Unclaimed Money Regulations 2019

The Regulations use a small set of recurring concepts that map directly onto the Act. The principal concepts in the text are:

• Business register of unclaimed money: The register is the administrative record referred to in section 11(1)(a) and (b) of the Act. The Regulations prescribe its form (Form 1, Schedule 1) and the specific particulars to be entered (reg 6; reg 7).

• Prescribed form and prescribed details: The instrument distinguishes between the form of the register (a table with fixed columns, Schedule 1, Form 1) and the details to be entered into that form (the fields listed in reg 7, including full name and last known address, date of birth, ABN or ACN, business reference, description, date payable and gross amount). The qualification "if known and applicable" (reg 7) limits the scope of compulsory disclosure when particulars cannot be obtained.

• Times for VCAT to re-open: For the purposes of s 63(3) of the Act, the Regulations set a precise temporal rule applicable when an objector fails to appear: a six week period commencing on the day the assessment, reassessment, decision under s 30 or repayment notice is confirmed by VCAT (reg 8). The text records that reg 8 was amended in 2026 (Reg. 8 amended by S.R. No. 8/2026 reg. 3).

• Authorised recipient for permitted disclosures: The Regulations nominate a named public officeholder, the Secretary to the Department of Education and Training, as an authorised recipient for the particular permitted disclosure enumerated in section 77(1)(g)(viii) of the Act (reg 9). The prescription is narrow: it is for the purposes of a single subsection of the Act.

• Revocation and commencement: The instrument revokes the prior Unclaimed Money Regulations 2009 (reg 4) and specifies its commencement date, 17 February 2019 (reg 3). The endnotes add that the Regulations will sunset ten years after making pursuant to the Subordinate Legislation Act 1994 (Endnotes, General information).

• Legislative provenance and interpretive notes: The Regulations state their authorising provision (s 103 of the Act) (reg 2). The endnotes include extended remarks on interpretation conventions under the Interpretation of Legislation Act 1984, for example that headings and examples form part of the instrument and that explanatory memoranda do not form part of the statutory rule (Endnotes, Interpretation). Those interpretive points affect how the form and headings in Schedule 1 are to be treated as part of the Regulations.

These concepts are technical and administrative. The Regulations do not introduce new substantive rights or penalties in themselves; they supply forms and time periods to be read together with the Act.

The Regulations affect actors who are governed by the Unclaimed Money Act 2008 and who therefore engage with the business register or tribunal processes the Act contemplates. The text does not restate the Act’s obligations about who must open or maintain a register; rather it prescribes the form and particulars to be used for the business register “for the purposes of section 11(1)(a) and (b) of the Act” (reg 6; reg 7). Consequently the primary category affected is any person or entity under a statutory duty in the Act to maintain such a register, because they must use the prescribed form and enter the prescribed particulars if they are required to comply with s 11(1).

Secondary affected groups include:

• Claimants and owners of unclaimed money: The register columns require the owner’s full name, last known address, date of birth, ABN/ACN and a business reference where applicable (reg 7; Schedule 1 Form 1). These persons are affected because the record created will be the official business register entry that the Act associates with unclaimed money.

• Businesses and record-keeping officers: Entities that handle unclaimed money and that must record it in the business register will be required to capture the prescribed particulars to the extent they are known and applicable (reg 7). That affects administrative practices and internal record-keeping.

• Parties to VCAT proceedings and objectors: Reg 8 prescribes the time within which VCAT may re-open a matter when an objector is in default of appearance, fixing that time at six weeks from confirmation by VCAT of an assessment, reassessment, decision under s 30 or a repayment notice. That prescription will influence the procedural landscape for objectors and respondents in tribunal matters under s 63(3) of the Act.

• The Department of Education and Training: The Secretary to the Department is expressly named as an authorised recipient for a particular permitted disclosure under s 77(1)(g)(viii) of the Act (reg 9). That agency and its Secretary are therefore actors who can receive specified information under that subsection.

• Regulators and advisers: Legal, accounting and compliance professionals who advise clients about unclaimed money obligations will need to incorporate the prescribed form and particulars into compliance systems and advice.

The Regulations do not themselves create new monetary liabilities, penalties or novel obligations outside the Act; they affect behaviour by standardising the register format, limiting the particulars that must be recorded to those prescribed (if known and applicable), and by conferring a named authorised recipient status for a specific disclosure route. Revocation of the 2009 Regulations (reg 4) means entities must comply with the new form and particulars from the date of commencement (reg 3).

The Regulations principally define administrative duties by prescribing form and content for the business register and by setting a tribunal time limit and a named authorised recipient. The instrument is not phrased as a standalone duty-creating statute; rather it supplies delegated particulars for duties referred to in the Act. Key duties and rights that the Regulations instantiate or clarify are:

• Duty to use the prescribed register form: For the purposes of s 11(1)(a) of the Act, the prescribed form is Form 1 in Schedule 1 (reg 6). Where the Act requires a business register, operators must use that format for the register entries captured under the Act. The form lists columns for owner name and address, date of birth, ABN/ACN, business reference, description, date payable and amount (Schedule 1 Form 1).

• Duty to capture prescribed particulars, if known and applicable: For the purposes of s 11(1)(b) of the Act, reg 7 prescribes the particulars that must be entered in the business register “if known and applicable”: full name and last known address; date of birth; ABN or ACN; business reference; description of the unclaimed money; date when it first became legally payable; and the gross amount of the unclaimed money (reg 7). The regulator’s delegated choice to require particulars only "if known and applicable" creates a conditional duty: the duty arises to the extent the particulars are available.

• Procedural timetable for VCAT re-opening: For the purposes of s 63(3) of the Act, a time period of six weeks is prescribed, starting on the day an assessment, reassessment, decision under s 30 or repayment notice is confirmed by VCAT (reg 8). This regulation defines the temporal right or limitation within which VCAT may act after confirmation, affecting parties’ procedural rights in tribunal proceedings concerning unclaimed money.

• Limited disclosure recipient entitlement: Reg 9 prescribes that the Secretary to the Department of Education and Training is an authorised recipient for the purposes of one specific permitted disclosure power in the Act, namely s 77(1)(g)(viii). That regulation confers a statutory entitlement on that officeholder to receive information under that subsection, to the extent the Act permits such disclosures.

• Revocation and transitional effect: Reg 4 revokes the Unclaimed Money Regulations 2009. The practical effect is that obligations to comply with the earlier form and particulars are replaced by the new prescriptions from the commencement date (reg 3). The endnotes indicate the instrument will sunset ten years after making under the Subordinate Legislation Act 1994 (Endnotes, General information), which affects the duration for which these duties will remain in force unless extended or remade.

The Regulations do not create standalone powers to sanction non-compliance; any enforcement or penalty regime would derive from the parent Act. The duties imposed by the Regulations are therefore administrative and procedural: maintain the register using the prescribed form and enter the prescribed fields if they are known and applicable, observe the VCAT re-opening time limit, and note the authorised recipient named for permitted disclosures.

The Regulations themselves do not specify monetary penalties, fines or enforcement mechanisms. They are an exercise of delegated legislative power made under section 103 of the Unclaimed Money Act 2008 (reg 2), and they operate to supply prescribed forms, particulars and procedural timeframes that must be read alongside the Act. Any penalties, offences, or enforcement pathways for non-compliance with the duties that the Regulations give form to will therefore be found in the parent Act, not in the Regulations’ text.

Because the instrument does not create its own enforcement provisions, a compliance failure (for example, failure to maintain a business register in the prescribed form or to record the prescribed particulars when known and applicable) would be actionable only to the extent the Act establishes a contravention or disciplinary mechanism tied to those obligations. The Regulations do, however, make practical processes administratively determinate,by prescribing form and fields and by fixing a re-opening period for VCAT matters,so compliance or non-compliance can be assessed against a clear technical benchmark.

The Regulations do affect procedural enforcement indirectly through reg 8, which prescribes the time within which VCAT may re-open a matter for the purposes of s 63(3) of the Act. That six week period will constrain tribunal scheduling and post-decision remedies related to assessments, reassessments, decisions under s 30 or repayment notices confirmed by VCAT. The procedural consequence is that parties and practitioners will need to act within or account for that time window; any tribunal-based relief or breach arising from failure to observe the given period will be determined under the Act and VCAT’s procedural rules, not by these Regulations.

The instrument’s revocation of the Unclaimed Money Regulations 2009 (reg 4) may have enforcement implications in the sense that compliance regimes previously governed by the 2009 Regulations are superseded as of commencement (reg 3). The endnotes indicate the Regulations are subject to the normal interpretive and sunset rules for subordinate instruments, including a ten-year sunset under the Subordinate Legislation Act 1994; any enforcement approach must therefore consider temporal application and potential future repeal or remaking of the delegated rules.

In summary, the Regulations define compliance metrics and procedural timeframes but defer to the Act for penalties and enforcement mechanics. Advisers and compliance officers must consult the Unclaimed Money Act 2008 to identify the specific sanctions or remedial pathways attached to obligations the Regulations prescribe.

The Regulations expressly operate as subordinate legislation to the Unclaimed Money Act 2008, being made under section 103 of that Act (reg 2). They are therefore part of a hierarchical legal relationship in which the Act provides the substantive framework and the Regulations provide delegated, specified detail for the Act’s operation, notably in relation to section 11(1)(a) and (b) (register form and particulars), section 63(3) (VCAT re-opening period), section 30 (decisions triggering the VCAT period, as referenced in reg 8), and section 77(1)(g)(viii) (authorised recipients for permitted disclosures) (regs 6, 7, 8 and 9).

The endnotes also locate the Regulations within the broader subordinate-legislation regime. They state the instrument will sunset ten years after making under section 5 of the Subordinate Legislation Act 1994 (Endnotes, General information). That sunset rule sets an external statutory limit on the duration of these Regulations unless re-made or extended by the appropriate process prescribed by the Subordinate Legislation Act 1994.

Further interpretive interconnections are signalled by the endnotes’ discussion of the Interpretation of Legislation Act 1984 (ILA). The endnotes state that headings, examples, diagrams, notes and punctuation form part of a Statutory Rule made after 1 January 2001, and that explanatory memoranda and other postscript material do not form part of the Rule (Endnotes, Interpretation). These ILA-derived interpretive rules affect how the Schedule 1 form and headings in these Regulations are read and applied. For example, the presence of the table headings in Form 1 is legally significant because the endnotes affirm that headings and examples are part of the instrument.

The Regulations also interact with prior subordinate instruments by expressly revoking the Unclaimed Money Regulations 2009 (reg 4). That revocation terminates the continuing operation of the previous instrument and replaces its delegated prescriptions with those in the 2019 Regulations as of the commencement date (reg 3). The Table of Amendments records that the Regulations were themselves amended by the Unclaimed Money Amendment Regulations 2026, S.R. No. 8/2026 (Table of Amendments).

In sum, the Regulations are tightly tied to the Act and to the general rules governing subordinate legislation. They neither purport to displace nor to supplant substantive Act provisions; rather, they supply procedural and record-keeping detail that will interact with the Act’s enforcement and substantive provisions. Practitioners therefore must read the Regulations in tandem with the Unclaimed Money Act 2008 and be attentive to interpretive rules under the Interpretation of Legislation Act 1984 and temporal constraints under the Subordinate Legislation Act 1994.

The Regulations were made on 12 February 2019 and commenced on 17 February 2019 (reg 3; Endnotes, General information). They revoked the prior Unclaimed Money Regulations 2009 as part of their operation (reg 4). The publication includes a Table of Amendments showing subsequent changes incorporated as at 17 February 2026 (Version No. 002).

The Table of Amendments records a discrete amending instrument: the Unclaimed Money Amendment Regulations 2026, S.R. No. 8/2026, made and commenced on 17 February 2026 (Table of Amendments). Within the body of the Regulations, reg 8 contains a marginal note that it was amended by S.R. No. 8/2026 reg. 3. That indicates the 2026 amendment altered the text of regulation 8, which prescribes the time for VCAT to re-open a matter for the purposes of s 63(3).

The endnotes also contain an historical cross-reference for reg 4, noting S.R. No. 11/2009 in relation to the earlier instrument (Endnotes, Explanatory details). The presence of the revocation provision in reg 4 and the explanatory cross-reference serves as the official record that the 2019 Regulations replaced and extinguished the 2009 Regulations.

The Version No. 002 heading and the prefatory note "Version incorporating amendments as at 17 February 2026" record that the published text incorporates the 2026 amendment. The Table of Amendments provides the date of making and commencement for the 2026 amending instrument (17.2.26) and identifies S.R. No. 8/2026 as the vehicle for that amendment.

Practitioners should note two time-related features in the instrument’s history. First, the commencement date of the Regulations was 17 February 2019 (reg 3), so compliance processes and revocation of the 2009 Regulations take effect from that date. Second, the endnotes indicate these Regulations will sunset on 12 February 2029 under the Subordinate Legislation Act 1994 (Endnotes, General information), unless sooner repealed or remade. The 2026 amendment to reg 8 shows that the instrument can be and has been updated by subsequent subordinate legislation between its making and the sunset date.

The text does not record any other amending instruments, case law, or judicial interpretations. For full historical detail beyond what is recorded here, the Table of Amendments entry and the marginal note in reg 7 referring to the 2026 amendment are the sole amendment-related references in the provided material.

The Regulations as published contain no citations to judicial decisions or any recorded litigation arising from their operation. The text does not list case names, decisions, or appeals that interpret or test the Regulations. The Table of Amendments and endnotes record legislative and subordinate instrument history only; there is no litigation history included in this instrument’s content or endnotes.

Because the Regulations operate as delegated particulars to the Unclaimed Money Act 2008, any litigation involving the form, the particulars to be recorded, the VCAT re-opening period or the authorised recipient named in reg 9 would ordinarily be litigated under the Act’s substantive and procedural provisions in the courts or VCAT. The Regulations themselves do not create bespoke adjudicative processes, nor do they include notes of decided cases. Accordingly, within the scope of the text provided, there are no recorded judicial interpretations, appellate decisions or tribunal rulings specifically construing these Regulations.

Users seeking litigation history must therefore look beyond the text of the Regulations to decisions under the Unclaimed Money Act 2008 and to VCAT and court records for cases that may raise issues connected to the register form, the prescribed particulars, the prescribed six week period in reg 8, or the authorisation conferred on the Secretary to the Department of Education and Training in reg 9. The absence of litigation references in the instrument is not evidence that no litigation exists; it only reflects that the published Regulations do not themselves carry a litigation history section.

For regulatory history, the instrument does note that reg 8 was amended by S.R. No. 8/2026 reg 3 (Reg. 8 amended by S.R. No. 8/2026 reg. 3), which is a legislative amendment rather than a judicial development. Any legal practitioners researching the practical application of these Regulations should therefore check external tribunal and court databases for decisions under the Act that may illuminate how the prescribed form, particulars and the VCAT time limit have been applied in disputes.

Several technical features of the Regulations can catch practitioners or non-specialist officers unprepared if they are not noticed. The instrument’s brevity makes such points easy to overlook, so attention to precise wording and to the endnotes is essential.

• "If known and applicable" qualification (reg 7): The particulars prescribed for the register are to be entered "if known and applicable". That phrase narrows the compulsion to record each item to circumstances where the information is actually available and relevant. Practically, this means an absence of a date of birth, ABN/ACN or last known address will not, on the face of the Regulations, automatically convert into a breach; the duty to record those particulars is conditional. However, because the Act itself (s 11(1)(b)) is the source of the underlying duty, compliance officers must map the Act’s obligations to this qualifying language to determine when the conditionality applies in fact.

• Prescribed form is a specific table (reg 6; Schedule 1 Form 1): The Regulations prescribe a table format with explicit column headings. Because the endnotes make headings and examples part of the Rule under the Interpretation of Legislation Act 1984, the table headings are not optional drafting flourishes; they form part of the legal prescription. Entities should therefore avoid ad hoc or materially different register templates.

• Narrow authorisation (reg 9): The Secretary to the Department of Education and Training is an authorised recipient only "for the purposes of section 77(1)(g)(viii) of the Act" (reg 9). The regulation does not authorise broader disclosure or confer generalised access to the register. Practitioners should avoid assuming the Secretary’s access or authority extends beyond the specific subsection referenced.

• VCAT time prescription tied to confirmation event (reg 8): The six week period for VCAT re-opening (reg 8) is measured from the day the relevant assessment, reassessment, decision under s 30 or repayment notice is confirmed by VCAT. The triggering event is confirmation by VCAT, not the date of the original decision, so parties must keep careful records of when VCAT confirmation occurred. The marginal note records that reg 8 was amended by S.R. No. 8/2026 reg. 3, so older guidance may be outdated.

• Revocation of 2009 Regulations (reg 4): The 2019 Regulations revoke the prior 2009 Regulations. Practitioners must ensure they are working from the current instrument and that any procedural or form changes introduced in 2019 (or amended in 2026) are adopted. Legacy forms or practices based on the 2009 instrument may be inconsistent with the new prescriptions.

• Sunset provision external to instrument (Endnotes): The endnotes state that these Regulations will sunset ten years after making on 12 February 2029 under the Subordinate Legislation Act 1994. That sunset is an external statutory effect that may be overlooked by those who assume subordinate instruments remain indefinitely in force.

• No penalties in the Regulations: Because the Regulations do not specify penalties, compliance officers must look to the Act for enforcement mechanisms and to VCAT or court processes for remedy. A failure to do so can lead to misapprehension about whether the Regulation itself imposes sanctions.

• Administrative identification emphasis: The prescribed fields include ABN/ACN and a business reference (reg 7; Schedule 1). That emphasises connections to existing corporate and taxation identifiers. Entities should not assume that a lack of an ABN or ACN removes all record-keeping responsibilities; the "if known and applicable" caveat again governs but requires active assessment.

• Amendments may be narrowly targeted: The marginal note about the 2026 amendment applies to reg 8 alone. Users should not assume other parts were amended unless the Table of Amendments or marginal notes indicate as much.

Spotting these features, especially the conditionality of the particulars and the interpretive status of headings and form columns (per endnotes), is crucial to avoid unintended non-compliance or procedural missteps.

Compliance with the Regulations requires adopting the prescribed register form and entering the prescribed particulars where available, observing the VCAT re-opening timeframe, and acknowledging the authorised recipient named for a specific disclosure. Steps to ensure operational compliance, limited to the scope of the Regulations, are as follows:

1. Use Form 1 for the business register: For the purposes of s 11(1)(a) of the Act, the prescribed register form is Form 1 in Schedule 1 (reg 6). Ensure your internal register template mirrors the table headings and column order in Schedule 1. Under the Interpretation of Legislation Act 1984 principles recorded in the endnotes, headings and examples form part of the Rule and therefore the form’s headings should be treated as part of the legal prescription.

2. Record the prescribed particulars when available and relevant: For the purposes of s 11(1)(b) of the Act, enter the particulars listed in reg 7 into the register if they are known and applicable. Those particulars are:

   • full name and last known address of the owner;
   • date of birth of the owner;
   • the ABN or ACN of the owner;
   • a business reference for the owner;
   • a description of the unclaimed money;
   • the date on which the unclaimed money first became legally payable; and
   • the gross amount of the unclaimed money (reg 7). Maintain a policy for capturing each item and for documenting why a particular field is left blank when the information is not known or not applicable.

3. Institutionalise ABN/ACN and business-reference checks: Because the form requires ABN/ACN and a business reference where applicable, compliance systems should include steps to check internal and public corporate identifiers. Where an ABN or ACN is not available, record that it is "not known" rather than inventing an identifier; the regulation conditions the duty on the information being known and applicable (reg 7).

4. Link date payable and amount fields to accounting records: The form requires the date the unclaimed money first became legally payable and the gross amount. Ensure accounting and ledger entries are reconciled with register entries so that the date and amount fields reflect the earliest legally payable date and the gross quantum.

5. Observe the VCAT re-opening period: Where VCAT confirmation of an assessment, reassessment, decision under s 30 or a repayment notice occurs, note that the period during which VCAT may re-open the matter is six weeks commencing on the day of confirmation (reg 8). Track the VCAT confirmation date in case the re-opening timeframe becomes relevant to further proceedings or administrative action.

6. Acknowledge authorised disclosure recipient: Where the Act contemplates a permitted disclosure under s 77(1)(g)(viii), note that the Secretary to the Department of Education and Training is an authorised recipient for that specific disclosure (reg 9). Do not assume broader disclosure rights; limit disclosures to the statutory power and ensure proper internal approvals and privacy considerations are observed.

7. Update templates and train staff on revocation and amendments: The 2019 Regulations revoke the 2009 Regulations (reg 4). Confirm that all forms, record-keeping templates and training materials were updated at commencement on 17 February 2019 (reg 3). Also incorporate the 2026 amendment to reg 8 where relevant; the Table of Amendments shows S.R. No. 8/2026 amended the Regulations on 17 February 2026.

8. Retain evidence of attempts to obtain particulars: Because many particulars are required only "if known and applicable", maintain contemporaneous records showing reasonable efforts to obtain missing particulars (for example, searches, third party enquiries or client communications). Those records will assist in demonstrating compliance if the absence of a field is questioned in administrative review or tribunal proceedings.

9. Review subordinate legislation lifecycle: Be aware that these Regulations are subject to a ten year sunset under the Subordinate Legislation Act 1994 (Endnotes, General information). Plan for the possibility that the delegated rules may be remade, amended or allowed to sunset, and ensure any changes to register form or particulars are reflected in procedures.

10. Coordinate with Act-based obligations: Finally, recognise that the Regulations supply only the form and prescribed particulars and that any substantive duties, timelines for transfer of unclaimed money, or enforcement mechanisms remain in the Unclaimed Money Act 2008. Consult the Act for the full scope of statutory obligations and any penalties.

Following these steps will align an entity’s record-keeping and procedural practices with the narrow technical prescriptions in the Regulations. Because the Regulations use conditional language for many particulars, clear documentation and reconciliation between accounting records and register entries are essential to demonstrate compliance.
