Unauthorized Documents Act 1958

Royal Arms and resembling arms. Section 3 prohibits the use of the Royal Arms or the arms of any part of the King’s Dominions, or arms so nearly resembling them as to be likely to deceive, on written or printed matter. The section does not define “Arms” further, but the reference to arms that are “likely to deceive” imports an objective test of resemblance that would mislead a reasonable person. The prohibition is not absolute: prior written authority from a list of specified persons or bodies is a defence, but the accused must prove that authority. The authorised sources are the King himself, any member of the Royal Family, any United Kingdom government department, the Governor-General or a state Governor or other person administering the government of any part of the King’s Dominions, any government department in any part of the Dominions (including the United Kingdom), or any Act of Parliament or Ordinance. This list is exhaustive: a private authorisation from, say, a foreign government or a non‑government entity would not be sufficient.

False process. Section 4 targets documents that are not genuine court or tribunal process but are designed to appear as such. The key concept is that the document must be “likely or intended to convey” the impression that it is an original or copy of a document published or issued out of, by, or under the authority or with the sanction of any tribunal. The court decides this as a matter of opinion. It is not necessary that the document actually mislead anyone; only that it has that tendency or purpose. The definition of “document” is very wide: it includes any notice, claim, demand, process or any document relating to any extra-judicial remedy, and it applies whether the document is in existence or not. This means a letter that looks like a court summons but claims to be an extra-judicial demand (for example, a debt collection letter that mimics the format of a default judgment) could be caught.

Tribunal. The definition of “tribunal” is equally broad: it includes any court, judge, magistrate or public officer whether in or out of Victoria and whether in existence or not. This extends the prohibition to documents that might appear to originate from any court anywhere in the world, or even from a tribunal that does not currently exist. The phrase “whether in existence or not” is extraordinary: a document that purports to be from a hypothetical future tribunal could theoretically fall within the section if a court considers it likely to deceive.

Burden of proof and presumptions. Section 3 places the burden of proving authority on the accused. Section 4(3) creates a prima facie presumption: if any person is named on a paper or writing in a way that implies they are the printer, publisher, seller or sender, that person is deemed to be the person who printed, published, sold or sent it, unless the contrary is proved. This effectively reverses the evidentiary burden for those identified on the offending document.

Penalties and dual enforcement. The Act provides two alternative enforcement mechanisms for section 4: either a pecuniary penalty of between 1 and 10 penalty units, or a finding of contempt of the Supreme Court with punishment at the court’s discretion. The latter route bypasses the fixed maximum and opens the possibility of imprisonment or an unlimited fine. Section 7 allows a private person, with the written authority of a law officer, to sue for any penalty imposed by the Act. This is a form of qui tam enforcement, unusual in Australian legislation.

The Act directly affects any person or entity that publishes, prints, distributes, sends or serves written or printed matter. This includes:

Commercial printers and publishers. Any business that prints or publishes material containing the Royal Arms for commercial use (for example, stationery, marketing materials, packaging) must either obtain prior written authority from an authorised source or risk prosecution under section 3. This creates a compliance burden: the business must identify the correct authority, apply for permission, and retain proof of that permission. If the permission is not in writing, the burden of proof lies on the accused , a trap for the unwary.

Debt collectors and credit management firms. Section 4 is particularly relevant to entities that send demands for payment. A debt collection letter that looks like a court document (for example, one that uses the heading “Notice of Legal Proceedings” or includes a seal or court‑style formatting) could be caught, even if it is clearly stated that it is not a court document. The court need only be of the opinion that the document is “likely or intended” to convey the impression that it is a tribunal document. This broad test creates uncertainty: a letter that is intended to intimidate a debtor into paying by creating a false sense of legal jeopardy may attract liability, while a letter that is merely firm but not misleading in format may not. The potential penalty for section 4 includes contempt of the Supreme Court, which carries no maximum penalty, increasing the risk for high‑volume operators.

Lawyers and legal practitioners. Lawyers who send letters of demand, statutory demands, or notices of default that are not issued out of a court but that resemble court documents could face liability. The definition of “tribunal” includes “public officer”, so a letter that appears to be from a government official could also be caught. Because the section covers documents “whether in existence or not”, a lawyer could not rely on the fact that a particular tribunal does not currently exist to argue that the document could not have been issued by it.

Not‑for‑profit organisations and event organisers. Charities, sports clubs, or community organisations that use the Royal Arms (for example, on fundraising materials or event programmes) without authorisation may be in breach of section 3. Many such organisations may be unaware that using a coat of arms , even in a trivial or decorative manner , requires prior written authority.

Directors, managers and company officers. Section 5 provides that directors, managers, secretaries, and officers of a body corporate who “knowingly authorise or permit” an offence under the Act are personally liable to the same penalty or punishment as the company. This imposes a positive obligation on officeholders to ensure that their organisation does not distribute unauthorised arms or false process documents. Ignorance is not a defence; the section requires “knowingly” but that is a mens rea element that may be satisfied by constructive knowledge or wilful blindness.

Complainants and private prosecutors. Section 7 allows any person with the written authority of a law officer to sue for a penalty under the Act. This enables competitors, trade associations, or disgruntled individuals to initiate proceedings, which may be used as a market‑discipline mechanism or, conversely, as a tool for harassment.

Government departments and agencies. Although the Act targets private misuse, it also binds the Crown? The Act does not contain an express Crown immunity provision. But section 3 requires “previous written authority” from specified Crown or government sources. That implies that government departments can authorise use of the Royal Arms for themselves or others. However, section 4 does not exempt the Crown, so a government department that issues a document that looks like a tribunal document but is not could theoretically be liable , though in practice enforcement against the Crown would be unlikely without express provision.

Duty not to misuse the Royal Arms. Section 3 imposes a duty on every person not to print, publish, distribute, send, deliver or serve any written or printed matter bearing the Royal Arms (or arms likely to be confused with them) without prior written authority. The duty is strict in the sense that the accused must prove they had authority; the prosecution need not prove lack of authority. The duty extends to direct and indirect acts: a person who “causes” such matter to be published or distributed is also liable.

Duty not to simulate tribunal process. Section 4 imposes a duty not to send, deliver, serve, print, publish, sell, or offer for sale any paper or writing that is not a genuine tribunal document but is likely or intended to convey the impression that it is one. The duty applies to any person, natural or corporate, and the prohibited acts are cast widely: “sends or delivers to or serves on … or causes to be sent or delivered to or served on”. The duty is not limited to documents that are actually misleading; it suffices that the document is “likely” to convey the impression, which is an objective test determined by the court. The duty also applies to those who print, publish, sell or exhibit such documents, making upstream actors (printers, publishers) liable as well.

Right to sue for a penalty. Section 7 gives any person who obtains the written authority of a law officer the right to sue for and recover a penalty imposed by the Act. This is not a general private right of action; it is a mechanism for private enforcement with state oversight. A successful plaintiff gets to keep the penalty (the section does not direct the penalty to the state, though it may be recoverable as a debt). The law officer’s written authority acts as a filter to prevent vexatious litigation, but it also means that the decision to enforce can be political or selective.

Right to be free from double punishment. Section 8 provides that nothing in the Act affects any other civil or criminal proceeding that might have been taken, but “no person shall be punished for the same offence under any such proceeding and under this Act”. This is a standard double‑jeopardy protection, but it leaves open the possibility that a person could face both a civil suit (for example, for passing off or trademark infringement) and a criminal prosecution under the Act, as long as they are not punished twice for the “same offence”. The section does not define “same offence”, so the common law principle of double jeopardy would apply.

Duty on directors and officers. Section 5 imposes a duty on directors, managers, secretaries, and officers of a body corporate not to “knowingly authorise or permit” an offence under the Act. This is a personal duty; an officer who turns a blind eye to a colleague’s use of the Royal Arms without permission or to the distribution of court‑lookalike documents may be liable. The section does not require the officer to take positive steps to prevent the offence, only to refrain from authorising or permitting it. But in practice, “permitting” may include failing to prevent when the officer has control.

The Act establishes a two‑tier penalty structure for section 4 and a single‑tier for section 3. For section 3, the maximum penalty is 10 penalty units. In Victoria, as at the date of the version (6 September 2023), one penalty unit is $192.31 (under the Monetary Units Act 2004), so the maximum fine is $1,923.10. This is a relatively modest amount, but it is per offence, and each publication or distribution could constitute a separate offence.

For section 4, the penalty is either a fine of not less than 1 penalty unit and not more than 10 penalty units (i.e., a minimum of $192.31 and a maximum of $1,923.10), or the offender may be deemed guilty of a contempt of the Supreme Court. The contempt route is far more serious. The Supreme Court has inherent power to punish contempt, which can result in imprisonment for a fixed term or an unlimited fine. The Act does not restrict the court’s discretion; the only limitation is that the punishment must be proportionate to the contempt. This dual enforcement option gives prosecutors a powerful tool: the threat of contempt proceedings can force a defendant to settle, even if the underlying conduct would only have attracted a small fine.

Enforcement of penalties is handled in two ways. First, a law officer (the Attorney‑General or Solicitor‑General) can authorise any person to sue for the penalty. This is a form of qui tam action: the private person becomes the plaintiff and keeps the penalty (or a portion of it, depending on the arrangement). The Act does not require the penalty to be paid into consolidated revenue. Second, the contempt power is exercised by the Supreme Court on the application of “any person complaining thereof” (section 4(2)(a)). This means a private person can initiate contempt proceedings directly, without needing the law officer’s consent. That is unusual: most contempt proceedings are commenced by the court itself or by the Attorney‑General. Here, any person who receives a false process document can apply to have the sender punished for contempt.

Section 5 provides that a body corporate is liable “as if it were a private person so far as such penalty or punishment is enforceable against a company or body corporate”. Because a company cannot be imprisoned, the only enforceable penalty is a fine. However, directors, managers, secretaries and officers are also personally liable. This means that in a case involving a corporate offender, both the company and its officers could be fined for the same conduct, but section 8 prevents double punishment for the “same offence”. The interaction between section 5 and section 8 is not straightforward: if a director knowingly permits the company to commit an offence, is that the same offence as the company’s offence? Likely not, because the director’s liability is for authorising or permitting, which is a separate act. But careful drafting would be needed to avoid a double‑punishment claim.

The Act does not specify a limitation period for prosecutions. The default under Victorian law is that summary offences have a limitation period of 12 months (section 7 of the Criminal Procedure Act 2009 applies, but the Unauthorized Documents Act does not expressly override it). For contempt proceedings, there is no statutory limitation period, but courts require that proceedings be brought within a reasonable time.

Section 8 of the Act expressly preserves other civil or criminal proceedings that could have been taken if the Act had not been passed, but prohibits punishment for the same offence under both the Act and another proceeding. This means that conduct caught by the Unauthorized Documents Act may also constitute offences under other Victorian or Commonwealth laws, such as:

Forgery and fraud. Producing a document that looks like a court process may also amount to forgery under the Crimes Act 1958 (Vic) or the Criminal Code (Cth) if it is made with intent to defraud. Section 4 of the Unauthorized Documents Act does not require an intent to defraud; it only requires that the document is “likely or intended to convey” the impression of being a tribunal document. So a person could be charged under both Acts, but the double‑punishment prohibition would limit the penalty to the higher of the two.

Consumer and trade practices law. Using the Royal Arms on goods or services without authority could breach the Australian Consumer Law (schedule 2 to the Competition and Consumer Act 2010 (Cth)) if it amounts to false or misleading representation that the goods or services have government sponsorship or approval. Similarly, a debt collection letter designed to look like a court document could be an unconscionable conduct or misleading representation. The Unauthorized Documents Act does not displace these provisions; it adds a criminal penalty on top.

Trademark and passing off. The Royal Arms are registered as trademarks in some cases, and unauthorised use could amount to trademark infringement or passing off. Section 3 of the Act does not require any commercial use; it covers any printed or written matter, whether for profit or not. So a non‑commercial use that would not be actionable in passing off could still be an offence.

Contempt of court. The alternative penalty for section 4 is contempt of the Supreme Court. This is a separate proceeding from a prosecution under the Act itself. The Supreme Court’s contempt power is broad, and the Act does not displace it. In practice, a person could face both a criminal prosecution (with the penalty unit fine) and a contempt application (with unlimited penalty) for the same conduct. Section 8’s double‑punishment prohibition would likely prevent this, but the section is ambiguous: if the contempt application is brought as a civil contempt (to vindicate the court’s authority) rather than as a criminal proceeding, it might be considered a separate proceeding not for the “same offence”. This creates a risk of double exposure.

State and federal jurisdiction. The Act is a Victorian statute. Section 4’s definition of “tribunal” includes “any court … whether in or out of Victoria”. This means a document that purports to be from a court in another Australian state or territory, or even from a foreign court, could be caught if sent into Victoria. Enforcement against an interstate or foreign sender would be challenging, but the Act purports to apply. The definition also includes “public officer”, which could include a federal officer, but the Commonwealth is generally immune from state criminal laws unless the Commonwealth consents.

Other state laws. Other Australian states have similar legislation (for example, the Unauthorized Documents Act 1916 (NSW) is still in force). A person who sends a false process document interstate could face charges in multiple jurisdictions. The double‑punishment prohibition in each Act may not apply across state lines, so cumulative penalties are theoretically possible.

The Unauthorized Documents Act 1958 is a consolidating Act that repealed and replaced the Unauthorized Documents Act 1928 (Act No. 3794). The 1958 Act came into operation on 1 April 1959 by proclamation. Since then, it has been amended five times, all but one being technical or machinery amendments:

1. Decimal Currency Act 1965 (No. 7315). This Act, which came into effect on 14 February 1966, amended the penalty provisions in sections 3 and 4 to convert references to pounds, shillings and pence into decimal currency. It did not alter the substance of the offences.

2. Penalties and Sentences Act 1981 (No. 9554). Schedule 2 items 351 and 352, which commenced on 1 September 1981, substituted references in sections 3 and 4 to specific monetary amounts with references to “penalty units”. This standardised penalties across Victorian legislation and allowed the dollar value of a penalty unit to be adjusted by regulation without amending individual Acts. The substitution increased the maximum fine under section 3 from £10 to 10 penalty units (then worth $100) and under section 4 from a range of £1-£10 to 1-10 penalty units.

3. Supreme Court Act 1986 (No. 110). Section 140(2) and Schedule, commencing 1 January 1987, amended section 4(2)(a) to update the cross‑reference to the contempt powers of the Supreme Court, which had been consolidated in the new Supreme Court Act 1986. This was a textual amendment only.

4. Magistrates’ Court (Consequential Amendments) Act 1989 (No. 57). Schedule item 204, which commenced on 1 September 1989 and 1 September 1990, amended section 4(1) and the definition of “tribunal” in section 4(4) to replace references to “Magistrates’ Court” and “Justice” with updated references consistent with the new Magistrates’ Court Act 1989. This was a machinery amendment.

5. Statute Law Amendment (References to the Sovereign) Act 2023 (No. 25). Section 7 and Schedule 1 item 29, commencing 6 September 2023, amended section 3 to replace references to “Queen” or “Her Majesty” with “King” or “His Majesty”, and to update the phrase “King’s Dominions” (previously “Queen’s Dominions”). This was a mechanical update following the accession of King Charles III. No substantive change was intended.

There have been no amendments to the core structure of the Act since 1958. The definitional framework, the reverse onus in section 3, the contempt alternative in section 4, and the personal liability of directors in section 5 have remained unchanged. The Act is therefore a relatively stable piece of legislation, but its 1958 drafting style (long sentences, compound definitions, and lack of modern statutory interpretation aids) means that courts must interpret it against contemporary principles.

The source text provided does not include any references to cases decided under the Unauthorized Documents Act 1958. The endnotes state “No entries at date of publication” under “Explanatory details”. This is consistent with the Act being rarely litigated in the public record. The Act is a short, targeted criminal statute, and prosecutions are likely infrequent. Most enforcement is probably dealt with by way of caution, letter of demand, or diversion. The qui tam mechanism in section 7 (private suit with law officer’s authority) is rarely used in practice.

The most likely area for litigation would be under section 4’s contempt alternative. A person who receives a document that looks like a court process could apply to the Supreme Court for contempt. Such applications are typically brought against debt collectors or scam operators who send fake court documents. The court would need to determine whether the document is “likely or intended to convey” the impression of being a tribunal document. The broad definition of “tribunal” , including any judge, magistrate or public officer, whether in existence or not , gives the court wide latitude.

Because no cases are cited in the source, this analysis cannot name any specific judgment. However, the general principles of statutory interpretation would apply. Courts would likely constrict the scope of the Act given its penal nature, but the reverse onus in section 3 and the “likely to convey” test in section 4 leave substantial room for prosecutorial discretion. The Act’s age and the absence of modern litigation may indicate that the Act is either very effective as a deterrent or largely ignored by enforcement agencies. The latter seems more plausible given the small penalties and the specialised nature of the conduct.

Reverse onus of proof under section 3. The accused must prove they had the required written authority to use the Royal Arms. This reverses the usual criminal burden; the prosecution only needs to prove that the written or printed matter bore the arms. This can be a trap: a person who believes they have implied permission (for example, a licensee of the Crown) but cannot produce written authorisation may still be convicted.

Definition of “tribunal” includes non‑existent bodies. Section 4(4) says “Tribunal includes any court judge magistrate or public officer whether in or out of Victoria and whether in existence or not”. The phrase “whether in existence or not” is extraordinary. It means a document that purports to be from a court that does not currently exist (for example, a “Tribunal of the Future”) could still be caught if a court finds it likely to convey that impression. This could apply to documents that are clearly fantastical but might deceive a vulnerable person.

Section 4 applies to “extra‑judicial remedies”. The definition of “document” includes “any document relating to any extra‑judicial remedy”. This phrase is not defined, but it would cover things like a notice of exercise of a contractual right of entry, a statutory demand under corporations law, or a private repossession notice. If such a notice is formatted to resemble a court order, it could be caught even though the remedy does not involve a court at all.

Prima facie presumption of identity. Section 4(3) creates a prima facie presumption that the person named on a document as printer, publisher, seller, or sender is actually that person. This reverses the evidentiary burden: the defendant must prove they were not the person responsible, which can be difficult if the name is a pseudonym or the document was produced by a third party.

Contempt carries no upper penalty limit. The alternative to the penalty unit fine under section 4 is that the offender “shall be deemed guilty of a contempt of the Supreme Court and may be punished accordingly”. The court’s contempt power is not capped by this Act. A judge could impose a fine of any amount or imprisonment for any period (within constitutional limits). This makes the risk profile for a potential offender highly uncertain.

Bodies corporate cannot be imprisoned, but directors can. Section 5 makes the body corporate liable “as if it were a private person so far as such penalty or punishment is enforceable against a company”. That limits companies to fines. But directors and officers are personally liable for imprisonment if the contempt route is taken.

“Knowingly authorises or permits” is broad. Section 5 does not require the director to have actual knowledge of the specific document; knowing authorisation or permission can be inferred from a director’s role in the company’s compliance systems. A director who fails to implement procedures to prevent misuse of the Royal Arms or false process documents could be found to have “permitted” an offence.

No statute of limitations expressly stated. The Act does not specify a time limit for prosecutions. For summary offences in Victoria, the default is 12 months from the date of the offence (Criminal Procedure Act 2009 s 7). But section 4(2)(a) permits contempt proceedings at any time, subject to the court’s discretion. A person could face contempt proceedings years after the event if the court considers it just.

“Other proceedings not affected” creates cumulative risk. Section 8 preserves other civil or criminal remedies. So a person who uses the Royal Arms without permission could be sued for passing off by the Crown or a licensee, and also criminally prosecuted under the Act, as long as the same act is not punished twice. The “same offence” limitation is narrow: a civil claim and a criminal prosecution are different proceedings, so double punishment would not apply.

The Act does not define “law officer”. Section 7 refers to “a law officer”. In Victoria, this likely means the Attorney‑General or Solicitor‑General, but the phrase is not defined. A private prosecutor must obtain written authority from the correct officer; authority from a junior minister or a Crown Solicitor may not be sufficient. This creates a procedural trap.

Royal Arms includes arms “likely to deceive”. Section 3 does not require an exact reproduction. Arms that “so nearly resemble” the Royal Arms as to be likely to deceive are sufficient. This means a modified or stylised version could still be an offence if it would mislead a reasonable person.

Royal Arms usage. Any person or entity that wishes to include the Royal Arms or arms resembling them on any written or printed matter must obtain prior written authority from one of the sources listed in section 3. The most practical route is to contact the Victorian Governor’s office or the appropriate Commonwealth department (for example, the Department of Prime Minister and Cabinet for Commonwealth arms). The authority must be in writing and retained as evidence. Because the burden of proof lies on the accused, the documentation should be kept for at least the limitation period (12 months plus the duration of any proceedings). For commercial publishers, a lawyer should review the letterhead, marketing materials, or products to ensure no arms appear without authorisation. Even historical or decorative uses (for example, in a book about heraldry) may require permission if the arms are printed in a way that could be seen as official.

False process avoidance. To avoid section 4, any document that is not genuine tribunal process must not be “likely or intended to convey” the impression that it is. The safest approach is to format all letters, demands, and notices in a way that is clearly distinguishable from court documents. Avoid using:

• Court‑style headings (e.g., “In the matter of”, “IN THE SUPREME COURT”)
• Seals, stamps, or crests that mimic those of a court
• Formal language that suggests the document is issued by a judge or magistrate
• References to filing numbers, court dates, or judge names
• Typefaces, borders, or layouts commonly used in court forms
• The phrase “Notice of Legal Proceedings” or similar unless it is genuinely from a court.

Instead, use plain business letterhead, state clearly that the document is not a court document, and include a disclaimer such as “This is a demand from [name], not a court document. If you are unsure, seek legal advice.” For extra‑judicial remedies (e.g., a statutory demand under the Corporations Act), follow the prescribed form exactly; do not embellish it with court‑like elements.

Corporate compliance systems. Directors and officers should implement policies and training to ensure that all staff understand the prohibitions. The policy should:

• Assign responsibility for obtaining authorisations for Royal Arms usage
• Require legal review of any document that could be mistaken for court process
• Prohibit the use of any language, symbols, or formatting that mimics tribunal documents unless the document is actually issued by a tribunal
• Provide a clear escalation path for any questions about compliance.

Given that section 5 imposes personal liability, a director who delegates compliance to a junior employee without supervision may still be found to have “permitted” an offence if a breach occurs.

Record keeping. Keep written authorities for Royal Arms on file, along with any correspondence with the authorising body. For section 4, maintain records showing that documents were reviewed by legal counsel and that all reasonable steps were taken to avoid misleading the recipient. If a document is challenged, these records will help demonstrate absence of intent.

Responding to complaints. If a complaint is received, do not ignore it. The Act’s qui tam mechanism means a private person can sue for the penalty with a law officer’s authority. It is better to investigate, rectify, and seek a release or undertaking from the complainant. Legal advice should be sought before any admissions are made.

Insurance and indemnity. Given the personal liability of directors, companies should consider whether directors and officers insurance covers penalties under the Act. Because the Act creates strict liability in part (reverse onus, prima facie presumption), penalties may not be insurable in some jurisdictions. Consult an insurance broker and legal adviser.

Seek legal advice for specific situations. The breadth of the definitions (especially “tribunal” and “extra‑judicial remedy”) means that borderline cases are best evaluated by a lawyer with experience in criminal and administrative law. A court‑lookalike document that is clearly a joke (for example, a parody) may still be caught if it is “likely to convey” the impression of being a real process to a vulnerable reader.
