26 Suspending and revoking permits

(1) The Minister may, by written notice given to a permit holder, suspend or revoke the permit if the Minister is satisfied that: (a) a condition of the permit has been contravened; or (b) it is necessary to do so in order to conserve and protect underwater cultural heritage. (2) If a permit is revoked, the revocation takes effect on the day specified in the notice. (3) If a permit is suspended: (a) the suspension takes effect on the day specified in the notice, and continues for the period specified in the notice; and (b) the permit has no effect while the suspension is in effect; and (c) the period for which the permit is specified to be in force continues to run during the period of suspension; and (d) the suspension does not prevent the revocation of the permit. (4) The day specified for the purposes of subsection (2) or paragraph (3)(a) must be at least 21 days after the day the notice is given to the permit holder.
