Uncollected Goods Act 1996

The Act is organised around a small set of regulatory building blocks that determine how goods move from private property in someone else’s possession to being lawfully disposed of. Those core concepts are: uncollected goods, possessor, owner, perishable goods, personal effects and the value bands that determine holding periods.

Uncollected goods. The statutory definition is in s 5 and is event-driven. Goods become "uncollected" in multiple ways: failure to collect after a contractual arrangement (s 5(1)(a)); lien-based defaults where notice under the Mercantile Law Act 1962 has been triggered (s 5(1)(b)); items received without an agreement where perishables or goods of no value are immediately deemed uncollected while other items require a failure to comply with a written request under s 7 (s 5(1)(c)); and items lost or abandoned at pool facilities or on public or unleased land where different rules apply (s 5(1)(d)-(e)). The statutory test for goods found in public or unleased land and at pool facilities uses the objective phrase "that a reasonable person would believe have been lost or abandoned" (ss 9, 14). For vehicles found on public or unleased land, the s 5(2) carve-out applies: the subsection does not make goods uncollected if they are vehicles, unless an authorised officer has reasonable grounds to believe the vehicle is abandoned.

Possessor and owner. The Act distinguishes the possessor, a person in possession of goods belonging to another (Dictionary), and the owner. Possessors may include commercial storage operators, service providers, pool operators, municipal or Territory agencies and individuals who find goods. Possessors acquire powers to request collection, retain, sell or otherwise dispose of goods in accordance with Part 3 once the statutory classification is met (ss 7-8, 18-25).

Value bands and net value. The Dictionary defines "goods of no value" (net value $20 or less), "goods of low value" (more than $20 but less than $500) and "goods of significant value" ($500 or more), and defines "net value" as market value less reasonable selling costs (Dictionary). Time to disposal depends on these bands: no-value items and perishable goods have the shortest windows (ss 20, 22), low-value goods require longer holding periods (s 23) and significant-value goods are subject to the longest period before auction (s 24). Vehicles follow accelerated timelines in several places, with abandoned vehicles generally having shorter holding periods before disposal (ss 22-24).

Formal notice and public notice routes. For goods held without a collection agreement, a possessor must make a written request to the owner that contains specific items: description, address for collection, times for collection, a statement that goods may be disposed of under Part 3 after 7 days and the costs required for release (s 7(2)). That request must be sent to the owner’s last-known address or, if no address can be found after reasonable inquiry, by public notice as defined by the Legislation Act (s 7(3)). For goods on public or unleased land, authorised officers may affix notices to goods stating they may be disposed of if not removed within 7 days (s 14(1)(a)(ii)). Public auctions require at least 7 days public notice (s 25(1)).

Protections, liabilities and remedies. Possessors acting under the Act have statutory protection from civil action in connection with taking or disposing of goods (s 32). Buyers at sales obtain title free of unknown mortgages, liens or charges of which they were unaware (s 35). An owner retains the opportunity to reclaim goods before disposal by proving ownership and paying reasonable costs, liens and unpaid rent, and may seek a Magistrates Court review of the possessor’s costs (ss 26-27). For Territory-handled goods (found on Territory-controlled premises), the Territory may dispose after prescribed periods and retain reasonable costs from sale proceeds (ss 28-31). The Minister can pay claimants from trust balances within statutory timeframes (s 31).

Administrative machinery and inter-act references. Authorised officers are appointed by the director-general and must carry identity cards (ss 16-16A). Retention areas are declared by the Minister (s 17) and are notifiable instruments. The Act cross-refers to several other statutory regimes: the Mercantile Law Act 1962 for liens (s 5(1)(b), s 26(c)), the Public Pools Act 2015 (operator and pool facility definitions at ss 9-12), the Public Unleased Land Act 2013 (s 14(2)(b)), the Residential Tenancies Act 1997 (s 24A and Part 4 application provision s 27A), and road transport regulations for vehicle parking rules in s 14(2)(c).

Collectively, the concept set imposes decision points on possessors and authorised officers about whether goods qualify as uncollected, how to serve notices, how long to hold goods, whether to auction, how to calculate and retain costs, and when to remit balances to the Territory. The Act operates as a procedural code that shifts risk, costs and administrative burdens between possessors, owners and the Territory depending on the facts and the statutory path followed.

The Act affects identifiable groups in concrete ways by assigning actions, costs, benefits and decision-making authority.

Possessors. Businesses and individuals who come into possession of other people’s goods are primary addressees. That includes repairers, storage operators, parking station managers, pool facility operators, towing operators and private individuals who take possession of lost or abandoned items. Possessors may request collection (s 7), classify goods as uncollected under s 5, and ultimately dispose of goods in conformity with Part 3 (ss 18-25). Possessors can recover costs and amounts secured by lien and unpaid rent from sale proceeds (s 30(1)). Possessors also obtain statutory protections from civil action for acts done under the Act (s 32), and they must keep an evidentiary record when required, for example the lost property register for pool facility operators (s 10). Possessors decide when to initiate the statutory process, create the initial written request with statutorily required content (s 7(2)), and run auctions with statutorily required public notice (s 25).

Owners. Owners of goods are affected by the Act’s frameworks for notification, collection windows and the potential loss of property by sale, appropriation or destruction. Owners facing a written request have 7 days to collect goods (s 7(1)); the owner may reclaim goods before disposal by satisfying the possessor of ownership and paying reasonable costs, liens and unpaid rent (s 26). Owners who dispute a possessor’s claimed costs may apply to the Magistrates Court for review and to halt disposal pending determination (s 27).

Finders and the public. Members of the public who find goods in public places, public unleased land or pool facilities are affected in that they are required to deliver goods to specified custodians: goods found at pool facilities must be placed with the operator or employee (s 9); goods found on public or unleased land must be given to a police officer if found by someone other than an authorised officer (s 14(1)(b)). Public finders who are authorised officers (appointed by the director-general) are equipped with statutory powers to remove goods to retention areas and to affix notices (ss 16, 14).

Pool facility operators and employees. Pool facility operators and their employees have a statutory duty to take possession of goods found at pool facilities (s 9), establish and maintain a lost property register for non-perishable items (s 10) and follow the claims procedure in s 11. They must treat certain items as uncollected after three months if unclaimed (s 12). For operators this is an administrative duty with recordkeeping and custody requirements.

Authorised officers and the Territory. Authorised officers (s 16) appointed by the director-general have powers under division 2.4 to remove goods found on public or unleased land and place them in retention areas or affix notices (s 14). Authorised officers must carry identity cards issued by the relevant director-general (s 16A) and return them promptly on ceasing office (s 16A(3)-(4)). The Minister may declare retention areas by written notifiable instrument (s 17). For goods found on Territory-controlled premises the person who finds goods must give them to a public employee in charge or to a police officer (s 28), and the Territory itself may dispose of such goods after set periods and retain reasonable costs (s 29, s 30(3)).

Buyers at auction and the market. Buyers of goods sold under this Act acquire title free of mortgages, liens or charges of which they were unaware at the time of acquisition (s 35). This legal assurance alters market risk and reduces due diligence costs for purchasers at auctions held under the Act.

Regulators and courts. The Act assigns review jurisdiction to the Magistrates Court to hear applications about possessor costs and stay disposals pending determination (s 27). The director-general and Minister exercise administrative and regulatory powers (ss 16, 17). Regulations may further specify procedures and identity card content (s 16A(2), s 38).

Who pays. Costs fall across groups depending on the stage. Possessors can require owners to pay "reasonable costs" incurred in complying with the Act and storing and maintaining goods as a condition of returning goods before disposal (s 26(2) and s 30(1)). Possessors may retain those sums from sale proceeds (s 30(1)). The Territory retains proceeds balances after possessor deductions and may need to administer trust accounts for balances and interest (s 30(2)-(5)). The Minister may pay persons with an interest in the goods from those balances if a timely claim is made (s 31).

Interaction with other legal regimes. Parties dealing with vehicles, animals, residential park homes, firearms, and other specifically regulated items must , before taking action under this Act , check the parallel regulatory regimes referenced or excluded in s 3(2), s 14(2)(c) and ss 24A, 27A. For example, the Act excludes animals falling under specified Acts and includes specific treatment for manufactured homes and mobile homes in residential parks following ACAT procedures (s 24A), and it cross-refers to the Mercantile Law Act 1962 for liens (s 5(1)(b), s 26(c)).

Overall, the Act allocates responsibilities among private possessors, public officers and the Territory, sets evidentiary and process standards, and shifts costs and decision rights depending on whether goods are perishable, low, no or significant value, or are lost or abandoned in particular settings.

The Act establishes a series of actionable and enforceable duties, and it creates corresponding rights for possessors, owners, authorised officers and the Territory.

Duties of possessors

• Make a written request to the owner when goods are held without an agreement for collection. The request must be in writing and contain mandatory contents: brief description of goods, address where goods are available, times/hours for collection, a statement that goods may be disposed of under Part 3 if not collected within 7 days, and a statement of any costs payable before release (s 7(1)-(2)). The request must be sent to the owner’s last-known address or made by public notice when no address can be found after reasonable inquiry (s 7(3)).
• Classify goods as uncollected and act in accordance with the schedules in Part 3 once the statutory triggers in s 5 are met (ss 5, 18-25). A possessor may dispose of uncollected goods per the timelines linked to the goods’ classification as perishable, personal effects, no-value, low-value or significant-value (ss 20-24).
• If disposing by auction, give public notice at least 7 days before the auction of the time, place and a general description of goods to be sold (s 25(1)). Possessors decide how to deal with goods passed in at auction (s 25(2)).
• Before handing goods to a claiming owner, the possessor may require payment of reasonable costs of complying with the Act, reasonable storage and maintenance costs, amounts secured by any lien under the Mercantile Law Act 1962, and unpaid rent owed to the possessor (s 26(2)). Those amounts may be retained from sale proceeds (s 30(1)).

Duties of pool operators and employees

• Take possession of goods found at pool facilities and enter non-perishable items in a lost property register with required particulars (ss 9-10). Allow claimants to take possession after satisfying entitlement and signing the register (s 11). If unclaimed after 3 months, goods taken by the operator or employee are treated as uncollected and may be disposed of under Part 3 (s 12).

Duties of authorised officers and the director-general

• Authorised officers are appointed by the director-general and given powers under division 2.4 to remove goods from public or unleased land and place items in retention areas or affix notices that goods may be disposed of after 7 days (ss 14-16). The director-general must issue identity cards that include a photograph, date of issue/expiry, and any other regulation-prescribed matter (s 16A(1)-(2)). Authorised officers must return their identity cards within 7 days upon ceasing office, failing which they commit a strict liability offence with a one penalty unit maximum penalty (s 16A(3)-(4)).

Duties of finders on public or Territory-controlled land

• Non-authorised finders of goods on public or unleased land must place the goods in the possession of a police officer (s 14(1)(b)). For Territory-controlled premises, finders must place goods in the hands of a public employee in charge or a police officer (s 28).

Rights of owners

• Owners have the right to reclaim goods at any time prior to disposal by satisfying the possessor of their ownership and by paying the reasonable costs required by s 26(2) (s 26(1)-(2)). Owners may challenge possessor-imposed costs in the Magistrates Court and seek an order preventing disposal pending determination (s 27).

Rights and duties of the Territory and the Minister

• The Territory, when selling goods found on Territory-controlled premises, may retain reasonable storage and sale costs from proceeds (s 29(1)-(2), s 30(3)). The possessor must pay any remaining balance to the Territory for placement in a trust bank account and the Minister may pay persons with an interest in those balances if claims are made before the expiry of the 3-year period after the money was paid into the trust account (ss 30(2), (6); s 31(1)-(3)). Interest realised on investments of trust funds must be used to meet administration costs or other prescribed purposes (s 30(5)).

Protections and liabilities

• Possessors acting under the Act are protected from civil actions "by reason of" taking, giving possession or disposing of goods under the Act (s 32(1)). The possessor is also not liable for reasonable damage caused by removal or retention of goods (s 32(2)). However, nothing in the Act abrogates or limits existing liens, powers of sale or other rights a possessor may have apart from this Act; those rights continue to be enforceable (s 33).
• A person who acquires goods sold or disposed of under the Act acquires title free of any mortgage, lien or charge affecting the goods of which the purchaser was unaware at the time of acquisition (s 35). This is a protective right for bona fide purchasers.

Procedural standards and flexibility

• The Act prescribes mandatory content for requests to owners but allows "substantial compliance" where strict compliance is not necessary unless a contrary intention appears, giving a degree of flexibility to possessor conduct in meeting formalities (s 37). The regulation-making power in s 38 permits further procedural detail to be set by regulation.

Collectively, the Act imposes duties on possessors and public officers to follow specified steps before disposal, gives owners rights to reclaim and to seek judicial review of costs, allocates retention and distribution of proceeds, and affords statutory protections to possessors and purchasers who act in conformity with the Act’s processes.

The Act is primarily procedural and civil in effect but contains limited criminal and administrative sanctions and establishes enforcement and remedial mechanisms that are relevant to practitioners.

Criminal and administrative offences

• The Act contains one explicit criminal offence with a specified penalty: an authorised officer who fails to return the identity card upon ceasing to be an authorised officer must return it as soon as practicable and no later than 7 days; failure to do so attracts a maximum penalty of 1 penalty unit and is a strict liability offence (s 16A(3)-(4)). The schedule at the front of the republication notes that at the republication date a penalty unit is $160 for an individual and $810 for a corporation under the Legislation Act 2001, s 133. The Act also includes the general note at s 2B that the Criminal Code chapter 2 applies to "all offences against this Act", so general principles like fault elements and defences are governed by the Criminal Code where applicable.

Civil protections and remedies

• The Act provides possessors with statutory protection from civil suit for acts done in accordance with the Act: "No action shall lie against a possessor by reason of the taking or giving of possession, or the sale, appropriation or destruction, of goods under this Act" (s 32(1)). It also states that a possessor acting under the Act is not liable for reasonable damage caused by removal or retention of goods (s 32(2)). These provisions function as statutory immunities rather than penal sanctions.
• Owners can seek relief against a possessor’s costs. The owner of uncollected goods may apply to the Magistrates Court for a review of any costs the possessor requires under s 26(2). The court may order that the goods not be disposed of pending determination or disallow the possessor’s costs in whole or part (s 27). The presence of this right supplies an enforceable judicial remedy which also operates as a check on possessors’ cost claims.

Procedural enforcement and evidence

• The Act supplies evidential shortcuts: a certificate signed by the director-general stating that specified land is unleased land is admissible evidence in proceedings for an offence against the Act (s 34). The Minister’s declaration of retention areas is a notifiable instrument (s 17(2)), which affects administrative transparency and the merits of enforcement actions that rely on retention-area placements (s 17).
• The Act preserves a possessor’s right to enforce liens and other rights that exist independently of the Act (s 33), which enables possessors to pursue remedies under other statutory or common law regimes even when operating within the Act.

Financial and administrative enforcement

• The possessor may retain from sale proceeds reasonable costs, lien amounts and unpaid rent (s 30(1)). The balance is payable to the Territory and must be paid into a trust bank account (s 30(2)). The Territory itself may retain reasonable costs from proceeds for sales under s 29(1)(b) (s 30(3)). Money in trust accounts is subject to prescribed uses for interest earned and becomes deemed interest after three years for the purposes of s 30(5)-(6).
• The Minister may pay persons with an interest in goods from trust balances if they make a claim before the expiry of the three-year period (s 31). The Act allows the Minister to make such a payment even if the period has expired before the claim is decided (s 31(3)). This creates an administrative route for claimants where judicial remedies have not been pursued or were unsuccessful.

Limits on enforcement power

• Section 36 clarifies that nothing in the Act authorises a mode of disposition that would otherwise be contrary to another Territory law. Practically, enforcement that involves vehicles, residential park homes, animals, firearms or other specially regulated categories must be reconciled with the relevant primary legislation cited in the Act, such as the Residential Tenancies Act 1997 (s 24A, s 27A) and the Road Transport Acts referenced in s 14(2)(c).

Regulations

• Section 38 grants the Executive power to make regulations for the Act. Regulations can supply enforcement detail, procedural standards or additional penalties. As with any delegated legislation, regulations may expand or refine implementation and enforcement timelines and require compliance with additional procedural safeguards.

In practice, the Act leans heavily on civil process and administrative pathways for enforcement: statutory immunity and title protections simplify the ability of possessors and purchasers to act without prolonged litigation, while the Magistrates Court review process and Ministerial trust-account payments preserve rights of owners and third parties to recover value. The explicit criminal exposure is narrow and targeted to the administration of authorised officer identity cards. Practitioners should therefore consider the Act primarily as a civil-administrative mechanism with limited criminal contours.

The Uncollected Goods Act 1996 explicitly cross-references several other Territory enactments and preserves the operation of rights and prohibitions found elsewhere, so its practical effect depends on interaction with multiple statutory regimes.

Express exclusions and cross-references

• Section 3(2) expressly excludes certain subject matter from the Act’s operation: unclaimed prizes under the Lotteries Act 1964; unclaimed money under the Unclaimed Money Act 1950; negotiable instruments such as cheques and IOUs; animals that fall within the Domestic Animals Act 2000 or the Stock Act 2005; firearms, firearm parts or ammunition under the Firearms Act 1996; and prohibited weapons or prohibited articles under the Prohibited Weapons Act 1996. For those categories, the statutory processes of the relevant Acts govern dealing with such items rather than the Uncollected Goods Act (s 3(2)). Practitioners must therefore check whether a found item is specifically governed by another regime before relying on the Uncollected Goods Act.

• Liens under the Mercantile Law Act 1962 are incorporated into the Act’s triggers and recovery rights. Under s 5(1)(b) goods subject to a lien with a notice of intention to sell given under s 22(2) of the Mercantile Law Act 1962 that remain unpaid are deemed uncollected. Possessors may retain the amount secured by any lien under the Mercantile Law Act 1962 from sale proceeds (s 30(1)(c)), and may require payment of any lien amount before releasing goods to the owner (s 26(2)(c)). The Act therefore operates alongside the Mercantile Law Act to facilitate enforcement of commercial liens.

Residential tenancies and manufactured/mobile homes

• The Act interacts with the Residential Tenancies Act 1997 in two ways. First, it excludes premises where the housing commissioner is the lessor under a residential tenancy agreement (s 27A). Second, s 24A deals specifically with manufactured homes and mobile homes abandoned in residential parks, linking the Act to ACAT declarations under the Residential Tenancies Act 1997, s 83. Section 24A permits disposal by public auction after 14 days from the date of the ACAT order where the ACAT has declared abandonment and has not made a different order. The Act therefore defers to ACAT processes for residential park homes and sets an auction timeline contingent on ACAT action.

Public pools and public unleased land regimes

• Pool facilities are dealt with using definitions in the Public Pools Act 2015 (ss 9-12). The Act requires pool facility operators to take possession and keep a lost property register. For goods found on public or unleased land, s 14 excludes objects placed with authority under the Public Unleased Land Act 2013 and items on land under a public unleased land permit (s 14(2)(b)). Retention areas are subject to Ministerial declaration as a notifiable instrument (s 17). The interaction with the Public Unleased Land Act 2013 means that goods legitimately placed in certain public-unleased land contexts are beyond the scope of the automatic removal and retention powers in division 2.4.

Road transport and vehicle regulation

• Section 14(2)(c) is framed to avoid conflict with road transport regulations: the subsection does not authorise removal where a vehicle is parked on a road or road-related area unless the authorised officer has reasonable grounds for believing the vehicle is an obstruction, hazard or contravenes road transport regulations, or if the authorised officer reasonably believes the vehicle is abandoned. This directs possessors and authorised officers to consider the Road Transport (Safety and Traffic Management) Act 1999 and its regulations when dealing with vehicles. Practitioners dealing with abandoned vehicles must evaluate both the Uncollected Goods Act processes and the road transport legislative framework.

Territory disposal and financial management

• The Financial Management Act 1996 is implicated via the definition of "trust bank account" and the mechanics of the Territory holding sale proceeds in trust (Dictionary; s 30). The Act requires the Territory to pay balances into a trust bank account and prescribes use of interest and treatment of funds after three years (s 30(2)-(6)). The Minister has discretion to pay claimants from these balances (s 31), but Financial Management Act processes for trust accounts and financial administration will apply.

Preservation of other rights and limits on disposals

• Section 33 preserves existing liens, powers of sale and other rights that a possessor may have independent of the Act, ensuring the Act does not supersede or extinguish other enforcement mechanisms. Conversely, s 36 states that nothing in the Act authorises a mode of disposition that would otherwise be contrary to another law of the Territory. This dual preservation and limitation means lawyers and compliance officers must check for overlapping regimes that either permit additional action beyond the Act or constrain the possessor from using the Act when other specific law applies.

Regulatory detail and subordinate legislation

• The Executive may make regulations under s 38, and the Act already references regulation-made content for identity cards under s 16A(2). Regulations may further shape compliance requirements and the interplay between the Act and other legislative instruments.

In sum, the Act is not a stand-alone regime. It is an overlay that prescribes certain procedural mechanisms for dealing with uncollected property while deferring to and integrating with other statutory regimes where items are otherwise regulated, where other tribunals (ACAT) have jurisdiction, and where financial administration and public land frameworks apply. Practitioners must therefore map the item at issue to the Act’s scope and the complementary or limiting legislation cited in the Act.

The Act has been amended multiple times since its original enactment in 1996. The endnotes in the republication provide the chronological history and list specific amending Acts and the provisions amended. The legislative history and amendment history reflect functional adjustments to definitions, procedural mechanics, scope exclusions and new subject-matter interactions.

Key milestones from the endnotes include:

• Initial enactment: Uncollected Goods Act 1996 A1996-86 was notified on 20 December 1996 and the remainder commenced 19 March 1997 (legislation history).
• Late 1990s and early 2000s amendments to reflect cross-Act consequences and harmonisation: e.g., the Road Transport Legislation Amendment Act 1999 (A1999-79) amended s 14 and related provisions affecting vehicles and public street interactions; the Legislation (Consequential Amendments) Act 2001 made various renumbering and consequential amendments that were commenced in 2001 (endnotes 3-4).
• The Mercantile Law and lien references have been preserved across amendments so that s 5(1)(b) links to the Mercantile Law Act 1962; amendments have maintained that connection (amendment history notes).
• Public pool regime: The Public Pools Act 2015 amendments introduced or clarified the pool facility provisions and inserted definitions for "operator" and "pool facility" into the Dictionary (A2015-7, ss noted in the amendment history). Sections 9-12 and the lost property register obligations were added or revised in the 2015 amendments (amendment history).
• Value-based categorisation and timing changes: Significant amendments in 2019 and 2020 recast disposal categories to use thresholds and net value concepts. The Litter Legislation Amendment Act 2019 (A2019-39) introduced the three value bands and disposal timing for goods of no value, low value and significant value (s 22-24 and Dictionary). The Residential Tenancies Amendment Act 2020 (No 2) (A2020-48) inserted s 24A for manufactured homes and mobile homes abandoned in residential parks and added a "mobile home" definition in the Dictionary.
• Administrative and technical amendments: The Statute Law Amendment Acts and Administrative (One ACT Public Service Miscellaneous Amendments) Act 2011 (A2011-22) effected drafting, administrative and machinery changes including to identity-card provisions for authorised officers (s 16A) and appointment mechanics (s 16 cross-references).
• Recent 2025 amendments: The Statute Law Amendment Act 2025 (A2025-29) made assorted changes which commenced 26 November 2025 for particular parts as shown in the endnotes. These include amendments to s 7 procedural content and to the application and disposal provisions affecting public or unleased land and Territory premises (endnote entries for 2025 amendments reference amdt numbers and parts but the republication is the definitive in-force text as at 2 December 2025).

Other technical points drawn from the amendment history:

• Definitions originally located in earlier sections were relocated into the Dictionary in the 2007 consolidation amendments and subsequent acts amended, inserted or removed definitions as public regimes evolved (e.g. light rail vehicle added by the Road Transport Reform (Light Rail) Legislation Amendment Act 2017).
• Some provisions had expiry clauses or transitional arrangements when inserted; the endnotes indicate certain subsections expired on specified dates and were later amended or re-inserted in revised form (see amendment history notes for s 16 and s 16A).
• The Act has been adapted periodically to align with evolving public place, public unleased land and residential tenancy frameworks, for example by referencing the Public Unleased Land Act 2013 and the Public Pools Act 2015.

The amendment history shows an incremental approach to reform: the core scheme from 1996 remains in place, while specific operational interactions, definitions and categories have been updated to reflect new statutory regimes, new categories of goods (for example, residential park homes) and administrative practice. Where the republication lists "amended" entries, those annotations indicate the loci of change and the Acts that caused them, for example A2015-7 (Public Pools Act) and A2019-39 (Litter Legislation Amendment Act) that materially altered disposal categories and pool facility obligations.

Practitioners should consult the endnotes in the republication for the precise amending item and commencement date when advising on historical disputes or on rights that crystallised under earlier versions of the Act.

The republication of the Act and its endnotes do not list case law or judicial decisions applying the Uncollected Goods Act 1996. The statutory text itself supplies procedural and remedial routes that could be the subject of litigation, but the Act does not annotate or summarise any judicial construction, contested interpretations or precedent. Accordingly, the Act as republished should be treated as a statutory source without appended case law commentary.

The Act supplies at least two express judicial touchpoints where litigation might occur:

• Magistrates Court review of possessor’s costs. Section 27 expressly allows an owner to apply to the Magistrates Court for review of any costs the possessor requires under s 26(2). The court may make orders to prevent disposal pending determination and to disallow costs in whole or part. This provision creates a statutory cause for litigation limited to cost disputes and interim relief concerning disposal.
• Criminal Code application. Section 2B states that the Criminal Code, chapter 2 applies to all offences against the Act. Where prosecutions arise under the Act, general Criminal Code principles will govern issues of fault, defences and burdens of proof. The Act itself contains one strict liability offence relating to return of identity cards by authorised officers (s 16A(3)-(4)). Any prosecutions under the Act would therefore be informed by Criminal Code constructs.

Because the republication does not list judicial decisions, practitioners seeking interpretative guidance must search relevant databases for reported or unreported decisions that interpret provisions such as:

• The meaning of "reasonable attempt" to deliver goods, used in s 5(1)(a)(ii) and elsewhere, for which judicial interpretation may be relevant in disputes about when goods became uncollected.
• The objective standard "that a reasonable person would believe have been lost or abandoned", used in s 9 and s 14, which may be litigated in contexts where the finder’s state of mind or the circumstances of the finding are contested.
• The adequacy of the written request under s 7(2) and the extent to which "substantial compliance" under s 37 suffices to trigger the statutory classification and disposal timetable.

Absent case law in the republication, advice must flag these likely litigation loci and recommend searches of territory court records and unreported decisions where interpretation might affect client rights. For matters involving interstitial regulatory interaction, litigation may also involve other statutory regimes such as the Residential Tenancies Act 1997 for residential park home disputes under s 24A. Where deadlines, notice adequacy and cost reasonableness are in dispute, the Magistrates Court is the initial forum for cost review under s 27, and other civil proceedings could be brought in Territory courts for matters outside the s 27 scope unless expressly precluded by the Act.

In short, the Act provides procedural remedies and a narrow specified judicial review route, but the republication does not summarise any litigation history. Practitioners should assume that disputed facts about classification, notice, costs and procedural sufficiency are the likely subject matter of litigation under the Act and should consult contemporaneous case law databases to identify any controlling or persuasive authority.

This Act contains a number of practical pitfalls where failure to follow the statutory mechanics precisely, or failure to check overlapping laws, will produce loss of rights or unexpected liabilities.

1. Formality of the request, and "last-known address" trap. The possessor’s statutory route to treating goods as uncollected for goods held without an agreement depends on making the written request with statutory contents in s 7(2) and sending it to the owner’s last-known address or resorting to public notice after reasonable inquiry (s 7(3)). Misdescribing goods, omitting the statutory statements (for example the disposal-after-7-days warning or the costs statement), failing to use a last-known address or not documenting "reasonable inquiry" into the owner’s address can be contested and may delay or invalidate disposal steps.

2. "Reasonable attempt" and "reasonable person" standards are unelaborated. The Act uses qualitative standards that are fact-sensitive: "after making a reasonable attempt" to deliver goods (s 5(1)(a)(ii)), and "that a reasonable person would believe have been lost or abandoned" (ss 9, 14). The statute contains no prescribed checklist or evidentiary standard for those phrases. Possessors and authorised officers must document attempts and the circumstances that lead to the objective belief; otherwise owners can challenge the classification and delay or overturn disposals.

3. Net value is market value less selling costs. The Dictionary defines net value as market value less reasonable costs of selling including removal, storage, preservation, transportation and advertising costs. Consequently, valuation after deducting expected selling costs can push goods into lower value bands and shorten or lengthen permissible disposal windows. Possessors who miscalculate net value risk procedural error. Transparent, contemporaneous valuation records and an explanation of deductions are prudent.

4. Personal documents and privacy exposure. Section 21(3) prohibits disposing of personal documents in a way that results in personal information becoming publicly available. The Act does not set out a process for secure destruction or redaction. Possessors must adopt procedures to protect private data when disposing of passports, bank books, licenses or photographs. Failure to do so could attract privacy law claims even though the Act shields certain disposals from suit (s 32), because privacy obligations may arise under other laws.

5. Vehicles and other overlapping regimes. Vehicles are given special treatment: s 5(2) exempts vehicles from s 5(1)(e) unless an authorised officer believes the vehicle abandoned. Section 14(2)(c) limits removal of vehicles parked on road-related areas unless they are obstructions, hazards or contravene road transport regulations, or are abandoned. Practitioners must reconcile the Uncollected Goods Act steps with road transport acts and local traffic regulations where towing, impoundment or disposal is contemplated.

6. Retention areas and retroactivity. The Minister may declare retention areas by notifiable instrument (s 17). Goods that are on an area when it is declared are taken to have been placed in the retention area under s 14(1)(a)(i) (s 17(3)). That can produce retroactive operational consequences if goods previously found in an area become subject to retention-area rules once the declaration is made. Possessors or the Territory should be cautious about post hoc application and ensure proper notification.

7. Pool facility obligations: register and three-month window. Pool operators must take possession of lost or abandoned goods and maintain a lost property register for non-perishable items (ss 9-10). Failure to keep the register or to follow the s 11 claims procedure can be operationally damaging. After three months unclaimed goods are deemed uncollected (s 12). For pool operators this is an administrative duty that requires capacity and record-keeping.

8. Possessor costs: "reasonable" but discretionary. Possessors may require payment of "reasonable costs" for compliance and storage before handing over goods, and may retain those from sale proceeds (ss 26(2), 30(1)). The Act leaves "reasonable" undefined, and the Magistrates Court has the power to disallow excessive costs under s 27. Possessors should document cost calculations and ensure recoverable items such as liens are properly evidenced to survive review.

9. Limited criminal exposure but immunities are not absolute. The Act immunises possessors from action "by reason of" complying with the Act (s 32) and protects purchasers (s 35). However, s 36 states the Act does not authorise modes of disposition contrary to other Territory law. This means that reliance on the Act does not permit contravention of other statutory duties. Practitioners should check parallel regimes, for example privacy law, road transport law, residential tenancy law, animal welfare law and weapons regulation.

10. Trust accounts and time limits. Proceeds after possessor deductions go to the Territory’s trust bank account (s 30(2)). Money in trust accounts is treated as interest for subsection (5) after three years (s 30(6)), and the Minister can pay claimants who apply before the three-year expiry (s 31). Owners who delay claiming risk losing direct access to proceeds and may face administrative hurdles.

11. Substantial compliance and evidentiary burden. Section 37 allows substantial compliance where strict compliance is not necessary. While this gives flexibility, it is also a source of uncertainty. In contested cases, courts will assess whether the possessor’s compliance was substantial. Good evidence of the steps taken will be decisive.

Practically, the most frequent operational "gotchas" are failure to follow the precise notice and content requirements in s 7, inadequate documentation of "reasonable attempts" or "reasonable inquiry", and misclassification of net value. Administrative actors should adopt written procedures that map statutory steps to operational actions and maintain contemporaneous records to support the possessor’s decisions.

This section sets out a practical compliance checklist tailored to the roles created by the Act. It concentrates on possessors, pool operators, authorised officers, public employees on Territory premises and the Territory itself. Each step references the controlling provisions.

For possessors (private businesses and individuals)

1. Before treating goods as uncollected, confirm the statutory trigger in s 5. Determine whether the goods are held under an agreement requiring owner collection, are subject to a Mercantile Law Act 1962 lien with an unsatisfied notice, or were received without any agreement. For the latter, check whether goods are perishable or of no value to see if they are immediately uncollected (s 5(1)(c); Dictionary).
2. If goods are held without an agreement, serve a written request complying with s 7(2). The request must include: a brief description of the goods; the address for collection; times/hours when goods are available for collection; a statement the goods may be disposed of after 7 days under Part 3; and the costs required before release. Send to the owner's last-known address or, if none can be found after reasonable inquiry, publish a public notice (s 7(3)). Keep records proving the date and method of delivery or publication and the steps taken to locate a last-known address.
3. Document "reasonable attempts" to deliver or to effect performance if relying on s 5(1)(a)(ii) or similar phrases. Record dates, times, names, telephone calls, emails and any missed delivery attempts. Preserve evidence in case of a later Magistrates Court review under s 27.
4. Calculate net value in accordance with the Dictionary when categorising goods. Net value equals market value less reasonable costs of selling, including removal, storage, preservation, transportation and advertising. Maintain contemporaneous valuation and cost records to support the classification into no-value, low-value or significant-value bands (Dictionary; ss 22-24).
5. Observe timeframes for disposal exactly. Perishable goods can be disposed of at any time (s 20). Personal effects are subject to the 3-month rule before public auction (s 21(1)). Goods of no value, low value and significant value have different holding periods (ss 22-24). Abandoned vehicles typically have shorter periods as specified in those sections.
6. For auctions, give public notice at least 7 days before the auction including time, place and a general description (s 25(1)). Retain proof of publication of the public notice.
7. Before releasing goods to an owner, require payment of reasonable costs, storage/maintenance costs, any lien amounts under the Mercantile Law Act 1962 and unpaid rent, and document those amounts (s 26(2)). Preserve supporting invoices and receipts.
8. Where costs are disputed, expect an owner may apply to the Magistrates Court under s 27. Be prepared to demonstrate reasonableness of costs and the steps taken.
9. Retain proceeds appropriately. From sale proceeds, retain reasonable costs and lien amounts and pay the balance to Territory trust account as required (s 30). Keep proper accounting records and cooperate with any Territory auditing of trust accounts.

For pool facility operators and employees

1. Take possession of goods found at the pool facility and log entries in the lost property register for non-perishable goods, including descriptions and other particulars required by s 10. Keep the register secure and readily available for claims (s 10).
2. Follow the claims process in s 11: satisfy a claimant of entitlement, require signature and address in the register on release, and retain proof of transfer.
3. Note the three-month period after which goods not claimed become uncollected and may be disposed of under Part 3 (s 12). Ensure the lost property register records dates to calculate this period.

For authorised officers and director-generals

1. Appointment and identity card compliance. Director-generals must appoint authorised officers (s 16). Issue identity cards that include a photograph and issue and expiry dates and any regulation-prescribed matter (s 16A(1)-(2)). Track card issuance and ensure timely return within 7 days of cessation to avoid strict liability exposure (s 16A(3)-(4)).
2. Removal and retention decisions on public or unleased land. Where goods appear to be lost or abandoned, decide whether they should be removed to a retention area or posted with a notice that they may be disposed of after 7 days. Ensure the authorised officer has reasonable grounds for the belief required by s 14 and document those grounds. Exclude goods on the land by authority or permit (s 14(2)(a)-(b)). For vehicles, comply with s 14(2)(c) and cross-check road transport regulations before removal.
3. Retention-area declarations. For retention-area creation, the Minister must make a written notifiable instrument (s 17(1)-(2)). Where a retention area is declared, record whether goods were already on the land when the declaration was made; s 17(3) deems such goods to have been placed in a retention area under s 14(1)(a)(i).

For Territory, Minister and public employees

1. For goods found on Territory-controlled premises, ensure the finder places items with a public employee in charge or a police officer (s 28). For disposal, the Territory may sell perishable goods at any time and other goods after 3 months, subject to public interest constraints (s 29). Document the public interest assessment if opting not to sell under s 29(2).
2. Administer trust bank accounts for balances of sale proceeds (s 30(2)). Ensure Financial Management Act compliance when investing or using interest for administration or prescribed purposes (s 30(5)). Track dates of payment into trust accounts so the 3-year deeming in s 30(6) can be applied correctly.
3. Handle claims timely. The Minister may pay claimants who apply before the three-year period expires (s 31). Implement a claims-handling process with clear time limits and verification steps.

Cross-checks and other compliance points

1. Check exclusions in s 3(2) before relying on the Act: animals, firearms, unclaimed moneys and other categories may be governed by other statutes.
2. For residential park homes, follow ACAT procedures under the Residential Tenancies Act 1997 before disposing under s 24A. Note the 14-day auction window after ACAT decisions where applicable (s 24A).
3. Ensure disposal modes comply with other Territory laws; s 36 prevents using the Act to authorise a disposition otherwise contrary to Territory law.
4. Adopt data protection procedures for personal documents to avoid disclosure of personal information when disposing of personal documents (s 21(3)).
5. Maintain documentary discipline: keep copies of all notices, requests, public notices, retention-area declarations, lost property register entries, valuation documents, invoices and receipts for costs, and auction notices and sale records. These documents underpin legal defensibility, particularly in s 27 judicial reviews.

Finally, consider adopting standard operating procedures that map statutory steps to organisational roles, train frontline staff (for example pool operators and parking managers) on the statutory contents required for written requests and auction notices, and set up an internal compliance audit process to ensure the statutory timelines and recordkeeping are adhered to. Where significant value goods are at issue, consult legal counsel early to manage valuation, owner outreach and risk of challenge.
