA Act; this Act simply excises them.
• TEQSA as a consultee. Under the new ss 58A-58B, ATEC must consult TEQSA before advising the Minister and provide TEQSA with at least 30 days’ written notice before reviewing standards. This creates procedural interlocks between ATEC and TEQSA in relation to the Higher Education Standards Framework (Schedule 1, item 13).

Constraints on rule‑making instruments

• Non‑amendment of parent Acts by rules. Schedule 2, Part 2, item 3(3)(e) expressly states that the rules the Minister makes may not "directly amend the text of this Act or the Universities Accord (Australian Tertiary Education Commission) Act 2026". The rule‑making power therefore interacts with the Universities Accord Act only by carrying out transitional, saving and necessary consequential matters without altering statutory text.

Administrative and privacy law interactions

• Retrospective application to data disclosures. The Schedule 2 application clause for disclosure amendments applies to information obtained before commencement if the disclosure occurs on or after commencement (Schedule 2, item 2). That interacts with existing privacy and secrecy obligations and will require administrators to reconcile prior privacy settings and data sharing arrangements under the HE Support Act with the new permitted class of recipients.
• Continuity and primacy. Where this Act preserves a provision as if it were under a section of the Universities Accord Act (Schedule 2, Part 1, item 1(1)), the Universities Accord Act will determine interpretive or operational questions about the compact in practice because the Act expressly continues compacts "as if" taken under the Universities Accord Act.

In sum, the Act operates as a textual and institutional bridge from the Higher Education Support Act and the TEQSA Act into the new ATEC and Universities Accord framework. It substitutes ATEC for the Panel in the TEQSA Act, links grant years to mission based compacts under the Universities Accord Act in the HE Support Act, expands authorised disclosure recipients to include ATEC Commissioners, and authorises transitional legislative instruments subject to explicit prohibitions.

This Act is itself a single, short consequential instrument enacted in 2026. The Act’s text, schedules and commencement table record the following enactment metadata and amendments.

• Assent and dates. The Act was assented to on 1 April 2026 (front matter). Under the commencement provision, the whole Act commences at the same time as the Universities Accord (Australian Tertiary Education Commission) Act 2026, with the commencement date recorded in the table as 29 April 2026 (s 2(1) and the commencement table).

• Structure. The Act comprises three short sections (Short title, Commencement, Schedules) and two Schedules: Schedule 1,Amendments, and Schedule 2,Application and transitional provisions (s 3).

• Schedule 1 amendments. Schedule 1 lists specific amendments to two Acts.

  • Higher Education Support Act 2003:
    • Item 1 repeals s 19‑110 and substitutes a new provision requiring mission based compacts to be in force for Table A/B providers receiving grants (Schedule 1, item 1).
    • Items 2 and 4 insert "an ATEC Commissioner" into the list of persons for disclosure in s 179‑15 and s 238‑5 respectively (Schedule 1, items 2 and 4).
    • Item 3 inserts a reference to the Universities Accord Act into another paragraph (Schedule 1, item 3).
  • Tertiary Education Quality and Standards Agency Act 2011:
    • Item 5 replaces references to "Higher Education Standards Panel" with "ATEC" in s 4.
    • Item 6 inserts the ATEC definition in s 5.
    • Items 7-9, and 11-12, 14 remove Panel references or repeal subparagraphs and definitions.
    • Item 13 adds new ss 58A and 58B that set advisory and review duties for ATEC.
    • Item 15 repeals paragraph 134(1)(h).
    • Item 16 repeals Part 9 of the TEQSA Act.

• Schedule 2 transitional provisions.

  • Part 1: General provisions.
    • Item 1 preserves existing mission based compacts in force immediately before commencement by treating them as if they were mission based compacts under s 27 of the Universities Accord Act; it states they remain in force for their balance of term subject to s 35 of the Universities Accord Act (Schedule 2, Part 1, items 1(1)-(2)).
    • Item 2 provides application of the disclosure amendments in Schedule 1 to s 179‑15 of the HE Support Act to disclosures on or after commencement regardless of when the information was obtained (Schedule 2, Part 1, item 2).
  • Part 2: Transitional rules.
    • Item 3 gives the Minister a legislative instrument power to make rules for matters required or permitted by the Act or necessary to give effect to it, including transitional savings; it sets explicit limits on what those rules may not do (Schedule 2, Part 2, item 3(1)-(4)).

• Notes in the Act text. Section 2(2) contains a publication note that the information in Column 3 of the commencement table is not part of the Act and may be edited in published versions; the Act explicitly preserves that distinction (s 2(2)).

• Parliamentary record. The printed Act notes the Minister’s second reading speeches were made in the House of Representatives on 26 November 2025 and in the Senate on 3 March 2026 (final page reference).

No other amendment history or prior versions are recorded within this instrument. The Act is specifically consequential to the Universities Accord Act; therefore any further amendment history that affects the operation of compacts, ATEC or the interaction with the HE Support Act and TEQSA Act will be found in those primary statutes or subsequent amending legislation.

The Act’s text contains no case references and records no judicial determinations. It is a recently enacted consequential and transitional instrument with assent dated 1 April 2026 and a commencement linked to the Universities Accord Act on 29 April 2026. As such, within the statute itself there are:

• No reported or named cases referenced, nor any statutory interpretation decisions recorded in the Act.
• No internal litigation notes or savings for ongoing proceedings are stated in the text.

The Act records that the Minister made second reading speeches in the House of Representatives on 26 November 2025 and in the Senate on 3 March 2026 (closing notation). Any litigation that may arise from the Act’s effects,in particular disputes over disclosure to ATEC Commissioners, the interpretation of the new s 19‑110 compact requirement, or the consequences of the repeal of Part 9 of the TEQSA Act,would need to be located in court records or subsequent reporting; none is referenced in the statute.

Practitioners should therefore treat this Act as freshly enacted, and if they require the litigation posture on the underlying Universities Accord Act, the HE Support Act or the TEQSA Act they must search case law and litigation records external to this instrument, because the Act itself contains no litigation history.

This Act is short and technical, but it contains a set of transition and disclosure mechanics that give rise to concrete compliance and operational issues. The observations below are grounded in the Act text and set out mechanistic risks and attention points for practitioners.

1. Compact timing linked to grant years

• The substituted s 19‑110 ties the existence of a mission based compact or default mission based compact to each year for which a grant is paid to a Table A or Table B provider (Schedule 1, item 1). That creates a timing dependency: if a grant is paid for a period that includes a year, a compact must be "in force" in respect of that year. Providers and administrators must ensure compacts are active for the precise accounting periods covered by grants. Failure to align compact terms with grant years could create difficulties in grant administration. The Act does not indicate remedial mechanisms or penalties for non‑alignment within its text; enforcement will depend on the primary statutes and the Universities Accord Act.

2. Existing compacts preserved but subject to s 35 of the Universities Accord Act

• The transitional provision continues any mission based compact in force immediately before commencement "as if it were a mission based compact under section 27 of the Universities Accord (Australian Tertiary Education Commission) Act 2026" and states the compact remains in force for the balance of its period "subject to section 35" of the Universities Accord Act (Schedule 2, Part 1, items 1(1)-(2)). Practitioners must check s 35 of the Universities Accord Act to know whether the Universities Accord Act permits variation or early termination of those preserved compacts; this Act does not supply that detail.

3. Retrospective scope for disclosures to ATEC Commissioners

• The amendment to s 179‑15 is applied to disclosures "on or after the commencement of this item, whether the information was obtained before, on or after that commencement" (Schedule 2, Part 1, item 2). Administrators must therefore review prior data collection and consent arrangements and existing privacy notices when sharing historical data with ATEC Commissioners, because the statutory permission to disclose attaches to the timing of the disclosure, not the timing of collection.

4. Switching institutional interlocutors from Panel to ATEC

• The repeal of the Higher Education Standards Panel definitions and the wholesale substitution of ATEC for Panel references in the TEQSA Act (Schedule 1, items 5-9, 11-12, 14) alters the statutory architecture for advice and standard setting. The Act inserts new ss 58A and 58B which impose an obligation on ATEC to consult specified parties and to review the Framework every five years. However, procedural detail (how ATEC conducts those consultations, publication obligations, timelines beyond the 30‑day notice to TEQSA) is not supplied here and will be found in the Universities Accord Act or in any rules ATEC or the Minister makes. Practitioners should not assume continuity of process merely from name substitution.

5. Limited rule‑making but with broad transitional remit

• The Minister may make rules by legislative instrument for any matter required or permitted by the Act or necessary or convenient to give effect to it, including transitional matters and savings (Schedule 2, Part 2, item 3(1)-(2)). The rules may be wide‑ranging so long as they do not create offences or civil penalties, confer coercive powers, impose taxes, direct appropriations, or directly amend the texts of this Act or the Universities Accord Act (item 3(3)). Clients should monitor these legislative instruments because the Act anticipates significant transitional detail may be set out there.

6. Repeal of Part 9 of the TEQSA Act without description

• The Act repeals Part 9 of the TEQSA Act (Schedule 1, item 16) and a paragraph at s 134(1)(h) (item 15). The Act does not reproduce what Part 9 or that paragraph contained, so the practical effect on rights, obligations or enforcement in that Part must be assessed by comparing pre‑amendment TEQSA Act text with the post‑amendment version. That comparison is essential because the repeal could remove procedural steps or appeal rights formerly located in that Part.

7. Legislative instrument form and oversight not specified in the Act

• The Act requires rules to be made "by legislative instrument" (Schedule 2, Part 2, item 3(1)) but does not specify parliamentary oversight, disallowance procedures or consultation steps for those instruments. Ordinarily legislative instruments are subject to the Acts Interpretation Act and disallowance procedures, but the Act itself does not state how oversight will be exercised. Practitioners should therefore treat the instruments as subordinate legislation and look to the usual parliamentary and administrative law frameworks for oversight.

8. Cross‑Act interpretive dependency

• Several provisions in this Act refer directly to sections of the Universities Accord Act (for example the compact is to be one "under the Universities Accord (Australian Tertiary Education Commission) Act 2026", and the transitional saving treats compacts "as if they were" under s 27 of that Act) (Schedule 1, item 1; Schedule 2, Part 1, item 1(1)). Interpretation of the compact requirement therefore depends on how the Universities Accord Act defines mission based compacts, default compacts and the office of ATEC Commissioner. This Act does not supply those definitions; practitioners must read the two Acts together.

9. No express prohibition on sharing some classes of information

• The Act authorises disclosure to ATEC Commissioners but does not enumerate limits or conditions for handling sensitive or protected categories of personal information; existing privacy regimes and the HE Support Act’s own provisions remain applicable. The practical control of risk around disclosure will therefore depend on privacy law and internal safeguards rather than on new limits set out in this instrument.

These are operational "gotchas" that arise directly from the Act’s text: timing dependency of compacts to grant years; retrospective application of disclosure authorisation; substitution of ATEC for the Panel while leaving procedural detail elsewhere; and an open but constrained ministerial rule‑making power that will contain key transitional detail.

Below are practical, source‑grounded steps and checks for administrators, legal advisers, higher education providers, TEQSA and ATEC, drawn from the Act’s text and its specific amendments.

For higher education providers that are Table A or Table B providers

• Confirm compact coverage for all grant years. Review every grant under the HE Support Act to determine the exact years covered. Under the new s 19‑110 replacement, a mission based compact or default mission based compact under the Universities Accord Act must be "in force" between ATEC and the provider for each year in respect of which a grant is paid that includes that year (Schedule 1, item 1). Ensure compact terms, effective dates and any renewal mechanics align with grant payment periods.
• Inventory existing compacts and retain documentary continuity. Any mission based compact in force immediately before commencement continues "as if it were" a mission based compact under s 27 of the Universities Accord Act and remains in force for its balance of term subject to s 35 of the Universities Accord Act (Schedule 2, Part 1, items 1(1)-(2)). Maintain clear records of existing compact terms, durations, and renewal clauses to evidence the compact was in force at the relevant time.
• Verify whether any compact provisions interact with s 35 of the Universities Accord Act. The continuation is stated to be "subject to section 35" of that Act; consult s 35 of the Universities Accord Act to identify any rights of variation, termination or other supervisory powers that could affect the preserved compact.

For data controllers and administrators handling HE Support Act information

• Update disclosure policies to reflect ATEC Commissioner as authorised recipient. Amend internal data sharing, privacy and disclosure registers and procedures to reflect that an ATEC Commissioner is an authorised recipient under s 179‑15 and s 238‑5 (Schedule 1, items 2 and 4).
• Note retrospective application of disclosure permission. The application provision explicitly states that the amendment applies to disclosures "on or after the commencement of this item, whether the information was obtained before, on or after that commencement" (Schedule 2, Part 1, item 2). Where historical records are to be disclosed to ATEC commissioners after commencement, ensure privacy impact assessments and data sharing agreements are in place consistent with the HE Support Act and the Privacy Act and any other applicable statutes.
• Retain evidence of lawful basis for disclosures. Where privacy or consent questions may arise, retain contemporaneous records demonstrating legal authorisations relied upon for each disclosure to an ATEC Commissioner.

For TEQSA and for ATEC

• Update statutory references and internal processes. The TEQSA Act’s references to the Higher Education Standards Panel are replaced with ATEC and the Panel definitions are repealed (Schedule 1, items 5-9, 11-12, 14). TEQSA should update internal manuals, delegations and procedural documents to reflect ATEC as the statutory interlocutor for the functions previously allocated to the Panel.
• Prepare for consultation obligations. ATEC must consult TEQSA, State and Territory Ministers responsible for higher education, provider and student representatives and "any other person or body the ATEC considers necessary" before advising the Minister on the Higher Education Standards Framework (new s 58A(2)). TEQSA should prepare to receive consultation requests and confirm internal review processes to respond within administrative timeframes.
• Implement the five‑year review calendar. ATEC must review the standards in the Higher Education Standards Framework at least once every five years and must give TEQSA written notice at least 30 days before a review (new s 58B(1)-(2)). ATEC should set a rolling review timetable and a notice mechanism to TEQSA in line with s 58B.

For the Minister’s office and regulators drafting transitional instruments

• Use the legislative instrument power for transitional detail but observe explicit prohibitions. The Minister may make rules by legislative instrument for matters required or permitted by the Act or necessary to give effect to it, including transitional savings (Schedule 2, Part 2, item 3(1)-(2)), but those rules may not create offences, impose civil penalties, confer coercive powers of arrest, entry, search or seizure, impose a tax, set appropriations, or directly amend this Act or the Universities Accord Act (item 3(3)). Drafting must therefore avoid any of those forbidden contents.
• Draft clear savings and application provisions. The Act anticipates transitional rules may preserve rights, obligations and processes. Draft instruments to address likely timing mismatches between grant years and compact terms, to specify processes for default mission based compacts, and to provide administrative clarifications for disclosures to ATEC Commissioners. Ensure instruments are framed as legislative instruments and comply with the Acts Interpretation Act and any parliamentary scrutiny processes that apply to legislative instruments.

For legal advisers and compliance teams

• Read the Universities Accord Act in tandem. Many operational questions (definition of ATEC Commissioner, content of mission based compacts, s 35 consequences) defer to the Universities Accord Act. Compliance advice and contract drafting must therefore integrate both Acts.
• Map pre‑ and post‑amendment TEQSA provisions. Because the Act repeals Part 9 of the TEQSA Act and removes paragraph 134(1)(h), counsel must compare pre‑amendment provisions with the post‑amendment statute to identify any procedural or substantive rights that have been excised or relocated.
• Review grant agreements and funding instruments. Funding agreements and standard terms in grant determinations or funding schedules should be reviewed and amended if they reference pre‑existing Panel processes or use language inconsistent with the ATEC substitution.

Recordkeeping and operational checklists

• Maintain dated proof that a compact was in force at any relevant grant payment date to demonstrate compliance with s 19‑110 replacement (Schedule 1, item 1).
• Maintain data sharing registers showing the date and legal authority for any disclosure to an ATEC Commissioner, noting the Schedule 2 application clause that makes disclosure power applicable even to data obtained before commencement (Schedule 2, Part 1, item 2).
• Monitor the Register of Legislative Instruments for any instruments made by the Minister under Schedule 2, Part 2, item 3, because those instruments are likely to contain transitional mechanics and savings.

These compliance steps arise directly from the Act’s amendments and transitional provisions. The Act itself supplies the new obligations and authorised recipients; implementing compliance requires harmonising operational practice with the Universities Accord Act and any legislative instruments the Minister makes under Schedule 2.
